PREPARED BY LT. MIKE IGLESIAS DEPARTMENT EXPLANATION _ Background In the July 14, 1998 meeting, the Council in Resolution 98-80,. authorized the City Manager to apply for FY 1998/99 Local Lai Enforcement Block grant from the U.S. Department of Justice fo_ police equipment and technology. Effective, October 1, 1998, the U.S. Department of Justice awarded the City of National Cit-a $183,809 in FY 1998/99 Local Law Enforcement Block grant funding_ Pursuant to federal law, a public hearing must be held prior to Council action on the allocation of the funds. The Police Department is requesting that all of the above funds be utilizer for the purchase of an integrated Computer Aided Dispatch ar_c Records Management System (CAD/RMS). The Warner Group conducted a CAD need assessment which was presented to Council on June 9, 1998.. The needs assessment determined that the Police Department' existing CAD/RMS system is not Year 2000 compliant nor does it have the functicnalities of a modern day CAD/RMS such as the ability tn provide officer safety premise history, officer safety time prompts for dispatchers, automated 911 interface, automated geofiles, unite assignment or simultaneous viewing of unit status and call screens.. COUNCIL AGENDA STATEMENT PUBLIC HEARING ON POLICE DEPARTMENT REQUEST FOR LOCAL LAW ENFORCEMENT BLOCK GRANT FUNDS PAGE 2 Additionally, the existing CAD/RMS system lacks the capacity cf producing management reports that track the time of all officers assigned to calls. The Warner Group recommended purchase of CAD/RMS system with the above functionalities. The Warner Grc= indicated that the the one time purchase cost of a CAD/RMS system which would fulfill the needs of the National City Police Department would be between $699,000 and $1,118,000. The Police Department submitted a Capital Improvement Request for a Computer Ahded Dispatch/Records Management system (Project nc.. 8010) during the FY 1998/99 budget process and received subsequence Council approval for the project as part of the FY 1998/99 Capita- Improvement Program. Proposal The Police Department is requesting a Resolution which would authorize the appropriation of $183,809 in FY 1998/99 Local Law Enforcement Block grant funding to C.I.P. account #169-409-000-80L2 for the purchase of an integrated Computer Aided Dispatch arr= Records Manacement System. It is the Police Department's intention. if the appropriation is approved, to provide the required cash_ match for these expenditures with $20,423 in asset seizure funds.. Under the proposal, the requested funds and local match would he applied towards the purchase an integrated Computer Aided Dispatch and Records Management system. The funds would be utilized for the purchase of necessary hardware, software, software configuratic= and customization, as well as necessary interfaces to the automated field reporting system, 911 and other critical law enforcement data bases. This proposal was presented to the Local Law Enforcement Block.: Grant Advisory Board at their meeting on December 1, 1998. The Local Law Enforcement Block Grant Advisory Board voted unanamousl-.- to recommend approval of the proposed Resolution. The Police Department currently estimates the cost of purchase cf a CAD/RMS at approximately $838,391. To date, approximate__, $508,370 Have been appropriated to the project. This funding, _f approved, would bring the total amount of approved funding for the project to $712,622. Under the current projected funding plan i- the CIE, the Police Department intends to fund the balance of the project with FY 1999/00 Local Law Enforcement Block Grant and Supplemental Paw Enforcement Services Funds. The Police Department will brine r_tuests to Council for appropriations of those funds __ the project when the city receives them. This agreement will renew the existing agreement for three years, from; November 1, 1998 to October 31, 2001. This agreement is needed in order to construct a portion of the Bay Shore Bikeway by Caltrans. The District is prepared to issue to the City a standard District Tideland Use and Occupancy Permit. (It is contemplated that the City and District will subsequently replace the Tideland Use and Occupancy Permit with a longer -term document.) Enclosed is a copy of the District's standard Tideland Use and Occupancy Permit form. The permit will be modified as follows: 1. Term: The term will be for a -year period. (When the construction commencement date on tidelands is known, please notify the District so that the permit can be prepared for execution by the City and the District. It will be appreciated if you can give the District at least 60 days advance notice.) 