HE ANSWERED QUESTIONS OF COMMISSIONERS REGARDING VARIOUS PROJECTS. 4. UPDATE ON PORT DISTRICT ACTIVITIES BY PORT COMMISSIONER VANDEVENTER. PUBLIC HEARINGS 5. PASTOR NOEL RAMOS, 839 RIDGEWATER DRIVE, CHULA VISTA, SPOKE IN SUPPORT OF THE APPLICATION. HE STATED THAT HE AGREES WITH CONDITIONS OF APPROVAL. 5. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR A CHURCH AT 1341 E. 8TH STREET, SUITE B. APPLICANT: REVIVAL LIGHTHOUSE CHURCH. STAFF REPORT BY ASSISTANT PLANNER HOSKINSON. CASE FILE NO. CUP-2001-17. COMMISSIONER VALDERRAMA ASKED STAFF WHY CONDITIONS OF APPROVAL LIMIT HOURS OF SERVICES TO TWO WEEKNIGHTS. HE ASKED IF THE CONDITION COULD BE CHANGED TO ALLOW SERVICES WEEKNIGHTS MONDAY THROUGH FRIDAY. THIS WILL ALLOW FLEXIBILITY. PASTOR RAMOS STATED THAT THEY HAVE BIBLE STUDIES IN HOMES THE OTHER NIGHTS OF THE WEEK. HE FILLED OUT THE APPLICATION WITH THE HOURS THE CHURCH IS CURRENTLY USING THE SITE. MOTION BY VALDERRAMA, 2ND BY REYNOLDS TO APPROVE CONDITIONAL USE PERMIT 2001-17 BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL, WITH MODIFICATION TO CONDITION NO. 6 TO EXPAND THE ALLOWABLE HOURS OF USE TO MONDAY THROUGH FRIDAY 7:00 P.M. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR A WIRELESS COMMUNICATIONS 4 November 5, 2001 SPRINT PCS, SPOKE IN SUPPORT AND COVERED SITES EXPLORED TO CO- LOCATE THIS WIRELESS FACILITY. FACILITY AT 303 PALM AVENUE. APPLICANT: SPRINT PCS. STAFF REPORT BY ASSISTANT PLANNER HOSKINSON. CASE FILE NO. CUP-2001-10. MOTION BY PARRA, 2ND BY VALDERRAMA, TO APPROVE CUP-2001- 10 BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL. DISCUSSION ON MOTION: COMMISSIONER DETZER STATED THAT THIS IS AN OPPORTUNITY TO MODIFY THE EXISTING WIRELESS COMMUNICATION FACILITY AT THE SITE AND MAKE IT STEALTH. HE STATED HE WOULD PREFER THAT THE ITEM BE CONTINUED AND THAT THE FACILITIES BE COMBINED AND MADE MORE ATTRACTIVE. STAFF RESPONDED TO COMMISSIONERS QUESTIONS ABOUT OTHER FACILITIES IN THE AREA, CONDITIONS REGARDING CO- LOCATION AND THE VERIZON WIRELESS AGREEMENT WITH THE CHURCH CONCERNING ACCESS TO THE GUARD ARMORY SITE. MS. KILBOURN RESPONDED TO COMMISSIONERS COMMENTS AND STATED THAT VERIZON NEVER SAID SPRINT CANNOT LOCATE ON THEIR POLE. THE POLE MAY NEED TO BE INCREASED IN HEIGHT. ENGINEERS WOULD NEED TO EVALUATE WHAT WOULD WORK. SHE ALSO STATED THAT SPECTRA SYSTEMS OWNS AND MAINTAINS THE POLE. COMMISSIONER DETZER AGAIN STATED THAT HE WOULD LIKE TO SEE A STEALTH INSTALLATION. THE MONOPOLE WAS INSTALLED IN 1996 AND TECHNOLOGY HAS CHANGED. COMMISSIONERS STATED THAT THEY PREFER STEALTH FACILITIES AND LIKED THE FLAGPOLE DESIGN. MAKER AND SECOND OF MOTION AMENDED MOTION TO CONTINUE THE HEARING TO DECEMBER 3, 2001. MOTION CARRIED BY THE FOLLOWING VOTE: 5 November 5, 2001 AYES: VALDERRAMA, PARRA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. 