Currently there are four vacancies on the Building Advisory & Appeals Board. Ms.
Louise Branch and Mr. Tim Moynahan, Jr. have previously been interviewed by the City
Council and served on our Project Area Committee. They both have expressed an
interest to be considered for the above -subject committee.
If there are no objections, I recommend we appoint Ms. Branch and Mr. Moynahan to
the Building Advisory & Appeals Board to serve a full term ending February 28, 2002.
This item will be placed on the Council Agenda for the meeting of September 1 1998.

EXPLANATION.
The applicant proposes to operate an indoor bazaar, a use permitted only with a CUP in the CG Zone. As
shown in the attached plan, the project involves partitioning the floor area for lease to independent retailers of
miscellaneous merchandise.
Council voted to continue the item following discussion and public testimony received during the August 25.
1998 hearing. The attached list of recommended conditions reflects changes in accordance with Council
deliberation, including condition #13 (stricken) and conditions 19-23 (added).
On August 3. 1998, following a public hearing on the matter held July 20, the Planning Commission
unanimously adopted a resolution denying CUP-I998-5.
The applicant filed an appeal on August 4, 1998. asserting a right to own and operate a business and that
the basis for denial is unsubstantiated. The appeal letter also states that the proposed use will benefit the
community.

BACKGROUND
The proposed use would be housed within an existing 25,250 square -foot commercial building,
located immediately south of the Fedco shopping center at 1320 Highland Avenue. This building
has been vacant since the previous occupant. a Lucky Market, closed in June 1997.
Commercial uses. including those within the Fedco center and those in the South Bay Plaza. exist
to the north and east. The latter includes Price Breakers, an existing indoor bazaar use. Areas south
of the subject site. across E. 14th Street, are developed with multi -family residential uses, and
commercial uses fronting on Highland Avenue. To the west, across "F" Avenue and Kimble Way,
are areas with both multi -family and single-family dwellings.
A sufficient number of parking spaces (256) are provided on site to accommodate the proposed use
in conformance with the Land Use Code. Seventy-seven parking spaces in excess of that required
for the shopping center are provided.
At the hearing, the Commission expressed concern over the potential for an over -concentration of
similar uses in the vicinity and in the City at large, noting the existence of Price Breakers. the City's
outdoor swap meet, and the recent proliferation of 99-cent stores in the City. These concerns were
echoed by a resident who spoke in opposition to the project.
The Commission also determined that approval of the proposed use would be contrary to General
Plan policies which encourage high -quality retail business development, seek to improve the
diversity and quality of the City's economic environment. and promote preservation and
strengthening of existing commercial uses.
This determination was made following consideration of a staff report which characterized the type
of commercial uses operating. within indoor bazaars as typically similar to those within an outdoor
swap meet. These facilities often provide a wide array of bargain products. of a quality below what
might generally be expected at a single -tenant department store. There is also an inherent degree of
instability associated with these types of facilities in that they sometimes accommodate marginally
profitable businesses. Such businesses often lack the wherewithal to guarantee the products they
sell and may fail to provide accountability. This presents a certain degree of risk to the consumer.
Also. concerns were expressed related to expected management problems and compliance with
conditions. These were based on information regarding a July 15 visit to the site by staff. On this
date. the proposed bazaar use was found in operation. despite staff having explicitly and repeatedly
advised the applicant that operating such a use prior to issuance of the required CUP is a violation
of the Municipal Code. During this visit. numerous merchants stationed at their respective stalls
were observed. each exhibiting a wide array of for -sale merchandise. Significant tenant
improvement work had also been completed by this time. including the installation of counters and
partition walls in areas throughout the building. Moreover. each of the more than ten tenants doing
business on the day staff visited the site were operating without the required City business license.
Mr. Chu was instructed to cease operations immediately.
This followed the recent issuance of a business license to the applicant for a single -tenant general
merchandise store. a use permitted by right in the zone. N Ir. Chu advised staff that he intended to
open this business. ("Highland Man"). in the interim processin period for the requested CUP. and
that he would continue to operate it if his CUP request is denied.
The proposed facility requires adequate management to ensure smooth and successful operations.
There is significant potential for violations to occur. due to the number and volatility of tenants
which may or may not be familiar with City codes and regulations. A good -faith relationship
between the operators of such a use and the City is particularly desirable.
If the CUP were approved, it would authorize multi -vendor use of the building only in substantial
conformance with the configuration shown on the proposed plans, and only those uses permitted by
right in the CG Zone. In order to avoid any potential unsightly and/or incompatible display of signs
related to the various vendors operating within the building, a recommended condition of approval
would limit the number of signs to one primary identification sign, and one small sign (under 25 sq.
ft.) on each wall. Also. two pole signs exist on site, one of which relates to the subject building.
Permits to install one channel letter wall sign and to re -face an existing freestanding cabinet sign
were recently issued to Mr. Chu. The signs were approved with the understanding that they would
correspond with the single -tenant "Highland Mart" business mentioned above. No additional signs
are proposed at this time.
Other recommended conditions for possible approval would restrict hours of operation to those
proposed: 10:00 a.m. to 8:00 p.m. Monday through Saturday and 10:00 a.m. to 6:00 p.m. on
Sundays. The sale of used merchandise would also be prohibited.
A letter from the subject property owner, Ernest Peterson. was received on August 17. The letter.
provided as an attachment. states an objection to recommended condition of approval number 13.
The condition would require that the driveway providing access between the subject property and
the Fedco shopping center property be made accessible if and when such access is made feasible by
improvements on the Fedco property.

Just because this builcing will be used as a bazaar dces not mean that infencr quality products will be
sold in a run-down atmoscnere. I intend to lease to vendors wne sell quality goods and services at a
reasonable pnce. It has been said that The dty has enough of this type of business.' This has teen
said from the standceint of pecole who earn a larger income than the average National C;ty resident.
The truth is. there are not enough businesses in Naticnai City which provide dependable cr cducs at
affordable prices. and I intend to help contribute to the City by doing rust that. In addition to the
commercial impact. this business will significantly contribute to employment in National C;ty.

