COMMISSIONERS DISCUSSED HOW THE RECYCLING FACILITY WORKS AND ASKED ABOUT THE FREQUENCY OF PICKUPS AND MAINTENANCE OF THE FACILITY. MR. KEARNS STATED THAT IT TAKES APPROXIMATELY 20 TO 30 MINTUES TO PICK-UP THE UNITS, WHICH IS DONE THREE TO FIVE TIMES A MONTH. THIS USUALLY OCCURS DURING DAYTIME HOURS. MAINTENANCE CREWS HANDLE ITEMS THAT ARE NOT ACCEPTED AT THE RECYCLING FACILITY BUT ARE LEFT. THEY HAVE A HOTLINE NUMBER FOR THE STORE TO CALL TO REPORT ILLEGAL 4 May 7, 2001 DROP OFFS AND GRAFFITI. MOTION BY GODSHALK, 2ND BY PARRA, TO APPROVE VARIANCE 2001-7 AND RECOMMEND TO THE CITY COUNCIL APPROVAL OF MODIFICATION OF CUP-1995-8 SUBJECT TO CONDITIONS OF APPROVAL AND BASED ON REQUIRED FINDINGS. HE SHOWED A FLYER ADVERTISING HIS STORE AS A MARKET EMPHASIZING FOOD SALES. HE FURTHER STATED HE HAS BEEN HERE TWO YEARS AND 70% OF HIS CUSTOMERS DO NOT DRIVE. HE IS TRYING TO MAKE IT CONVENIENT FOR HIS CUSTOMERS TO HAVE ONE STOP SHOPPING. 6. PUBLIC HEARING – CONDITIONAL USE PERMIT FOR THE SALE OF BEER AND WINE IN AN EXISTING MARKET AT 421 N. HIGHLAND AVENUE. APPLICANT: SAMIR SOMO. STAFF REPORT BY ASSISTANT PLANNER MARCHESANO. CASE FILE NO. CUP-2001-5. JOHN REED, 840 BUCKY LANE, AND DAVID BARRAGAN, 929 BUCKY LANE, SPOKE AGAINST THIS APPLICATION. THEY SAID IT WOULD BE DETRIMENTAL TO ALLOW THIS IN THEIR NEIGHBORHOOD. THEY STATED THEY HAVE WORKED HARD TO CREATE A CLEAN, SAFE NEIGHBORHOOD HERE. ORENCIO GABRIEL, 1740 S. 43RD STREET, SAN DIEGO, SPOKE AGAINST APPLICATION AND REPORTED 5 May 7, 2001 GRAFFITI PROBLEMS AT THE SITE. HE STATED THEY SELL HOT FOOD OUTSIDE OF THE MARKET AFTER 5:00 P.M. SHEILA SALONIUS, 304 W. 18TH STREET, AND MARK BACA, 105 S. HARBISON OF THE NATIONAL CITY ALCOHOL TOBACCO AND OTHER DRUG TASK FORCE, SPOKE AGAINST THIS PERMIT. THEY STATED THERE ARE SEVERAL OTHER ALCOHOL RETAILERS IN THE AREA, EXPRESSED CONCERN FOR THE YOUTH OF THE CITY AND QUALITY OF LIFE FOR CITIZENS. SAMIR SOMO, APPLICANT, STATED HE IS NOT PUSHING ALCOHOL. THIS IS A GROCERY STORE. HE WANTS TO PROVIDE A SERVICE TO HIS FAITHFUL CUSTOMERS. FRANCES YOUNG, 4245 DELTA, SPOKE IN SUPPORT OF THE APPLICATION. SHE STATED THIS MARKET IS AN ASSET TO THE COMMUNITY AND URGED COMMISSIONERS TO GIVE THEM A CHANCE. COMMISSIONER MARTINELLI STATED THAT SHE HAS A PROBLEM WITH ISSUING THIS PERMIT AS THERE IS ANOTHER MARKET NEARBY WHICH SELLS BEER AND WINE AND THIS MARKET IS LOCATED NEAR A RESIDENTIAL NEIGHBORHOOD. COMMISSIONER VALDERRAMA STATED HE HAS CONCERNS AS THIS MARKET IS LOCATED IN THE THIRD HIGHEST CRIME AREA IN THE CITY. MOTION BY VALDERRAMA, 2ND BY MARTINELLI TO CLOSE THE PUBLIC HEARING AND DENY CONDITIONAL USE PERMIT 2001-5 BASED ON FINDINGS FOR DENIAL. COMMISSIONER GODSHALK ASKED STAFF TO PROVIDE THE CHECKED COPY OF THE INITIAL STUDY. COMMISSIONER GODSHALK EXPRESSED CONCERN ABOUT THE NINE TRUCKS A DAY AND THE ROUTE TRUCKS WILL USE. GREG WYLIE, KLEEN BLAST ABRASIVES, SAN JOSE, STATED THAT 80% OF THE TRAFFIC WILL HEAD TOWARD THE NAVY PIERS AND NOT USE INTERSTATE 5. 