MOTION BY GODSHALK, 2ND BY MARTINELLI, FOR APPROVAL OF AGENDA. ROLL CALL: AYES – UNANIMOUS. APPROVAL OF AGENDA 2 March 5, 2001 RESOLUTION 2. MOTION BY BACA, 2ND BY MARTINELLI, FOR APPROVAL OF RESOLUTION NO. 07-2001. ROLL CALL: AYES – UNANIMOUS. 2. RESOLUTION NO. 07-2001. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A PLANNED DEVELOPMENT PERMIT TO ALLOW A FAST FOOD RESTAURANT AT 1704 SWEETWATER ROAD. APPLICANT: KEITH GLASSMAN, GLASSMAN PLANNING ASSOCIATES FOR JOLLIBEE RESTAURANT. CASE FILE NO. PD-2000-7. PUBLIC HEARINGS - 3. JANET CARREON, 5561 NERAK COURT, BONITA, PROPERTY OWNER, AND JEFF CARREON, SON OF PROPERTY OWNER, SPOKE IN SUPPORT OF THE VARIANCE. THEY ADDRESSED AN AREA WHERE A PARKING SPACE COULD BE MADE AVAILABLE AND SUBMITTED PHOTOS SHOWING THE PROPERTY. THEY STATED THEY HAVE SPENT OVER $65,000 IN STUCCO AND FENCING TO UPGRADE THE PROPERTY. 3. PUBLIC HEARING – ZONE VARIANCE TO ADD A RESIDENTIAL UNIT AND ELIMINATE ALL REQUIRED PARKING AT 930 E. 18TH STREET. APPLICANT: JANET M. CARREON. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. Z-2001-02. COMMISSIONER BACA ASKED IF THEY AGREE WITH CONDITIONS OF APPROVAL. THEY STATED THEY AGREED WITH CONDITIONS OF APPROVAL. STAFF STATED THAT THE AREA FOR PROPOSED PARKING IS IN THE FRONT YARD SETBACK. COMMISSIONER MARTINELLI EXPRESSED CONCERN ABOUT EMERGENCY FIRE ACCESS IF THIS PARKING SPACE WAS CREATED. COMMISSIONER VALDERRAMA SUGGESTED THAT THIS ITEM BE CONTINUED TO THE NEXT MEETING TO ALLOW STAFF TIME REVIEW THE PROPOSAL OF HAVING A PARKING SPACE ADDED. 3 March 5, 2001 MOTION BY VALDERRAMA, 2ND BY BACA, TO CONTINUE THE HEARING TO THE MEETNG OF MARCH 19, 2001 TO ALOW STAFF SUFFICIENT TIME TO REVIEW PROPOSAL PRESENTED TO HAVE A PARKING SPACE ADDED IN THE FRONT YARD SETBACK. ROLL CALL: AYES – UNANIMOUS. 4. VERN MYERS, 11965 FUERTE DRIVE, EL CAJON, APPLICANT, GAVE A HISTORY OF THE PROPERTY AND DESCRIBED THE NEW PROPOSED USE OF STORING VEHICLES FOR A LOCAL MOVING COMPANY. COMMISSIONER DETZER ASKED STAFF IF THE NEIGHBORS HAD BEEN NOTIFIED OF THIS PROPOSAL. 4. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR A VEHICLE STORAGE LOT ON VACANT PROPERTY NORTH OF 1330 HARDING AVENUE. APPLICANT: J. VERNON MYERS. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. CUP-2001-01. STAFF STATED THAT PROPERTY OWNERS WITHIN 300 FEET OF THE PROPERTY HAD BEEN NOTIFIED. COMMISSIONER DETZER ASKED IF WROUGHT IRON FENCING HAD BEEN CONSIDERED. MR. MYERS STATED THAT THE USE OF WROUGHT IRON FENCING IS NOT COST EFFECTIVE. MR. MYERS STATED THAT THE SITE CURRENTLY IS A DUMPING GROUND AND TRASH COLLECTION SITE. IT WOULD BE A BENEFIT TO THE CITY TO HAVE THE VACANT LOT MADE INTO A PARKING LOT FOR VEHICLE STORAGE. COMMISSIONERS DISCUSSED THE REQUIRED 5-FOOT LANDSCAPED SETBACK REQUIREMENT BETWEEN THE STORAGE LOT AND THE ADJACENT SINGLE-FAMILY DWELLING. MR. MYERS STATED IT IS DIFFICULT TO MAINTAIN THE LANDSCAPE AREA AND WOULD LIKE THE CONDITION REMOVED. COMMISSIONER GODSHALK STATED THAT HE WOULD LIKE TO HAVE CONDITIONS ADDED THAT THE REPAIR OF VEHICLES, THE OUTDOOR STORAGE OF ITEMS OTHER THAN 4 March 5, 2001 VEHICLES, STORAGE OF NON- OPERATIVE OR WRECKED VEHICLES, AND THE CONSTRUCTION OF BOXES OR MOVING EQUIPMENT NOT BE ALLOWED ON THE LOT AT ANY TIME. COMMISSIONER VALDERRAMA ASKED MR. MYERS IF HE AGREES WITH THE ADDITIONAL PROPOSED CONDITIONS OF APPROVAL. MR. MYERS STATED THAT HE AGREES WITH THEM. COMMISSIONER BACA ASKED IF A BLOCK WALL SHOULD BE INSTALLED ALONG THE SOUTH PROPERTY LINE. MR. MYERS STATED THAT HE DOES NOT WANT TO INSTALL A BLOCK WALL. HE