RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AUTHORIZING THE CITY MANAGER OR THEIR DESIGNEE TO EXECUTE VOLUNTARY
AGREEMENTS WITH THE CALIFORNIA DEPARTMENT OF TOXIC SUBSTANCES
CONTROL FOR NOT-TO-EXCEED AMOUNTS OF $55,971 EACH FOR ENVIRONMENTAL
OVERSIGHT OF CITY-OWNED PROPERTIES LOCATED AT 921-929 NATIONAL CITY
BOULEVARD AND 1028 A AVENUE.
WHEREAS, in 2022, the City of National City ("City") and San Diego State University
(SDSU) initiated the National City Brownfields Assessment Project ("Project"), funded by the
Environmental Protection Agency ("EPA") and the California Department of Toxic Substances
Control ("DISC"); and
WHEREAS, the DTSC is a qualified state environmental regulator that has worked with
the City before to provide oversight of environmental remediation planning and implementation
for the Westside Transit-Oriented Development (WI-TOD)/ Paradise Creek Project; and
WHEREAS, an upcoming step in the Project is to coordinate with the DTSC to oversee
the investigation and/or remediation of any potential hazardous substances from two City-owned
sites located at 921-929 National City Blvd and 1028 A Avenue; and
WHEREAS, in January 2026, City staff applied to the DTSC for this oversight along with
funding to cover the associated costs; and
WHEREAS, the DTSC has approved the application for oversight and provided City staff
with Voluntary Agreements which require the City to pay for all costs incurred by the DTSC
through completion of the Project; and
WHEREAS, each Agreement contains cost estimates of$55,971 for a combined total of
$111,942, half of which must be provided as an advancement within 10 days of execution; and
WHEREAS, in January 2026, City staff applied to the DTSC for funding to cover the
associated costs from the DTSC's Comprehensive Environmental Response, Compensation,
and Liability Act 128(a) State and Tribal Response Program Grant ("CERCLA"); and
WHEREAS, the DTSC has committed to covering costs with CERCLA grant funding
through the end of fiscal year("FY") 2025-2026; and
WHEREAS, the DTSC has indicated that they may be able to continue supporting costs
into the following FY if additional CERCLA funding is available, however that cannot be
guaranteed at this time; and
WHEREAS, should the City's advance deposit not be fully drawn down by the completion
of the Project, the remaining funds would be returned to the City.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1: That the City Council hereby authorizes the City Manager or their designee
to execute two agreements with the California Department of Toxic Substances Control, in not-
to-exceed amounts of $55,971 each, to oversee the investigation and/or remediation of any
potential hazardous substances on City-owned properties located at 921-929 National City Blvd
and 1028 A Avenue.
Section 2: That the City Clerk shall certify to the passage and adoption of this Resolution
and enter it into the book of original Resolutions.