2. Rent: No rent is District member c 3. San Diego, CA 92186-5406 TIDELAND USE AND OCCUPANCY PERMIT THIS PERMIT, granted this 15th day of December , 1998 , by the SAN DIEGO UNIFIED PORT DISTRICT, a public corporation, hereinafter called "District," to CITY OF NATIONAL CITY, a municipal corporation, hereinafter called "Tenant," WITNESSETH: District for the considerations hereinafter set forth, hereby grants to Tenant upon the terms and conditions and for the purposes and uses hereinafter set forth, the right to use and occupy a portion of those lands conveyed to the San Diego Unified Port District by that certain Act of the Legislature of the State of California, entitled "San Diego Unified Port District Act," Stats. 1962, 1st Ex. Sess., c. 67, as amended, which lands are more particularly described as follows: Approximately 11,785 square feet of tideland area located east of the 32nd Street cul-de-sac in the City of National City, California, more particularly described and delineated on Drawing No. 528-01 1, dated January 2, 1998, labeled Exhibits "A" and "B" and by this reference made a part hereof. This Permit is granted upon the following terms and conditions: 1. TERM: The term of this Permit shall be for three (3) years, commencing on the 1st day of November, 1998, and ending on the 31st day of October, 2001, unless sooner terminated as herein provided. 2. CONSIDERATION: Consideration is the benefits to the people of the State of California, and of the covenants and agreements to be kept and performed by Tenant. 3. USE: The above -described premises shall be used only and exclusively for the purpose of construction, operation, inspection, and maintenance of a bike path and associated signs and for no other purpose whatsoever without the pricr written consent of the Executive Director of District in each instance. 1 ORIGINAL Machines, appliances, equipment, and trade fixtures of any kind placed on the above -described premises by Tenant are owned by and title thereto is vested in Tenant and shall be removed by Tenant within thirty (30) days after the expiration of the term of this Permit or sooner termination thereof; provided, however, Tenant agrees to repair any and all damage occasioned by the removal thereof. If any such machines, appliances, equipment, and trade fixtures are not removed within thirty (30) days after the termination of this Permit, the same may be considered abandoned and shall thereupon become the property of District without cost to the District and without payment to Tenant, except that District shall have the right to have the same removed at the expense of Tenant. During any period of time employed by Tenant under this paragraph to remove structures, buildings, installations, improvements, machines, appliances, equipment and trade fixtures, Tenant shall continue to pay the full rental to District in accordance with this Permit which said rental shall be prorated daily. 8. REMOVAL OF MATERIALS: Tenant hereby agrees that upon the expiration of this Permit or the sooner termination as herein provided, it will remove within thirty (30) days ail ships, vessels, barges, hulls, debris, surplus, and salvage materials from the land area and water area forming a part of or adjacent to the above -described premises, so as to leave the same in as good condition as when first occupied by Tenant, subject to reasonable wear and tear; provided, however, that if any said ships, vessels, barges, hulls, debris, surplus, and salvage materials shall not be so removed within thirty (30) days by Tenant, District may remove.. sell, or destroy the same at the expense of Tenant; and Tenant hereby acrees tc pay District the cost of such removal, sale, or destruction; or at the option of District, the title to said ships, vessels, barges, hulls, debris, surplus, and salvage materials not removed shall become the property of District. During any period of time employed by Tenant under this paragraph to remove ships, vessels, barges, hulls, debris, surplus and salvage materials, or test for and/or remediate Contaminants as required in this Permit, Tenant shall continue to pay the full rental to District in accordance with this Permit which said rental shall be prorated daily. 9. TERMINATION: It is mutually agreed that this Permit may be terminated -cy either party at any time upon the giving of one hundred eighty (180) days' notica in `writing to the other party of its intention to so terminate, and District expressly reserves the right to terminate this Permit without incurring any liability whatsoever for any damage or loss occasioned by such termination. In the event of such termination by District, Tenant shall not be entitled to compensation for installations or improvements of any kind in existence on the premises at the time :;f such termination; provided, further, that installations or improvements of any kind in existence on the premises shall be removed as provided in Paragraphs 7 and 8 hereinabove set forth. 3 In the event of termination, if Tenant elects to relocate its improvements, it shall be at Tenant's sole cost and expense, and any proposed relocation of -enant's installations or improvements on District property must be acceptaz:e to District in its sole discretion. 