HomeMy WebLinkAboutReso 12-93, CUP-1993-6RESOLUTION NO. 12-93 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT APPLICATION TO ALLOW A THRIFT STORE AT 2401 PLAZA BOULEVARD. APPLICANT: SALVATION ARMY CASE FILE NO. CUP-1993-6 WHEREAS, the Planning Commission of the City of National City considered a Conditional Use Permit Application to allow a thrift store at 2401 Plaza Boulevard at the regularly scheduled Planning Commission meeting on August 2, 1993, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the Planning Commission considered the staff report contained in Case File No. CUP-1993-6 which is maintained by the City and incorporated herein by reference; and, WHEREAS this action is taken pursuant to all applicable procedures required by State law and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare; and, NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of National City, California, that the testimony and evidence presented to the Planning Commission at the public hearing held on August 2, 1993, support the following findings: 1. That the site for the proposed use is adequate in size and shape, since the 8,600 square foot suite is adequate in size for a thrift store. There is adequate area in the northwest corner of the property, adjacent to the existing loading dock, for collection of used household goods. 2. That the site has sufficient access to streets and highways that are adequate in width and pavement type to carry the volume and type of traffic generated by the proposed use, since the property has 300 feet of frontage on Plaza Boulevard and 146 feet of frontage on Euclid Avenue. Plaza Boulevard and Euclid Avenue are classified as arterial roadways in the Circulation Element of the City's General Plan. They have adequate capacity to carry the traffic generated by the proposed use. 3. That the proposed use will not have an adverse effect upon adjacent or abutting properties, since the retail sale of used merchandise will be conducted entirely within an enclosed building. The site is separated from adjacent residences by topography and dense landscaping. The collection of used household goods will take place in the existing loading dock area, adjacent to the west of the building, away from other businesses in the shopping center. The collection center will be manned by a Salvation Army employee at all times the facility is open to ensure that it is kept in a neat and orderly manner. 4. That the proposed use is deemed essential and desirable to the public convenience or welfare, since the use will serve the needs of lower income families in the community and profits from the sales of used merchandise will be used to fund drug and alcohol rehabilitation programs, sponsored by Salvation Army, throughout San Diego County. Salvation Army has operated a thrift store in the City for several years, and the new store will provide a more modern and improved facility. BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved subject to the following conditions: 1. Street pavement repair will be required on 12th Street. It shall include the removal and replacement of the approximately 25 ft. by 6 ft. section of the A.C. pavement and base as marked in the field, in the proximity of the existing westerly entrance to the parking lot. A separate permit from the Engineering Department shall be obtained for the performance of this work. A bond shall be posted with the Engineering Department for the required work prior to the approval of any building permits. 2. A fully dimensioned floor plan of the building detailing all exit locations and classification of the existing structure in accordance with Table 5A of the Uniform Building Code shall be submitted to the Department of Building and Safety for review and approval. 3. A sign permit shall be obtained for all signs. The plans shall be in substantial conformance to Exhibit A-2nd revision, Case File No. CUP- 1993-6, dated July 27, 1993. Window signs shall be limited to a total area of 25 square feet. 4. Thrift store business hours shall be between 9:00 a.m. to 8:00 p.m., seven days a week. Hours of delivery of merchandise shall be between 9:00 a.m. to 3:00 p.m., Monday through Friday. 5. Existing Valueland signs shall be removed. All striping on the building front shall be removed. Required touch up painting shall match the existing building facade color. Any proposed change to the existing building exterior color shall be approved by the Planning Director. 6. Before this conditional use permit shall become effective, the applicant shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the conditional use permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The Notice of Restriction shall provide information that conditions imposed by approval of Conditional Use Permit No. CUP-1993-6 are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. 7. Use of the property as authorized by this permit shall be limited to a thrift store. 8. This permit shall become null and void if not exercised within one year after adoption of the resolution of approval unless extended according to procedures specified in Section 18.116.190 of the Municipal Code. 9. The applicant shall submit plans for the collection center for review and approval by the Planning Director. The plans shall include the type of facility used to house the collected items. The facility shall meet all requirements of the Land Use Code. The plans shall also indicate the location, height and type of fencing to be used to enclose and screen the collection site. The fence enclosure shall include a gate with a lock. The gate shall be locked at all times the collection area is closed. 10. The collection center shall be an incidental use to the thrift store. It shall not be open other than thrift store business hours. A Salvation Army employee shall be at the collection center at all times the facility is open to ensure that the site is kept in a neat and orderly manner. 11. The collection center trailer shall be removed and replaced with another trailer a minimum of twice a week. 12. After -hour collection arrangements shall be made to allow donations to be placed inside the building after business hours. 13. Parking or storage of delivery trucks is prohibited. BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the applicant and to the City Council. BE IT FINALLY RESOLVED that this Resolution shall become effective and final on the day following the City Council meeting where the Planning Commission resolution is set for review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m., on the day of that City Council meeting. The City Council may, at that meeting, appeal the decision of the Planning Commission and set the matter for public hearing. The time within which judicial review of this decision may be sought is governed by the provisions of Code of Civil Procedures Section 1094.6.
