NOTICE: The health and well-being of National City residents, visitors,
and employees during the COVID-19 outbreak remains our top priority.
The City of National City is coordinating with the County of San Diego
Health Human Services Agency, and other agencies to take measures
to monitor and reduce the spread of the novel coronavirus (COVID-19).
The World Health Organization has declared the outbreak a global
pandemic and local and state emergencies have been declared
providing reprieve from certain public meeting laws such as the
Brown Act.
As a result, the City Council Meeting will occur only online to ensure
the safety of City residents, employees and the communities we serve.
A live webcast of the meeting may be viewed on the city's website
at www.nationalcityca.gov. For Public Comments see "PUBLIC
COMMENTS" section below
ORDER OF BUSINESS: Public sessions of all Regular Meetings of the
City Council / Community Development Commission - Housing
Authority (hereafter referred to as Elected Body) begin at 6:00 p.m. on
the first and third Tuesday of each month. Public Hearings begin at
6:00 p.m. unless otherwise noted. Closed Meetings begin in Open
Session at 5:00 p.m. or such other time as noted, and after announcing
closed session items, convenes into a Closed Meeting. If a workshop
is scheduled, the subject and time of the workshop will appear on the
agenda. The Mayor and Council members also sit as the Chairperson
and Members of the Board of the Community Development
Commission (CDC).
REPORTS: All open session agenda items and reports as well as all
documents and writings distributed to the Elected Body less than 72
hours prior to the meeting, are available for review on the City's
website at www.nationalcityca.gov. Regular Meetings of the Elected
Body are webcast and archived on the City's website at
www.nationalcityca.gov.
PUBLIC COMMENTS: The City Council will receive public comments
via e-mail at clerkAnationalcityca.gov regarding any matters within the
jurisdiction of the City Council. Written comments or testimony from
the public (limited to three minutes) must be submitted via e-mail
by 4:00 p.m. on the day of the City Council Meeting. All
comments received from the public will be made a part of the
record of the meeting.

The time limit established for public testimony is three minutes per speaker. The Mayor or
Chairperson may limit the length of comments due to the number of persons wishing to
speak or if comments become repetitious or unrelated.
WRITTEN AGENDA: With limited exceptions, the Elected Body may take action only upon items
appearing on the written agenda. Items not appearing on the agenda must be brought back on a
subsequent agenda unless they are of a demonstrated emergency or urgent nature, and the need to
take action on such items arose after the agenda was posted.
CONSENT CALENDAR: Consent calendar items involve matters which are of a routine or
noncontroversial nature. All consent items are adopted by approval of a single motion by the City
Council. Prior to such approval, any item may be removed from the consent portion of the agenda
and separately considered, upon request of a Councilmember, a staff member, or a member of the
public.
Upon request, this agenda can be made available in appropriate alternative formats to persons with a
disability in compliance with the Americans with Disabilities Act. Please contact the City Clerk's Office
at (619) 336-4228 to request a disability -related modification or accommodation. Notification 24-
hours prior to the meeting will enable the City to make reasonable arrangements to ensure
accessibility to this meeting.

EXPLANATION:
The CLLS grant is designed to support the Library's literacy services program to adults who seek to imp . e their
reading, writing, math, and computer skills. The award amount the State Library provides to libraries that offer
literacy services to their communities is based on a funding formula consisting of three parts:
1. A baseline amount ($20,000) for each approved library literacy program;
2. A per capita amount per adult learner served in the previous year's program; and
3. Additional funding raised by local funds earmarked for adult literacy services. This local funding is fulfilled
by a CDBG grant the City Council awarded to the Library on May 5, 2020 in the amount of $52,000 to
defray the personnel costs of the Literacy Coordinator who oversees the operation of the literacy program.
The CLLS grant is awarded in two installment payments: First payment of $37,973 (90% of the Adult Literacy
Award) is being awarded at this time; Second payment of $4,219, representing the remaining 10% of the total
award for FY2021, can be claimed at a later date upon submission of the mid -year narrative and financial report
that demonstrates project activity and confirmation that 75% of the award has been expended. Total award
amount for FY2021 will be $42,192.