and the applicant's lack of relevant business experience and failure to abide by City
regulations in establishing the proposed use demonstrates a lack of management expertise.
RECOMMENDED FINDINGS FOR APPROVAL,
That the site for the proposed use is adequate in size and shape. since the use would be
established in an existing commercial building with adequate floor space to accommodate
the type of business proposed: and a sufficient number of on -site parking spaces are
available.
That the site has sufficient access to streets and highways that are adequate in width and
pavement type to carry the volume and type of traffic generated by the proposed use. since
access to the property is provided along Highland Avenue and E. 14th Street: and the use is
expected to generate traffic commensurate with the previously existing use and the intended
use of the structure.
3. That the proposed use will not have an adverse effect upon adjacent or abutting properties.
since it would be compatible with the primarily commercial uses surrounding the property.
is adequately buffered from adjacent residential uses. and would generally conform with the
previously existing use of the site.
4. That the proposed use is deemed essential and desirable to the public convenience and
welfare. since the use supports General Plan policies intended to help expand employment
opportunities and which encourage businesses to locate in the City. where compatible with
existing development. In addition the proposal will utilize a large vacant building.
RECOMMENDED CONDITIONS OF APPROVAL
I. A sewer permit and/or payment of additional sewer fees may be required. The applicant shall
submit a site plan to the Engineering Department showing existing sewer laterals and provide
evidence of sewer connection.
2. The deteriorated portions of existing right-of-way improvements along the property's street
frontages and as marked in the field, shall be removed and replaced. including approximately
471 square feet of sidewalk. 44 lineal feet of curb and gutter, and 150 square feet of driveway
along E. 14th Street; and 342 square feet of sidewalk along Highland Avenue. Other areas with
chipped, broken, or cracked concrete surfaces shall receive epoxy patching. Raised edges shall
be grinded to eliminate trip hn7nrds. In lieu of removal, and as directed by the City Engineering
Department, marked areas, including two driveway areas along E. 14th Street, may be grinded.
All affected "no parking" zones shall be repainted red after completion of work.
3. Existing catch basins on -site shall be provided with a "No Dumping" tile in accordance with the
NPDES program.
4. A permit shall be obtained from the Engineering Department for all improvement work within
the public right-of-way.
5. A performance bond acceptable to the City attorney and inspection deposit for all street
improvement work shall be posted prior to approval of any building permits.
6. Tenant improvement plans must conform with the 1994 Editions of the Uniform Building
Code. Uniform Mechanical Code, and Uniform Plumbing Code; the 1993 Edition of the
National Electrical Code; and State Title 24 handicapped and energy regulations.
7. The applicant shall. upon the issuance of required signbuilding permits, be permitted to install
a maximum of one primary identification sign per street frontage. in conformance with National
City Municipal Code Section 13.62.100 - Permanent On -site Advertising in Commercial and
Manufacturing Zones, plus one additional sign with a maximum area of 25 square feet per street
frontage. This condition shall supersede the provisions of N.C.M.C. Section 18.16.130 - Small
Permanent Signs in Commercial and Manufacturing Zones. and 18.62.150 - Small Temporary
Window Signs in Commercial and Manufacturing Zones.
8. The west facing exterior wall of the subject building shall re -painted and treated with "Graffiti
Melt Coating" manufactured by Genesis Coatings. Inc. A similar product may be used, subject
to approval from the Building and Safety Director. Graffiti shall be removed within 24 hours of
its observance.
9. The use may open for business only between the hours of 10:00 a.m. and 3:00 p.m. Monday
through Saturday, and between 10:00 am and 6:00 p.m. on Sundays. Merchandise delivery.

9:00 p.m. Monday through Saturday and between 10:00 p.m. and 6:00 p.m. on Sundays.
10. The sale of used merchandise shall not be permitted.
19. Evidence shall be provided to the satisfaction or' the Planning Department that reciprocal
parking and access agreements are recorded to maintain parking for the proposed use.

14. Except as required by conditions of approval, tenant improvement plans shall be submitted for
review and approval by the Planning Director in conformance with Exhibit A. Case File No.
CUP-1998-5, dated 05/28/98.
15. Before this Conditional Use Permit shall become effective, both the applicant and the property
owner shall sign and have notarized an Acceptance Form, provided by the Planning
Department, acknowledging and accepting all conditions imposed upon the approval of this
permit. Failure to return the signed and notarized Acceptance Form within 30 days of its
receipt shall automatically terminate the • Conditional Use Permit. The applicant shall also
submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real
Property is recorded with the County Recorder. The applicant shall pay necessary recording
fees to the County. The Notice of Restriction shall provide information that conditions imposed
by approval of Conditional Use Permit No. 1998-5 are binding on all present or future interest
holders or estate holders of the property. The Notice of Restriction shall be approved as to form
by the City Attorney and signed by the Planning Director prior to recordation.
16. Use of the property as authorized by this Conditional Use Permit shall be limited to the
operation of an indoor bazaar in conformance with all provisions of the National City
Municipal Code. excepting those provisions specifically superseded by adopted conditions of
approval.
17. This permit shall become null and void if not exercised within one year after adoption of the
resolution of approval unless extended according to procedures specified in Section 18.116.190
of the Municipal Code.
18. This permit shall expire if the use authorized by this resolution is discontinued for a period of
twelve months or longer. This permit may also be revoked. pursuant to provisions of the Land
Use Code, if discontinued for any lesser period of time.
19. Outdoor vending machines shall be prohibited.
20. On -premise food and drink sales shall be prohibited. except from vending machines.
21. Space within the facility shall be made available to individual retailers only upon execution of
lease agreements with a minimum term of one year.
22. Each prospective retailer within the facility shall be required to obtain a City business license
prior to operation.
23. The height of dispiayedistored merchandise located within ten feet of windows shall not exceed
the sill height of such windows.

EXPLANATION
At the June 16, 1998, City Council meeting, the Council directed that a public hearng be scheduled to
receive public comment regarding changing the name of 24th Street between National City Boulevard
and Interstate 5, and between Interstate 5 and Terminal Avenue. Attachment A is a copy of the Notice
of Public Hearing which was mailed to all owners of property abutting 24th Street between National City
Boulevard and Terminal Avenue. In addition, a copy of the Notice of Public Hearing was posted on
each side of 24th Street between National City Boulevard and Terminal Avenue at '/-mile intervals.
Attachment B is a map showing the area of the proposed street name change, and a list of the owners of
properties abutting 24t Street between National City Boulevard and Terminal Avenue. Attachment C
a copy of a memorandum from the City Engineer which discusses cost issues associated with the
proposed street name change. Attachment D is a copy of a memorandum from :he Building & Safety
Director detailing the procedures for changing name of a city street.
Should :he City Council be desirous of proceeding with the street name change at the conclusion of :he
pubiic hearing, the next step would be for the Council to direct staff to prepare a resolution for its
consideration approving the name change.

The following are the administrative procedures for chancing the name of a street:
Step 1:
City Council sets a date and time for a public hearing on the proposal.
with sufficient lead time to allow the completion of Steps 2 and 3
(typically 20 to 30 days in advance).
Step 2: Building & Safety sends a Notice of Public Hearing to all owners and
tenants alone the affected street at least 10 days before date of hearing.
Step 3: Public Works posts a copy of the Notice of Public Hearing on each side of
the street at 'A mile intervals, but not less than 3 notices on each side.
Step 4: City Council conducts public hearing and. if desired, adopts a r esch. Lion
with a recommended 60-day lead effective date.

