A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A PLANNED DEVELOPMENT PERMIT FOR AN AUTO BODY SHOP AT THE NORTHWEST CORNER OF 25TH STREET AND A AVENUE. APPLICANT: ROBERT P. BALL. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NO. PD-2000-11. CONTINUED PUBLIC HEARING - 4. JANET CARREON, 5561 NERAK COURT, BONITA, PROPERTY OWNER, AND HER SON JEFF CARREON, 930 VALENCIA PLACE, CHULA VISTA, SPOKE IN SUPPORT OF THE VARIANCE. THEY SAID THAT THE GARAGE HAS BEEN USED AS A UNIT FOR MANY YEARS, AND THAT THEY HAVE HAD MANY SECTION 8 TENANTS. THEY HAVE SPENT $75,000 TO IMPROVE THE PROPERTY IN THE PAST TWO YEARS. 4. CONTINUED PUBLIC HEARING – ZONE VARIANCE TO ADD A RESIDENTIAL UNIT AND ELIMINATE ALL REQUIRED PARKING AT 930 E. 18TH STREET. APPLICANT: JANET M. CARREON. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. Z- 2001-02. COMMISSIONER VALDERRAMA ASKED WHAT THE GARAGES ON ADJACENT PROPERTIES UNDER THE SAME OWNERSHIP ARE USED FOR. THE APPLICANT SAID THAT THEY ARE RENTED TO TENANTS FOR THEIR USE ONLY, AND TENANTS USE THEM AS GARAGES OR FOR STORAGE. COMMISSIONERS VALDERRAMA AND 3 March 19, 2001 BACA STATED THAT APPROVAL OF THE PROJECT COULD SET A PRECEDENT WITH REGARD TO PARKING STANDARDS AND THAT THEY COULD NOT SUPPORT THE PROPOSAL. CHAIRMAN UNGAB ASKED IF THE PROPOSED PARKING SPACE ADJACENT TO THE GARAGE WOULD BE LARGE ENOUGH TO ACCOMMODATE ANY SIZE CAR. THE APPLICANT SAID THAT IT WOULD BE. THE APPLICANT STATED THAT ALL RECOMMENDED CONDITIONS OF APPROVAL COULD BE SATISFIED. MOTION BY BACA, 2ND BY VALDERRAMA TO DENY ZONE VARIANCE 2001-02 BASED ON REQUIRED FINDINGS FOR DENIAL. ROLL CALL: AYES – VALDERRAMA, GODSHALK, UNGAB, BACA, MARTINELLI. ABSENT: PARRA, DETZER. PUBLIC HEARING - 5. MIKE HENNESSEY, 17581 IRVINE BOULEVARD, TUSTIN, APPLICANT, STATED THAT HE HAS BEEN WORKING WITH CDC ON THIS PROJECT SINCE OCTOBER 1998. HE SAID THAT THE SITE IS APPROPRIATE FOR AUTO- RELATED USES, THAT THE TENANTS ARE MAJOR CORPORATIONS, THAT THE PROPOSAL MEETS CODE REQUIREMENTS AND DESIGN GUIDELINES, AND THAT LANDSCAPING EXCEEDS MINIMUM REQUIREMENTS. HE SAID THAT APPROXIMATELY $50,000 PER YEAR IN TAX REVENUES WOULD BE GENERATED AND THAT THE PROJECT WOULD HAVE 50 EMPLOYEES, MOST WITH BENEFITS. 5. PUBLIC HEARING – PLANNED DEVELOPMENT PERMIT FOR A GAS STATION, FAST FOOD RESTAURANT, AND CONVENIENCE STORE WITH ALCOHOL SALES AT THE NORTHWEST CORNER OF 8TH STREET AND ROOSEVELT AVENUE WITH A VARIANCE TO ALLOW REDUCED LANDSCAPING AND A TENTATIVE PARCEL MAP TO MERGE SIX PROPERTIES INTO ONE. APPLICANT: MICHAEL HENNESSEY AND COMMUNITY DEVELOPMENT COMMISSION. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NOS. PD-2000-6, Z-2001-3, LS-2001-2, IS-2000-5. KENT ALLEN, 1523 GOLDEN AVENUE, HERMOSA BEACH, REPRESENTING ARCO, SPOKE IN FAVOR OF THE PROJECT. 4 March 19, 2001 CHRISTIAN FAULK, 22497 KENT AVENUE, TORRANCE, REPRESENTING THE APPLICANT, REQUESTED CLARIFICATION OF CONDITIONS REGARDING SCREENING ROOFTOP EQUIPMENT, ALCOHOL SALES HOURS, STORM WATER MANAGEMENT AND PUBLIC IMPROVEMENTS. COMMISSIONERS VALDERRAMA, GODSHALK AND UNGAB ASKED QUESTIONS REGARDING THE QUEUING AREA FOR THE DRIVE-THRU AND THE ADEQUACY OF CIRCULATION ON THE SITE. STAFF SAID THAT THE PROJECT DESIGN COMPLIES WITH DESIGN GUIDELINES FOR THESE ISSUES. COMMISSIONER GODSHALK ASKED WHETHER A SIGN INDICATING NO LEFT TURN FROM THE SOUTH DRIVEWAY ONTO 8TH STREET SHOULD BE PROVIDED. ENGINEERING STAFF SAID THAT IT WOULD NOT BE REQUIRED OR NECESSARY ALTHOUGH ENGINEERING RECOMMENDS ADDITIONAL STUDY OF THE SITUATION LATER. SENIOR ASSISTANT CITY ATTORNEY HRADECKY SAID THAT A CONDITION COULD BE ADDED REQUIRING THE DEVELOPER TO INSTALL ANY SIGNAGE NEEDED IN THE FUTURE. COMMISSIONER GODSHALK DISCUSSED THE POSSIBILITY OF REMOVING FIVE COMPACT PARKING SPACES IN THE CENTER OF THE PROPERTY TO ALLOW BETTER CIRCULATION. THE DEVELOPER INDICATED THAT THIS MIGHT PUT THEM UNDER THE CODE MINIMUM. THE APPLICANT AND COMMISSIONERS DISCUSSED THE 75-FOOT TALL POLE SIGN ALONG THE FREEWAY. THE APPLICANT SAID THAT HE WOULD BE WILLING TO ACCEPT A CONDITION THAT WOULD REQUIRE A STUDY TO JUSTIFY THE HEIGHT OF THE SIGN. 5 March 19, 2001 MR. HENNESSEY, APPLICANT, STATED THAT HE IS WILLING TO ACCEPT ALL CONDITIONS OF APPROVAL. SHEILA SALONIUS, 304 W. 18TH STREET, SPOKE IN OPPOSITION TO THE ALCOHOL SALES PROPOSED AS PART OF THE PROJECT ON BEHALF OF THE NATIONAL CITY ATOD TASK FORCE. SHE STATED THAT ALTHOUGH CRIME HAS DECREASED IN THE AREA, THERE IS STILL PROSTITUTION AND OTHER CRIMINAL ACTIVITY IN THE AREA. INCREASED AVAILABILITY OF ALCOHOL COULD CONTRIBUTE TO INCREASES IN CRIME. COMMISSIONER VALDERRAMA ASKED IF MS. SALONIUS WOULD OPPOSE THIS PROJECT IF IT WERE LOCATED ELSEWHERE. SHE SAID THAT SHE WOULD SINCE THIS IS A CITYWIDE ISSUE. PETER MIRANDA, 304 W. 18TH STREET, PATRICIA CANALES, 204 V AVENUE, #B, JEANETTE VELAZQUEZ, 1120 E. 1ST STREET, AND IRMA HERNANDEZ, 1116 E. 1ST STREET, SPOKE IN OPPOSITION TO THE ALCOHOL SALES PORTION OF THE PROJECT. THEY STATED THAT YOUTH WILL FREQUENT THE BUSINESS AND WILL BE EXPOSED TO THE ALCOHOL SALES, THAT THERE ARE ENOUGH ALCOHOL SALES ESTABLISHMENTS IN THE CITY, THAT THERE IS PUBLIC DRINKING IN THE AREA, AND THAT ALCOHOL CONTRIBUTES TO YOUTH PROBLEMS. THEY SAID THAT EASY ACCESS TO ALCOHOL ALSO INCREASES THE PROBLEM. THE APPLICANT STATED