7. MR. KRIKORIAN, ONE OF THE OWNERS OF NATIONAL CITY GALLERIA SHOPPING CENTER SPOKE IN SUPPORT OF THE ZONE CHANGE AND GENERAL PLAN AMENDMENT AND DISTRIBUTED A HANDOUT OUTLINING WHY THE CHANGE IS NEEDED. CHAIRMAN UNGAB ASKED IF SECURITY IS PROVIDED ON-SITE. 7. PUBLIC HEARING – AMENDMENT TO THE COMBINED GENERAL PLAN/ZONING MAP FROM CL-PD TO CG-PD FOR THE GALLERIA SHOPPING CENTER AT 2720 E. PLAZA BOULEVARD AND ADJACENT PARKING AREA. APPLICANT: NATIONAL CITY GALLERIA LLC AND NATIONAL SCHOOL DISTRICT. STAFF REPORT BY ASSISTANT PLANNER HOSKINSON., CASE FILE NOS. GP- 2001-2/ZC-2001-1. MR. KRIKORIAN STATED THAT SECURITY IS PROVIDED. DON LORTSCHER, 2537 E. 13TH STREET, ASKED WHY THE PARKING LOT ZONING NEEDS TO CHANGE. HE EXPRESSED CONCERN FOR THE SAFETY OF THE SCHOOL CHILDREN. HE STATED THAT THE FENCE NEEDS REPAIR AND THE ORIGINAL AGREEMENT WITH THE SCHOOL DISTRICT WAS FOR THE SHOPPING CENTER TO MAINTAIN THE FENCE. HE ALSO EXPRESSED CONCERN ABOUT BARBED WIRE ON THE FENCE. STAFF RESPONDED THAT NO PHYSICAL CHANGES ARE PROPOSED TO THE CENTER. THIS ZONE CHANGE WOULD ALLOW ADDITIONAL USES THAT ARE NOT ALLOWED UNDER THE CURRENT CL ZONING. MR. KRIKORIAN STATED THAT HE ALSO IS CONCERNED ABOUT THE SAFETY OF THE SCHOOL CHILDREN. HE HAS WORKED WITH THE SCHOOL DISTRICT. HE ALSO STATED THAT NO LIQUOR WOULD BE SOLD IN HIS SHOPPING CENTER. MOTION BY BACA, 2ND BY PARRA TO RECOMMEND THAT THE CITY COUNCIL APPROVE THE PROPOSED AMENDMENT OF THE COMBINED GENERAL PLAN/ZONING MAP FROM CL-PD TO CG-PD FOR THE PROPERTY. 6 November 5, 2001 MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, PARRA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. 8. SAMI JIHAD, 1673 AVENIDA CHERRYLATA, EL CAJON, SPEAKING ON BEHALF OF THE APPLICANT, SUBMITTED A PETITION AND LETTER OF SUPPORT. HE RESPONDED TO COMMISSIONERS QUESTIONS REGARDING CONDITIONS OF APPROVAL AND STATED THAT THEY OBJECT TO CONDITIONS NOS. 8, 9 AND 10. HE STATED THAT THEY DID NOT WANT TO MERGE THE TWO PARCELS BECAUSE IT IS NOT FINANCIALLY FEASIBLE. THEY DO NOT WISH TO REMOVE THE HOME AND GARAGE ON THE ADJOINING PARCEL BECAUSE THEY DO NOT FEEL IT IS UNSAFE AND THEY DO NOT WISH TO USE THE PARCEL WITH THE HOME ON IT AS OUTDOOR AREA. HE STATED THAT THE TWO PARCELS ARE SEPARATE. THE PLANS DO NOT INCLUDE ANY AREA OF THE PARCEL AT 526 NATIONAL CITY BOULEVARD. 8. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR AN ADULT DAY HEALTH CARE CENTER AT 540 NATIONAL CITY BOULEVARD. APPLICANT: SABAH ABRO. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. CUP-2001-14. HE FURTHER STATED THAT TIME IS AN ISSUE AS THE HEALTH CARE PROVIDED HAS APPLIED TO THE STATE FOR A LICENSE, AND THIS WILL EXPIRE AT THE END OF THE YEAR. MR. JIHAD FURTHER STATED THAT THE ELDERLY IN THE CITY NEED THIS PROJECT, IT IS A BEAUTIFUL BUILDING AND THE ISSUE OF AN UNSAFE BUILDING AT 526 NATIONAL CITY BOULEVARD WAS NEVER MENTIONED BY STAFF SINCE THEIR SUBMITTAL IN AUGUST. THIS ISSUE CAME UP IN EARLY NOVEMBER. NABIL KACHI, PROJECT ENGINEER STATED THE HOUSE IS NOT UNSAFE. IT HAS A BRICK VENEER THAT IS CRACKED, BUT THE HOME IS ON A SOLID FOUNDATION. HE ADDRESSED THE ISSUE OF AN OUTDOOR SPACE AND SAID THAT THE STATE DOES NOT REQUIRE IT. DIRECTOR POST STATED THAT THE APPLICANTS PROPOSAL IS TO USE A 7 November 5, 2001 TEN FOOT AREA THAT IS LOCATED ON ANOTHER PARCEL. IT IS PROPER TO MERGE THE PARCELS IF THIS AREA IS TO BE USED. IF IT IS NOT PART OF THE PROPOSAL, STAFF NEEDS TO RE- EVALUATE THE SITUATION. COMMISSIONER VALDERRAMA STATED THAT HE UNDERSTANDS THE CONCERNS OF THE APPLICANT, BUT STAFF PROVIDED THEIR ANALYSIS BASED ON THE TWO PARCELS BEING USED. IF ONLY 540 NATIONAL CITY BOULEVARD IS TO BE CONSIDERED, IT IS APPROPRIATE TO CONTINUE THE ITEM AND ALLOW STAFF TO ANALYZE THE PROJECT FOR THE ONE PARCEL. MOTION BY VALDERRAMA, 2ND BY REYNOLDS TO CONTINUE THE HEARING TO THE MEETING OF NOVEMBER 19, 2001 TO ALLOW STAFF TIME TO REVIEW THE PROJECT FOR THE ONE PARCEL. MOTION CARRIED BY THE FOLLOWING VOTE: VALDERRAMA, PARRA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. NO REPORT. SENIOR ASSISTANT CITY ATTORNEY DIRECTOR POST REPORTED THAT THE DEAD PALM TREE AT THE PLAZA BOULEVARD AND I-805 WIRELESS FACILITY SITE WAS REPLACED LAST FRIDAY WITH A NEW PALM TREE. HE ALSO MENTIONED ITEMS PROVIDED TO THE COMMISSIONERS IN THE FRONT OF THEIR BOOKS; THE UPDATED WIRELESS FACILITIES MAP AND LIST OF UPCOMING NEW CASES. PLANNING DIRECTOR COMMISSIONER DETZER STATED THAT THE 42 LOT SUBDIVISION WILL BE BEFORE THE CITY COUNCIL TOMORROW AND ACCORDING TO A FLYER PASSED THROUGH THE NEIGHBORHOOD THE NUMBER OF HOMES HAS BEEN REDUCED TO 38. COMMISSIONERS 8 November 5, 2001 COMMISSIONER FLORES REPORTED A DAY CARE SIGN AT 24TH STREET AND L AVENUE. COMMISSIONER BACA ASKED ABOUT THE CHURCH THAT RECEIVED A CONDITIONAL USE PERMIT AT 18TH AND PALM AND NOW A VIDEO STORE IN GOING IN AT THE SITE. DIRECTOR POST STATED A VIDEO STORE IS ALLOWED THERE AND THAT HE DOES NOT KNOW WHY THE CHURCH DID NOT EXERCISE THEIR CUP. CHAIRMAN UNGAB ASKED IF WE SHOULD MAKE IT MANDATORY FOR ADULT DAY CARE CENTERS TO HAVE OUTDOOR AREAS. DIRECTOR POST RESPONDED THAT THIS IS A STATE REQUIREMENT THAT CAN BE WAIVED. HE SUGGESTS THAT EACH REQUEST BE REVIEWED ON A CASE BY CASE BASIS AND COMMISSION LOOK FOR THE NEED AND OPPORTUNITY FOR EACH SITE. CHAIRMAN NONE. ORAL COMMUNICATIONS (3 MINUTE TIME LIMIT).
