STAFF STATED THAT CHANGES NEED TO BE MADE TO THE FOLLOWING CONDITIONS OF APPROVAL: CONDITION NO. 1; THE WORDS PRE- PACKAGED FROZEN AND SMOKED SHOULD BE ADDED AS THE TYPE OF FISH THAT CAN BE SOLD; AND THE SECOND SENTENCE OF CONDITION NO. 7 SHOULD BE DELETED. APPLICANT: CANNED FOODS, INC. STAFF REPORT BY ASSISTANT PLANNER HOSKINSON. CASE FILE NO. CUP-2001-15. 3 October 1, 2001 GREG HENNIG, CANNED FOODS, INC., APPLICANT, SPOKE IN SUPPORT OF CONDITIONAL USE PERMIT. HE STATED THAT HE WOULD LIKE CONDITION NO. 10 CHANGED TO ALLOW THE SELLING OF PREPACKAGED CUPS IN QUANTITIES LESS THAN 12. HE STATED THAT BIRTHDAY CUPS ARE SOLD IN PACKAGES OF SIX. HE ALSO STATED THAT HE WOLD LIKE MODIFICATIONS TO CONDITION NO. 14 TO ALLOW WINDOW DISPLAYS OF 8 ½ X 11 PRINTED ADVERTISING. HE STATED THESE MODIFICATIONS HAD BEEN DISCUSSED WITH THE POLICE DEPARTMENT AND PRINCIPAL PLANNER RAY. COMMISSIONERS DISCUSSED TYPE OF WINDOW DISPLAYS CURRENTLY OCCURRING AND SIZE OF PREPACKAGED CUPS THAT ARE SOLD AT THE STORE ON “L” AVENUE IN CHULA VISTA. COMMISSIONERS ALSO ASKED PERCENT TOTAL ALCOHOL SALES VERSUS OTHER TOTAL SALES. MR. HENNIG STATED THAT 4 TO 5 PERCENT OF ANNUAL SALES IS FROM ALCOHOL. MOTION BY DETZER, 2ND BY BACA, TO APPROVE CONDITIONAL USE PERMIT 2001-15, BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL, WITH MODIFICATIONS TO CONDITIONS NO. 1 AND 7 AS STATED BY STAFF, WITH NO FURTHER CHANGES TO CONDITIONS. SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT CONDITION NO. 8 SHOULD BE FURTHER MODIFIED TO REFER TO MUNICIPAL CODE SECTION 10.30 REGARDING SIGNAGE REQUIRED IN ADDITION TO SIGNAGE AT EACH ENTRANCE TO THE STORE. THE APPLICANT STATED THAT HE AGREES WITH THE PROPOSED MODIFICATIONS TO CONDITIONS. 4 October 1, 2001 MAKER AND SECOND OF MOTION STATED THEY AGREE WITH CHANGES PROPOSED BY THE SENIOR ASSISTANT CITY ATTORNEY. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, PARRA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. CONTINUED PUBLIC HEARING 5. COMMISSIONERS DETZER AND REYNOLDS STEPPED DOWN FROM THEIR SEATS ON THIS ITEM AS THEY BOTH LIVE WITHIN 500 FEET OF THE PROJECT SITE AND THIS COULD CONSTITUTE A CONFLICT OF INTEREST. COMMISSIONER VALDERRAMA STEPPED DOWN FROM HIS SEAT AS HE HAS A CONFLICT OF INTEREST BECAUSE HIS COMPANY DOES BUSINESS WITH THE APPLICANT. 5. CONTINUED PUBLIC HEARING – SPECIFIC PLAN AND SUBDIVISION FOR 42 SINGLE- FAMILY RESIDENTIAL PARCELS ON THE SOUTH SIDE OF PARADISE VALLEY ROAD EAST OF THE TERMINUS OF E. 8TH STREET. APPLICANT: SIMON & RICHARD CONSTRUCTION CO., INC. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NO. SP-2000-1, S-2000-3, IS-2000-10. CHAIRMAN UNGAB REPORTED FOR THE RECORD THAT HE LIVES 700 FEET FROM THE PROJECT SITE, BUT WILL REMAIN TO VOTE ON THIS ITEM. CHAIRMAN UNGAB SATED THAT COMMISSIONERS HAD BEEN CONTACTED BY THE CONSULTANT HIRED BY THE DEVELOPER AND ASKED FOR EACH TO REPORT ON ANY CONVERSATIONS HELD WITH THE CONSULTANT. COMMISSIONER PARRA REPORTED THAT HE SPOKE WITH THE CONSULTANT AND WAS INFORMED ABOUT THE COMMUNITY MEETINGS WHICH WERE HELD, AND DETAILS WERE TO BE PROVIDED TONIGHT AT THE HEARING. COMMISSIONER FLORES STATED THAT SHE HAD TWO MESSAGES LEFT AND THE CALLS WERE NOT RETURNED. 5 October 1, 2001 COMMISSIONER BACA STATED THAT HE HAD BEEN OUT OF TOWN AND A PHONE MESSAGE WAS LEFT, BUT NO CONTACT MADE. CHAIRMAN UNGAB STATED THAT HE WAS GIVEN AN UPDATE BY THE CONSULTANT ON THE COMMUNITY MEETING. STAFF DISTRIBUTED TWO HANDOUTS, ONE A LETTER RECEIVED FROM TED GODSHALK, AND A PETITION FROM RESIDENTS OF THE MANCHESTER NEIGHBORHOOD OPPOSING THE PROJECT BECAUSE OF BIOLOGY, DENSITY, OFF STREET PARKING, HOME DESIGN AND LOT SIZE ISSUES. J.R. CHANTENGCO, 612 VIA ARMADO, CHULA VISTA, CONSULTANT FOR APPLICANT, SPOKE IN SUPPORT OF PROJECT. HE ADDRESSED THE TWO COMMUNITY MEETINGS THAT WERE HELD AND COMPROMISES REACHED. HE STATED THE HOMES WILL INCORPORATE ARCHITECTURAL FEATURES LIKE THE WELLINGTON ESTATE AND ADDRESSED PROJECT AMENITIES, TRAFFIC, ENVIRONMENTAL ISSUES, AND HOW THE PROJECT IS CONSISTENT WITH THE GENERAL PLAN. PETER MONCRIEFF, 3600 E. 8TH STREET, SPOKE IN SUPPORT OF THE PROJECT. HE STATED THAT THE CLUSTERING OF THE HOMES ON THE LOWER PORTION OF THE SITE WILL PRESERVE THE HILLSIDE AND RESULT IN MINIMAL GRADING. HE ALSO STATED THAT 72 HOMES COULD BE PROPOSED ON THE PROPERTY, BUT THIS PROJECT IS FOR ONLY 42 HOMES. ED NIETO, 809 MARY COURT, RIP REOPELLE, 801 ETHEL PLACE, KATHY SMITH, 815 ETHEL PLACE, ALAN ROCKEFELLER, 1135 MARY LANE, ANN CAMPBELL, 1129 MARY LANE, RON DETZER, 1129 MARY LANE, VINCE REYNOLDS, 1243 MANCHESTER, ALL SPOKE AGAINST THE PROJECT AND EXPRESSED CONCERN ABOUT HIGH DENSITY, SMALL LOT SIZES, SMALL BACKYARDS, LIMITED PARKING, SCHOOL IMPACTS, NEGATIVE AFFECT 6 October 1, 2001 ON PROPERTY VALUES, AFFECT ON ADJACENT NEIGHBORHOODS AS WELL AS FUTURE RESIDENTS OF THE SUBDIVISION AND ASKED THAT THE COMMISSION HELP PROTECT ESTABLISHED SINGLE-FAMILY NEIGHBORHOODS. COMMISSIONERS TOOK A FIVE MINUTE RECESS. MEETING RESUMED. COMMISSIONERS PARRA, FLORES, UNGAB, BACA PRESENT. CHAIRMAN UNGAB ASKED WHAT OTHER OPTIONS WERE AVAILABLE AND IF THE PROJECT COULD BE REDESIGNED TO USE SOME OF THE SLOPE AREAS. HE ALSO ASKED ABOUT FIRE TURNAROUND. COMMISSIONER BACA EXPRESSED CONCERNS REGARDING TRAFFIC, AND LOT SIZES. HE ALSO STATED NO SIDEWALKS ARE PROPOSED. STAFF STATED THAT SIDEWALKS ARE REQUIRED ALONG THE ENTIRE LENGTH OF PARADISE VALLEY ROAD AND IN THE NEW STREETS. STAFF FURTHER STATED THAT FIRE AND ENGINEERING CODE REQUIREMENTS HAVE BEEN MET. COMMISSIONER PARRA STATED THAT HE IS GLAD TO SEE SINGLE FAMILY HOMES PROPOSED AND