10. HOLD HARMLESS: District, and its agents, officers, and e:r.p_cyees shall, to the full extent allowed by law, be held by Tenant free and harmless =rim and indemnified against any liability pertaining to or arising out of the-ecoicent or intentional act or omission by Tenant relating to the use and operaton of the premises and any costs or expenses incurred on account of any o afrn or claims therefor, including reasonable attorney's fees. INSURANCE: Tenant is lawfully self -insured pursuant to California Government Code Section 990 et seq. 12. TAXES AND UTILITIES: This Permit may result in a taxabie _cssessorj interest and be subject to the payment of property taxes. POLICY OF DISTRICT: It is the policy of District that prevailing wage rates shall be paid all persons who are employed by Tenant on the property of District_ 15. DEFAULT: If any default be made in the payment of the rental herein provided or in the fulfillment of any terms, covenants, or conditions hereof, and said default is not cured within ten (10) days after written notice thereof, this Permit shall immediately terminate and Tenant shall have no further rights hereunder and shall immediately remove from said premises; and District shall immediately thereupon, without recourse to the courts, have the right to reenter and take possession of said premises. District shall further have all other rights and remedies as provided by law, including without limitation the right to recover damages from Tenant in the amount necessary to compensate District for all the detriment proximately caused by Tenant's failure to perform its obligations under this Permit or which in the ordinary course of things would be likely to result therefrom. 16. LIENS: Tenant agrees that it will at all times save District free and harmless and defend and indemnify it against all claims and liens for labor, services or materials in connection with improvements, repairs, or alterations on the premises caused to be performed by Tenant, and the costs of defending against such claims, including reasonable attorney's fees. 17. BANKRUPTCY: In the event Tenant commences a proceeding under Chapt9r XI of the Federal Bankruptcy Act, or is adjudicated bankrupt or insolvent, or a judicial sale is made of Tenant's interest under this Permit, this Permit shall at the option of District immediately terminate and all rights of Tenant hereunder shall immediately cease and terminate. 18. EASEMENTS: This Permit and all rights given hereunder shall be subject tc all easements and rights -of -way now existing or heretofore granted or reserved by District in, to, or over the premises for any purpose whatsoever, and shall be subject to such rights -of -way for reasonable access, sewers, pipelines, conduits. and such telephone, telegraph, light, heat, or power lines as may from time to time be determined by District to be in the best interests of the development of the tidelands. District agrees that such easements and rights -of -way shall be so located and installed as to produce a minimum amount of interference tc the business of Tenant. 19. TITLE OF DISTRICT: District's title is derived from the provisions of the San Diego Unified Port District Act, Appendix 1, Harbors & Navication Code, and is 5 subject to the provisions of said Act. This Permit is granted subject to the -tirrns and conditions of said Act. 20. JOINT AND SEVERAL LIABILITY: If Tenant, as a party to this Permit_ is a partnership or joint venture, or is comprised of more than one party or enth.7 or a combination thereof, the obligations imposed on Tenant under this Permit shall be joint and several, and each general partner, joint venturer, party, or entity of Tenant shall be jointly and severally liable for said obligations. Furthermore, nothinc_ contained herein shall be deemed or construed as creating a partnership or ,cEir venture between District and Tenant or between District and any other errdrr or party, or cause District to be responsible in any way for the debts or obligations of Tenant, or any other party or entity. 21. NONDISCRIMINATION: Tenant agrees at all times to fully comply wft ail laws prohibiting discrimination against any person or class of persons by re=nn of sex, color, race, religion, handicap or national origin. If the use provided fcr n this Permit allows the Tenant to offer accommodations or services to the public, such accommodations or services shall be offered by the Tenant to the public on =air and reasonable terms. In complying with all such laws, including, without limit=_inn, the Americans With Disabilities Act of 1990, Tenant shall be solely respons pie fcr such compliance and required programs and there shall be no allocation of ary sump responsibility between District and Tenant. 