RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
FOLLOWING A PUBLIC HEARING PURSUANT TO NATIONAL CITY MUNICIPAL CODE
CHAPTER 1.36 (ABATEMENT OF PUBLIC NUISANCE) TO CONSIDER CONFIRMING
NUISANCE ABATEMENT COSTS, APPROVING THE REPORT AND ACCOUNTING IN THE
AMOUNT OF $31,331.57 FOR THE PROPERTY LOCATED AT 1508 E. 8TH STREET.
WHEREAS, pursuant to National City Municipal Code Chapter 1.36 (Abatement of Public
Nuisance), when the City Manager, his designee, or the Department Director abates a public
nuisance, the City Manager, his designee, or the Department Director shall prepare a report
describing the work performed, an itemized account of the total abatement costs, the name and
address of the responsible person and the tax assessor's parcel number (the "Report and
Account"); and
WHEREAS, the property located at 1508 E. 8th Street (APN 557-180-07-00) was found
to be in violation of the National City Municipal Code due to the accumulation of junk, trash, and
construction debris, constituting a public nuisance; and
WHEREAS, on September 12, 2024, the City issued a Notice of Violation requiring
correction of the violations, and after continued non-compliance, the City obtained an abatement
and inspection warrant on September 3, 2025, authorizing entry onto the property to abate the
public nuisance; and
WHEREAS, a city-led abatement was conducted between September 16 and September
18, 2025, resulting in the removal of substantial quantities of debris, including eight (8) 40-yard
bins of waste and two (2) trailer loads of appliances; and
WHEREAS, the Office of the City Clerk has given notice of the filing of the Report and
Account and of the time for a Public Hearing by the City Council pursuant to National City
Municipal Code Section 1.36.090; and
WHEREAS, on April 21, 2026, the City Council held a Public Hearing at which the Report
and Account, and all written appeals, protests, or objections, if any, were duly presented, read,
and considered, and all persons desiring to be heard were heard, and the City Council gave all
persons an opportunity to submit written testimony with respect to any matter relating to the work,
or to any other concerns relating to the work or the costs or the proceedings; and
WHEREAS, all persons desiring to submit written testimony or written comments to the
City Council have been heard.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DOES
HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council hereby approves the Report and Account, attached to the
agenda report as Exhibit A, for the property located at 1508 8th Street in the total amount of
$31,331.57.
SECTION 2. The City Council hereby authorizes the recordation of a nuisance abatement
lien with the San Diego County Recorder's Office or placement of a special assessment on the
property with the County of San Diego Auditor and Controller if not paid within thirty days of
service of this Resolution.
SECTION 3.That the City Clerk shall certify to the passage and adoption of this Resolution
and enter it into the book of original Resolutions.