We're pleased to provide funds to support your California Library Literacy Services program
and the important work that you and your staff and volunteers do in your community.
The state budget continues California Library Literacy Services funding at $4.82 million for
adult literacy services and $2.5 million for family literacy services.
Your total award for the fiscal year that began July 1, 2020, is:
• Adult Literacy Services: $42,192
Your award will be claimed in two stages. The attached claim form will allow you to request the
first 90% of your Adult Literacy and Family Literacy Award:
• 90% of the Adult Literacy Award - $37,973
Note: Information about claiming the remainder of you award is included in the payment
schedule at the back of your award packet.
There are three parts to the funding formula for California Library Literacy Services' adult
literacy services program:
• A baseline amount ($20,000) for each approved library literacy program;
• A per capita amount per adult learner served in your program as reported in the most
recent Final Report on file from your library; and
• Additional funding based on local funds raised and expended for adult literacy services —
reflecting a commitment to state/local partnerships in support of literacy services.
Your funds must be encumbered by June 30, 2021, and fully expended, in accordance with your
approved budget on file with the State Library, by December 31, 2021. Encumbered funds are
those that have been deposited in the awardee's accounting system and for which a budget has
been provided to and approved by the State Library.
Please be sure your program expenditures are consistent with the California Library Literacy
Services allowable and unallowable costs guide. If you have any questions about expending your
funds please reach out to the library.
We strongly encourage your program staff to develop and maintain community partners to
strengthen your program as well as attend regular regional library literacy network meetings and
participate in library literacy training opportunities offered by the State Library and the regional
networks.

On April 4, 2016, California Governor Jerry Brown signed Senate Bill 3 increasing California's mint m wage
each year until it reaches $15.00 per hour on January 1, 2022. Under the current City of National City Part-time
and Seasonal compensation plan there are twenty-seven classifications to be amended. Staff hereby requests
authorization to adjust salaries upwards for Part -Time and Seasonal employee classifications starting at $15.00 per
hour effective January 1, 2021, in order to address compaction issues between classifications, align salaries to
classifications that are also full-time classifications, and use the revised salary schedule as a recruitment tool to
attract and retain talent. The changes to the position ranges are noted on the attachment "Exhibit A".
In addition, staff request to move the Home Delivered Meals Driver classification salary range in the NCMEA
Salary Schedule from 047 to 058 to accommodate the minimum wage adjustment to $15.00 per hour.

The estimated fiscal impact for Fiscal Year 2021 is $26,123. Impacted departments may be able to absorb a
portion of the estimated increase through salary savings. Any required adjustments to appropriations will be

Explanation
The project will enhance pedestrian and bicycle connections between Naval Base San
Diego, the 8th Street Trolley Station, and Downtown National City. The project will provide
streetscape, lighting, signage, mobility options, urban greening, and parking to the east
side of Roosevelt Avenue, between 8th Street and National City Blvd. The proposed
project is consistent with the adopted Downtown Specific Plan as well as the previous
Downtown Specific Plan dated in 2005 and 2012. Therefore, the project does not require
environmental review at this time.
In the fall of fall 2018, SANDAG awarded the City of National City (City) a $2,080,000
grant ($1,780,000 for Construction and $300,000 for Design) funded by the TransNet
Smart Growth Incentive Program, with a local match requirement of $625,000, The City
Manager subsequently executed the grant agreement with SANDAG of February 14,
2019
On November 2, 2020, the bid solicitation was posted on PlanetBids, a free public
electronic bidding system for contractors. On November 4, 2020 and November 11, 2020,
the bid solicitation was advertised in local newspapers.
On November 24, 2020, five (5) bids were received by the 1:00 p.m. deadline. Bid results
were immediately available for viewing on PlanetBids. Tri-Group Construction and
Development, Inc. was the apparent lowest bidder with a total bid amount of $2,049,491.
Upon review of all documents submitted, Tri-Group Construction and Development, Inc.
bid was deemed responsive, and they are the lowest responsible bidder qualified to
perform the work as described in the project specifications.
Therefore, staff recommends awarding a contract to Tri-Group Construction and
Development, Inc. in the not -to -exceed amount of $2,049,491. Staff also recommends
authorizing a 25% contingency in the amount of $512,485 to address any unforeseen
conditions that may arise. Staff is requesting a 25% contingency to fund unforeseen
conditions and additional paving work on Roosevelt Avenue as existing conditions are
deteriorated. Staff will fund the contingency through prior City Council CIP Budget
appropriations for SB-1 Gas Tax (RMRA). The local Match requirement will be satisfied
through SB-1 Gas Tax (RMRA).
Attached are the bid opening summary sheet and a line item summary of the three lowest
bidders for reference. Also attached is the Owner --Contractor Agreement.
Construction is estimated to be completed by Fall 2021. Updates will be provided on the
City's CIP Projects Dashboard available at:

OWNER - CONTRACTOR AGREEMENT
ROOSEVELT SMART GROWTH CORRIDOR PROJECT, CIP NO. 19.19
This Owner -Contractor Agreement ("Agreement") is made by and between the City of
National City, 1243 National City Boulevard National City, California 91950 and Tri-Group
Construction and Development, Inc. ("Contractor"), 9580 Black Mountain Road, Suite L,
San Diego, CA 92126, on the 1St" day of December, 2020, for the construction of the above
referenced Project.
In consideration of the mutual covenants and agreements set forth herein, the Owner
and Contractor have mutually agreed as follows:
1. CONSTRUCTION
1
The Contractor agrees to do all the world and furnish all the labor, services, materials and
equipment necessary to construct and complete the Project in a turn -key manner in
accordance with this Agreement and all documents and plans referenced in Exhibit "A",
(hereinafter "Contract Documents"), in compliance with all relevant Federal, State of
California, County of San Diego and City of National City codes and regulations, and to the
satisfaction of the Owner.
2. CONTRACT PRICE
Owner hereby agrees to pay and the Contractor agrees to accept as full compensation for
constructing the project in accordance with these Contract Documents in an amount not
to exceed the contract price as set forth in Exhibit "B" attached hereto and incorporated
herein by reference. Payments to the Contractor shall be made in the manner described
in the Special Provisions.
3. TIME FOR PERFORMANCE
Time is of the essence for this Agreement and the Contractor shall construct the project
in every detail to a complete and turn -key fashion to the satisfaction of the Owner within
the specified duration set forth in the Special Provisions.
4. NON-DISCRIMINATION
In the performance of this Agreement, the Contractor shall not refuse or fail to hire or
employ any qualified person, or bar or discharge from employment any person, or
discriminate against any person, with respect to such person's compensation, terms,
conditions or privileges of employment because of such person's race, religious status,
sex or age.

5. AUTHORIZED OWNER REPRESENTATIVES
On behalf of the Owner, the Project Manager designated at the pre -construction meeting
shall be the Owner's authorized representative in the interpretation and enforcement of
all Work performed in connection with this Agreement.
6, WORKERS' COMPENSATION INSURANCE
a) By my signature hereunder, as Contractor, I certify that I am aware of the
provisions of Section 3700 of the Labor Code, which requires every employer to be insured
against liability for Workers' Compensation or to undertake self-insurance in accordance
with the provisions of that Code, and I will comply with such provisions before commencing
the performance of the Work of this Agreement.
b) The Contractor shall requiire each subcontractor to comply with the
requirements of Section 3700 of the Labor Code. Before commencing any Work, the
Contractor shall cause each subcontractor to execute the following certification:
"I am aware of the provisions of Section 3700 of the Labor Code, which requires
every employer to be insured against liability for worker's compensation or to
undertake self-insurance in accordance with the provisions of that Code, and I will
comply with such provisions before commencing the performance of the Work of
this Agreement."
7. ENTIRE AGREEMENT; CONFLICT
The Contract Documents comprise the entire agreement between the Owner and the
Contractor with respect to the Work. In the event of conflict between the terms of this
Agreement and the bid of the Contractor, then this Agreement shall control and nothing
herein shall be considered as an acceptance of the terms of the bid conflicting herewith.
S. MAINTENANCE OF AGREEMENT DOCUMENTATION
Contractor shall maintain all books, documents, papers, employee time sheets, accounting
records and other evidence pertaining to costs incurred and shall make such materials
available at its office at all reasonable times during the term of this Agreement and for three
(3) years from the date of final payment under this Agreement, for inspection by Owner
and copies thereof shall be furnished to Owner if requested.
9. INDEPENDENT CONTRACTOR
At all times during the term of this Agreement, Contractor shall be an independent
contractor and shall not be an employee, agent, partner or joint venturer of the Owner.

Owner shall have the right to control Contractor insofar as the results of Contractor's
services rendered pursuant to this Agreement; .however, Owner shall not have the right to
control the means by which Contractor accomplishes such services.
10. LICENSES AND PERMITS
Contractor represents and declares to Owner that it has all licenses, permits, qualifications
and approvals of whatever nature which are legally required to practice its profession.
Contractor represents and warrants to Owner that Contractor shall, at its sole cost and
expense, keep in effect at all times during the term of this Agreement, any licenses, permits,
qualifications or approvals which are legally required for Contractor to practice its
profession.
11. GOVERNING LAW, VENUE
This Agreement and the Contract DocumentsIshali be construed under and in accordance
with the laws of the State of California, and the appropriate venue for any action or
proceeding arising from this Agreement and/or the Contract Documents shall be had in the
Superior Court of San Diego, Central Branch.
12. COUNTERPARTS
This Agreement may be executed in any number of counterparts, each of which shall for all
purposes be deemed to be an original.
13. FALSE CLAIMS
Contractor acknowledges that if a false claim is submitted to the Owner, it may be
considered fraud and Contractor may be subject to criminal prosecution. Contractor
acknowledges that the False Claims Act, California Government Code sections 12650, et
seq., provides for civil penalties where a person knowingly submits a false claim to a public
entity. These provisions include within their scope false claims made with deliberate
ignorance of the false information or in reckless disregard of the truth or falsity of the
information. In the event the Owner seeks to recover penalties pursuant to the False
Claims Act, it is entitled to recover its litigation costs, including attorneys' fees. Contractor
hereby acknowledges that the filing of a false claim may the Contractor to an
administrative debarment proceeding wherein Contractor may be prevented from
further bidding on public contracts for a period of up to five (5) years.

