EXPLANATION.
Once the County has canvassed the election and provided an "Official Canvass" of the
returns to the City Clerk, the Council can meet and adopt a resolution to "Declare
Results" pursuant to California Election Code 15400, incorporating the "Official
Canvass" into the resolution as "Exhibit A."

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
RECI1LNG THE FACT OF THE GENERAL MUNICIPAL ELECTION
N F LD ON NOVEMBER 3, 1998, DECLARING THE RESULT
AND SUCH OTHER MATTERS AS PROVIDED BY LAW
WITFREAS, a General Municipal Election was held and conducted in the City of
National City. California, on Tuesday, November 3, 1998, as required by law; and
WHFREAS, notice of the election was given in time, form and manner as
provided by law; voting precincts were properly established; election officers were
appointed and in all respects the election was held and conducted and the votes were cast_
received and canvassed and the returns made and declared in time, form and manner as
required by the provisions of the Elections Code of the State of California for the holding
of elections in general law cities; and
WHFREAS, pursuant to Resolution No. 98-77 adopted on July 14, 1998, the San
Diego County Registrar of Voters canvassed the returns of the election and has certified
the results to rHs City Council, the results are received, attached and made a part hereof
as Exhibit ` A."
NOW, 1 ELEREFORE, THE CITY COUNCIL OF THE CITY OF
NATIONrAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERVTT``E
AND ORDER AS FOLLOWS:
SECTION 1. That the whole number of ballots cast in the City, except absent
voter ballots. was 5950.
That the whole number of absent voter ballots cast in the City was 2036, making a
total of 7986 ballots cast in the City.
SECTION 2. That the names of persons voted for at the election for Mayor are as
follows:

SECTION 3. That the number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective offices for
which the persons were candidates were listed in Exhibit "A" attached.
SECTION 4. The City Council does declare and determine that:
GEORGE H. WATERS was elected as Mayor for the full term of four years;
MITCH BEAUCHAMP was elected as Member of the City Council for the full
term of four years:
FRED SOTO was elected as Member of the City Council for the full term of four
years;
SECTION 5. That the City Clerk shall enter on the records of the City Council of
the City, a statement of result of the election showing:
(a) The whole number of votes cast in the City;
(b) The names of the persons voted for;
(c) For what office each person was voted for;
(d) The number of votes given at each precinct to each person;
(e) The total number of votes given in the city to each person.

SECTION 6. That the City Clerk shall immediately make and deliver to each of
the persons so elected a Certificate of Election signed by the City Clerk and
authenticated; that the City Clerk shall also administer to each person elected the Oath of
Office prescribed in the Constitution of the State of California and shall have them
subscribe to it and file it in the Office of the City Clerk;
Each and all of the persons so elected shall then be inducted into the respective
office to which they have been elected.
SECTION 7. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

SUBJECT: VICE -MAYOR APPOINTMENT
At our regular scheduled Council meeting on December 1, 1998 at 3:00 p.m., I will be
appointing Cc.cilman Ron Morrison to serve as Vice -Mayor for 1999. The Vice -
Mayors term .viil expire on November 10, 1999. If there are any questions or
objections to t. s appointment, please notify my office immediately.

term on the above -subject committee ending April 30, 2000. This item will be placed on

EXPLANATION
The City Engineer requests vacation of a 500 square foot portion of right-of-way, located at the terminus of the E. 19th
Street cul-de-sac, just east of Euclid Avenue. The parcel is utilized as an extension of the front yard of the residential
property existing contiguously to the north. Existing improvements, include full -width street, curb, gutter and side-
walk. The requested vacation would not affect utility distribution nor reduce public access.
Council declared the property surplus at a meeting held in January, 1992, and directed the Engineering Department
to initiate conveyance to the adjacent property owner, Charles Hostler, Jr. Mr. Hostler holds underlying fee title to
the subject property and has agreed to legally merge it with his residential lot following conveyance.
A Council resolution giving notice of intent to vacate was adopted on November 10, 1998. This followed a hearing
held November 2, 1998, at which Planning Commission voted to recommend approval. The item was continued at the
November 24 meeting to allow adequate hearing notice.
Findings for approval, in accordance with adopted criteria for street vacations and as recommended by the Com-
mission, are provided as an attachment.

RECOMMENDED FINDINGS FOR APPROVAL
1. That the area to be vacated is not needed for public purposes, since said parcel is deemed
surplus right-of-way and all necessary and desired public access to contiguous property is
provided and will be maintained.
That the area to be vacated is not useful to pedestrians, bicyclists or equestrians as a non -
motorized transportation facility, (defined in Sec. 156 of the Street and Highways Code of
California), since said parcel is a remnant of adequate non -motorized transportation facilities
existing contiguous to said parcel.
3. That the vacation of right-of-way is consistent with the City's General Plan, which encourages
proposals to reduce traffic through neighborhoods, since the parcel to be vacated would be
utilized as right-of-way only in the event of a street opening for access to Euclid Avenue. Such
an opening would have potential to increase traffic through the neighborhood containing the
subject parcel, and would therefore be discouraged.

EXPLANATION
The technical amendment to the National City LCP was submitted and adopted by the California Coastal Commission
at the October meeting in Oceanside. However, at the meeting, a request by Coastal Commission Staff was made to
change a statement concerning Local authority over Federal lands on figures 1, 2 and 3.
The original language was:
"Consistent with the U.S. Attorney General opinion, lands owned by the United States are not subject to the
controls of the Local Coastal Program".
The suggested language that was adopted by the Coastal commission is:
"The National City LCP policies, relating to land owned by the federal government, are advisory only and have
no binding legal effect on federal activities".

