A RESOLUTION OF THE PLANNING COMMISSION THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A ZONE VARIANCE FOR AN OFFICE BUILDING WITH LESS THAN REQUIRED PARKING AND PROJECTIONS INTO THE REQUIRED FRONT YARD IN THE 1400 BLOCK OF HIGHLAND AVENUE. APPLICANT: KATHRYN WILLETS FOR PAUL AGPAOA AND THE NATIONAL CITY COMMUNITY DEVELOPMENT COMMISSION. CASE FILE NO. Z-2001-10. 3. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR A WIRELESS COMMUNICATIONS FACILITY ON AN EXISTING BUILDING ADJACENT AND EAST OF THE SAN DIEGO TROLLEY LINE BETWEEN 21ST AND 22ND STREETS. APPLICANT: SPRINT PCS. CASE FILE NO. CUP-2001-4. 3 August 20, 2001 PUBLIC HEARINGS 4. STAFF STATED THAT THE APPLICANT HAD REQUESTED THAT CONDITION NO. 7 BE AMENDED TO REMOVE THE REQUIREMENT FOR 7 FOOT OR TALLER LOCKABLE GATES. THE CONDITION WILL NOW REQUIRE THE ENLARGED TRASH ENCLOSURE TO HAVE A 10- FOOT CEILING AND FINAL DESIGN OF THE TRASH ENCLOSURE SHALL BE SUBJECT TO APPROVAL BY THE PLANNING DIRECTOR. THIS IS AGREEABLE TO STAFF. 4. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR A WIRELESS COMMUNICATIONS FACILITY ON AN EXISTING BUILDING AT 3007 HIGHLAND AVENUE. APPLICANT: NEXTEL COMMUNICATIONS. STAFF REPORT BY ASSISTANT PLANNER HOSKINSON. CASE FILE NO. CUP-2001-12. RENA ELWARDANI, NEXTEL COMMUNICATIONS, 2576 COPLEY DRIVE, SAN DIEGO, APPLICANT, SPOKE IN SUPPORT OF THE CONDITIONAL USE PERMIT. SHE ANSWERED QUESTIONS OF COMMISSIONERS CONCERNING POSSIBLE FUTURE NEXTEL SITES IN THE CITY. COMMISSIONER DETZER ASKED STAFF IF CONSIDERATION HAD BEEN GIVEN TO HAVING A BOND POSTED IF THE FACILITIES BECOME ABANDONED OR DECOMMISSIONED AND NEXTEL NO LONGER EXISTS. DIRECTOR POST STATED THAT POSTING OF A BOND IS NOT NECESSARY AS THE PROPERTY OWNER WOULD ULTIMATELY BE RESPONSIBLE FOR REMOVAL OF EQUIPMENT OR FACILITIES THAT ARE ABANDONED OR DECOMMISSIONED. MOTION BY BACA, 2ND BY DETZER TO APPROVE CONDITIONAL USE PERMIT 2001-12 BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL WITH MODIFICATION TO CONDITION NO. 7. MOTION CARRIED BY THE FOLLOWING VOTE: AYES – VALDERRAMA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. ABSENT: PARRA. 4 August 20, 2001 5. STAFF DISTRIBUTED TWO HANDOUTS RECEIVED, ONE FROM A PROPERTY OWNER OPPOSED TO THE PROJECT DUE TO LOT SIZES, AND THE OTHER FROM THE U.S. FISH AND WILDLIFE SERVICE AND THE STATE DEPARTMENT OF FISH AND GAME STATING THAT MORE INFORMATION IS NEEDED ALONG WITH REVISIONS TO MITIGATION MEASURES AS DESCRIBED IN THE NEGATIVE DECLARATION. STAFF SUGGESTS THAT THE COMMISSION CONSIDER A CONTINUANCE TO ADDRESS THESE AND OTHER ISSUES. 5. PUBLIC HEARING – SPECIFIC PLAN AND SUBDIVISION FOR 42 SINGLE-FAMILY RESIDENTIAL PARCELS ON THE SOUTH SIDE OF PARADISE VALLEY ROAD EAST OF THE TERMINUS OF E. 8TH STREET. APPLICANT: SIMON & RICHARD CONSTRUCTION CO., INC. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NO. SP-2000-1, S-2000-3, IS- 2000-10. STAFF STATED THAT CONDITION NO. 34 NEEDS TO BE CORRECTED CONCERNING THE SIZE OF THE REAR SETBACKS. STAFF ALSO MENTIONED THE APPLICANT HAS EXPRESSED CONCERN WITH CONDITION NO. 39 REGARDING ACCESSORY STRUCTURES AND WOULD LIKE THE CONDITION MODIFIED TO ALLOW ACCESSORY STRUCTURES IN THE REAR YARDS OF THOSE HOMES ON THE SOUTH SIDE OF THE PROPOSED NEW ROAD. COMMISSIONER VALDERRAMA STATED THAT HE DOES HAVE A CONFLICT OF INTEREST AS HIS COMPANY DOES BUSINESS WITH THE APPLICANT. HE WILL BE ABSTAINING ON THIS ITEM. COMMISSIONERS DETZER AND REYNOLDS COMMENTED THAT THEY MIGHT BE WITHIN 500 FT. OF THE PROJECT BOUNDARIES AND MIGHT HAVE A CONFLICT OF INTEREST. SENIOR ASSISTANT CITY ATTORNEY STATED THAT COMMISSIONERS NEED TO DETERMINE IF THEY HAVE A CONFLICT OF INTEREST AND IF DOUBTS EXIST THE FPPC CAN HELP MAKE THAT DETERMINATION UPON WRITTEN REQUEST. 5 August 20, 2001 CHAIRMAN UNGAB STATED THAT DUE TO ONE COMMISSIONER NEEDING TO ABSTAIN, AND TWO OTHER MEMBERS POSSIBLY BEING WITHIN 500 FT. AND POSSIBLY NEEDING TO ABSTAIN, THE HEARING WILL NEED TO BE CONTINUED DUE TO LACK OF A QUORUM. PETER MONCRIEFF, 3600 E. 8TH STREET, ASKED WHY COMMISSIONERS WOULD HAVE A CONFLICT IF THEY ARE WITHIN 500 FT, WHEN A 300 FT. RADIUS IS USED FOR NOTIFICATION. SENIOR ASSISTANT CITY ATTORNEY HRADECKY EXPLAINED THAT CONFLICT OF INTEREST RULES ARE SEPARATE FROM PUBLIC NOTICE LAWS. HE STATED THAT NO TESTIMONY SHOULD BE TAKEN AT THIS TIME DUE TO LACK OF A QUORUM PRESENT TO ACT ON THIS ITEM. ANN CAMPBELL, 1129 MARY LANE, URGED COMMISSIONERS TO NOTIFY INTERESTED RESIDENTS OF THE NEXT HEARING. SHE REQUESTED NOTIFICATION BEYOND 300 FT, AS SEVERAL RESIDENTS IN ATTENDANCE TONIGHT LIVE BEYOND 300 FT. TED GODSHALK, 2143 CLEVELAND AVENUE SUGGESTED GETTING NAMES OF THOSE IN ATTENDANCE WHO WISHED TO RECEIVE NOTIFICATION. PAT LARGE, 820 MARY COURT STATED THAT SHE WILL NOT BE AVAILABLE TO SPEAK AT FUTURE MEETINGS AND COULD SHE SHARE HER FEELINGS ABOUT THE PROJECT NOW. CHAIRMAN UNGAB STATED THAT WRITING A LETTER TO THE PLANNING DEPARTMENT IS OPTION. ED NIETO, 809 MARY COURT ASKED IF A 500 FT. MAILING RADIUS WOULD BE USED. 6 August 20, 2001 CHAIRMAN UNGAB STATED THAT A 300 FT. MAILING LIST WILL BE USED, IN ADDITION TO NAMES ADDED TO THE LIST FOR INTERESTED PARTIES TO SIGN. COMMISSIONER BACA ASKED HOW LONG OF A CONTINUANCE WOULD BE NEEDED. DIRECTOR POST STATED THAT SUFFICIENT TIME IS NEEDED FOR COMMISSIONERS TO DETERMINE IF THEY HAVE A CONFLICT OF INTEREST, AND FOR THE APPLICANT TO ADDRESS U.S. FISH AND WILDLIFE SERVICES AND STATE FISH AND GAME CONCERNS. HE ALSO SUGGESTED THAT THE APPLICANT CONTACT THE COMMUNITY TO GET THEIR FEEDBACK ON THE PROJECT. COMMISSIONER DETZER ASKED STAFF TO PROVIDE FINITE MEASUREMENT OF DISTANCE OF COMMISSIONERS HOMES TO THE PROJECT SITE. LAWRENCE EMERSON, 1344 MANCHESTER, ASKED THAT HANDOUTS BE AVAILABLE TO THE PUBLIC SO THAT THEY CAN GET A BETTER FEEL FOR THE PROJECT. STAFF STATED THAT SEVERAL INTERESTED PEOPLE CAME IN OR CONTACTED STAFF PRIOR TO THE MEETING ABOUT THIS PROJECT. MOTION BY BACA, 2ND BY FLORES, TO CONTINUE THIS ITEM TO THE MEETING OF OCTOBER 1, 2001. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: FLORES, UNGAB, BACA. ABSTAINING: VALDERRAMA, REYNOLDS, DETZER. ABSENT: PARRA. 