Explanation:
The City of National City's sewage transportation and treatment cost to the City of San
Diego Metro is based primarily on the quantity of sanitary sewer flows transported to the
City of San Diego for treatment.
Public Works has concerns on the accuracy and validity of sanitary sewer flows currently
being measured by San Diego with the existing ADS flow monitoring equipment.
To satisfy our concerns. Public Works proposes to have MGD. the only other independent
flow measurement company in San Diego, install their flow recorders to measure the
sanitary sewer flows at four (4) key locations (NC3. NCS, NC7, and NC10) for a 30-day
period.
We also have concerns about the editing of the raw data supplied to San Diego by the
ADS meters. MGD will do a comparative analysis of obtained data and compare it with
past data supplied to National City by San Diego.
The end result of this study will permit National City to either agree with past flow
quantities billed by Metro, or provide a solid irrefutable basis for requiring Metro to re -bill
for excessive flows charged. The award amount of this study is S14,630.00
This is a negotiated, professional services contract that has been tailored to meet the
specific needs of National City. MGD Technologies Inc. is the only firm in the area other
than ADS (the current metering firm) with significant experience with this technology, and
hence the contract is with MGD Technology Inc.

RESOLUTION OF 1111, CITY COUNCIL OF
THE CITY OF NATIONAL CITY AUTHORIZING
THE MAYOR TO EXECUTE A NEGOTIATED

WHEREAS, the City has reasonable doubt as to the accuracy of sewer flow
quantities being billed by San Diego Metro; and
WHEREAS, independent concurrent measurement of sewer flows at select
locations will provide a solid basis for agreeing or refuting such billings; and
WHEREAS, MGD Technologies is the only firm in the area other than the
current metering firm with adequate experience and technology to provide comparative
measurement of flows.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the Mayor is authorized to execute a negotiated professional services
contract with MGD Technologies for sewer metering at select locations, in the amount of

UNDERSTANDING OF THE PROJECT
MGD Technologies Inc. (MGD) understands the city of National City (City) wastewater billing
is based on the quantity of sanitary sewer flows transported to the City by other agencies and the
amount of sanitary sewer flows transported to the city of San Diego. The City has concerns on the
accuracy and validity of sanitary sewer flows currently being measured by existing flow monitoring
equipment. To satisfy it's concerns, the City has decided to have MGD, an independent flow
measurement company, measure, confirm and validate the sanitary sewer flows at four (4) key
locations (NC3, NC5, NC7, and NC10) which are currently being flow monitored. We also
understand that the City has particular concerns at one of the sites, identified as NC3 which is a 30"
diameter pipe.
The flow data measured by MGD will be used by the City to confirm and validate flow
measurements of the existing flow monitors.
To insure accurate data at NC3 and the other locations depending on hydraulic conditions,
MGD proposes to install an ADFM Velocity Profiler (ADFM). The ADFM uses advanced pulse
Doppler technology to accurately measure velocities at multiple points throughout the wetted cross-
section. Pulse Doppler technology allows much more accurate velocity measurement, thus more
accurate flow rate computations than the typical continuous wave Doppler systems. The ADFM is
unique because it is the only Doppler flow meter that uses velocity profiling technology to accurately
measure flow rate. This technology is not susceptible to the sources of measurement error that
traditional Doppler systems suffer from when installed in large pipes. In addition, the ADFM does
not require an in -situ calibration. This removes the dependence of accuracy on the continued
presence of highly trained staff to insure proper meter calibration. The ADFM is virtually
maintenance free.
In order to obtain a solid understanding of the flow rates at these sites. and to quantify the
net flow, MGD recommends that the flow monitoring duration be one -month (3Gdays).
CITY RESPONSIBILITES
The City shall provide the following in advance of MGD field activities to accomplish the
base scope of service:
n field locate and open manhole cover(s) at proposed flow monitoring location(s)
n clearing of debris, if necessary, at proposed flow monitoring ;ccaticn(s)
• provide engineering maps of the monitoring location(s) shall be provided to
MGD
n provide a list of the monitoring locations) with pipe diameter identified shall be
provided to MGD at least 1-week prior to mobilization to the project site
(imperative for preparing sensor flow monitoring equipment)
The City shall provide the following at the time of MGD field activities to accomplish the
base scope of services:

DELIVERABLES
MGD will deliver the following:
a two (2) copies of a flow monitoring data report which will include hydrographs of
the data (flow rate, average velocity, and depth) in 1-hour increments; tabular
ouut of the data in 1-hour increments including daily average, peak flow rate,
and minimum flow rate; electronic version of all data in 15-minute increments,
provided in a CSV format
n Comparative analysis of data obtained by MGD and data obtained by the
presentiy installed flow monitor at NC3. This analysis will include an assessment
of the quality of the data from each flow monitor. This analysis will be included in
the main report.
FLOW MONITORING EQUIPMENT
The flow monitoring equipment provided by MGD shall be suitable for open channel sewer
flow monitoring. MGD will use portable, battery -powered area -velocity flow monitoring equipment at
all flow monitoring locations.
For small diameter pipes (<24" diameter), flow monitoring equipment will be American
Sigma model 920 cr 950 flow monitors, with level and velocity sensors. These flow monitors use
bubbler or pressure sensor technology for level measurement, and continuous wave Doppler
technology for velcc:ty measurement. Flow monitors will be programmed to record measured flow
depth and velocity at no greater than 5-minute intervals.
For large diameter pipes (24" diameter), MGD may substitute the ADFM flow monitor for
the American Sigma flow monitors in pipe diameters larger than 24" if hydraulic conditions permit
(typical minimum depth no less than 8"). The ADFM uses advanced pulse Doppler technology to
accurately measure velocities at multiple points throughout the wetted cross-section. Pulse Doppler
technology allows much more accurate velocity measurement, thus more aerate flow rate
computations than the typical continuous wave Doppler systems. We will use the ADFM wherever
hydraulic conditions permit
SAFETY
MGD shad assign personnel to the project who are trained in flow monitoring, familiar with
working in the fiend. trained in safe traffic control, and certified confined space access procedures.
A 2-person field crew is nominally required for safe confined space access (manhole entry) Per CA -
OSHA and OSHA regulation.