AMENDMENT TO THE CERTIFIED NATIONAL CITY LCP LAND USE PLAN
NOTE: This draft amendment to the certified National City Local Coastal Land Use Plan has been
prepared to update h with regard to (1) the ownership status of Paradise Marsh, the resultant legal
and restoration authorities over it. (2) deletion by the Coastal Commission in the Chula Vista LC?
of the Tidelands Avenue extension across Sweetwater Channel and the need to harmonize the
parallel provision of the National City LCP, and (3) pending changes in land use planning and
permitting authority over a portion of the National City Marina project site, for which the Part
District has proceccesl Port Master Plan Amendment No. 19 and is currently processing a legal
geographical boundary amendment, which will give it coastal development permit review
responsibility in this area.
1.0 Policy Recommendations
1.1 Recreation Policy 1
Revise as follows to accurately state the status of Paradise Marsh wetlands:
"The National City bayfront shall be designated for tourist commercial an d
tt4. ational use, as indicated in the Land Use Plan (Figure 1). The areas north to -.he
west and to the north..."

Revise as follows to reflect the deletion of the Tidelands Avenue crossing „rum V e
Chula Vista LCP by the Coastal Commission:
"Tourist commercial development in the above referenced areas shall be consistent
w-irh existing or currently planned road capacities to the north and south of fne
proposed tourist commercial area, including the planned extension of Harrison
Avenue and of 32°d Street to intersect with it.
1.3 Recreation Policy 5
Given the federal acquisition of Paradise Marsh, Policy 5 should be revised as
fo l'_o ws:
"Paradise Marsh has been acquired by the United States of America and is manages^
as a National Wildlife Refuge unit by the U. S. Fish and Wildlife Service. _J
enhance the environmentally sustainable recreational potential and attractiveness of

the National City waterfront, the restoration and management of Paradise Marsh for
high quality endangered species habitat and associated wetland values is a desirable
pro lam. A feasible restoration plan is the province of the U. S. Fish and Wildlife
Service. whose coordination and cooperation with the City and other interested
agencies, persons, and organizations is cordially invited.
1.4 Marsh Preservation Policy 1
Given the federal acquisition of Paradise Marsh, and the U.S. Attorney General's
opinion that the state coastal program does not govern federal lands, this policy
requires jurisdictional specifications. The following is recommended:
"The wetlands of the Paradise Marsh complex, including the secondary area of
Paradise Marsh, east of 1-5 (Banister Marsh), salt marsh, freshwater marsh, salt -pan,
channel, and mudflat habitats, are valuable and sensitive biological resources, and
shall be preserved through coordinated actions by the City and the United States
Fish and Wildlife Service, which manages Paradise Marsh for the United States of
America. The plan shall be OPEN SPACE/WETLAND PRESERVE. The
boundaries of the "Open Space Wetland Preserve" include marsh area within the
Calt-ans right-of-way easterly of the SDG&E right-of-way and Bannister Marsh..."
1.5 Marsh Preservation Policy 3
Given the federal acquisition of Paradise Marsh, and the US Attorney General's
opinion that the state coastal program does not govern federal lands. this policy also
recuires jurisdictional specification. The following is recommended:
"To enhance the habitat and aesthetic value of Paradise Marsh transitional and high -
tide refugia areas located within the City's jurisdiction, the wetlands located west of
the railroad, which are not proposed for federal acquisition, as well as Bannister
Marsh and the Sweetwater River south of 35th Street, feasible restoration activities
shall be encouraged. Feasible restoration activities shall be determined with the
potential assistance of the State Coastal Conservancy, US Fish and Wildlife Service,
California Department of Fish and Game, or other public agency or private group,
inch'ciing the Bayfront Conservancy Trust to finance, plan. implement and manage
a :oration program. The recommended elements for a restoration program
inc ' de:

• -The removal of all rubbish and debris...
• - = he encouragement of a scientific research and educational program"
2.0 Maps
NOTE: Revised LUP Maps Figures 1,2, and 3, as adopted by the City Council to
implement the written recommendations below, are attached. Drafts of these mans s were
attached to the June 16, 1998 Public Review Draft LUP Amendment.
2.1 Land Use Plan map (Figure 1)
2.1.1 The Land Use Plan map presently designates the area of Paradise Marsh
owned by the United States for "OSR" Open Space Wetland Preserve.
The map should be amended to state, than the National City LCP policies,
relating to land owned by the federal government, are advisory only and
have no binding legal effect on federal activities".
2.1.2 The Land Use Plan map presently extends the CT (Tourist Commercial)
District south of the easterly projection of 32" Street, between the historic
mean high tide line on the west and the westerly boundary of the SDGc E
utility corridor parcel. This area is part of the National City Marina
project addressed by the Port District in Ply PA 19 art) will be fort: er
addressed in the pending Port District legal geographical bourraD' -reap
amendment. This area should therefore be deleted ;Tom Flaure 1
2.2 Political Jurisdictions (Figure 2)
2.2.1 The Political Jurisdictions map presently desis-nares the area of Paradise
Marsh owned by the United States as being within the political ur=sdiction
of the City of National City. The map should be amended to state. -har the
National City LCP policies, relating to land owned by the federal
government, are advisory only and have no binding legal effect on federal
activities".
2.2.2 The Political Jurisdictions map also presently includes the area south. of 32'
Street and between the historic MHTL and the westerly boundary of the
SDG&F utility corridor parcel, as being in the City's political ;an-isdiction.
With Port District transmittal of the above -referenced legal geogranitii
boundary amendment and Coastal Commission ministerial action on it. the
area should also be deleted from this map.
2.3 Subareas (Figure 3)
2.3.1 The Subareas map includes the area of Paradise Marsh owned by the cite:
States within Coastal Zone Subarea H. The map should be amended to store,
that the National City LCP policies, relating to land owned by the federal
government_ are advisory only and have no binding legal effect. on federal
activities".