7 August 20, 2001 6. COMMISSIONER REYNOLDS STATED THAT HE SERVES ON THE BOARD OF DIRECTORS FOR THE STEIN FARM, BUT DOES NOT FEEL THAT THIS IS A CONFLICT. SALVADOR ADAME, 1006 CORDOVA DRIVE, CHULA VISTA, APPLICANT, SPOKE IN SUPPORT OF THE TENTATIVE PARCEL MAP AND STATED THAT HE SUPPORTS OPTION #3 AS OUTLINED IN THE STAFF REPORT. HE STATED THAT HE HAS OWNED THE PROPERTY FOR SIX MONTHS AND IS IN THE PROCESS OF CLEANING IT UP. 6. PUBLIC HEARING – TENTATIVE PARCEL MAP TO DIVIDE ONE LOT INTO THREE FOR PROPERTY AT 1905 AND 1909 E AVENUE AND 1904 F AVENUE WITH EXCEPTIONS TO THE SUBDIVISION ORDINANCE TO ALLOW AN IRREGULAR LOT SHAPE AND REDUCED STREET FRONTAGE FOR ONE LOT. APPLICANT: SALVADOR ADAME. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. LS-2001-3. FRANCISCO VALDEZ, 1919 E AVENUE, ROBERTO VALDEZ, 1836 GOTHAM, CHULA VISTA, SPEAKING OF BEHALF OF THEIR MOTHER WHO LIVES AT 1919 E AVENUE, AND MIGUEL BELTRAN, 1933 E AVENUE, ALL SPOKE AGAINST THE PROPOSED PARCEL MAP. THEY EXPRESSED CONCERNS REGARDING GRAFFITI, CRIME PROBLEMS AND INCREASE OF TRAFFIC IN THE NEIGHBORHOOD. COMMISSIONERS DISCUSSED VARIOUS OPTIONS AS OUTLINED IN THE STAFF REPORT. COMMISSIONER DETZER SUGGESTED THAT THE ALLEY COULD BE VACATED. COMMISSIONER DETZER STATED THE HE IS IN FAVOR OF SPLITTING THE LOT IN SUCH A WAY TO ALLOW FOR HOMEOWNERSHIP. MR. BELTRAN, 1933 E AVENUE STATED THAT HE DID NOT RECEIVE NOTIFICATION OF THE HEARING. STAFF RESPONDED THAT PROPERTY OWNERS WITHIN A 300 FT. RADIUS WERE NOTIFIED. COMMISSIONER REYNOLDS QUESTIONED WHY VIOLATIONS THAT EXIST ON THE SITE HAVE NOT BEEN CORRECTED. 8 August 20, 2001 MR. ADAME REPLIED THAT HE IS IN THE PROCESS OF CLEANING THE SITE. COMMISSIONER DETZER STATED THAT OPTION #2 BEST PROMOTES GENERAL PLAN POLICIES TO ENCOURAGE HOMEOWNERSHIP. COMMISSIONER FLORES STATED SHE AGREES. DIRECTOR POST STATED THAT IF THE PROPOSAL IS TO BE AMENDED, READVERTISING AND RENOTICE MAY BE NEEDED. MOTION BY VALDERRAMA, 2ND BY BACA TO CONTINUE THE PUBLIC HEARING TO THE MEETING OF SEPTEMBER 17, 2001 TO ALLOW THE APPLICANT TO AMEND THE PROPOSAL WITH NOTIFICATION TO BE PROVIDED TO PROPERTY OWNERS, AND READVERTISING OF THE HEARING IF NECESSARY. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, FLORES, UNGAB, BACA, REYNOLDS, DETZER. ABSENT: PARRA. NO REPORT. SENIOR ASSISTANT CITY ATTORNEY DIRECTOR POST MENTIONED SEVERAL NEW CASES AND THE UPCOMING LEAGUE OF CALIFORNIA CITIES CONFERENCE IN SACRAMENTO IN MID SEPTEMBER. PLANNING DIRECTOR COMMISSIONER FLORES REPORTED A SIGN ADVERTISING DAYCARE AT 28TH AND J AVENUE. COMMISSIONERS CHAIRMAN UNGAB COMMENTED ON THE DIFFICULTY IN VIEWING EXHIBITS BY BOTH COMMISSIONERS AND THE PUBLIC. CHAIRMAN 9 August 20, 2001 DIRECTOR POST STATED THAT THE COUNCIL CHAMBERS WILL BE REMODELED AND THAT BETTER DISPLAY OF GRAPHICS IS BEING PLANNED AS PART OF THAT. HE STATED HE WOULD KEEP COMMISSION INFORMED OF TIMELINES. TED GODSHALK, 2143 CLEVELAND AVENUE, MENTIONED A BUSINESS AT 2142 CLEVELAND AVENUE IS STILL STORING BUSINESS EQUIPMENT OUTDOORS AND AN RV. ORAL COMMUNICATIONS (3 MINUTE TIME LIMIT). NOTE: Under State law, items requiring Commission action must be brought back on a subsequent agenda unless they are of a demonstrated emergency or urgent nature.
