HomeMy WebLinkAbout2026-09 - Adopt 2025 Development Impact Fees ScheduleRESOLUTION NO. 2026 - 09 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, ADOPTING THE 2025 DEVELOPMENT IMPACT FEE SCHEDULE. WHEREAS, Section 66000, et seq. of the Government Code, enacted by the State of California in 1987, allows cities to charge Development Impact Fees to offset the costs associated with providing new infrastructure and facilities demanded as a result of development, subject to assessment, spending, and disclosure requirements per Assembly Bill 1600 ("AB 1600"); and WHEREAS, it was determined that adjustments in Development Impact Fees may be necessary to close the gap between current fees and actual facility development and construction costs because the City of National City's ("City") Development Impact Fee Schedule had not been updated since 2005; and WHEREAS, on January 29, 2024, the City entered into an agreement with David Taussig and Associates ("DTA") to conduct a comprehensive AB 1600 DIF Nexus Study for the purpose of establishing updated Development Impact Fees and to recommend the appropriate fee justification methodology and fee levels to support specific types of City -selected capital facilities needed to serve new growth and determine whether there are additional Development Impact Fees that may be implemented; and WHEREAS, the completed Development Impact Fee Study is presented in Exhibit B to the Agenda Report and provides the necessary analysis and justification to support the proposed new City of National City 2025 Development Impact Fee Schedule as shown in Exhibit C; and WHEREAS, staff recommends that the new Development Impact Fee Schedule be adopted and be regularly reviewed and updated to ensure cost recovery is maintained in future years based on the California Construction Cost Index; and WHEREAS, a public hearing to consider adjustments to City user fees was held at a publicly noticed regularly scheduled City Council meeting on January 20, 2026, wherein the City Council considered oral and written presentations of City staff, and members of the public; and WHEREAS, after said public hearing, approved changes to City fees will become effective after at least ninety (90) days; therefore, if adopted on January 20, 2026, the 2025 Development Impact Fee Schedule will become effective no sooner than April 20, 2026. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: Section 1: That the City Council hereby adopts the 2025 Development Impact Fee Schedule, superseding all fees previously established for said activities. The 2025 Development Impact Fee Schedule is attached to the Agenda Report as Exhibit C. Section 2: That the City Council hereby authorizes City staff to annually review at the beginning of each fiscal year the Development Impact Fees to ensure cost recovery is maintained in future years based on the California Construction Cost Index or other relevant data that may be available and make recommendations for changes to the Development Impact Fees to the City Council. Section 3: That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original Resolutions. PASSED and ADOPTED this 20"' day of Japumy, 2026.