MGD will provide limited traffic control setup with cones and signs, as required.
MGD shall be fully responsible for its own safety while on the job. MGD personnel shall
comply with City, County, State and Federal requirements.
SPECIFIC EXCLUSIONS
MGD specifically excludes the following work tasks necessary to accomplish the base
scope of service:
heavy traffic control is NOT provided by MGD. Heavy traffic control includes light
arrow boards, cones, traffic plans, etc.
n searching for manhole(s)
n uncovering manhole(s)
x- field visit(s) to the flow monitoring location(s) between scheduled visits
moving flow monitors once installed
n provision of more than a 2-person field crew
D permits, fees, license, etc. required by the City
a data loss due to events beyond MGD's control
FEE SCHEDULE
MGD's fee for the flow monitoring services as described in this proposal is S14.c30.00. At
the end of the initial month long monitoring period, the City may elect to continue monitoring cn a
weekly basis, at $1750.00 per week.
If the City decides to convert the ADFM at NC3 into a permanent installation, the
balance due will be $14,980.00. MGD will inspect The installation, and make any required
changes to insure that the system is properly installed as a permanent site. MGD will provide
the City with WinADFM, the ADFM proprietary software package, as well as all Technical
Manuals. In addition, MGD will provide one (1) day of training on the operation, data collection
and analysis of ADFM data. If the City wishes to install AC power and telemetry, MGD can
provide a price quote for these services at that time.
WORK SCHEDULE

receipt of a written Notice -to -Proceed (NTP)

AGREEMENT
BY AND BETWEEN
THE CITY OF NATIONAL CITY
AND
MGC TECHNCLOG[ES, INC.
THIS AGREEMENT is entered into this 1st day of September
1998 , by and between the CITY OF NATIONAL CITY, a municipal corporation
(the "City"), and f4GC TECHNOLCGIES. INC. , (the "CONTRAC-
TOR").
RECITALS
WHEREAS, the CITY desires to employ a CONTRACTOR to
pr0vi'ie T.easurements cf sanitary sewer flows in se'ec- .cations.
WHEREAS, the CITY has determined that the CONTRACTOR is a
exDer- and is qualified by experience
and ability to perform the services desired by the CITY, and the CONTRACTOR
is willing to perform such services.
NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE
AS FOLLOWS:
1. ENGAGEMENT OF CONTRACTOR. The CITY hereby agrees
to engage the CONTRACTOR and the CONTRACTOR hereby agrees to perform
the services hereinafter set forth in accordance with all terms and conditions
contained herein.

The CONTRACTOR represents that all services required hereunder
will be performed directly by the CONTRACTOR or under direct supervision of
the CONTRACTOR.
2. SCOPE OF SERVICES. The CONTRACTOR will perform
services as set forth in the attached Exhibit

The CONTRACTOR shall be responsible for all research and reviews
related to the work and shall not rely on personnel of the CITY for such
services, except as authorized in advance by the CITY. The CONTRACTOR
shall appear at meetings cited in Exhibit to keel staff and City Ceunc
advised of the progress on the project.
The CITY may unilaterally, or upon request from the CONTRACTOR,
from time to time reduce the Scope of Services to be performed by the
CONTRACTOR under this Agreement. Upon doinc so, the CITY and the
CONTRACTOR agree to meet in goad faith and confer for the purpose of
negotiating a corresponding reduction in the compensatior associated with said
reduction in services.
3. PROJECT COORDINATION AND SUPERVISION.
Joe Srn hereby is designated as the Project
Coordinator for the CITY and will monitor the progress and execution of this
Agreement. The CONTRACTOR shall assign a single Project Director to provide
supervision and have overall responsibility for the progress and execution of this

Agreement for the CONTRACTOR. Mike Metcalf hereby is
designated as the Project Director for the CONTRACTOR.
4. COMPENSATION AND PAYMENT. The compensation for the
CONTRACTOR shall be based on monthly billings covering actual work
performed. Billings shall include labor classifications, respective rates, hours
worked and also materials, if any. The total cost for all work described in
Exhibit shall not exceed the schedule given in Exhibit without prior
written authorization from Ai& C. R. 'r!i 1 1 i ams . r.
Monthly invoices will be processed for payment and remitted within
thirty (30) days from receipt of invoice, provided that work is accomplished
consistent with Exhibit a as determined by the CITY.
The CONTRACTOR shall maintain all books, documents, papers,
employee time sheets, accounting records, and other evidence pertaining to
costs incurred and shail make such materials available at its office at all
reasonable times during the term of this Agreement and for three (3) years from
the date of final payment under this Agreement, for inspection by the CITY and
for furnishing of copies to the CITY, if requested.
5. LENGTH OF AGREEMENT. Completion dates or time
durations for specific portions of the Project are set forth in Exhibit
6. DISPOSITION OF DOCUMENTS. The Memoranda, Reports,
Maps, Crawincs, Plans, Specifications and ether documents prepared by the
CONTRACTOR for this Project shall become the property cf the CITY for use

solely with respect to this Project, and shall be turned over to :-.e CITY upon
completion of the Project, or any phase thereof, contemplated by this
Agreement.
7. INDEPENDENT CONTRACTOR. Both parties hereto in the
performance of this Agreement will be acting in an independent capacity and
not as agents, employees, partners or joint venturers with one another. The
CONTRACTOR is not an employee of the CITY and is not entitled to any of the
rights, benefits, or privileges of the CITY's employees, includinc but not limited
to medical, unemployment, or workers' compensation insurance.
This Agreement contemplates the personal seriices of the
CONTRACTOR and the CONTRACTOR's employees, and it is rec:cnized cy the
parties that a substantial inducement to the CITY for entering into this
Agreement was, and is, the professional reputation and competence of the
CONTRACTOR and its employees. Neither this Agreement nor any interest
herein may be assigned by the CONTRACTOR without the prior written consent
of the CITY. Nothing herein contained is intended to prevent the CONTRAC-
TOR from employing or hiring as many employees as the CONTRACTOR may
deem necessary for the proper and efficient performance of this Agreement.
8. CONTROL. Neither the CITY nor its officers, agents cr
employees shall have any control over the conduct of the CONTRACTOR cr any
of the CON T RAC OR's employees except as herein set forth, and the
CONTRACTOR expressly agrees not to represent that the CONTRACTOR cr the

CONTRACTOR's agents, servants, or employees are in any manner agents,
servants or employees of the CITY, it being understood that the CONTRACTOR,
its agents, servants, and employees are as to the CITY wholly independent
contractors and that the CONTRACTOR's obligations to the CITY are solely
such as are prescribed by this Agreement.
9. COMPLIANCE WITH APPLICABLE LAW. The CONTRACTOR,
in the performance of the services to be provided herein, shall comply with all
State and Federal statutes and regulations, and all ordinances, rules and
regulations of the City of National City whether now in force or subsequently
enacted. The CONTRACTOR, and its subcontractors, shall obtain a current City
of National City business license prior to performing any work within the City.
10. LICENSES, PERMITS, ETC. The CONTRACTOR represents
and covenants that it has all licenses, permits, qualifications, and approvals of
whatever nature that are legally required to practice its profession. The
CONTRACTOR represents and covenants that the CONTRACTOR shall, at its
sole cost and expense, keep in effect at all times during the term of this
Agreement, any license, permit, or approval which is legally required for the
CONTRACTOR to practice its profession.
1 1 . STANDARD OF CARE. The CONTRACTOR, in performing any
services under this Agreement, shall perform in a manner consistent with that
level of care and skill ordinarily exercised by members of the profession
currently practicing under similar conditions and in similar locations.