2.3.2 The Subareas map also includes the area of the National City Marina that
shortly will be within the Port District's jurisdiction upon Coastal
Commission action on the revised legal geographic boundary. It should be
excluded here, as well.

Dear Mr. Desrochers:
On October 15, 1998, the California Coastal Commission approved, with suggested
modifications, the above -described LCP Amendment. For your reference, a copy of the
suggested modificons are attached. The amendment involved several technical
revisions to the City's certified Land Use Plan (LUP). Specifically, the amendment
revises several LT...-? policies and maps to reflect the change in ownership of Paradise
Marsh and the desiznation of the marsh area as a National Wildlife Refuge. In addition,
the amendment includes LUP policy revisions to reflect the elimination of the Tidelands
Avenue crossing- over the Sweetwater Channel and revision to the LUP jurisdictional map
to reflect a bounder=; change from National City to Port jurisdiction for a portion of the
National City Marina project site.
Before the LCPA can become effectively certified, the Executive Director must
determine *hat imr.iementation of the LCPA will be consistent with the Commission's
certification order. This is necessary because the LCPA was certified with suggested
modifications and --A,-as originally transmitted to the Commission without a resolution
from the City stann= that the LCPA will take effect automatically upon Coastal
Commission approval.
In order for the Executive Director to make this determination, the City Council must
formally acknowiedzze receipt of the Commission's resolution of certification, including -
any terms or sugg.ed modifications; accept and agree to those terms and modifications;
and, take any formal action which is required to satisfy them, such as rezonings or other
ordinance revisions. As soon as the necessary documentation is received in this once,
and accepted. the E ecutive Director will report his/her determination to the Co^mission
at its next regular-: scheduled public hearing.

The National City, City Council will hold a public hearing at the time and place indicated
above to review, and possibly take action to amend the National City Local Coastal
Program (National City LCPA No. 1-98A) in response to, recommendations by the staff
of the California Coastal Commission, including corrections, modifications, or other
minor changes.
Interested persons may review the Coastal Commission Staff Report and
Recommendations for the National City LCPA 1-98A during normal business hours or
the public counter of the National City Community Development Commission (140 East
12th Street, Suite B, National City 91950), or at the National City Public Library (200
East 12th Street). The Coastal Commission Staff Report and Recommendations for
National City LCPA No. 1-98A may also be requested directly from the California
Coastal Commission (3111 Camino Del Rio North, Suite 200, San Diego, CA 92108).
All interested persons are invited to comment either in person at the time of the public
hearing, or in writing prior to or at the time of the public hearing. Please address

Assembly Bill 3229, Chapter 134, Statutes of 1996, established the
Citizen's Option for Public Safety (COPS) Program to provide local
law enforcement supplemental funding to eligible jurisdictions, as
defined, for public safety purposes. Under the COPS Program, the
City of National City will receive its share of the $100,000,000 _n
1998-99 appropriations from the State of California based on its
proportionate share of the State's population using the State
Department of Finance's January 1, 1998 population estimates.
According to the January 1, 1998 State Department of Finance
National's City population was estimated at 54,400 making it
eligible for approximately $122,698 in COPS funding during FY
1998/99. The COPS program is an on -going program. However it will
require a new appropriation for continued funding each year. The
State Controller allocated funds to each county on September
15,
1998. The funds in each county were appropriated to the cities on
October 15, 1998. (continued)

In the case of a city, the City Council is required to appropriate
existing and anticipated COPS moneys exclusively to fund front line
municipal pc lice services. Front line COPS funds may be used to
fund both police personnel and equipment. The COPS monies must
supplement and not supplant existing police services.
COPS funds shall be appropriated pursuant to written requests from
the Chief of Police. The request must specify the front line law
enforcement needs of the requesting entity including the personnel,
equipment and programs.
Pursuant to AE 3229, the City Council must hold a public hearing in
to consider these requests. Funding will be determined by a
majority vote of those present at the Council meeting within 60
days of receiving the request for funding. The City Council must
consider these written requests separate and apart from the
proposed allocations from the city general fund.
The National City Police Department is therefore submitting a
request that the City Council appropriate FY 1998/99 Supplemental
Law Enforcement Services Fund monies in the amount of $122,698
for the purchase of an integrated Computer Aided Dispatch (C.A.D.)
and (R.M.S. system.
The Warner group conducted a CAD needs assessment which was
presented cc Council at the June 9, 1998 meeting. The needs
assessment determined that the Police Department existing CAD/R:YIS
is not Year 2000 compliant nor does it have the functionalities of
a modern day CAD/RMS system such as the ability to provide officer
safety premise history, officer safety time prompts for
dispatchers, automated 911 interface, automated geofiles, unit
assignment or simultaneous viewing of unit status and call screens.
Additionally the exisitng C.A.D. system lacks the capacity of
producing management reports that track the time of all officers
assigned to calls. The Warner Group recommended purchase of a
CAD/RMS system with the above functionalities. The Warner Grout
indicated that the one time purchase cost of a CAD/RMS system which
would fu' the needs of the National City Police Department
would be between $699,000 and $1,118,000.
The Police De artment submitted a Capital Improvement Request for
a Computer Aided Dispatch/Records Management System (Prcject no.
8010) during the FY 1998/99 budget process and received subsequent
Council apprc-.al for the project as part of the FY 1998/99 Capital
Improvement Program.