WHEREAS, the City Council of the City of National City, by Resolution No. 2020-
, on the 15th day of December, 2020, has awarded Tri-Group Construction and
Development, Inc., hereinafter designated as the "Principal", the ROOSEVELT SMART
GROWTH CORRIDOR PROJECT, CIP NO. 19-19.
WHEREAS, said Principal is required under the terms of said contract to furnish a
bond for the faithful performance of said contract.
NOW, THEREFORE, we, the Principal and
as surety, are held and firmly
bound unto the City of National City, hereinafter called the "City", in the penal sum of
Two Million, Forty Nine Thousand, Four Hundred Ninety One ($2,049,491.00llawful
money of the United States, for the payment of which sum well and truly to be made,
we bind ourselves, our heirs, executors, administrators and successors, jointly and
severally, firmly by these presents.
THE CONDITION OF THIS OBLIGATION IS SUCH THAT if the above bounden Principal,
his/her or its heirs, executors, administrators, successors or assigns, shall in all things
stand to and abide by, and well and truly keep and perform the covenants, conditions and
agreements in the said contract any alteration thereof made as therein provides, on his
or their part, to be kept and performed at the time and in the amount therein specified,
and in all respects according to their true intent and meaning, and shall indemnify and
save harmless the City of National City, its officers, agents, employees, and volunteers as
therein stipulated, then this obligation shall become null and void; otherwise it shall be
and remain in full force and virtue.
And the said Surety, for value received, hereby stipulates and agrees that no
change, extension of time, alteration or addition to the terms of the contract or to the
work to be performed herein or the specifications accompanying the same shall in any
wise affect its obligations on this bond, and it does hereby waive notice of any such

In the event suit is brought upon this bond by the City and judgment is recovered, the

subcontractors pursuant to Section 18806 of the Revenue and Taxation Code, with
respect to such work and labor the Surety will pay for the same in an amount not
exceeding the sum hereinafter specified, and also, in case suit is brought upon this bond,
a reasonable attorney's fee, to be fixed by the Court.
This Bond shall inure to the benefit of any of the persons named in Section 3181 of
the California Civil Code, so as to give a right of action to such persons or their assigns in
any suit brought upon this bond.

exonerated or released from the obligation of this bond by any change, extension of time
for performance, addition, alteration or modification in, to, or of any contract, plans,
specifications, or agreement pertaining. or relating to any scheme or work of

materials, or equipment therefore, not by any change or modification of any terms'of
payment or extension of the time for any payment pertaining or relating to any scheme
or work of improvement hereinabove described, nor by any rescission or attempted
rescission of the contract, agreement or bond, nor by any conditions precedent or
subsequent in the bond attempting to limit the right of recovery of claimants otherwise
entitled to recover under any such contract or agreement or under the bond, nor by any
fraud practiced by any person other than the claimant seeking to recover on the bond
and that this bond be construed most strongly against the Surety and in favor of all
persons for whose benefit such bond is given, and under no circumstances shall Surety be
released from liability to those for whose benefit such bond has been given, by reason of
any breach of contract between the owner of Public Entity and original contractor or on
the part of any obliges named in such bond, but the sole conditions of recovery shah be