12. NON-DISCRIMINATION PROVISIONS. The CONTR,=.2TOR
will not discriminate against any employee or applicant for employment because
of age, race, color, ancestry, religion, sex, sexual orientation, marital status,
national origin, physical handicap, or medical condition. The CONTRACTOR will
take positive action to insure that applicants are employed without regard to
their age, race, color, ancestry, religion, sex, sexual orientation, marital status,
national origin, physical handicap, or medical condition. Such action shall
include but not be limited to the following: employment, upgrading, demotion,
transfer, recruitment or recruitment advertising, layoff or termination„ razes of
pay or other forms of compensation, and selection for trair.inc, ir ciuting
apprenticeship. The CONTRACTOR agrees to post in conspicuous pieces
available to employees and applicants for employment any notices prcviced by
the CITY setting forth the provisions of this non-discrimination clause.
13. CONFIDENTIAL INFORMATION. The CITY may frc.m time to
time communicate to the CONTRACTOR certain confidential irfcrmatcr to
enable the CONTRACTOR to effectively perform the services to be provided
herein. The CONTRACTOR shall treat all such information as confidential and
shall not disclose any part thereof without the prior written consent of the
CITY. The CONTRACTOR shall limit the use and circulation of suchinforma-
tion, even within its own organization„ to the extent necessary to per`crm the
services to be provided herein. The foregoing obligation of th s Secticn
however, shall rot apply to any part of the information that (i) has begin

disclosed in publicly available sources of information; (ii) is, through no fault of
the CONTRACTOR, hereafter disclosed in publicly available sources of
information; (iii) is already in the possession of the CONTRACTOR without any
obligation of confidentiality; or (iv) has been or is hereafter rightfully disclosed
to the CONTRACTOR by a third party, but only to the extent that the use or
disclosure thereof has been or is rightfully authorized by that third party.
The CONTRACTOR shall not disclose any reports, recommenda-
tions, conclusions or other results of the services or the existence of the subject
matter of this Agreement without the prior written consent of the CITY. In its
performance hereunder, the CONTRACTOR shall comply with all legal
oblications it may now or hereafter have respecting the information or other
property of any other person, firm or corporation.
14. HOLD HARMLESS. The CONTRACTOR agrees to indemnify,
defend, and hold harmless the City of National City, its officers, employees and
volunteers, against and from any and all liability, less, damages to property,
injuries to, or death of any person or persons, and all claims, demands, suits,
actions, proceedings, costs or attorneys' fees, of any kind or nature, including
workers' compensation claims, of or by anyone whomsoever, in any way
resulting from or arising out of the CONTRACTOR's performance of this
Agreement.
15. WORKERS' COMPENSATION. The CONTRACTOR shall
comply with all of the provisions of the Workers' Compensation Insurance and

Safety Acts of the State of California, the applicable provisions of Division 4
and 5 of the California Government Code and all amendments thereto; and all
similar state or Federal acts or laws applicable; and shall indemnify, defend and
hold harmless the CITY and its officers, employees and volunteers from and
against all claims, demands, payments, suits, actions, proceedings and
judgments of every nature and description, including attorney's fees and costs
presented, brought or recovered against the CITY or its officers, employees, or
volunteers, for or on account of any liability under any of said acts which may
be incurred by reason of any work to be performed by the CONTRACTOR under
this Agreement.
16. INSURANCE. The CONTRACTOR, at its sole cost and
expense, shall purchase and maintain throughout the term of this agreement,
the following insurance policies:
a. Professional liability insurance with minimum limits of
$ 1 ,000,000 per occurrence.
b. Automobile insurance covering all bodily injury and property
damage incurred during the performance of this Agreement, with a minimum
coverage of $500,000 combined single limit per accident. Such automobile
insurance shall include non -owned vehicles.
c. Comprehensive general liability insurance, with minimum
limits of $1,000,CCO combined single limit per occurrence, covering all bodily
injury and property damage arising out of its operation under this Agreement.

d. Workers' compensation insurance covering all of its employ-
ees and volunteers.
e. The aforesaid policies shall constitute primary insurance as to
the CITY, its officers, employees, and volunteers, so that any other policies held
by the CITY shall not contribute to any loss under said insurance. Said policies
shall provide for thirty (30) days prior written notice to the CITY of cancellation
or material change.
f. Said policies, except for the professional liability and worker's
compensation policies, shall name the CITY and its officers, agents and
employees as additional insureds.
g.
This Agreement shall not take effect until certificate(s) or
other sufficient proof that these insurance provisions have been complied with,
are filed with and approved by the CITY's Risk Manager. If the CONTRACTOR
does not keep all of such insurance policies in full force and effect at all times
during the terms cf this Agreement, the CITY may elect to treat the failure to
maintain the requisite insurance as a breach of this Agreement and terminate
the Agreement as provided herein.
h. If required insurance coverage is provided on a "claims made"
rather than 'occurrence" form, the CONTRACTOR shall maintain such insurance
coverage for three years after expiration of the term (and any extensions) of
this Acreement.

Any aggregate insurance limits must apply solely to this
Agreement.
1 7. LEGAL FEES. If any party brings a suit or action against the
other party arising from any breach of any of the covenants or agreements or
any inaccuracies in any of the representations and warranties on the part of the
other party arising out of this Agreement, then in that event, the prevailing
party in such action or dispute, whether by final judgment or out -of -court
settlement, shall be entitled to have and recover of and from the other party all
costs and expenses of suit, including actual attorneys' fees.
18. MEDIATION/ARBITRATION. 1f a dispute arises out cf or
relates to this Agreement, or the breach thereof, the parties acree first tc try,
in good faith, to settle the dispute by mediation in San Diego, California, in
accordance with the Commercial Mediation Rules of the American Arbitration
Association the ("AAA") before resorting to arbitration. The costs of mediation
shall be borne equally by the parties. Any controversy or claim arising cut of,
or relating to, this Agreement, or breach thereof, which is not resolved by
mediation shall be settled by arbitration in San Diego, California, in accordance
with the Commercial Arbitration Rules of the AAA then existing. Any award
rendered shall be final and conclusive upon the parties, and a judgment thereon
may be entered in any court having jurisdiction over the subject matter of the
controversy. The expenses of the arbitration shall be borne equally by the
parties tc the arbitration, provided that each party shall pay fcr and bear the

