HomeMy WebLinkAbout2025-57 - California Governor’s Office of Emergency Services (Cal OES) Mutual Aid RESOLUTION NO. 2025- 5 7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, CLARIFYING THE CALIFORNIA FIRE ASSISTANCE AGREEMENT (CFAA) BY IDENTIFYING SUPPRESSION/SAFETY AND NON-SUPPRESSION PERSONNEL THAT CAN BE COMPENSATED PORTAL TO PORTAL FOR SERVICES RENDERED AT INCIDENTS, AS REQUESTED BY THE CALIFORNIA GOVERNOR'S OFFICE OF EMERGENCY SERVICES (CAL OES). WHEREAS, on May 5, 2015, the City Council adopted Resolution 2015-54, authorizing portal-to-portal compensation for National City Fire Department personnel deployed on mutual aid assignments, and allowing for reimbursement of expenses by the California Governor's Office of Emergency Services (Cal OES) or the requesting agency; and WHEREAS, the California Fire Assistance Agreement (CFAA) provides for reimbursement of all costs associated with aid assignments, including personnel costs, backfill costs, and apparatus and equipment use fees; and WHEREAS, the authorization provided in Resolution 2015-54 referred generically to "suppression/safety and non-suppression personnel to be compensated portal-to-portal for services rendered at incidents"; and WHEREAS, Cal OES has requested that the City identify the specific classifications of the personnel who would be responding to incident and further clarify portal-to-portal compensation; and WHEREAS, those response personnel include the Suppression/Safety classifications of Fire Chief, Fire Division Chief, Fire Battalion Chief, Fire Captain, Fire Engineer, and Firefighter, as well as the Non-Suppression classification of Emergency Manager; and WHEREAS, National City Fire Department response personnel will be compensated above straight time/overtime when applicable while in the course of their employment, away from their official duty station, and assigned to or supporting an emergency incident, or pre-positioned for emergency response; and WHEREAS, the City of National City desires to incorporate the updated language requested by Cal OES to formalize the terms and conditions under which Fire Department response personnel and necessary backfill personnel are compensated portal-to-portal while assigned to aid incidents under the CFAA. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: Section 1: That the City Council hereby authorizes the City Manager, or his designee, to take any administrative actions necessary to clarify the California Fire Assistance Agreement (CFAA) by including the Fire Chief, Fire Division Chief, Fire Battalion Chief, Fire Captain, Fire Engineer, and Firefighter under the Suppression/Safety classifications, as well as the Emergency Manager as the Non-Suppression classification that can receive portal-to-portal compensation when deployed under the CFAA, as requested by Cal OES. Section 2: That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions.