EXPLANATION
Mr. Lincoln Henderson, an area resident, has requested the installation of red curb "No
Parking" and a Stop control sign at the "T" intersections of "F" Avenue, between E. 18th
Street and E. 22nd Street, in order to improve visibility and enhance safety at the
intersections.
Staff visited the site and confirmed the "T" intersections are located on "F" Avenue
between E. 18th Street and E. 22nd Street. "F" Avenue is currently a 2-lane wide street
with parking available on both sides of the street. Staff confirmed that the "T" intersection
between E. 18th Street and "F" Avenue is currently stop controlled for northbound traffic
on "F" Avenue. There is 30 feet of existing red curb on the northeast corner of "F" Avenue
and E. 22nd Street due to an existing fire hydrant. Staff confirmed that when vehicles park
too close to the corners on "F" Avenue at these intersections, the visibility for the vehicles
that are exiting onto "F" Avenue is obstructed.
Based on the guidelines outlined in the State of California Manual on Uniform Traffic
Control Devices (MUTCD) Section 2B.04, staff recommends the installation of Stop
Control signs at these "T" intersections, delimitated by the area described above. In
addition, a Stop Control sign is required for vehicles on a street entering a designated
through street.
Staff also reviewed the traffic collision history for these intersections which confirmed
there were three (3) "reported" traffic collisions within the past four years. The NCPD
report shows that one of the crashes at the intersection was due to a violation of right-of-
way in the intersection (CVC 21802A). See attachment "Traffic Collision History."
This item was presented to the Traffic Safety Committee via Zoom platform on November
11, 2020. Staff sent notices to area residents inviting them Zoom -in to call -in to the Traffic
Safety Committee Meeting and/or contact staff with any questions. Mr. Henderson called -
in to the meeting to speak in support of the item.
After the discussion, the Traffic Safety Committee approved staff's recommendation for
the following traffic safety enhancements for the intersections of "F" Avenue between E.
18th Street and E. 22nd Street:
1. Install one Stop control sign on E. 19th Street on the east side of "F" Avenue;
2. Install 25 feet of red curb "No Parking" on E. 19th Street on the east side of "F"
Avenue. This will result in the loss of one (1) on -street parallel parking space;
3. Install one Stop control sign on E. 20th Street on the west side of "F" Avenue;
4. Install 25 feet of red curb "No Parking" on E. 20th Street on the west side of "F"
Avenue. This will result in the loss of one (1) on -street parallel parking space;
5. Install one Stop control sign on E. 21st Street on the east side of "F" Avenue;
6. Install 25 feet of red curb "No Parking" on E. 21st Street on the east side of "F"
Avenue. This will result in the loss of one (1) on -street parallel parking space;
7. Install one Stop control sign on E. 22nd Street on the east side of "F" Avenue;

space;
15. Install 10 feet of red curb "No Parking" on the east side of "F" Avenue, on the north

Installation of red curb "No Parking" striping is used to prevent vehicles from obstructing
visibility of the Stop signs and centerline striping for alignment and are typical traffic
engineering safety measures for implementation of Stop sign control.
If approved by City Council, all work will be performed by City Public Works.

intersections.
Staff visited the site and confirmed the "T" intersections on "F" Avenue between E. 18th
Street and E. 22nd Street. "F" Avenue is currently 2-lane wide with parking available on both
sides of the street. Staff confirmed that the "T" intersection between E. 18th Street and "F"

Staff recommends the installation of a Stop Control sign at the "T" intersection delimitated
by the area described above since vehicles travelling on the minor streets must make a
complete stop before attempting to enter onto the major streets that have the right of way.
Staff also reviewed the traffic collision history for these intersections, which confirmed there
were three (3) "reported" traffic collisions within the past four years. The NCPD report
shows that one of the crashes at the intersection was due to a violation of right-of-way in
the intersection (CVC 21802A). See attachment traffic collision summary table.
STAFF RECOMMENDATION:
Staff recommends the following traffic safety enhancements for the intersections of "F"
Avenue between E. 18th Street and E. 22nd Street:

EXPLANATION
An area resident has requested red curb "No Parking" at the intersection between Division
Street and Dahlia Drive to improve visibility and enhance safety for the vehicles exiting
from Dahlia Drive onto Division Street.
Staff performed a site evaluation. Division Street is currently 2-lanes wide and has
available parking on both sides of the street. Dahlia Drive is an alley with no parking
allowed on both sides of the street. The posted speed limit on Division Street is 30 mph.
Staff confirmed that there is no existing red curb on the south side of Division Street, east
and west sides of Dahlia Drive.
Staff confirmed that when vehicles park too close to the corner on Division Street and
Dahlia Drive at the intersection, the visibility for the vehicles that are exiting Dahlia Drive
onto Division Street is obstructed.
Furthermore, staff also reviewed the traffic collision history for this location, which
confirmed there was two (2) "reported" traffic collision within the past four years. The
NCPD report shows that crash at the intersection was due to a violation of left turn yield
until safe in the intersection (CVC 21801A). See attachment "Traffic Collision History."
This item was presented to the Traffic Safety Committee on November 11, 2020. Staff
presented the results of the site evaluation and after discussion, the Traffic Safety
Committee voted to approve staff's recommendation to install red curb "No Parking" on
the intersection of Division Street and Dahlia Drive to improve visibility for vehicles exiting
from Dahlia Drive onto Division Street. This will result in the loss of one (1) on -street
parking space.