ccsts of its own experts, evidence and attorneys' fees, except that the
arbitrator may assess such expenses or any part thereof against a specified
party as part of the arbitration award.
19. TERMINATION. This Agreement may be terminated with or
without cause by the CITY. Termination without cause shall be effective only
upon 60-day written notice to the CONTRACTOR. During said 60-day period
the CONTRACTOR shall perform all services in accordance with this Agree-
ment.
This Agreement may also be terminated immediately by the CITY
for cause in the event of a material breach cf this Agreement, misrepresentation
by the CONTRACTOR in connection with the formation of this Agreement or
the performance of services, or the failure to perform services as directed by
the CITY.
Termination with or without cause shall be effected by deliver/ of
written Notice of Termination to the CONTRACTOR as provided for herein.
In the event of termination, all finished or unfinished Memoranda
Reports, Macs, Drawings, Plans, Specifications and other documents prepared
by the CONTRACTOR shall become the property of and be delivered to the
CITY, and the CONTRACTOR shall be entitled to receive just and equitable
compensation for any work satisfactorily completed on such documents and
other ,materials up to the effective date of the Notice of Termination, not to

exceed the amounts payable hereunder, and less any damages caused the CITY
by the CONTRACTOR's breach, if any.
20. NOTICES. All notices or other communications required or
permitted hereunder shall be in writing, and shall be personally delivered; or
sent by overnight mail (Federal Express or the like); or sent by registered or
certified mail, postage prepaid, return receipt requested; or sent by ordinary
mail, postage prepaid; or telegraphed or cabled; or delivered or sent by telex,
telecopy, facsimile or fax; and shall be deemed received upon the earlier of (i)
if personally delivered, the date of delivery to the address of the person to
receive such notice, (ii) if sent by overnight mail, the business day following its
deposit in such overnight mail facility, (iii) if mailed by registered, certified or
ordinary mail, five (5) days (ten (10) days if the address is outside the State of
California) after the date of deposit in a post office, mailbox, mail chute, or
other like facility regularly maintained by the United States Postal Service, (iv)
if given by telegraph or cable, when delivered to the telegraph company with
charges prepaid, cr (v) if given by telex, telecopy, facsimile or fax, when sent.

Notice of change of address shall be given by written notice in the
manner specified in this Section. Rejection or other refusal to accept or the
inability to deliver because of changed address of which no notice was given
shall be deemed to constitute receipt of the notice, demand, request or
communication sent. Any notice, request, demand, direction or other
communication sent by cable, telex, telecopy, facsimile or fax must be
confirmed within forty-eight (48) hours by letter mailed or delivered as specified
in this Secticn.
21. CONFLICT OF INTEREST AND POLITICAL REFORM ACT
OBLIGATIONS. Curing the term of this Agreement, the CONTRACTOR shall not
perform services of any kind for any person or entity whose interests conflict
in any way with those of the City of National City. The CONTRACTOR shall at
ail times comply with the terms of the Political Reform Act and the National

City Conflict of Interest Code. The CONTRACTOR shall immediately disqualify
itself and shall not use its official position to influence in any way any matter
coming before the CITY in which the CONTRACTOR has a financial interest as
defined in Government Code Section 87103. The CONTRACTOR represents
that it has no knowledge of any financial interests which would require it to
disqualify itself from any matter on which it might perform services for the
CITY.
The CONTRACTOR shall comply with all of the reporting require-
ments of the Political Reform Act and National City regulations. Specifically,
the CONTRACTOR shall file Statements of Economic Interest with the City
Clerk of the City of National City in a timely manner on forms which the
CONTRACTOR shall obtain from the City Clerk, if required by the National City
Conflict of Interest Code as determined by the City Attorney of the City of
National City.
22. MISCELLANEOUS PROVISIONS.
a. Computation of Time Periods. If any date or time period
provided for in this Agreement is or ends on a Saturday, Sunday or federal,
state or legal holiday, then such date shall automatically be extended until 5:00
p.m. Pacific Time of the next day which is not a Saturday, Sunday or federal,
state or legal holiday.

b. Counterparts. This Agreement may be executed in multiple
counterparts, each of which shall be deemed an original, but all of which,
together, shall constitute but one and the same instrument.
c. Captions. Any captions to, or headings of, the sections or
subsections of this Agreement are solely for the convenience of the parties
hereto, are not a par of this Agreement, and shall not be used for the
interpretation or determination of the validity of this Agreement or any provision
hereof.
d. No Obligations to Third Parties. Except as otherwise
expressly provided herein, the execution and delivery of this Agreement shall
not be deemed to confer any rights upon, or obligate any of the parties hereto,
to any person or entity other than the parties hereto.
e. Exhicits and Schedules. The Exhibits and Schedules attached
hereto are hereby incorporated herein by this reference for all purposes.
f. Amendment to this Agreement. The terms of this Agreement
may not be modified or amended except by an instrument in writing executed
by each of the parties hereto.
g-
Waiver. The waiver or failure to enforce any provision of this
Agreement shall not operate as a waiver of any future breach of any such
provision or any other provision hereof.
h. Apciic3cle Law. This Agreement shall be governed by and
construed in accordance with the laws of the State of California.

i. Entire Agreement. This Agreement supersedes any prior
agreements, negotiations and communications, oral or written, and contains the
entire agreement between the parties as to the subject matter hereof. No
subsequent agreement, representation, or promise made by either party hereto,
or by or to an employee, officer, agent or representative of any party hereto
shall be of any effect unless it is in writing and executed by the party to be
bound thereby.
J.
Successors and Assigns. This Agreement shall be binding
upon and shall inure to the benefit of the successors and assigns of the parties
hereto.
k. Construction. The parties acknowledge and agree that (I)
each party is of equal bargaining strength, (ii) each party has actively
participated in the drafting, preparation and negotiation of this Agreement, (iii)
each such party has consulted with or has had the opportunity to consult with
its own, independent counsel and such other professional advisors as such
party has deemed appropriate, relative to any and all matters contemplated
under this Agreement, (iv) each party and such party's counsel and advisors
have reviewed this Agreement, (v) each party has agreed to enter into this
Agreement following such review and the rendering of such advice, and (vi) any
rule or construction to the effect that ambiguities are to be resolved against the
drafting party shall not apply in the interpretation of this Agreement, or any
portions hereof, or any amendments hereto.

