SECOND AMENDMENT TO THE AGREEMENT
BY AND BETWEEN
THE CITY OF NATIONAL CITY
AND
CLAIMS MANAGEMENT ASSOCIATES, INC.
This Second Amendment to the Agreement is entered into this Oh day of August
2026, and effective July 1, 2026, by and between the CITY OF NATIONAL CITY, a
municipal corporation ("CITY"), and CLAIMS MANAGEMENT ASSOCIATES, INC., a
California corporation (the "CONSULTANT").
RECITALS
WHEREAS, the CITY and the CONSULTANT entered into an Agreement on July
1, 2024 ("the Agreement"), wherein the CONSULTANT agreed to provide Risk
Management Liability Consulting services to include liability claims management,
adjusting and investigation, for a not-to-exceed amount of$160,000, and a one-year term,
with the option to extend this term one (1) year; and
WHEREAS, the Agreement provided that it may be extended by mutual agreement
upon the same terms and conditions for an additional one (1) year term and that the
Parties may exercise up to three (3) one-year extensions; and
WHEREAS, on December 2, 2025, the Parties executed the 1st amendment to the
agreement by extending the term to June 30, 2026; and
WHEREAS, the Parties desire to amend the Agreement by exercising the 2nd of
three (3) one-year options to extend the term of the Agreement to June 30, 2027.
AGREEMENT
NOW, THEREFORE, the parties hereto agree that:
1. The Parties desire to amend the Agreement by exercising the Second of the
three (3) one-year options to extend the term of the Agreement to June 30, 2027.
2. The parties further agree that, with the foregoing exceptions, each and every
other term and provision of the July 1, 2024, Agreement shall remain in full force and
effect.
IN WITNESS WHEREOF, the parties hereto have executed this First Amendment
to the Agreement on the date and year first above written.
