MOTION BY BACA, 2ND BY MARTINELLI, FOR APPROVAL OF MINUTES FOR THE MEETING HELD ON JANUARY 22, 2001. ROLL CALL: AYES – VALDERRAMA, GODSHALK, UNGAB, BACA, MARTINELLI, DETZER. ABSTAINING: PARRA. 1. MINUTES OF THE REGULAR MEETING HELD ON JANUARY 8, 2001. MOTION BY PARRA, 2ND BY GODSHALK, FOR APPROVAL OF AGENDA. ROLL CALL: AYES – UNANIMOUS. APPROVAL OF AGENDA 2 February 5, 2001 PUBLIC HEARING 2. KEITH GLASSMAN, 1309 POST AVENUE, TORRANCE, CALIFORNIA, ANSWERED QUESTIONS OF COMMISSIONERS CONCERING AGREEMENT WITH CONDITIONS OF APPROVAL, NO ALCOHOL SALES REQUESTED AND MENU ITEMS. COMMISSIONER MARTINELLI STATED THAT SHE IS GLAD TO SEE THIS VACANT SPACE OCCUPIED AND THINKS JOLLIBEE WILL BE A GREAT ADDITION TO THE CITY. ERNIE BALAGE, JOLLIBEE RESTAURANT, DESCRIBED RESTAURANT MENU, WHICH IS AMERICAN, WITH ASIAN PACIFIC TASTE. HE STATED THEY ARE ENTERING INTO THE U.S. MARKET AND FEELS NATIONAL CITY IS AN IMPORTANT PLACE TO START THEIR BUSINESS. 2. PUBLIC HEARING – PLANNED DEVELOPMENT PERMIT TO ALLOW A FAST FOOD RESTAURANT AT 1704 SWEETWATER ROAD. APPLICANT: KEITH GLASSMAN, GLASSMAN PLANNING ASSOCIATES FOR JOLLIBEE RESTAURANT. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. PD-2000-7. GREG ROJA, PROJECT ARCHITECT, 25 KEARNEY STREET, SAN FRANCISCO, ADDRESSED COMMISSIONER GODSHALK’S QUESTIONS REGARDING USE OF SKYLIGHTS, OPERABLE WINDOWS AND SOLAR LANDSCAPE LIGHTS. MR. ROJA STATED THAT EXISTING AIR CONDITIONING EQUIPMENT IN THE CENTER OF THE BUILDING ROOF PROHIBITS THE USE OF SKYLIGHTS. HE STATED THEY INTEND TO HAVE AN ENERGY EFFICIENT BUILDING. COMMISSIONER GODSHALK ASKED IF WE COULD REQUIRE USE OF ENERGY EFFICIENT SYSTEMS BEYOND STATE REGULATIONS. BUILDING AND SAFETY DIRECTOR TREES STATED THAT IN A BUILDING PERMIT SUBMITTAL ALL THAT CAN BE REQUIRED IS THE STATE REGULATIONS. DEVELOPERS CAN ONLY BE ENCOURAGED TO GO ABOVE AND BEYOND. 3 February 5, 2001 SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT SPECIFIC PUBLIC HEALTH AND SAFETY ISSUES WOULD NEED TO BE INVOLVED TO REQUIRE HIGHER THAN STATE MANDATED REQUIREMENTS. RESEARCH WILL BE NEEDED BEFORE A LEGAL OPINION CAN BE PROVIDED. MOTION BY PARRA, 2ND BY MARTINELLI TO APPROVE PLANNED DEVELOPMENT PERMIT 2000-7 BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL. ROLL CALL: AYES – UNANIMOUS. OTHER BUSINESS 3. COMMISSIONER GODSHALK ASKED FOR A HISTORY OF WHY THE LOT WAS FORMED THIS WAY. DIRECTOR POST STATED THAT MANY PROJECTS WERE BUILT THIS WAY IN THE ‘70’S AND ‘80’S TO TAKE ADVANTAGE OF OWNERSHIP AND TAX BENEFITS. 