The Police Department is requesting that the $122,678 in FY 1998/59
SLESF funds be appropriated to CIP account #157-5C9-300-8010 for
the purchase of an integrated Computer Aided Dispatch and Records
Management system. The funds would be utilized to purchase the
necessary computer hardware, software, software configuration,
software customization, as well as necessary interfaces to the
automated field reporting system (AFR), 911 and other critical Law
enforcement databases.
These funds require no local match from the City of National City.
The Police Department currently estimates the cost -of the purchase
of a CAD/RMS system at approximately $838,391. Tc date Council has
approved appropriation of $178,391 in FY 1997/58 Local Law
Enforcement Block grant funds, $19,801 in Asset
and $187,500 in COPS More funding towards the project.
Under the current projected funding plan in the CI_, the Police

On November 11, 1998, the Traffic Safety Committee considered a request by Mr. Ed a r

Tisnado of 440 E. Plaza Boulevard to install traffic signals at the intersection of Plana
Boulevard and "E" Avenue adjacent to the Central Elementary School, and to review the o-:a
all traffic conditions around the school pertaining to speeding, children's safety, _--
congestion. After reviewing the staff report, and listening to the school offici==
present at the meeting, the Committee approved a number of measures which were recommer^-
to mitigate the congestion, parking, and school crossing problems during the peak school
hours. Cne of the items approved was to provide a stop sign on E. 9th Street at
intersection with 'E" Avenue in order to protect the safety of the children crossing - -
street at the painted crosswalk. The school is currently providing crossing guards at t_ _
location with the aid of adult supervision. The stop sign will control the traffic
approaching the crosswalk, allowing a safer crossing. The City's warrants for stop s_

installation were not considered nor investigated for the intersection, rather, this i_a=
was recommended as tart of the overall measures for the improvement of the traffic sa____-
around the school. The Traffic Safety Committee did not recommend the traffic s g-=

School in the vicinity of the corner of Plaza Boulevard and "E" Avenue. Based upon our
discussions, he has concerns for the safety of the children crossing Plaza Boulevard. as well as -.ne
traffic circulation in and out of the intersection. Mr. Tisnado is requesting the installation of traf=r.
signals and crosswalks at the intersection of Plaza Boulevard and "E” Avenue to alleviate
problem. He has been asked to appear before the Committee for additional input. We have

We have checked the available accident reports relevant to the area of s t.-.:dv. and found four
accidents in 1997' and 1998' occurring at the intersection of Plaza Boulevard and "B" Avenue. as
well as near "E" Avenue and 9th Street in front of the school. The accidence involve vehicles as well
as pedestrians. Refer to the attachments for more details.
STAFF RECOMMENDATIONS:
Open for discussion. but the following items should be considered:
1. Initiate the warrant study for traffic signals on Plaza Boulevard and "E" Avenue
2. Installation of a stop sign on E. 9th Street at its intersection with "B" Avenue :o enhance the
safety of pedestrians using the painted crosswalk.
3. If traffic sianais are not warranted, install timed flashing beacons on P'a7'1 Boulevard for
both directions of approach, on the existing "SCHOOL. SPEED LL\HT 25. `� r-._:=

4. Re -paint the "SCHOOL ZONE" pavement legends on the westbound lanes

EXPLANATION
On November 11, 1998, the Traffic Safety Committee considered a request by the Howrey
Family to investigate a speeding problem on Laurel Avenue, allegedly caused by the traffic
traveling in from 4th Street and proceeding to the intersection of First Street and Laurel
Avenue. After reviewing the staff report, and hearing the testimony from the Howrey's,
the Committee recommended the installation of a 3-way stop control at the intersection,
even though it did not meet the City's all -way stop sign warrants. Based upon the
warrants, a total of 30 points is necessary in order for an intersection to qualify for
an all -way stop control. The intersection of First Street and Laurel Avenue scored only
11 points. The intersection did however score 17 points out of the necessary 18 points
under the 2-way stop control warrants, for stop sign installation on First Street, as
it
meets Laurel Avenue. The Committee voted to approve the 3-way stop control due to the
skewed roadway alignments, and concerns over the occurrence of accidents at the
intersection due to the speeding motorists.

DISCUSSION:
This is an old item carried forward to this month from the September meeting. On September L.
1998. the Howley Family was present at the meeting, and were concerned about a speeding probierm
on Laurel Avenue caused by the traffic moving in from 4th Street_ and proceeding to the intersect:cm
of First Street and Laurel Avenue near Division Street. It was stated that speed control measu=
were needed along Laurel Avenue where it meets First Street. The Committee directed the staff .n
investigate the intersection of First Street and Laurel Avenue for a 3-way stop control. Based urcm_
the
City warrants for an all -way stop sign installation. the intersection does not qualify for a 3-way'
control. The total points scored for the 3-way stop control was 11 (out of the necessary 3
However. it scored a total of 17 pts. (out of the necessary 18) on the warrant study for a wan
control. with First Street being the minor street and having one direction of approach to =h_
intersection only. We found one accident report relating to a high rate of speed caused by a vetric_:=
traveling westbound on First and heading northbound into Laurel. According to the police repo--..
as a result of the high speed. this vehicle skidded -off its path. and hit another vehicle which .y.
parked on the opposite side of Laurel in the southbound direction. First Street has a skewed cur: et i
alignment as it meets Laurel Avenue. A stop sign installation on First Street therefore might be -
solution to reduce he potential for such accidents. and may be considered as justified. OthW

