Supporting Information: Under Contracts Specification Section 5—Utilities,all utility potholing is to be completed prior to beginning construction to avoid conflicts,rework,and interruption of production.At the contractor's request,the City acknowledges that the contractor will proceed with potholing concurrently with construction activities rather than completing all potholes in advance.This does not waive any contract requirements and sole acknowledges the contractor's chosen means and methods.The contractor accepts full responsibility and liability for all impacts resulting from incomplete potholing,including,but not limited to utility conflicts,delays,damages,re-excavation, additional traffic control,re-sequencing,or any other operation disruptions caused by encountering utilities during construction. This change order is not effective until approved by the City. Time adjustment: Zero(0)working days are added to contract time. If this Change Order is approved, Contractor will provide all of the equipment,materials and labor necessary to provide a complete work as described above at that the price stated herein. Contractor confirms that the price is fair and complete and represents all costs associated with the work, including but not limited to all equipment,materials,labor,supervision,overhead,fees,bonds,insurance,profit, etc. and that there will be no further compensation. All of the terms and conditions of the original contract documents are incorporated herein.