22. ENTIRE UNDERSTANDING: This Permit contains the entire understardinc of the parties, and Tenant, by accepting the same, acknowledges that there is nc other written or oral understanding between the parties in respect to the accwe-- described premises. No modification, amendment, or alteration of this Perr-: _ sr aJ be valid unless it is in writing and signed by the parties hereto. 23. PEACEABLE SURRENDER: Upon the termination of this Permit by t.e expiration thereof or the earlier termination as by the terms of this Permit or=vices. Tenant will peaceably surrender said above -described premises in as good condition, subject to normal and ordinary wear and tear resulting from the _ of such premises as herein provided, as the same may be at the time Tenant -es possession thereof, and to allow District to take peaceable possession there. 24. HOLDOVER: This Permit shall terminate without further notice at ex_:r—c- of the term. Any holding over by Tenant after either expiration or tern s-» not constitute a renewal or extension or give Tenant any rights in or to the premises. If Tenant, with District's consent, remains in possession of the o.-=-:ses after expiration or termination of the term or after the date in any notice ci : __-- o d District to Tenant terminating this Permit, such possession by Tenant snail deemed to be a month -to -month tenancy terminable on thirty (30) days' nc-�e given at any time by either party. During any such month -to -month tenanc•. Tenant shall pay all rent required by this Permit; and if percentage rent is =_ by the Permit, it shall be paid monthly on or before the tenth (10th) day month. 6 All provisions of this Permit, except those pertaining to term, shall apply to the month -to -month tenancy. 25. ACCEPTANCE OF PREMISES: By signing this Permit, Tenant represents and warrants that it has independently inspected the premises and made all tests, investigations and observations necessary to satisfy itself of the condition of the premises. Tenant agrees it is relying solely on such independent inspection, tess, investigations and observations in making this Permit. Tenant also acknowledges that the premises are in the condition called for by this Permit, that District has performed all work with respect to premises and that Tenant does not hold Dist. ict responsible for any defects in the premises. Tenant furthermore accepts and shall be responsible for any risk of harm to any person and property, including withou:i limitation employees of Tenant, from any latent defects in the premises. 26. WARRANTIES -GUARANTEES: District makes no warranty, guarantee, covenant, including but not limited to covenants of title and quiet enjoyment, or averment of any nature whatsoever concerning the condition of the above - described premises, including the physical condition thereof, or any condition which may affect the above -described premises; and it is agreed that District will not be responsible for any loss or damage or costs which may be incurred by Tenant by reason of any such condition or conditions. 27. ATTORNEY'S FEES: In the event any suit is commenced to enforce, protect or establish any right or remedy of any of the terms and conditions hereof, including without limitation a summary action commenced by District under the laws of the State of California relating to the unlawful detention of property, the prevailing party shall be entitled to have and recover from the losing party reasonable attomey's fees and costs of suit. 28. HAZARDOUS MATERIALS: Tenant shall comply with all laws regarding hazardous substances, materials or wastes, or petroleum products or fraction thereof (herein collectively referred to as "Contaminants") relative to occupancY and use of the premises. Tenant shall be liable and responsible for any Contaminanzs arising out of the occupancy or use of the premises by Tenant. Such liability and responsibility shall include, but not be limited to, (i) removal from the premises any such Contaminants; (ii) removal from any area outside the premises, including 'b_rt not limited to surface and groundwater, any such Contaminants generated as part of the operations on the premises; (iii) damages to persons, property and the premises; (iv) ail claims resulting from those damages; (v) fines imposed by any governmental agency, and (vi) any other liability as provided by law. Tenant shall defend, indemnify and hold harmless the District, its officials, officers, agents, and employees from any and all such responsibilities, damages, claims, fines, liabili =;ems, including without limitation any costs, expenses and attorney's fees therefor. District shall have a direct right of action against Tenant even if no third party —.as asserted a claim. Furthermore, District shall have the right to assign said indemnity. 