3. CERTIFICATE OF COMPLIANCE FOR A LOT LINE ADJUSTMENT IN THE SOUTHPORT OFFICE PARK AT 123 MILE OF CARS WAY. APPLICANT: SOUTHPORT OFFICE PARK. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NO. CC-2001-01. CHAIRMAN UNGAB ASKED IF WE KNOW WHY THE SURVEY WAS PERFORMED. STAFF STATED THIS IS A CLEAN UP EFFORT TO CORRECT THE BOUNDARY LINE. MOTION BY GODSHALK, 2ND BY PARRA, TO DETERMINE THAT THE PARCELS AS DESCRIBED ON THE PLAT MAP ARE IN COMPLIANCE WITH THE STATE MAP ACT AND TITLE 17 OF THE MUNICIPAL CODE, SINCE NO NEW PARCELS WILL BE CREATED, NO ILLEGALLY CREATED PARCELS WILL BE INCLUDED, NO ALTERATIONS TO EXISTING IMPROVEMENTS WILL BE REQUIRED AND NO VIOLATION OF CITY STANDARDS WILL BE CREATED. ROLL CALL: AYES – UNANIMOUS. 4 February 5, 2001 4. BUILDING AND SAFETY DIRECTOR TREES ADDRESSED AB970, ESTABLISHING NEW STATE REGULATIONS, WHICH BECOME EFFECTIVE JUNE 1, 2001. IT REQUIRES COOL ROOFS, HIGHER DUCT RATES, AND CERTIFICATIONS TO BE SUBMITTED TO THE DEPARTMENT THAT ENERGY EFFICIENT MATERIALS HAVE BEEN USED. 4. DISCUSSION OF WAYS TO CONSERVE ENERGY. SHE ADDRESSED SDG&E EFFORTS TO ENCOURAGE SUPEREFFICIENT HOMES AND WAYS TO ENCOURAGE DEVELOPERS TO CONSTRUCT THEM, WITH REDUCED PLAN CHECK TIMES. ASSOCIATE CIVIL ENGINEER LONG ADDRESSED ON-GOING PROGRAMS THAT THE ENGINEERING DEPARTMENT IS CURRENTLY IMPLEMENTING TO CONSERVE ENERGY. COMMISSIONER GODSHALK ASKED ABOUT WAYS WHICH CITY BUILDINGS ARE CONSERVING. ASSOCIATE CIVIL ENGINEER LONG STATED THAT CITY BUILDING TEMPERATURES HAVE BEEN LOWERED, LIGHTS MODIFIED AND MOTION DETECTORS INSTALLED. DIRECTOR POST MENTIONED ENERGY CONSERVATION POLICIES IN THE LAND USE CODE, GENERAL PLAN, HOUSING ELEMENT, AND DESIGN GUIDELINES. COMMISSIONER GODSHALK STATED THAT DURING THE PUBLIC HEARING ON JOLLIBEE, USE OF SKYLIGHTS, SOLAR LANDSCAPING AND OPERABLE WINDOWS WERE DISCUSSED. HE STATED HE WOULD LIKE TO SEE THESE ADDED AS CONDITIONS, BUT THAT SENIOR ASSISTANT CITY ATTORNEY WOULD NEED TIME TO RESEARCH IF HIGHER STANDARDS COULD BE PLACED AS CONDITIONS ON DISCRETIONARY PERMITS, AS WELL AS IF THE CITY COULD REQUIRE DEVELOPERS ON NEW PERMITS TO GO ABOVE AND BEYOND STATE REQUIREMENTS. COMMISSIONER GODSHALK STATED 5 February 5, 2001 THE COMMISSION SHOULD DO THEIR PART TO CONSERVE ENERGY AND THUS PRESERVE THE LEVEL OF CITY SERVICES PROVIDED AND HELP BUSINESSES STAY OPEN. HE STATED THAT THE STRATEGY WITH THE CLEAN AIR REGULATIONS IS TO HAVE A CERTAIN NUMBER OF ELECTRIC VEHICLES ON THE ROAD BY A CERTAIN YEAR. HE ASKED IF THE