I BACKGROUND
The Accounting Records Supervisor is a key management position in the Finance Department. This
position is responsible for the day to day supervision of the Information Services Division staff in payroll.
accounts payable and transit. Being a critical position, it cannot be done by an entry level accountant. It
requires a degreed professional to cam out a higher level of accounting inorder to complete the task.
Aside from the supervision of three accounting sections, this position is also involved in the following
functions:
I. Monitor the general ledger to verify that funding allocations are appropriate and that cash controlled
accounts are updated. Research and determine any journal entries that are necessary.
2. Monitor budget balances. Research budget deficits to determine the source of the deficit and notify
departments if necessary.
3. Responsible for all transit accounting, including reporting requirements.
4. Perform cash reconciliations and prepare cash reports.
5. Maintain fixed asset records.
6. Reconcile numerous general ledger accounts (Trust & Agency accounts. withholding accounts. etc.)
7. Prepare year end adjustments, audit schedules, and financial statements.
8. Responsible for all grant accounting and reporting (except CDBG).
9. Responsible for internal charges.
10.Prepare Prop A maintenance of effort calculations.
I I .Review general ledger for out -of -balance errors.
I2.Assist in budget preparation.
I3.Prepare State Controller's Report and the Street Report.
I4.Prepare monthly accrual journal entries.
I5.Review IBARs for propriety. and prepare adjustments for interfund transfers.
I6.Assist in special projects as assigned.
We have an existing vacancy for this position in the finance department since May 1998. Our initial
recruitment back in June did not get the applicants who would fit our job requirements. We have extended
the recruitment and advertised the job actively even in government publications but were still unsuccessful
in attracting applicants with municipal accounting experience. According to our Personnel Director. the
possible cause for this failure is the salary offered. l then requested him to do a salary survey of other
cities in San Diego. The salary survey he conducted showed that the municipal accountants from other
public agencies that \ce hoped to attract were already earning a higher average salary than what we were
offering as our Supervising Accountant. The highest salary (top step) we can offer is S 3,450/month for the
Accounting Records Supervisor. Non -supervisory accountants from other cities in San Diego County earn
an average top salary of S 3.650:month and the average top salary for Supervisory Accountants is S
4.467.00. Attached is the survey data that was compiled.
II RECOMMENDATION
Recommendation is for the salary band for the position of Accounting Records Supervisor be increased to
S 2,800.00 - S 4.000.00/month. Current salary hand is S S 2.520.00 - S 3.-150.00. This position is
reimbursed 100°o by TDA funds and the total annualized increase amounts to S 6.600.00 in salaries
& S 2.178.00 in benefits.. This salary should be attractive to most municipal accountants and approaches
the average paid by other cities for their comparable positions.

RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY APPROVING AN INCREASE
ADJUSTMENT OF FEE SALARY BAND FOR THE
POSITION OF ACCOUNTING RECORDS SUPERVISOR
WHEREAS, the Accounting Records Supervisor is a key management position
in the Finance Department that is responsible for the day to day supervision of the Information
Services Division staff in payroll, accounts payable and transit; and
WHEREAS, because the City has been unable to attract qualified applicants for
the position of Accounting Records Supervisor, the position has been vacant since May 1998;
and
WHEREAS, a salary survey conducted by the Personnel Director revealed that
the average top salary for an equivalent position in other San Diego County cities is higher
than that offered by the City of National City, indicating the possible reason for the lack of
success in recruiting for this position.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby approves an increase adjustment in the salary band for the position of
Accounting Records Supervisor.

This ordinance amends portions of Title 1 to focus abatement of public nuisances. It adds
provisions to Sections 1.12.030, 1.20.020 and 1.36.080 to accomplish the following:
a) Require remediation of a site where illegal work (work without a permit) is occurring, and;
b) Prohibit issuance of any permits other than those necessary to correct a nuisance violation
during the pendency of any violation.
These additional provisions have been suggested to round out and further improve code enforcement.

ENTRY FOR INSPECTION, CHAPTER 1.20 REGARDING
GENERAL PENALTY, AND CHAPTER 1.36
REGARDING ABATEMENT OF A PUBLIC NUISANCE
BE IT ORDAINED by the City Council of the City of National City that the
National City Municipal Code be amended as follows:
Section 1. That Title 1, Chapter 1.12, Section 1.12.030 of the National City
Municipal Code is amended to read as follows:
1.12.030 Stop Orders. A. Scope. This section applies to any work,
construction, development or land grading for which a permit is required and has not been
obtained.
B. Definition. A "Stop Order" is a written notice directed to one or more persons
directing them to cease and desist immediately from continuing or performing work,
construction or development for which a permit is required but has not been obtained, or
for which a permit was issued, but the performance under which was contrary to the terms
of the issued permit or law or regulation.
C. Issuance of Stop Order. A public officer charged with the enforcement of the
Municipal Code or State law may issue a Stop Order to any person who is performing
work or allowing work to occur in violation of law or the Municipal Code. The Stop
Order may be issued to any employee, agent or contractor on site who is actually
performing the work. All work must immediately stop upon service, or posting of the
Stop Order, or both, and shall not proceed again until authorized.
D. Posting of Stop Order. One copy of the Stop Order shall be posted
conspicuously at the entrance to the site, and an additional copy be posted on any structure
which has been enjoined from construction. Additional copies may be posted every two
hundred feet along the perimeter if the work site consists of unimproved real property.
E. Removal prohibited. Once posted, Stop Orders shall not be removed until a
permit is issued or a determination is made by the Building Official, the City Engineer or
the Planning Director, as applicable, that a permit is not required or that the work is
consistent with an issued permit.
F. Cessation of work and remediation. While the stop order is in effect, no
person_ shall authorize, perform or allow an act or omission which directly or indirectly
allows the prohibited activity to proceed towards completion, except that material and
equipment may be removed from the site while the stop order is in effect. The owner and
contractor or other responsible person may additionally be required to secure the area

against danger to the public by erecting barricades or fencing, and to fill in any excavation
and remove debris or other obstructions to pedestrian and vehicle safety that has occurred
by virtue of the enjoined activity.
G. Contents of Stop Order. Stop Orders posted on site will be comprised of an 8
1/2 x 11 inch cardboard backing against a red background on which will appear the words
"Stop Order" in one -inch (1") block letters. In smaller size type, the following
information shall also appear: a description or address of the site, time and date issuer. a
notice that it is unlawful and a misdemeanor with a penalty of a S1,000 fine or
imprisonment not to exceed six (6) months, or both, to remove the sign or to continue
work without authority. The Stop Order shall be signed by or on behalf of the Buiidi^.g
Official, City Engineer or Planning Director and shall cite this Section 1.12.030 as
authority. Stop Orders issued to a person may be of non -cardboard paper material, 'cut
shall contain the same information as the posted notice.
H. Violations and penalties.
1. It is unlawful and a misdemeanor for any person upon whom a Stop Order is
served, or who has actual notice of the Stop Order, to continue to perform or to authorize
or allow work to occur by which the enjoined activity will continue to proceed towar ss
completion, or to fail or refuse to install fencing or barricading, remove debris and e
obstructions to pedestrian or vehicle safety, or fill in excavations, as may be required in
order to remediate the site.
2. It is unlawful and a misdemeanor for any person to remove a Stop Order
lawfully posted pursuant to this Section 1.12,030 until a permit is issued or a determina-
tion of exemption or compliance is made about the enjoined activity.
3. Violators are subject to arrest and both criminal and civil liability for violati-_e
this section and the underlying provisions of law governing the enjoined or regula-'
activity. It shall be the duty of a peace officer to accept the custody of a violator whc .s
arrested pursuant to this section by a public officer who is not a peace officer.
Section 2. That Title 1, Chapter 1.20, Section 1.20.020 is amended to read as
follows:
1.20.020 Violation a public nuisance. A. In addition to the other penalde—s
provided in this code, any condition caused or permitted to exist in violation of any
the provisions of this Code shall be deemed a public nuisance and may be, by this Ci: . .
summarily abated and/or enforced by civil action, and each day such condition
continues shall be regarded as a new and separate offense.
B. As part of a civil action filed to enforce provisions of this Code, a cour.
may assess, pursuant to Government Code Section 36901, a maximum civil penalty
two thousand five hundred dollars per violation of the Municipal Code for each da:.