7 If Tenant has in the past or continues to use, dispose, generate, cr store Contaminants on the premises, District, or its designated representatives, ET District's sole discretion, may at any time during the term of this Permit, enter upon the premises and make any inspections, tests or measurements District deems necessary in order to determine if a release of Contaminants has occurred. District shall give Tenant a minimum of twenty-four (24) hours' notice in 'writing prior to conducting any inspections or tests, unless, in District's scie judgment, circumstances require otherwise, and such tests shall be conducted in a manner so as to attempt to minimize any inconvenience and disruption to Tenant's operations. If such tests indicate a release of Contaminants, then District, at District's sole discretion, may require Tenant, at Tenant's sole expense, and at any time oaring the term of this Permit, to have tests for such Contaminants conducted by a qualified party or parties on the premises. If District has reason to believe that any Contaminants that originated from a release on the premises have contaminated any area outside the premises, including but not limited to surface and groundwater, then District, at District's sole discretion, may require Tenant- at Tenant's sole expense, and at any time during the term of this Permit, to rave tests for such Contaminants conducted by a qualified party or parties on said area outside the premises. The tests conducted by Tenant's qualified party shall include, but not be limited to, applicable comprehensive soil, emission, or groundwater sampiinc test or ~ter procedures to determine any actual or possible contamination. Tenant sha:3 expeditiously, but no longer than thirty (30) days after District's request for such tests, furnish to District the results of said tests, samplinc plans, and analysis thereof identifying any Contaminants which exceed then acpiicacie 'eveis cer;nitted by federal, state, or local laws. Tenant shall report such contaminabon tc the District within seventy-two (72) hours and shall diligently proceed to idea =✓ the extent of contamination, how it will be remediated, when it will be rer;edia _d, by whom, and the cost of such remediation. 29. Tenant agrees to keep complete and accurate records on the premises for a period of not less than thirty-six (36) months from the applicable events, including, but: not limited to permit applications, monitoring, testing, equipment installation, repairing and closure of the underground storage tanks, and any unauthorized releases of Contaminants and make such records available for District or responsible agenc•w inspection. Tenant further agrees to include a copy of Health and Safety Code, Chapter 6.7, Section 25299, as part of any agreement between Tenant and any' Operator of such underground storage tanks. Furthermore, Tenant shall be responsible for compliance with all other laws ana regulations presently existing or hereinafter enacted applicable to underground storage tanks, including without limitation any such laws and regulations which alter any of the above requirements. 30. ABOVEGROUND STORAGE TANKS: Tenant shall be responsible for any aboveground storage tanks on the premises. Tenant shall, in accordance with its Permit and applicable laws and regulations, secure and pay for all necessary permits and approvals, prepare a spill prevention control counter measure plan and conduct periodic inspections to ensure compliance therewith, including conformance with the latest version of said laws and regulations. In addition, Tenant shall maintain and repair said tanks and conform and comply with all other applicable laws anc regulations for aboveground storage tanks, including without limitation all of the requirements of Health & Safety Code, Sections 25270 through 25170.13 as presently existing or as hereinafter amended, including without limitation conducting daily visual inspection of said tanks, allowing the San Diego Regional Water Quality Control Board, District, or responsible agency, to conduct periodic inspections and complying with valid orders of said Board, filing the required storage tank statement and payment of the fee therefor, establishing and maintaining the required monitoring program and systems, reporting spills as required, and payment of lawfully imposed penalties as provided therein and as otherwise provided by law. Tenant shall be responsible for all costs associated with an unauthorized release from such tanks, including but not limited to, investigative, surface and groundwater cleanup, expert and agency fees. 31. NOTICES: Any notice or notices provided for by this Permit or by law to ne given or served upon Tenant may be given or served by certified or registered letter addressed to Tenant at 1243 National City Boulevard, National City, California 91950 and deposited in the United States mail, or may be served personally upon said Tenant or any person hereafter authorized by it in writing to receive such notice; and that any notice or notices provided for by this Permit or by law to be served upon District may be given or served by certified or registered letter addressed to Executive Director of District at the Administrative Offices of the man Diego Unified Port District, Post Office Box 120488, San Diego, California 92 i ' 2- 0488 and deccsited in the United States mail, or may be served personally upc- 9 said Executive Director or his duly authorized representative; and that any notice or notices given or served as provided herein shall be effectual and binding for all purposes upon the parties so served. 