STATED HE FEELS IT WOULD BECOME A PLACE FOR GRAFFITI. COMMISSIONER MARTINELLI STATED THAT MR. MYERS SHOULD APPLY FOR A VARIANCE AS SUGGESTED BY STAFF IF HE DOES NOT AGREE WITH CONDITION NO. 14 REQUIRING A 5- FOOT LANDSCAPED SIDE YARD SETBACK. SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT A VARIANCE MAY NOT BE ABLE TO BE GRANTED UNLESS APPROPRIATE FINDINGS CAN BE MADE. FURTHER STUDY WOULD BE NEEDED. DIRECTOR POST SUGGESTED THAT COMMISSION TAKE ACTION AND LEAVE THE VARIANCE OPTION OPEN. THE 5-FOOT LANDSCAPE SETBACK IS REQUIRED BY CODE. THE IDEA IS TO HAVE A BUFFER BETWEEN INCOMPATIBLE USES. COMMISSIONER MARTINELLI STATED THAT SHE FEELS THE SETBACK IS NEEDED. MR. MYERS STATED THAT HE WOULD HAVE TO SPEAK WITH THE INTENDED LEASOR ABOUT THE REQUIRED 5- FOOT LANDSCAPE AREA. COMMISSIONERS DISCUSSED IF A CONTINUANCE IS NEEDED. 5 March 5, 2001 COMMISSIONER GODSHALK STATED THAT HE FELT THE CONDITION SHOULD REMAIN AND ACTION TAKEN. IT THEN BECOMES MR. MYERS OPTION TO MEET CONDITIONS OR NOT EXERCISE THE CONDITIONAL USE PERMIT. MOTION BY VALERRAMA, 2ND BY GODSHALK TO APPROVE CONDITIONAL USE PERMIT 2001-01 BASED ON ATTACHED FINDINGS AND RECOMMENDED CONDITIONS OF APPROVAL WITH ADDED CONDITIONS 18, 19, AND 20 REQUIRING THE REPAIR OF VEHICLES NOT BEING ALLOWED ON THE STORAGE LOT, OUTDOOR STORAGE OF ITEMS OTHER THAN VEHICLES NOT BEING ALLOWED AND NONOPERABLE OR WRECKED VEHICLES NOT BE STORED ON THE PROPERTY AT ANY TIME. ROLL CALL: AYES – UNANIMOUS. 5. BOB BALL, 3248 CASA BONITA, BONITA, APPLICANT STATED HE WAS AVAILABLE TO ANSWER QUESTIONS OF COMMISSIONERS. COMMISSIONER DETZER ASKED IF HE AGREES WITH CONDITIONS OF APPROVAL. MR. BALL STATED THAT THEY AGREE WITH CONDITIONS OF APPROVAL. COMMISSIONER BACA ASKED ABOUT THE LETTER RECEIVED COMPLAINING ABOUT THE EXISTING FACILITY. MR. BALL STATED THAT THE MANAGER HAS BEEN CONTACTED AND COMPLAINTS WILL BE ADDRESSED. 5. PUBLIC HEARING – PLANNED DEVELOPMENT PERMIT FOR AN AUTO BODY SHOP AT THE NORTHWEST CORNER OF 25TH STREET AND A AVENUE. APPLICANT: ROBERT P. BALL. STAFF REPORT BY ASSOCIATEPLANNER CAIN. CASE FILE NO. PD-2000-11. MOTION BY GODSHALK, 2ND BY DETZER TO APPROVE PLANNED DEVELOPMENT PERMIT 2000-11 BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITONS OF APPROVAL. ROLL CALL: AYES – UNANIMOUS. 6 March 5, 2001 SENIOR ASSISTANT CITY ATTORNEY HRADECKY INDICATED THAT THE MUNICIPAL CODE STATES IT IS THE RESPONSIBILITY OF PROPERTY OWNERS TO KEEP THEIR PROPERTY CLEAN. SENIOR ASSISTANT CITY ATTORNEY DIRECTOR POST MENTIONED ITEMS PROVIDED TO COMMISSIONERS IN THE FRONT OF THEIR BOOKS; THE MONTHLY CODE CONFORMANCE LOG, REPORT ON RECENT REFERRALS, AND LIST OF UPCOMING CASES. PLANNING DIRECTOR COMMISSIONER DETZER COMMENTED ON THE COUNCIL PUBLIC HEARING ON EXTENDED STAY AMERICA AND THE IMPORTANCE OF COMMISSIONERS ATTENDANCE AT COUNCIL HEARINGS TO VOICE THEIR OPINIONS. COMMISSIONERS COMMISSIONER MARTINELLI ASKED FOR AN UPDATE ON THE 9TH AND A PROJECT. SHE ASKED IF THE DESIGN WAS STILL VICTORIAN. STAFF STATED THAT THE PROJECT IS MOVING FORWARD. COMMISSIONER BACA STATED THAT A JOINT MEETING BETWEEN THE CITY COUNCIL AND THE PLANING COMMISSION WOULD BE USEFUL. COMMISSIONER GODSHALK ASKED ABOUT THE ORDINANCE CONCERNING REGULATION OF TELECOMMUNICATION SYSTEMS UTILIZING PUBLIC STREETS, RIGHTS- OF-WAY OR OTHER PUBLIC PROPERTY THAT IS BEING ADOPTED BY CITY COUNCIL. SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT THIS PERTAINS TO USE OF PUBLIC STREETS AND PUBLIC PROPERTY AND DOES NOT INVOLVE THE PLANNING COMMISSION. NO REPORT. CHAIRMAN 7 March 5, 2001 NONE.
