RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
APPOINTING SCOTT HUTH AS INTERIM CITY MANAGER PER GOVERNMENT CODE
SECTIONS 7522.56 AND 21221(h).
WHEREAS, Government Code section 21221(h) of the Public Employees' Retirement
Law permits the Mayor and City Council to appoint a California Public Employees' Retirement
System ("CaIPERS") retiree to a vacant position requiring specialized skills during recruitment
for a permanent appointment, and provides that such appointment will not subject the retired
person to reinstatement from retirement or loss of benefits so long as it is a single appointment
that does not exceed 960 hours in a fiscal year; and
WHEREAS, the City of National City ("City") desires to appoint Scott Huth as an interim
appointment retired annuitant to the vacant position of City Manager for the City under
Government Code section 21221(h), effective April 23, 2025; and
WHEREAS, the City Council of the City, the City, and Scott Huth certify that Scott Huth
has not and will not receive a Golden Handshake or any other retirement-related incentive; and
WHEREAS, the City opened the search for a permanent City Manager on April 21 2025;
and
WHEREAS, Government Code section 21221(h) appointments shall only be made once
each and will end when the permanent hire for the position is on boarded or when the retiree
reaches 960 hours worked, whichever occurs first; and
WHEREAS, the compensation paid to retirees cannot be less than the minimum nor
exceed the maximum monthly base salary paid to other employees performing comparable
duties, divided by 173.333 to equal the hourly rate; and
WHEREAS, the City Council adopted National City Executive Salary Schedule states the
base salary range for City Manager is determined by employment agreement, and the most recent
employment agreement for City Manager establishes a base salary of $130.88 per hour as of
February 1, 2024; and
WHEREAS, the hourly rate paid to Scott Huth will be $130.88 per hour and he will not
receive any other benefit, incentive, compensation in lieu of benefit, or other form of compensation
in addition to this hourly pay rate.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1: That the City Council hereby certifies the nature of the employment of Scott
Huth as described herein and that this appointment is necessary to fill the critically needed
position of City Manager for the City of National City effective April 23, 2025 because the position
became vacant and his employment is needed to continue to perform the critically needed and
specialized duties of the position until a permanent City Manager is hired.
Section 2: That, as an employee of the City, Scott Huth will be entitled to all rights and
protections of City employees including, but not limited to, reimbursement of expenses (including
under Administrative Policy Nos. 03.03 and 03.04) and defense and indemnification under State
law (including Government Code sections 825, et seq. and 995, et seq.), consistent with and as
allowed for appointments pursuant to Government Code section 21221(h).
Section 3: That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.