32. Revisions to Council Policy 704 are proposed to delete reference to Garage/Yard/Rummage Sale, which are regulated by Chapter 7.21, National City Municipal Code. It eliminates reference to political and religious activities, and instead, adopts a content neutral regulation regarding noise generating outdoor activities, and activities in temporary structures. Eiser. m, City Attorney CITY COUNCIL POLICY 111'LE: MUTATION OF CITY APPROVED POLICY SPECIAL EVENTS WITHIN 1'HE CITY NUMBER 704 ADOY1ED: November 15, 1988 AMENDED OR REVISED: October 21, 1997 Purpose The City Council recognized the potential impact of various special events within the City, specifically when held concurrently, upon Police Department resources and public safety. The purpose of this policy is to limit the number of such events held concurrently in recognition of that potential impact and provide guidelines to insure public safety. Policy Those City approved temporary use activities listed under "Class A Uses/Activities" in the attached sheet (with the exception of "mobile home type structures," which are already limited to periods no longer than one year), shall be limited to no more than two occurring concurrently on a given day. The Police Department shall indicate on the Temporary Use Permit application form prior to its submission to the City Council, the potential impact of a particular event upon Police resources or public safety. Fach event will have necessary security as determined by the National City Police Department. This security can be a) private security, b) combination of private security and police officers, c) police officers and reserve officers. The Police Department must aanrove security arrangements prior to the issuance of a Temporary Use Permit. The person or organization responsible for the event will be required to pay for officers assigned to the event for traffic control and public safety. There will be no charge for Reserve Officers or for officers assigned solely for the protection of bystanders or participants in parades, demonsaations, or other "expressive activity" events. If additional officers are required over the number of officers initially assigned to the event, no further charge will be made to the operation or responsible officers present and police activity increases and additional officers are required, there would be no charge for those additional officers. Alcohol will be prohibited to reduce chances of violence and disorderly conduct. A fence may be :required, at the discretion of the Police Department, based upon, 1) event location, 2) past acrvity at the site, 3) estimated crowd and, 4) type of entertainment in order to control access to the activity by large groups of people. Activities will not operate between the hours of 11 PM and 8 AM on any day. There will be no sales of tickets for any activity one half hour before closing time, if there is an imminent danger to the well being of citizens, the Police Department shall adjust operations hours. Effective, October 1, 1998, the U.S. Department of Justice awarded the City of National City $183,809 in FY 1998/99 Local Law Enforcement Block grant fundima. Pursuant to federal law, a public hearing must be held prior to Council action on the allocation of the funds. The Police Department is requesting that all of the above funds be utilized for the purchase of an integrated Computer Aided Dispatch and Records Management System (CAD/RMS). The Warner Group conducted a CAD need assessment which was presented to Council on June 9, 1988. The needs assessment determined that the Police Department's existing CAD/RMS system is not Year 2000 compliant nor does it have the functicnalities of a modern day CAD/RMS such as the ability- 7o provide officer safety premise history, officer safety time prompts for dispatchers, automated 911 interface, automated geofiles, u_- assignment or simultaneous viewing of unit status and call screens. Proposal The Police Department is requesting a Resolution which would authorize the appropriation of $183,809 in FY 1998/99 Local La' Enforcement Block grant funding to C.I.P. account #169-409-000-80= for the purchase of an integrated Computer Aided Dispatch and Records Management System. It is the Police Department's intention if the appropriation is approved, to provide the required cash match for these expenditures with $20,423 in