DISCUSSION:

Staff performed a site evaluation. Division Street is currently 2-lanes wide and has available

Based on evaluation of existing conditions, staff recommends the installation of 20 feet of red
curb "No Parking" on the south side of Division Street, west of Dahlia Drive, and 10 feet of
red curb "No Parking" on the south side of Division Street, east of Dahlia Drive, to improve
visibility for vehicles exiting Dahlia Drive onto Division Street. This will result in the loss of
one (1) on -street parking space.

Dear Mayor Sotelo-Solis and Councilmembers:
This letter serves as my formal letter of resignation as the City Attorney of National City
effective December 30, 2020. Consequently, my first day of retirement from employment
with the City of National City shall be December 31, 2020.
Please know that I appreciate you and every member of the City Council for providing me
the opportunity to serve as your City Attorney. Serving in this positon has been more than
the final chapter of my long career, it has been an amazing honor and privilege to serve a
wonderful city. Specifically, it has allowed me to work for a terrific Mayor and Council as
well as the opportunity to work alongside employees who take pride in providing great
service to the public.
I have enjoyed my three and a half years with you as your City Attorney, however I am
pleased with the knowledge that I'm leaving you in the good hands of Charles Bell and
Nicole Pedone. I know that they will do an excellent job for you and the City of National City.
I wish the entire City Council, the residents of the City of National City and the employees of
this great city nothing but continued success going forward and will miss working for you
and living in National City. My employment with the City of National City has been an
opportunity to serve, learn and grow. I will take so many positive memories with me as
enter my retirement. Thank you for allowing me to be a part of this amazing city as your City
Attorney and resident which has resulted in me experiencing a fantastic journey of working
for you and with some extraordinary people.

LOCAL APPOINTMENTS LIST FOR 2021 - MADDY ACT
Staff Report
California Government Code 54970-54974 requires on or before December 31 of each
year, each legislative body shall prepare an appointments list of all regular and ongoing
boards, commissions, and committees which are appointed by the legislative body of the
local agency. This list shall be known as the Local Appointments List.
The Appointments List serves to provide awareness of the opportunities to serve on local
regulatory and advisory boards, commissions and committees.
Any unscheduled vacancy that may occur during 2021 will be determined a special
vacancy and notice shall be posted at City Hall and the City Website pursuant to Section
54973-54974 of the Government Code not earlier than twenty (20) days before and not
later than twenty (20) days after the vacancy occurs. Final appointment to the
Board/Commission/Committee shall not be made by the legislative body for at least ten
(10) working days after the posting of the notice in the Clerk's Office.
Discussion:
In compliance with the requirements of Government Code Section 54970, the following
Local Appointments List is posted on an annual basis. The List presents all current
members of the City Boards/Commissions/Committees and the dates of the terms.
Civil Service Commission consists of up to five (5) members who are appointed by
the City Council and are required to be a resident of National City and a registered
voter. The City Council appoints the members for a term of five (5) years. The Civil
Service Commission recommends to the City Council, after a public hearing, the
adoption, amendment or repeal of Civil Service Rules and Regulations not in conflict
with the Government Code; hears appeals of any person in the classified service
relative to any suspension, demotion or dismissal; and makes any investigation
concerning the administration of personnel in the municipal service and reports its
findings to the City Council and the City Manager.
Community and Police Relations Commission consists of eight (8) individuals
appointed by the Mayor with the approval of the City Council. Of the eight (8)
members, seven (7) shall be voting members, and one (1) shall be non -voting
members. Of the seven (7) voting members, five (5) shall be residents of the City of
National City. The non -voting members shall be a member of the National City Police
Officers' Association. The terms of the members shall be for three (3) years.