Initiate a speed hump study for Laurel. with stop control provided on First Street. T

A fully justified, properly installed four-way stop can effectively assign _gnt-
of-way, reduce vehicle delay and decrease accidents. Generally, a four.way
stops reserved for use at the intersection of two through highways, an_a only
as an interim traffic control measure prior to signalization. �-

FACTS:
NOTIFICATION: I was dispatched to a call of a hit and run traffic collision at 1,500
hours. I responded from 1200 National City Boulevard and arrived on scene at 16C5
hours. All times, speeds and measurements in this investigation are approximate.
Measurements were taken by rollrnetemexcept where otherwise indicated.
, CENE: At the scene of this collision, 00 Laurel Avenue is a northbound/southbo ad
city street consisting of two lanes. The roadway is straight and level. The southbotd
area on Laurel Avenue near First Street has a. "S" type bend. The surface is composed
primarily of asphalt.

PARTY=1(T"nknown) Lett the scene of the collision without identifying themsei , es.
V-1: A red 1988 Ford Escort California plate of 3LOG791, left the scene of the cci lion.
P-2: A green 1998 Ford pick up truck., was located on its wheels, facing southbouz
parked next to the curb.
PHYSICa_L EVIDENCE: Located at the scene was P-2 and (1) foot of lateral sic:t
marks from P-2 and debris in the roadway from both vehicles. V-1 left (30) feet of _re -
collision lock wheeled skid marks and (1) foot of post collision skid marks upon the
roadway. I photoQ*aphed the damage and the paint transference to P-2 and later log_ed
the photograph into NCPD property.
STATFMT-NTS:
PARTY=1/Unknown) P-I left the scene without identifying themselves.
CHERYL FOREMIA_Y (WITNESS) Foreman heard an engine racing and she looked
outside and saw V-1 hit P-2. V-1 then backed up and Ieft southbound on Laurel Avenue.
Foreman was unable to describe the suspect.
Foreman describer V-I as follows: Red Ford Escort.
LAWRFNCE . FRINAN (WITNESS) Kiernan said he was out in front of his house
when he saw V-1 northbound on Laurel Avenue. V-1 lost control of his vehicle as he
reached the curve at 1' Street and Laurel Avenue. V-1 hit his brakes and started to scd

until he struck the front end of P-2, which was parked at the curb with the front end of V-
I. V-1 then backed up and left southbound on Laurel Avenue.
Kiernan described the suspect as follows: Hispanic male adult, 20 years old, short hair on
the sides pulled into a ponytail.
He described V-1 as follows; a red Ford Escort GT, California plate of 3LOG791.
SUSAN DAVIS (WITNESS) Davis said she was behind V-1 as it turned off east Ind
Street onto northbound Laurel Avenue. V=1 accelerated to a high rate when it reached
Laurel Avenue. V-1 started to lose control and swerved onto east 1st Street. V-1 locked
his brakes and skidded head on into P-2. V-1 then backed um and fled southbound on
Laurel Avenue. Davis followed V-I to the area of east 2nd Street and "T' Avenue where
she Iost sight of him.
Davis described the driver of V-1 as follows: Hispanic male adult.
She described V-1 as follows: red Ford Escort California Iicense blare 3LOG791.
OPINIONS ND CONCLUSIONS:
SUMMARY: V-1 was northbound Laurel Avenue at a high rate of .need has he reached

ARF 4 OF IMPACT: The Area of Impact measured (121) fee: south of the south curb
line of Division Street, and (5) feet east of the west curb line of Laurel Avenue.
• CAUSE; The primary cause for this collision was a result of V-1 driving diving on the
wrong side of the road, violation of 21650 CVC. A secondary cause of this collision was
from V-1 driving too fast for the conditions, violation of 22250 CVC. An associated
factor to this collision when V-1 left the scene of the collision without identifying
themselves. violation 20002(a) CVC.

THE CALIFORNIA COASTAL COMNIISSION'S
SUGGESTED MODIFICATIONS TO THE
LOCAL COASTAL PROGRAM AMENDMENT NO. 1-98A.
WHEREAS, on July 28, 1998, the City Council of the City of National City approved an
amendment to update relevant policies and maps of the National City Certified Local Coastal
Program Land Use Plan for submittal to the California Coastal Commission as Local Coastal
Program Amendment No.1-98A; and,
WHEREAS, on October 15, 1998, the California Coastal Commission Resolution of
Certification for National City Local Coastal Program Amendment No.1-98A with suggested
modifications: and,
WHEREAS, on October 23, 1998, the California Coastal Commission Resolution Of
Certification for National City Local Coastal Program Amendment No.1-98A was transmitted
to the City of National City, setting forth the suggested modifications which must be accepted
and adopted by the City Council of the City of National City to achieve final certification of
Local Coastal Program Amendment No.1-98A; and,
WHEREAS, the Community Development Commission of the City of National City has
prepared revisions to Local Coastal Program Amendment No. 1-98A that incorporate the
suggested modifications contained in the California Coastal Commission Resolution of
Certification; and
WHEREAS, public notice of the intent of the City Council of the City of National City to
consider those revisions to Local Coastal Program Amendment No. 1-98A on December 1,
1998, to incorporate the California Coastal Commission's suggested modifications, was
mailed, published in a newspaper of general distribution, and otherwise made available on
November 11, 1998; and
WHEREAS, the review and approval of the suggested modifications by the California Coastal
Commission on October 15. 1998 constituted the functional equivalent of CEQA review; and
WHEREAS, the proposed action is statutorily exempt from CEQA;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City
acknowledges receipt of the California Coastal Commission Resolution of Certification for
National City Local Coastal Program Amendment No. 1-98A with suggested modifications.

