A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A REQUEST FOR EXCEPTION TO
FLOODPROOFING REQUIREMENTS FOR PROPERTY LOCATED AT THE
SOUTHWEST CORNER
OF HIGHLAND AVENUE AND STATE ROUTE 54.
APPLICANT: STUART ENGINEERING FOR
NU -WESTERN DEVELOPMENT CO.
WHEREAS, the Planning Commission of the City of National City considered a
request for exception to floodproofing requirements for property located at the southwest
corner of Highland Avenue and State Route 54 at the regularly scheduled Planning
Commission meeting on November 15, 1993, at which time oral and documentary
evidence was presented; and,
WHEREAS, at said public hearing the Planning Commission considered the staff
report maintained by the City and incorporated herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by
State law and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation
of public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of National City, California, that the testimony and evidence presented to the
Planning Commission at the public hearing held on November 15, 1993, support the
following findings:
1. The granting of the exception to the map will not result in the increase in flood
levels during the base flood discharge. The designated Base Flood Elevation as
shown on the Flood Insurance Rate Map in effect at present does not reflect the
current situation. Flood elevations within the channelized Sweetwater River will
not be impacted by this exception.
2. The granting of the exception will not result in increased flood heights, additional
threats to public safety, extraordinary public expense, create nuisances, cause fraud
on or victimization of the public nor be in conflict with existing local laws or
ordinances.
The improvements installed by the Corps of Engineers have significantly reduced
the overall floodplain elevation in the region. In addition, the properties are
protected from the influence of flows from the Sweetwater River by the Corps
project, which has protected the public welfare, and substantially reduced the risk
of flood damage.
3. Failure to grant the exception would result in exceptional hardship to the applicant.
To either flood proof or elevate the site would be costly and unnecessary. Once
the Federal Emergency Management Agency maps have been revised to reflect the
construction of the Sweetwater River Flood Control Channel, the area is expected
to no longer be within zone "AE". The initial purpose and intent was to protect
property from flood damage by raising the elevations of the building sites to the
original map elevations, but it is realized the original values will not be relevant
after the area is remapped.
4. There is good and sufficient cause for this exception. Since the preparation of the
FEMA maps and the drafting of the Ordinance, an extensive flood control facility
has been installed by the Corps of Engineers designed to handle a 500 year flood.
5. The applicant has been notified that the use of the exception could result in a
substantial increase in flood insurance rates which will be commensurate with the
increased risk resulting from the reduced lowest floor elevation.
BE IT FURTHER RESOLVED that the request for exception is approved subject
to the following condition:
The applicant shall obtain a Letter of Map Amendment (LOMA) or a letter of Map
Revision (LOMR) from FEMA or a performance bond shall be placed to assure
the completion of the map amendment or map revision.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council; and,
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on the
day following the City Council meeting where the Planning Commission resolution is set for
review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of that
City Council meeting. The City Council may, at that meeting, appeal the decision of the Planning
Commission and set the matter for public hearing. The time within which judicial review of this
decision may be sought is governed by the provisions of Code of Civil Procedures Section
1094.6.