WOULD LIKE TO SEE THE PROJECT REDESIGNED TO ADDRESS CONCERNS RAISED BY THE NEIGHBORS AND A BETTER PLAN WITH LARGER LOT SIZES. HE ALSO EXPRESSED CONCERNS ABOUT THE BIOLOGY REPORT. MR. CHANTENGCO STATED THAT THEY WOULD LIKE TO MOVE THE PROJECT FORWARD FOR COUNCIL HEARING, AND THIS ITEM HAS ALREADY BEEN CONTINUED. THE BIOLOGY CONCERNS HAVE BEEN ADDRESSED BY CONDITIONS OF APPROVAL AND THEY CAN BE MITIGATED. HE STATED MARKET STUDIES HAVE BEEN PREPARED AND THEY KNOW WHAT FUTURE HOME OWNERS WANT. THEY HAVE CLUSTERED THE DEVELOPMENT AND FEEL THEY HAVE STRUCK A BALANCE 7 October 1, 2001 WITH THE NATURAL CONTOURS OF THE SITE. COMMISSIONER FLORES ASKED ABOUT THE HOMES AND HOW MANY OF EACH MODEL WOULD THERE BE. MR. CHANTENGCO RESPONDED THAT THE HOMES WOULD BE EVENLY DISTRIBUTED BETWEEN THE THREE MODELS. HE STATED THAT THE HOMES WOULD HAVE ARCHITECTURAL FEATURES AND COLOR SCHEMES TO CHOOSE FROM. CHAIRMAN UNGAB STATED THAT HE WOULD LIKE TO SEE LARGER LOTS. MR. CHANTENGCO DISTRIBUTED HANDOUT SHOWING LOT SIZES AND PAD AREAS. HE STATED IT SHOWS THE SMALLEST LOT AT 5,290 SQ.FT. AND THE LARGEST BEING OVER 10,000 SQ.FT. COMMISSIONER PARRA STATED THAT HE WOULD LIKE TO SEE A CONTINUANCE TO ADDRESS ENVIRONMENTAL CONCERNS AND ALLOW THE DEVELOPER TO INCREASE LOT SIZES WITH A MINIMUM OF 60 FT. FRONTAGES. STAFF STATED THAT COMMENTS RECEIVED FROM THE US FISH AND WILDLIFE SERVICE AND STATE DEPARTMENT OF FISH AND GAME HAVE BEEN ADDRESSED IN CONDITIONS OF APPROVAL. PRINCIPAL PLANNER RAY STATED THAT COMMISSION SHOULD EXPRESS WHAT TYPE OF PROJECT THEY WOULD LIKE TO SEE, IF THEY WANT TO CONTINUE THE HEARING. THE STAFF REPORT AND TESTIMONY TONIGHT HAS PROVIDED A LOT OF INFORMATION TO DIGEST. ANDY LAMBERT, CIVIL ENGINEER FOR PROJECT STATED THAT ENVIRONMENTAL ISSUES ARE RESOLVED IN CONDITIONS OF APPROVAL . HE STATED THIS IS A GOOD PROJECT WHICH PRESERVES THE WELLINGTON ESTATE, LEAVES OPEN SPACE, CLUSTERS THE LOTS AND WILL PROVIDE NICE HOMES. 8 October 1, 2001 THEY DO NOT WISH TO HAVE A CONTINUANCE AS THEY ARE OUT OF TIME AND NEED TO MOVE FORWARD. MOTION BY BACA, 2ND BY PARRA TO RECOMMEND THAT THE CITY COUNCIL DENY SP-2001 AND S-2000-3 BASED ON FINDINGS FOR DENIAL PROVIDED IN THE STAFF REPORT. MOTION CARRIED BY THE FOLLOWING VOTE: AYES – PARRA, FLORES, UNGAB, BACA. COMMISSIONERS VALDERRAMA, REYNOLDS AND DETZER RETURNED TO THEIR SEATS. NO REPORT. SENIOR ASSISTANT CITY ATTORNEY PRINCIPAL PLANNER RAY MENTIONED A NEW UPCOMING CASE, AS PROVIDED IN THE FRONT OF COMMISSIONERS BOOKS. PLANNING DIRECTOR COMMISSIONER REYNOLDS ASKED WHO IS RESPONSIBLE FOR CLEANING UP OF THE BOLL WEEVIL PROPERTY. PRINCIPAL PLANNER RAY STATED THAT THE PROPERTY OWNER IS RESPONSIBLE AND WILL BE CONTACTED. COMMISSIONERS CHAIRMAN UNGAB ASKED STAFF TO EXPRESS THE COMMISSION’S WELL WISHES TO ROGER’S ILL MOTHER.