asset seizure funds.. Under the proposal, the requested funds and local match would be applied towards the purchase an integrated Computer Aided Dispatch and Records Management system. The funds would be utilized for the purchase of necessary hardware, software, software configuration and customization, as well as necessary interfaces to the automated field reporting system, 911 and other critical law enforcement data bases. This proposal was presented to the Local Law Enforcement Block Grant Advisory Board at their meeting on December 1, 1998. The Local Law Enforcement Block Grant Advisory Board voted unanamousl-- to recommend approval of the proposed Resolution. The Police Department currently estimates the cost of purchase cf a CAD/RMS at approximately $838,391. To date, approximate_- $508,370 have been appropriated to the project. This funding, __ approved, would bring the total amount of approved funding for the project to $712,622. Under the current projected funding plan it the CIP, the Police Department intends to fund the balance of the project with FY 1999/00 Local Law Enforcement Block Grant and Supplemental Law Enforcement Services Funds. Existing Chapter 15.60 of the Municipal Code currently governs the process. Existing Chapter 6.52 covers the process for parade permits. Each of these processes involve standards for issuance or denial of a permit and regulations for the event's conduct. Parades and other uses or activities in which principles of free spy (expressive activity) are often involved have been subject to intense judicial scrutiny over the past decade and certain requirements have been imposed upon municipalities in order to constitutionally prohibit or disallow an event from occurring, and to regulate its conduct. The existing provisions of Chapter 15.60 and Chapter 6.52 do not comply with the case law that has evolved. These existing provisions have been administered in a manner consistent with case law however. Notwithstanding, the absence of constitutionally permissible standards and requirements established by ordinance could prove fatal to a future effort to not allow an event to occur where, arguably, some element of "expressive activity" is involved. This ordinance accomplishes the following: 1. It establishes a rational, constitutional basis, framework and set of _:andards for the issuance, issuarce with modification, or denial of a temporary use permit for special events; 2. It allows the City the ability to constitutionally deny a permit on a basis that is generally judic'ally acceptable, thereby insulating the City from liability for im-�-proper denial; 3. It repeals outmoded language in Chapter 6.52 (parades) and integrates a parade permit into the temporary use permit process without unnecessary duplication: 4. It establishes insurance requirements that, in particular for expressive activity, are constitutionally necessary; 5. It allows for cost recovery; 6. It allows the City to require revenue sharing from special events on public property or streets for which admission fees are charged; 7. It limits fees for police services solely to protect participants and bystanders during special events constituting expressive activity, as defined and required by case law. This ordinance has been coordinated with the Police, Building and Safety Departments and Risk Management. The Building Official shall coordinate the permit application with other departments or agencies having requirements and conditions related to the use for which the temporary use permit is sought. C. The Building Official shall process all applications, maintain records cif temporary use permits issued, and prescribe any additional procedures necessary nti implement and conform to the regulations herein. D. No special use shall be permitted to operate or be occupied until all departmental or other agency inspections and requirements are fully completed and approved. 15.60.015 Temporary use classes. Uses authorized by this chapter are divided into hree separate classes, each having a separate administrative process snri requirements. The classification of an activity into a particular use class shall be sew forth in Council Policy adopted by resolution_ A. Class A Use: Requires City Council approval; B. Class B Use: Issued and approved by Building Official; C. Class C Use: Subject only to business license regulations. 