7 May 7, 2001 COMMISSIONER DETZER STATED THAT HE WOULD LIKE TO SEE ELEVATIONS OF THE BUCKET ELEVATOR. PAUL DESROCHERS, CDC DIRECTOR, STATED THAT THEY THOUGHT THE FACILITY PROPOSED SANDBLASTING ON-SITE. SINCE THEY DO NOT, CDC MAY REVISE THEIR COMMENTS. HE EXPRESSED CONCERN THAT THIS USE BE CONSISTENT WITH THE HARBOR DISTRICT SPECIFIC PLAN. THEY VISITED THE SITE IN SAN DIEGO AND IT IS AN EYESORE. THEY ARE CONCERNED ABOUT TRAFFIC, LANDSCAPING AND NOISE. COMMISSIONERS ASKED FOR THE ADDRESS OF THE BUSINESS IN SAN DIEGO. MR. PARRA GAVE THE ADDRESS AS 93 8TH AVENUE, SAN DIEGO. DESROCHERS FURTHER STATED THAT THE CDC/COUNCIL HAS SCHEDULED A HEARING ON THIS ITEM AND AFFECTED PROPERTY OWNERS WILL HAVE OPPORTUNITY AT THAT TIME TO ADDRESS THIS ISSUE. COMMISSIONER MARTINELLI STATED THAT SHE USUALLY IS NOT IN FAVOR OF THE USE OF EMINENT DOMAIN BUT IT IS JUSTIFIED IF NEEDED. SHE IS GLAD THIS IS NOT FOR A SINGLE- FAMILY HOME. COMMISSIONER GODSHALK ASKED ABOUT ROLE OF PLANNING STAFF REVIEW FOR THE NEGATIVE DECLARATION. MR. DESROCHERS STATED THAT THE CDC IS THE LEAD AGENCY IN THE ENVIRONMENTAL REVIEW FOR THE AMENDMENT TO THE REDEVELOPMENT PLAN. COMMISSIONER GODSHALK DISCUSSED REASONS EMINENT DOMAIN MAY BE NECESSARY TO USE AT THIS SITE. HE REFERRED TO TARGET’S CONVENANT PROHIBITING ANOTHER BIG BOX RETAILER, SEPARATE OWNERSHIP OF THE CORNER PARCELS AND NEED TO PROVIDE PARKING. MR. DESCROCHERS CONFIRMED THAT IN ORDER TO FULFILL THE PROPOSAL 9 May 7, 2001 BY K-MART, THE CORNER PARCELS ARE NEEDED FOR PARKING AND RETAIL USE. MR. DESROCHERS ALSO STATED THAT THE CORNER PARCELS WERE GIVEN THE OPPORTUNITY TO PARTICIPATE IN THE REDEVELOPMENT OF THE SITE. THEIR PROPOSAL DID NOT ADDRESS THE WHOLE SITE AND DID NOT ADDRESS INGRESS AND EGRESS TO FACILITATE BETTER CIRCULATION. IT IS EVIDENT THAT THE PARCELS NEED TO BE DEVELOPED AS A WHOLE, TO ADDRESS TOPOGRAPHY AND PARKING PROBLEMS. COMMISSIONERS DISCUSSED IF MORE OF HIGHLAND AVENUE SHOULD BE INCLUDED IN THE AMENDMENT. MR. DESROCHERS STATED THIS WOULD BE BEST LEFT FOR ANOTHER TIME. COMMISSIONER VALDERRAMA ASKED IF THE PROPERTY OWNER IS AWARE OF THIS ITEM. HE EXPRESSED CONCERN ABOUT THE USE OF EMINENT DOMAIN. MR. DESROCHERS STATED THAT THE OWNER IS AWARE OF THE UPCOMING CDC/COUNCIL HEARING. COMMISSIONER DETZER STATED THAT THE COMMISSIONS ROLE IS TO SERVE THE INTEREST OF THE CITIZENS AND OF THE COMMUNITY. THIS IS A RECOMMENDATION ONLY. CONTINUED DISCUSSION OF WAYS TO CONSERVE ENERGY. DIRECTOR POST STATED THAT THE BUILDING DEPARTMENT HAS RESPONSIBILITY FOR IMPLEMENTATION OF THE STATE ENERGY REGULATIONS (TITLE 24). THE CITY CANNOT ADOPT STANDARDS THAT WOULD BE IN CONFLICT WITH STATE LAW. SENIOR ASSISTANT CITY ATTORNEY ALSO DISCUSSED THE CITY’S LIMITATIONS ON EXCEEDING STATE STANDARDS.