agrees to those suggested modifications to National City Local Coastal Program Amendment

BE IT FURTHER RESOLVED that the City Council of the City of National City hereby
formally adopts those suggested modifications as amendments to National City Local Coastal
Program Amendment No.1-98A.
BE IT FURI'lihR RESOLVED that the City Council of the City of National City agrees to
issue coastal development permits for the total area included in the land use plan, including
those portions covered by National City Local Coastal Program Amendment No. 1-98B. as
certified by the California Coastal Commission on November 5, 1998.
BE IT FURTHER RESOLVED that the City Council of the City of National City authorized
transmittal of this resolution and all relevant supporting documentation to the Executive
Director of the California Coastal Commission for determination that this action is lezaJy
adequate to satisfy the suggested modifications contained in the Commission's action on October
15, 1998.
BE IT 1- JRTHER RESOLVED that the City Council of the City of National City respectfully
requests concurrence in the Executive Director's determination by the California Coastal
Commission at its December meeting in San Francisco.

AMENDMENT TO THE CERTIFIED NATIONAL CITY LCP LAND USE PLAN
NOTE: This draft amendment to the certified National City Local Coastal Land Use Plan has been
prepared to update it with regard to (1) the ownership status of Paradise Marsh, the resultant legal
and restoration authorities over it, (2) deletion by the Coastal Commission in the Chula Vista LCP
of the Tidelands Avenue extension across Sweetwater Channel and the need to harmonize the
parallel provision of the National City LCP, and (3) pending changes in land use planning and
permitting authority over a portion of the National City Marina project site, for which the Port
District has processed Port Master Plan Amendment No. 19 and is currently processing a legal
geographicalboundary amendment, which will give it coastal development permit review
responsibility in This area.
1.0 Policy Recommendations
1.1
Recreation Policy 1
Revise as follows to accurately state the status of Paradise Marsh wetlands:
"The National City bayfront shall be designated for tourist commercial and
recreational use, as indicated in the Land Use Plan (Figure 1). The areas north to the
west and to the north..."
1.2 Recreation Policy 3, Paragraph 2
Revise as follows to reflect the deletion of the Tidelands Avenue crossing from the
Chula Vista LCP by the Coastal Commission:
"Tourist commercial development in the above referenced areas shall be consistent
with existing or currently planned road capacities to the north and south of the
proposed tourist commercial area, including the planned extension of Harrison
Avenue and of 32"d Street to intersect with it.
1.3 Recreation Policy 5
Given the federal acquisition of Paradise Marsh, Policy 5 should be revised as
fo lows:
"Paradise Marsh has been acquired by the United States of America and is managed
as a National Wildlife Refuge unit by the U. S. Fish and Wildlife Service. To
enhance the environmentally sustainable recreational potential and attractiveness of

the National City waterfront, the restoration and management of Paradise Marsh for
high quality endangered species habitat and associated wetland values is a desirable
program. A feasible restoration plan is the province of the U. S. Fish and `,'wildlife
Service, whose coordination and cooperation with the City and other interested
agencies, persons, and organizations is cordially invited.
1.4 Marsh Preservation Policy 1
Given the federal acquisition of Paradise Marsh, and the U.S. Attorney General's
opinion that the state coastal program does not govern federal lands, this aoiicy
requires jurisdictional specifications. The following is recommended:
"The wetlands of the Paradise Marsh complex, including the secondary area of
Paradise Marsh, east of 1-5 (Banister Marsh), salt marsh, freshwater marsh, salt -par,_
..
channel, and mudflat habitats, are valuable and sensitive biological resources, art+
shall be preserved thronah coordinated actions by the City and the United Stares
Fish and Wildlife Service, which manages Paradise Marsh for the United States of
America. The plan shall be OPEN SPACE/WETLAND PRESERVE. Toe
boundaries of the "Open Space Wetland Preserve" include marsh area within foe
Caltrans right-of-way easterly of the SDG&E right-of-way and Bannister Marry..'
1.5 Marsh Preservation Policy 3
Given the federal acquisition of Paradise Marsh, and the US Attorney General's
opinion that the state coastal program does not govern federal lands, this policy ails-)

"To enhance the habitat and aesthetic value of Paradise Marsh transitional and lig^-
tide refugia areas located within the City's jurisdiction, the wetlands located west
the railroad, which are not proposed for federal acquisition, as well as Barniw
Marsh, and the Sweetwater River south of 35th Street, feasible restoration activities
shall be encouraged. Feasible restoration activities shall be determined with *tne
potential assistance of the State Coastal Conservancy, US Fish and Wildlife Service
California Department of Fish and Game, or other public agency or private prat:
including the Bayfront Conservancy Trust, to finance, plan implement and manac
a restoration program. The recommended elements for a 1e Loration
include:
• "A public access and information program...
• "The removal of all rubbish and debris...
• "The encouragement of a scientific research and educational haugram."