THAT THE AM/PM IS A NATIONAL CHAIN WITH STRONG MANAGEMENT AND THAT THE CONDITIONS WILL PROHIBIT THE SALE OF SINGLE AND HARD LIQUOR. MIKE BREWER, 28465 OLD TOWN FRONT STREET, TEMECULA, REPRESENTING AM/PM SPOKE IN FAVOR OF THE PROPOSAL. HE SAID THAT THE CORPORATION IS SERIOUS ABOUT NOT SELLING TO MINORS, THAT THE INSIDE OF THE STORE WILL BE VISIBLE FROM THE STREET AND 6 March 19, 2001 THAT THIS LOCATION IS BETTER THAN A RESIDENTIAL AREA. COMMISSIONERS MARTINELLI AND BACA EXPRESSED CONCERN REGARDING THE PROPOSED ALCOHOL SALES. THE APPLICANT INDICATED THAT THE PROJECT WOULD LIKELY NOT PROCEED IF ALCOHOL SALES WERE NOT ALLOWED. BEN MARTINEZ, CDC PROJECT MANAGER STATED THAT THE PROJECT HAS CDC APPROVAL. SENIOR ASSISTANT CITY ATTORNEY HRADECKY RECOMMENDED THAT IF THE PROJECT IS APPROVED, AN ADDITIONAL FINDING REGARDING ALCOHOL SALES SHOULD BE ADDED. MS. SALONIUS QUESTIONED HAVING ALCOHOL SALES AVAILABLE NEAR THE PROPOSED COLLEGE CAMPUS AND QUESTIONED THE NEED FOR AN ADDITIONAL ALCOHOL SALES ESTABLISHMENT. CDC STAFF STATED THAT THE DEVELOPMENT AGREEMENT FOR REDEVELOPMENT OF THE PROPERTY WOULD BE NULLIFIED IF ALCOHOL SALES WERE NOT PERMITTED AS A COMPONENT OF THE DEVELOPMENT. COMMISSIONERS DISCUSSED THE NEED FOR THE AREA TO BE REDEVELOPED. MOTION BY VALDERRAMA, 2ND BY GODSHALK, TO APPROVE TENTATIVE PARCEL MAP AND PLANNED DEVELOPMENT PERMIT WITH ADDED FINDING REGARDING ALCOHOL SALES, AND SUBJECT TO CONDITIONS OF APPROVAL. 7 March 19, 2001 ROLL CALL: AYES – VALDERRAMA, GODSHALK, UNGAB. NAYS – BACA. ABSTAINING: MARTINELLI. ABSENT: DETZER, PARRA. SENIOR ASSISTANT CITY ATTORNEY HRADECKY NOTED THAT COMMISSIONER MARTINELLI IS ABSTAINING SINCE SHE LIVES IN CLOSE PROXIMITY TO THE PROPOSED PROJECT. COMMISSIONER VALDERRAMA ASKED THAT THE LOCATION OF POLICE BEATS BE ATTACHED TO ANY FUTURE REPORTS THAT REFER TO THEM. COMMISSIONER BACA SUGGESTED THAT THE PLANNING COMMISSION AND CITY COUNCIL HOLD JOINT MEETINGS FOR ITEMS LIKE THIS. CONTINUED OTHER BUSINESS - 6. MOTION BY GODSHALK, 2ND BY BACA TO CONTINUE THIS ITEM TO THE NEXT MEETING. ROLL CALL: AYES – VALDERRAMA, GODSHALK, UNGAB, BACA, MARTINELLI. ABSENT: PARRA, DETZER. 6. DISCUSSION OF WAYS TO CONSERVE ENERGY. SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT HE WOULD COMMUNICATE WITH THE POLICE DEPARTMENT REGARDING ALCOHOL COMMENTS. SENIOR ASSISTANT CITY ATTORNEY NO REPORT. PLANNING DIRECTOR COMMISSIONER GODSHALK ASKED STAFF TO SEE IF THE FILL AT 1945 PALM AVENUE IS LEGAL. HE ALSO SUGGESTED A NEW POLICY FOR NEW ALCOHOL SALES ESTABLISHMENTS WHEREBY NO NET GAIN IN LIQUOR LICENSES WOULD BE ALLOWED. COMMISSIONERS 8 March 19, 2001 NO REPORT. CHAIRMAN NONE.