CITY COULD ADOPT A PHASING PLAN ON NEW DEVELOPMENT AND PROJECTS REQUIRING DISCRETIONARY PERMITS IN WHICH 50% OF OUTDOOR ILLUMINATION COULD BE SOLAR BY 2002, 75% BY 2005, OR SOMETHING SIMILAR. HE STATED THAT THE CITY AND CDC SHOULD CONSIDER THAT ALL PROJECTS THEY ARE INVOLVED WITH TO GO ABOVE AND BEYOND WHAT IS REQUIRED BY STATE AND FEDERAL LAW. COMMISSIONER GODSHALK ASKED WHAT NEEDS TO HAPPEN TO UPDATE THE GENERAL PLAN AND CODES TO INCORPORATE ADDITIONAL ENERGY CONSERVATION MEASURES, AS STATED IN THE HOUSING ELEMENT. DIRECTOR POST STATED THAT RESOURCES WOULD NEED TO BE ALLOCATED TO ACCOMPLISH THIS. COMMISSIONER VALDERRAMA ASKED FOR ADDITIONAL INFORMATION ABOUT THE SIX NEW POWER PLANTS THAT HAVE BEEN APPROVED AND PRESENTLY SCHEDULED TO COME ON- LINE IN SAN DIEGO COUNTY BY JUNE 1, 2001. HE ALSO ASKED FOR INFORMATION ABOUT THE 501 MEGAWATTS POWER PLANT THAT IS IN THE PERMIITTING PROCESS TO BE LOCATED IN OTAY MESA. COMMISSIONER GODSHALK ASKED THAT THE ABOVE MENTIONED ITEMS BE INCORPORATED INTO A REPORT AND BROUGHT TO THE COMMISSION ON MARCH 19, 2001. 6 February 5, 2001 COMMISSIONER DETZER ASKED THAT STAFF EXPLORE AN INCENTIVE PLAN TO INCORPORATE SOLAR POWER. CHAIRMAN UNGAB STATED THAT WE NEED TO SEE WHAT WILL BE IN THE BEST INTEREST OF THE CITY AND THEN MAKE RECOMMENDATIONS. COMMISSIONER MARTINELLI ASKED THAT STAFF LOOK INTO LOW- INTEREST LOAN PROGRAM FOR HOMEOWNERS TO MAKE ENERGY EFFICIENT IMPROVEMENTS TO THEIR HOMES. MOTION BY GODSHALK, 2ND BY BACA TO HAVE STAFF BRING BACK A REPORT AT THE MEETING OF MARCH 19, 2001 TO LOOK AT ITEMS DISCUSSED ABOVE AND HAVE RECOMMENDATIONS TO PRESENT TO COUNCIL. NO REPORT. SENIOR ASSISTANT CITY ATTORNEY DIRECTOR POST STATED THAT THE MONTHLY CODE CONFORMANCE LOG AND LIST OF UPCOMING CASES IS PROVIDED TO THE COMMISSIONERS IN THE FRONT OF THEIR BOOKS. PLANNING DIRECTOR COMMISSIONER GODSHALK REPORTED THAT THE TRASH ENCLOSURE NEAR THE PIZZA HUT AT THE SWEETWATER TOWN AND COUNTRY SHOPPING CENTER NEEDS TO BE LOOKED AT, AS WELL AS A BANNER DISPLAYED AT A CLOTHING STORE NEAR THE CARL’S JR. RESTAURANT. COMMISSIONERS HE ALSO REPORTED ANOTHER TRASH ENCLOSURE THAT SHOULD BE LOOKED AT NEAR THE CHUCK E. CHEESE AND PET STORE IN SOUTH BAY PLAZA. CHAIRMAN UNGAB ASKED IF ADDITIONAL DISPLAY EASELS SHOULD BE USED TO ALLOW DISPLAY MAPS TO BE VISIBLE TO COMMISSION AND TO PUBLIC. CHAIRMAN 7 February 5, 2001 DIRECTOR POST STATED THAT ADDITIONAL EASELS ARE AVAILABLE AND ADDITIONAL MAPS CAN BE DISPLAYED. NONE. ORAL COMMUNICATIONS (3 MINUTE TIME LIMIT).