2.0 Maps
NOTE: Revised LUP Maps Figures 1,2, and 3, as adopted by the City Council to
implement the written recommendations below, are attached. Drafts of these maps were
attached to the June 16, 1998 Public Review Draft LUP Amendment.
2.1 Land Use Plan map (Figure 1)
2.1.1 The Land Use Plan map presently designates the area of Paradise Marsh
owned by the United States for "OSR" Open Space Wetland Preserve.
The map should be amended to state, that the National City LCP policies.
relating to land owned by the federal government, are advisory only and
have no binding legal effect on federal activities".
2.1.2 The Land Use Plan map presently extends the CT (Tourist Commercial)
District south of the easterly projection of 32nd Street, between the historic
mean high tide line on the west and the westerly boundary of the SDG&E
utility corridor parcel. This area is part of the National City Marina
project addressed by the Port District in PMPA 19 and will be further
addressed in the pending Port Distiict legal geographical boundary map
amendment. This area should therefore be deleted from Figure 1.
2.2 Political Jurisdictions (Figure 2)
2 2.1 The Political Jurisdictions map presently designates the area of Paradise
Marsh owned by the United States as being within the political jurisdiction
of the City of National City. The map should be amended to state, that the
National City LCP policies, relating to land owned by the federal
government, are advisory only and have no binding legal effect on federal
activities".
2.2.2 The Political Jurisdictions map also presently includes the area, south of 32'
Sheet and between the historic MHTL and the westerly boundary of the
SDG&E utility corridor parcel, as being in the City's political jurisdiction.
With Port District transmittal of the above -referenced legal geographical
boundary amendment and Coastal Commission ministerial action on it. the
area should also be deleted from this map.
2.3 Subareas (Figure 3)
2.3.1 The Subareas map includes the area of Paradise Marsh owned by the United
States within Coastal Zone Subarea II. The map should be amended to state.
that the National City LCP policies, relating to land owned by the federal
government. are advisory only and have no binding legal effect on federal
activities".

2.3.2 The Subareas map also includes the area of the National City Marina that
shortly will be within the Port District's jurisdiction upon Coastal
Commission action on the revised legal geographic boundary. It should be
excluded here, as well

Dear Mr. Desrochers:
On October 15, 1998, the California Coastal Commission approved, with suggested
modifications, the above -described LCP Amendment. For your reference, a copy of the
suggested modifications are attached. The amendment involved several :ec nicai
revisions to the City's certified Land Use Plan (LUP). Specifically, the amendment
revises several LUP policies and maps to reflect the change in ownership of Paradise
Marsh and the designation of the marsh area as a National Wildlife Re± e. In addition,
the amendment includes LISP policy revisions to reflect the eliminarion of he Tidelands
Avenue crossing over the Sweetwater Channel and revision to the LUP jurisdictional map
to reflect a boundary change from National City to Port jurisdiction for a portion of the
National City Marina project site.
Before the LCPA can become effectively certified, the Executive Director must
determine that implementation of the LCPA will be consistent with the Commission's
certification order. This is necessary because the LCPA was certified with suggested
modifications and was originally transmitted to the Commission without a resolution
from the City stating that the LCPA will take effect automatically upon Coastal
Commission approval.
In order for the Executive Director to make this determination, the City Council must
formally acknowledge receipt of the Commission's resolution of certifcanon. including -
any terms or suggested modifications; accept and agree to those terms and modifications;
and, take any formal action which is required to satisfy them, such as rezc ings or other
ordinance revisions. As soon as the necessary documentation is received in this office,
and accepted, the Executive Director will report his/her determination to "tee Commission
at its next regularly scheduled public hearing.

EXPLANATION a'"?
Assembly Bill 3229, Chapter 134, Statutes of 1996, established the
Citizen's Option for Public Safety (COPS) Program to provide local
law enforcement supplemental funding to eligible jurisdictions, as
defined, for public safety purposes. Under the COPS Program, the
City of National City will receive its share of the $100,000,000 i__
1998-99 appropriations from the State of California based on its
proportionate share of the State's population using the Stare
Department of Finance's January 1, 1998 population estimates.
According to the January 1, 1998 State Department of Finance
National's City population was estimated at 54,400 making _b
eligible for approximately $122,698 in COPS funding during FY
1998/99. The COPS program is an on -going program. However it will
require a new appropriation for continued funding each year. The
State Controller allocated funds to each county on September 15,
1998. The funds in each county were appropriated to the cities by
October 15, 1998. (continued)

W H H REAS, Assembly Bill 3229, Chapter 134, Statutes of 1996, established the
Citizen's Option for Public Safety (COPS) Program to provide Supplemental Law Enforcement
Services Funding (SLESF) for public safety purposes; and
WWFREAS, the City Council must designate an eligible public safety program for
which the annual fiscal year COPS grant will be appropriated in order to receive such grant; and
W1-►HREAS, the City Council pursuant to the recommendation of the Chief of Police has
determined that the purchase of an integrated Computer Aided Dispatch and Records
Management System (CAD/RMS) will be an appropriate expenditure of said grant funds.
NOW, 1HitREFORE, BE TT RESOLVED that the City Council of the City of
National City hereby designates and therefore appropriates the anticipated grant fund of
$122,678 inFY 1998/99 SLESF funding, to CIP Account #157-409-000-8010 for the purchase
of the necessary hardware and software and appropriate interface for an integrated CAD/RMS
system.