Library Board of Trustees consists of five (5) member appointed by the Mayor, with
the consent of the City Council for a three (3) year term. The Library Board of Trustees
coordinates the activities of the City Library; advises the City Librarian on operational
policies; approves warrants; and recommends to the City Council the adoption of rules
and regulations, as it may deem necessary for the administration and protection of the
City Library. The Library Board of Trustees is regulated by Education Code Section
et seq., Ordinance 1062 and Resolution 8210.
Parks, Recreation and Senior Citizens Advisory Board consists of seven (7)
members to be appointed by the Mayor subject to confirmation by the City Council,
each for a term of three (3) years. The Parks, Recreation and Senior Citizen Advisory
Board acts in an advisory capacity to the City Council in matters of policy and
administration of city owned parks and the recreation programs operated within the
parks and recreation centers; investigates and reports on related matters as referred
by the Council; and submits recommendations to Council on relative subjects which
the Board deems important.
Planning Commission consists of seven (7) members appointed by the City Council
for a term of four (4) years. The Planning Commission is appointed to consider land
use planning matters. The Commission renders determinations and makes
recommendations to the City Council on a variety of land use matters, including
changes to the City's General Plan, Specific Plans and Land Use Code. They also
provide discretionary review for land use matters such as Conditional Use Permits,
Variances, and Subdivisions.
The Planning Commission also serves on the Housing Advisory Committee, which
provides input on housing related matters such as the Housing Element and the Focus
General Plan Update and plays a role in moving forward housing programs and
projects.
Public Art Committee consists of five (5) members of the Public Art Committee are
appointed by the Mayor, with the consent of the City Council, to serve three (3) year
terms. The Public Art Committee acts in an advisory capacity to the City Council in
matters of policy and selection of public art installed anywhere in the City.
Traffic Safety Committee consists five (5) members of the Traffic Safety Committee
are appointed by the Mayor, with the consent of the City Council, for three (3) year
terms. The Traffic Safety Committee reviews and makes recommendations on
matters related to vehicular and pedestrian safety within the City of National City. As
directed by the City Council, the Traffic Safety Committee conducts investigations and
reports on safety issues requested by appropriate public agencies and responsible
private citizens / private organizations.

Veterans and Military Families Advisory Committee consists seven (7) members
of the Veterans and Military Families Advisory Committee are appointed by the Mayor,
with the consent of the City Council, to serve four (4) year terms. Of the seven (7)
members, five (5) shall be residents and up to two (2) may be non-residents. The
National City Veterans and Military Families Advisory Committee serves in an advisory
capacity to the City Council of the City of National City on matters related to the
support of our veterans and military community. The committee makes
recommendations to the City Council with respect to veterans and military service
member -related issues, ceremonies, and other activities that occur within National
City. Committee meetings provide a forum for discussion of issues relating to veterans
and military families. The committee provides advice and assistance to National City
residents regarding resources available for veterans, military personnel, and their
families. The committee acts as a conduit of communication and coordination
between the local veteran and military community, and the City of National City.
The committee's responsibilities may include providing recommendations to the City
Council on issues of interest to veterans, military personnel, and their families;
providing a forum to discuss and help resolve issues, encouraging and promoting
awareness, planning and assisting the City with planning of events honoring the
heritage of our veterans and military community to establish and promote positive
relations within the city; and serving as a liaison between the city of National City and
community partners.
Public Notification:
Approve the Local Appointments List for 2021 and authorize the City Clerk to post the list
at City Hall and on the City website, in compliance with Government Code 54972.

SUBJECT: Adjustments in Compensation for the Mayor and City Council
City Council Salary
The last salary adjustment for the Mayor and City Council occurred on February 21, 2017, with the
enactment of Ordinance No. 2017-2431, a copy of which is attached. That Ordinance set the base
salary of the City Council at $1,189.78 per month.
Government Code Section 36516.5 provides that a change in compensation does not apply to a
councilmember during his or her term in office. However, compensation for all members of the City
Council may be adjusted whenever one or more members become eligible for an increase by virtue
of beginning a new term of office. As a result, adjustments to compensation of councilmembers have
been geared to elections at which members begin a new term in office.
Pursuant to Government Code Section 36516(a)(4), the Council may, by ordinance, increase its
compensation by 5% each calendar year from the date of the last increase in compensation. A 20%
increase in the salary of the City Council would amount to $237.96, for a total of $1,427.74 per
month.

Pursuant to Government Code Section 36516.1, an elected mayor may be provided with
compensation in addition to that which he or she receives as a councilmember, pursuant to an
ordinance or by a vote of the electors at a municipal election. There are no statutory limitations
imposed on the amount of the mayor's compensation. The last salary adjustment for the Mayor
occurred on February 21, 2017, pursuant to Ordinance No. 2017-2431, which set the base salary of
the Mayor at $4,532.13. Historically, the Mayor's salary has been increased by the same percentage
as the salary of the City Council. If the Mayor's compensation were increased by 20%, the Mayor's
monthly salary would be increased by $906.43, for a total monthly amount of $5,438.56.