during which any person commits, continues, allows or maintains a violation of any
provision of this Code.
C. During the period of time that a public nuisance exists on real property
and a stop order, civil injunction or nuisance abatement proceeding is in effect, no
permits or licenses other than those necessary to correct the violation shall be issued or
processed on behalf of an applicant who is the owner or occupant of the affected site.
D. Maintenance of a public nuisance, if not otherwise punishable by a
specific provision of law, is punishable under the provisions of Section 1.36.160.
Section 3. That Title 1, Chapter 1.36, Section 1.36.080 is amended to read as
follows:
1.36.080 Abatement by city personnel or city contractor --Report and
account. A. If the responsible person fails or neglects to abate the public nuisance
within the time frame specified by the City Council, or within the time frame specified
by the Planning Commission or the Advisory and Appeals Board when a final decision
is made by either of those bodies, the City Manager or his/her designee or the
department director shall cause the public nuisance to be abated. The abatement work
may be done by city personnel or by private contractor.
B. City personnel or a private contractor can enter upon private property in a
reasonable manner to abate the public nuisance as specified in the abatement notice or
abatement order.
C. If the responsible person abates the public nuisance before the City
performs the actual abatement pursuant to an abatement notice or abatement order, the
City may still assess all costs incurred by the City at that point against the responsible
person pursuant to the provisions set forth in this Chapter.
D. When abatement is completed, a report describing the work performed and
an itemized account of the total abatement costs shall be prepared by the City Manager
or his/her designee or by the department director. The report shall contain the names
and addresses of the responsible person for each parcel, and the tax assessor's parcel
number.
E. The City Manager or his/her designee or the department director shall
request the City Clerk to schedule a confirmation of costs hearing pursuant to this
Chapter. unless waived in writing by all responsible persons.
F. All administrative and actual costs incurred by the City in abating the
public nuisance may be assessed and recovered against the responsible person pursuant
to this Chapter.
G. Pursuant to Government Code Section 38773.5. attorneys' fees may be
awarded to the prevailing party in any administrative or judicial proceeding to abate a

public nuisance. If the responsible party is the prevailing party, attorneys' fees shall not
exceed the amount of attorney fees incurred by the City in contesting or defending the
action.
H. Pursuant to Government Code Section 38773.7, treble damages may be
requested as part of any court order to abate a public nuisance which was the subject of a
previous criminal or civil judgement within the preceding two-year period.
I. Any personal property that is useable or that has some utility value and which is
removed from the premises as part of an abatement order shall be stored at the expense of
the responsible party. The responsible party may reclaim the property within ninety (90)
days, but may not return the property to the premises from which it was abated without
authorization of the City Manager, unless the property is stored within properly
conforming storage containers or structures. If the property is not reclaimed after ninety
(90) days, a notice shall be directed to the owner or other responsible party that the
property will be treated as abandoned property and be disposed of according to Civil Code
section 2080, et seq.

EXPLANATION
This is a request from the San Diego County Boy's Baseball League to conduct a fund raising event consisting. of a
two mile run, a half mile walk, and parade through City streets from 8:00 a.m. to 7:00 p.m. on Saturday. October
10, 1998. The request includes the closure of City streets along the run, walk, and parade route. Attached is a
description of the courses for the I/2-mile walk and 2-mile fun run. The parade will begin after the walk/run and
will consist of a marching band, a City Fire engine and Police vehicle. The parade will start in front of St.
Anthony's Church and proceed north down Harding Avenue. turn right on 16th Street to Coolidge Avenue. turn
right on Coolidge and end at Kimball School for the flag raising. This area is a bus route, therefore, National City
Transit has agreed to detour bus service on the day of the event. The fund raising event will be held at Kimball
School and will begin immediately after the parade, and will include a live band, a disc jockey, a television news
broadcast and the sale of food, beverages and merchandise. This event is free and open to the public. The
applicant has advised that the proceeds of the event will be distributed to a service club, social services agency, or
other secular non-profit organization located within National City. The specific organization(s) to receive the
proceeds from the event have yet to be selected by the applicant. A waiver of fees is requested. In that the sponsor
is a non-profit organization and the event will not generate any income to the sponsoring organization, the
applicant and the event qualify for a waiver of fees pursuant to City Council Policy No. 704.

Final plans are being completed fur this years Old Town National City Reunion
Festival, scheduled for October 10 1998 at Kirroail Elementary School. 302 West '8th
Street.
As in the past. we will start the festivities at approximately 8 00 A M. with a
neighborhood 2-mile run and '/, mile walk through the streets of the west side. (course
description attached). We anticipate that this event will end by 10 00 A.M.
AT 11:00 A.M. we have scheduled a oarede The parade route is planed to start at /crr,,ca// Sc, ,/
Kimball Community Park (adjacent to Kimball School) The parade will proceed west
on 19th Street from the park to Harding Ave: turn right or tlarding Ave to 18th Street.
right on 18th Street to the intersection of 18th and Coolidge Ave. which is the main
entrance of Kimball School.
At the main entrance of the school. a flag raising ceremony will be conducted by the
Sweetwater High School ROTC Color Guard We would cordially like to invite the
Mayor and Council members to join us in the parade ant_ :he ribbon cutting ceremonies
that will officially open the Old Town Reunion Festival The festival portion of the
reunion will run from 12'00 noon to 7:00 P M.
In order for this event to proceed. we ere reouesting that the City grant us penmssion.
approve the necessary permits and provide Police personnel and equipment necessary
to barricade streets for the run/walk and parade
We have scheduled many events. live n'.us.c and other entertainment for this day long
activity. Other plans include sale of food and merchandise. various dearth booths
including representation from Children s Hosc!tai and Chancel ,0 will be represented
by their mobile unit. We would also like to extend an invitation to the National City
Police Neighborhood Bus and Senior Citizen Volunteer Fatroi to participate in this very
special event
The Old Town Reunion Committee .s working very hard to make this event a success
As you know. the proceeds from these reunions rave all gone to projects that better the
City of National City The most recent recipient being the Boys Club of National City