In the case of a city, the City Council is required to appropriate
existing and anticipated COPS moneys exclusively to fund front line
municipal police services. Front line COPS funds may be used to
fund both police personnel and equipment. The COPS monies must
supplement and not supplant existing police services.
COPS funds shall be appropriated pursuant to written requests from
the Chief of Police. The request must specify the front line law
enforcement needs of the requesting entity including the personnel,
equipment and programs.
Pursuant to AB 3229, the City Council must hold a public hearing in
to consider these requests. Funding will be determined by a
majority vote of those present at the Council meeting within 60
days of receiving the request for funding. The City Council must
consider these written requests separate and apart from the
proposed allocations from the city general fund.
The National City Police Department is therefore submitting a
request that the City Council appropriate FY 1998/99 Supplemental
Law Enforcement Services Fund monies in the amount of $122,698
for the purchase of an integrated Computer Aided Dispatch (C.A..
and (R.M.S.) system.
The Warner Group conducted a CAD needs assessment which was
presented to Council at the June 9, 1998 meeting. The needs
assessment determined that the Police Department existing CAD/RMS
is not Year 2000 compliant nor does it have the functionalities of
a modern day CAD/RMS system such as the ability to provide ofr
safety premise history, officer safety time prompts for
dispatchers, automated 911 interface, automated geofiles, unit
assignment cr simultaneous viewing of unit status and call screens.
Additionally the exisitng C.A.D. system lacks the capacity of
producing management reports that track the time of all officers
assigned to calls. The Warner Group recommended purchase of a
CAD/RMS system with the above functionalities. The Warner Group
indicated that the one time purchase cost of a CAD/RMS system which
would `.•,r; " the needs of the National City Police Department
would be between $699,000 and $1,118,000.
The Police Department submitted a Capital Improvement Request
for
a Computer Aided Dispatch/Records Management System (Project no.
8010) during the FY 1998/99 budget process and received subsequent
Council approval for the project as part of the FY 1998/99 Capital
Improvement Program.

The Police Department is requesting that the $122,678 in FY 1998/99
SLESF funds be appropriated to CIP account #157-409-000-8010 for
the purchase of an integrated Computer Aided Dispatch and Records
Management system. The funds would be utilized to purchase the
necessary computer hardware, software, software configuration,
software customization, as well as necessary interfaces to the
automated field reporting system (AFR), 911 and other critical _a::
enforcement databases.
These funds require no local match from the City of National City.
The Police Department currently estimates the cost of the purchase
of a CAD/RMS system at approximately $838,391. To date Council has
approved appropriation of $178,391 in FY 1997/98 Local Law
Enforcement Block grant funds, $19,801 in Asset forfeiture funds
and $187,500 in COPS More funding towards the project. This
resolution, if approved, would bring the total amount of aoorove_d
funding for the project to $508,370.
Under the current projected funding plan in the CIP, the Police
Department intends to fund the balance of the project with —
1998/99 Local Law Enforcement Block grant funds. The P^'=^=
Department will bring a request to Council for those funds after '-
has been reviewed by the Local Law Enforcement Block Grant Advisor -
Board.
Approval of the Resolution would authorize appropriation of
$122,698 in FY 1998/99 Supplemental Services Funds for the purchase
of an integrated Computer Aided Dispatch and Records Management
system.

Government Code §36516.5 provides that a change in compensation does not apply to a
councilman during his term in office. However, compensation for all members of the City:
Council may be adjusted whenever one or more members become eligible for an increase by
virtue of beginning a new term of office. As a result, adjustments to compensation of Council
members has been geared to elections at which members begin a new term in office.
The last salary adjustment for the Mayor and City Council occurred on December 17, 1996.
with the enactment of Ordinance No. 96-2128. That ordinance provides that for the base
period between January 17, 1997 and November 3, 1998, the base salary of the Mayor and
City Council shall be increased by the same percentages, on the same dates, and subject to the
same conditions. as the salary increases for Municipal Employees' Association members, is
any, provided that the salary increases for the City Council shall not exceed a total of ten
percent of the current base monthly salary. Pursuant to Ordinance No. 96-2128, the current
base monthly salary for the Mayor is $2548.21, and the current base monthly salary for the
City Council is S691.16, with an increase of 3% to take effect January 12, 1999.
Under Government Code §36516, the Council may, by ordinance, increase its compensation
by 5 % per calendar year from the date of the last increase in compensation. Accordingly, the
City Council may at this time increase its monthly compensation by 10%. Pursuant to
Government Code §36516.1, an elected mayor may be provided with compensation in addition
to that which he receives as a councilman, pursuant to an ordinance or by a vote of the electors
at a municipal election. There are no limitations imposed on the amount of the mayor':
compensation. Historically, the mayor has received the same adjustments in compensation as
the City Council.
Health and Safety Code §34130 (part of the Community Redevelopment Law) states that the
City Council may provide for the compensation of members of the Community Developmer._
Commission. There are no limits stated with respect to the amount of compensation, or with
respect to the timing of any adjustments in compensation. Past practice has been for the Chair

and Members of the Community Development Commission to receive the same compensation
as the City Council, and for adjustments to be made at the same time as adjustments in City
Council compensation. Ordinance No. 91-2000 provides that "the salary for the Chairman and
each member shall hereafter be the same as that paid each member of the City Council of the
City of National City." Accordingly, the compensation for the Chairman and members of the
CDC, if modified, would be set at the same level as the compensation for City Council.
If the City Council desires to increase the compensation of the Mayor, the City Council, the
CDC Chairman and Board Members by the same percentages, on the same dates, and subject
to the same conditions as the upcoming salary increases for Municipal Employees' Association
Members, if any, then the attached ordinance should be approved for introduction.

BE IT ORDAINED by the City Council of the City of National City as follows:
Section 1. That pursuant to the provisions of Sections 36516 and 36516.5 of the
California Government Code, for the time period between the effective date of this Ordinance and di-
-general municipal election held on November 7, 2000, the base monthly salary for the City Coun:
shall be increased by the same percentages, on the same dates, and subject to the same conditions,
the upcoming salary increases for Municipal Employees' Association members, if any, provided th.
the salary increases for the City Council shall not exceed a total of ten percent of the current baste

dates, and subject to the same conditions, as the upcoming salary increases for Municipal Employees
Association members, if any, provided that the salary increases for the Chairman and each member of
the Community Development Commission shall not exceed a total of ten percent of the current base
monthly salary.