Proposed Ordinance
A proposed ordinance is attached increasing the salaries of the Mayor and City Council by 20%
and is being submitted for introduction at the December 15, 2020, City Council meeting. If the
City Council wishes to modify the provisions of the ordinance, it is recommended that such
modifications should be acted upon at the time that ordinance is introduced. If modifications are
made at the meeting at which the ordinance is considered for final adoption, it will be necessary
for that ordinance to be re -introduced, with final adoption to occur at a later meeting. Delaying
final adoption of either ordinance in this manner would raise issues regarding the timeliness of the
action under applicable state law.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
ESTABLISHING THE COMPENSATION OF THE MAYOR AND CITY COUNCIL
BE IT ORDAINED by the City Council of the City of National City as follows:
Section 1. That the base monthly compensation for the City Council is
established at $1,427.74 per month, pursuant to the provisions of Sections 36516 and
36516.5 of the California Government Code.
Section 2. That the base monthly compensation for the Mayor is established at
$5,438.56 per month, pursuant to the provisions of Sections 36516.1 of the California
Government Code.

SUBJECT: The Selection of Vice Mayor Procedure per Council Policy No. 120
Appearing on the City Council agenda for the meeting of December 15, 2020, is a resolution
declaring the results of the General Municipal Election held on November 3, 2020.
In a general law city such as National City, the California Government Code, at Section
36801, provides that at the meeting at which the declaration of results for a general
municipal election is made, the City Council shall, following the declaration of the election
results and installation of elected officials, choose one of its members as mayor pro tempore
(referred to in National City as the vice -mayor).
Government Code Section 36802 provides that the mayor shall preside at the meetings of
the City Council; that if the Mayor is absent or unable to act, the mayor pro tempore shall
serve until the mayor returns or is able to act; and that the mayor pro tempore has all of the
powers and duties of the mayor.
On November 20, 2018, the City Council adopted Policy No.120 as the Selection of Vice
Mayor procedure. The express purpose of Policy No.120 is to provide every member of the
City Council with an opportunity to serve as Vice Mayor.
Policy No. 120 provides that the selection is made on the basis of the length of time that a
member has served on the City Council, and whether or not the member has previously
had the opportunity to serve. The Policy provides that the position of Vice Mayor shall be
rotated among the Councilmembers so that each Councilmember serves one (1) year as
Vice Mayor during his/her four (4) year term.
The Policy under paragraph 4 reads as follows:

"4. The Vice Mayor shall be the Councilmember with the most seniority
who has not been Vice Mayor in the last three consecutive years. In the
event two or more Councilmembers have equal seniority and have not
been Vice Mayor in the last three consecutive years, the Councilmember
with the most votes in their last regular general election shall serve as
Vice Mayor."

by approval of a motion in accordance with the Policy.

PURPOSE
In order to provide every member of the City Council with an opportunity to serve as
Vice Mayor, it is the policy of the City Council that selection be made on the basis
of the length of time that a member has served on the City Council, and whether or
not the member has previously had the opportunity to serve.
POLICY
It is the policy of the City Council of the City of National City that the position of Vice
Mayor shall be rotated among the Councilmembers so that each Councilmember
serves one (1) year as Vice Mayor during his/her four (4) year term. The City
Council shall select the Vice Mayor in accordance with the procedure set forth
herein.
1. As a general law city, selection of the Vice Mayor is governed by Sections
36801 and 34905 of the California Government Code. Section 36801
provides:
The city council shall meet at the meeting at which the
declaration of the election results for a general municipal
election is made pursuant to Sections 10262 and 10263 of
the Elections Code and, following the declaration of the
election results and the installation of elected officials,
choose one of its number as mayor, and one of its number
as mayor pro tempore. [Referred to as the "vice mayor" in
National City.]
Because National City has a directly elected Mayor, pursuant to Title 4,
Division 2, Article 3 of the Government Code, the provisions of Section
36801 pertaining to the City Council selecting the Mayor do not apply; the
Council selects only the Vice Mayor.

2. The Vice Mayor shall have the powers and duties as specified in
Government Code Section 36802 which provides that the Mayor shall
preside at the meetings of the City Council and that if the Mayor is absent or
unable to act, the Vice Mayor has all of the powers and duties of the Mayor.
3. The term of Vice Mayor shall be for one year and, in accordance with
Government Code Section 36801, selection of the Vice Mayor shall occur
upon certification of the election results. For purposes of this policy, the
election assumes the general election held in November and certification of
the election results generally occurring in December.
4. The Vice Mayor shall be the Councilmember with the most seniority who has
not been Vice Mayor in the last three consecutive years. In the event two or
more Councilmembers have equal seniority and have not been Vice Mayor
in the last three consecutive years, the Councilmember with the most votes
in their last regular general election shall serve as Vice Mayor.
5. In the event of a vacancy on the City Council that is filled by appointment,
the appointee shall not be included in the rotation for Vice Mayor during the
appointed term of office.
