HomeMy WebLinkAboutQuercus Land Use Planning - Amendment - 2025 AMENDMENT TO THE AGREEMENT BY AND BETWEEN THE CITY OF NATIONAL CITY AND QUERCUS LAND USE PLANNING THIS FIRST AMENDMENT TO THE AGREEMENT is entered into by and between the CITY OF NATIONAL CITY, a municipal corporation ("CITY"), and QUERCUS LAND USE PLANNING, a California sole proprietor ("CONSULTANT"). RECITALS WHEREAS,the CITY and the CONSULTANT entered into an Agreement on November 7, 2024 ("Agreement"),wherein the CONSULTANT agreed to provide assistance with Phase I of the City's Local Coastal Plan Amendment, for a not-to-exceed amount of$27,400.00, for an initial term of one year, with the option to extend this term for up to three (3), one-year extensions; and WHEREAS, the parties desire to amend the Agreement by exercising the first of the three one year options to extend the term of the Agreement to June 30, 2026, and WHEREAS, the parties desire to expand the scope of services as outlined in attached proposal, Exhibit "A"; and WHEREAS, the parties desire to amend the Agreement to cover the cost of providing the increased scope of services from the amount of$27,400.00 to the not-to-exceed amount by$9,000.00, for a total not-to-exceed amount of$36,400.00. AGREEMENT NOW, THEREFORE, the parties hereto agree that: 1. The November 7, 2024 Agreement in exercise of the option provision is hereby amended to extend the term of the Agreement by one (1) year to June 30, 2026. 2. Exhibit "A" of the November 7, 2024 Agreement is hereby amended to include services as outlined in attached proposal, Exhibit"A"; and 3. The November 7, 2024 Agreement is hereby amended to cover the cost of the increased scope of services from original contract amount of$27,400.00 to the not-to-exceed amount by$9,000.00, for a total not-to-exceed amount of$36,400.00. 4. The parties further agree that, with the foregoing exceptions, each and every other term and provision of the November 7, 2024-Agreement shall remain in full force and effect. Helmer, DBA Quercus Land Use Planning(Consultant)proposes the following tasks and estimated hours needed to complete processing of the Balance Plan and necessary amendments to the City of National City's (City) Local Coastal Plan Amendment(LCPA) and related documents (Project). All work would be completed at the direction of the City. All work would be on a time and materials basis with a not-to-exceed cost of$36,400.00 at an hourly rate of$150.00/hour.This cost includes the contingencies outlined in Task 4 below and including $400.00 for required travel cost related to the Coastal Commission hearing outside San Diego County, if so directed by the City.Any additional work is to be authorized by the City and would be on a time and material basis as described herein. The following tasks include the maximum estimated respective hours; actual hours per task may differ depending upon circumstances. Task 4. Implementation of Balanced Plan for City owned properties (240 hours) • Coordinate and meet with City staff and City consultants • Undertake research to assist City with preparation of any RFP/RFQ for development of the properties. • Prepare any necessary revisions or modifications to the LCP implementation document • Coordinate ongoing LCP revisions with City and Commission staff • Coordinate with Planning Division staff on appropriate public noticing and public outreach • Assist with Preparation of Planning Commission and City Council staff reports • Coordinate with City staff on the preparation of supporting resolutions, ordinances and findings. • If directed by City, attend Planning Commission and City Council hearings • Coordinate and meet with Coastal Commission staff, and City staff regarding Implementation Plan process, any LCPA modifications and public hearings. • Continue to work with City and Commission staff to resolve any outstanding issues • Attend Commission hearing(s) either in person or remotely as directed • If necessary and if so directed, travel to and attend Coastal Commission meeting outside of San Diego County. • Perform other tasks as assigned by the City EXHIBIT A