15.60.00 Application and Processing. A. Applications for CIass A and B temporary use permits shall be filed with the Building and Safety Department the following specified minimum number of calendar or working days prior to the activity: 1. Class A use (except for parades and photography/motion picture permits): fifteen (15) working days; 2. Parades requiring a Class A use permit : ten (10) calendar days= 3. An applicant may appeal the action of denial or the imposition of conditions by the Building Official or any City department by filing a written letter of appeal to the City Council with the City Clerk within ten (10) calendar days of the date of the Building Official's action stating the reasons therefor. The City Clerk shall docket the appeal upon the agenda of the next regularly scheduled Council meeting (normally once a week). B. Upon the filing of an appeal, action on the permit shall be withheld until the City Council hearing and decision is rendered. The City Council shall have the final authority to approve, conditionally approve or deny the temporary use application. C. The City Council , on its own motion, may move to modify or rescind a previously granted approval of any temporary use application, and, except for emergency situations, the applicant shall first have the opportunity to show cause to the City Council before the approval may be rescinded or modified. Expressive activity protected under the first amendment whici does not involve animals, structural construction, pyrotechnics or mechanic equipment (other than sound equipment), and for which no fee is charged or donation exacted as a condition of admittance or participation, is exempted. =. For all other events, upon a determination by the Risk Manager that a greater or lesser amount of insurance for personal injury or property damage is necessary or permissible, according to generally accepted, objective risk managemem principles applicable to the nature of the event or the equipment to be employed. C. T..ndemnification Agreement. The Risk Manager shall require an applicant exempted from the insurance requirements of Section 15.60.06.5B to execute an indemnification and hold harmless agreement with the City, and may require other applicants to do the same when appropriate to the nature of the event. D. Security for Damages or Surety Bonds. The City Council or the Building Official may require a security deposit to be posted, either in cash, negotiable instrument or surety bond issued by a licensed surety, to cover actual or reasonably anticipated damage to public property in an amount not to exceed twenty five thousand dollars (S25,000). 15.60.0-0 Violations. A. Violations of any of the provisions of this chapter are punishable as misdemeanors and carry the penalties prescribed in Chapter 1.20 of the National City Municipal Code. B. Except as provided in this chapter 15.60 it is unlawful and a misdemeanor: 1) to conduct a special event without a temporary use permit; 2) to interfere with or join a special event for which a temporary use permit has been issued without the authorization of ;.ne permittee; or, 3) to continue to participate in or conduct a special event after the temporary use permit has been revoked or suspended. These requests were for the City to make Las Palmas Pool available for their swim teams' use as a -eplacement for facilities in Chula Vista which have been closed. At the same time staff was directed to prepare an updated report on how much it would cost to keep the pool open through February 1999. The pool has been closed in recent years from November 1 until March 1 as a move to reduce operating costs and to allow a period in which maintenance work can be accomplished on the pool itself which cannot be done during the normal operating season. Staff has reviewed and updated where possible the costs associated with the operation of the pool and have compiled a spread sheet itemizing projected costs and income for the pool operations for the period 1 November 1998 through 1 March 1999. (refer to attachment A) As of this time a total of $2400 per month in fees have been offered to offset any additional operating costs for the period November 1,1998 through March 1,1999. It should be noted that Bonita Vista High School will be returning to their regular facility next year. This would reduce the available offsetting funds for the period November 1, 1999 through March 1, 2000 to $1600.00 per month. (refer to attachment B) The use of these fees as an offset to increased operational costs leaves a unfunded balance of S16.942.00 in costs associated with the operation of Las Palmas Pool for the current fiscal year. It needs to be noted that the costs for electric and gas utilities are based on usage and consumption reports for this time frame that are five years old. While there may be some additional efficiencies gained through equipment upgrades that have been implemented the impacts are unknown. More current information is not available since the pool has not been in operation for the Nov.1 through March 1 time frame since then. If Council wishes, the extending of the pool's operating season could be done on a one time basis. This would allow staff the opportunity to develop current costs associated with the pool's operations for the period in question, and would allow for the matter of the pool's operating schedule to be considered at Finance Committee time as part of next year's budget.
