(IAFD), and to perform the work by their own forces. The reason for the request is that the subcontractor has caused a substantial delay to the progress of the work. In accordance with Section 4107(a)7 of the Public Contract Code (attached), We have notified the subcontractor and have not received an objection to the intended replacement within the required time limits set in the Code. This failure on the part of IAFD to file a written objections to the replacement indicates their consent to the replacement. Shasta's superintendent Jim Duff told Intra-Am-erican to schedule -pile driving to begin on Monday, October 5, 1998. This work was actually ready for them last week but Intra-American hasn't even moved any equipment to the job -site yet. In- accordance with state law and our subcontract agreement I faxed a letter to them yesterday giving them 48 hours - to- supply equipment, material, and workmen to the jobsite. Then today Infra -American told me that they will not have a crew ready until Wednesday next week October 14, 1998. At 10:30 tomorrow morning -they will be inviolationof their subcontract and they will have delayed the job four more days. During stage 1 construction on this project Infra -American was late showing up and then managed to establish a production rate less than 2 pile per day delaying the work. They are not starting off any better this time. Therefore, we request that the City permit Shasta Constructors, Inc. to take over and complete this work with our own forces. We have a 100 Ton 3 drum conventional truck crane on hold and a Delmag hammer with 100' of leads ready to ship. With your prompt approval we could be driving pile on Monday, October 12, 1998. AGC' CALIFORNIA An Equal Opportunity Employer § 4107 Substitution of Subcontractor; Assignment of Subcontractor; Work for which Subcontractor not Designated No prime contractor whose bid is accepted shall: (a) Substitute any person as subcontractor in place of the subcontractor listed in the original bid, except that the awarding authority, or its duly authorized officer, may, except as otherwise provided in Section 4107.5, consent to the substitution of another person as a subcontractor in any of the following situations: (1) When the subcontractor listed in the bid after having had a reasonable opportunity to do so fails or refuses to execute a written contract, when that written contract, based upon the general terms, conditions, plans and specifications for the project involved or the terms of that subcontractor's written bid, is presented to the subcontractor by the prime contractor. Prior to approval of the prime contractor's request for the substitution the awarding authority, or its duly authorized officer, shall give notice in writing to the listed subcontractor of the prime contractor's request to substitute and of the reasons for the request. The notice shall be served by certified or registered mail to the last known address of the subcontractor. The listed subcontractor who has been so notified shall have five working days within which to submit written objections to the substitution to the awarding authority. Failure to file these written objections shall constitute the listed subcontractor's consent to the substitution. If written objections are filed. the awarding authority shall give notice in writing of at least five working days to the listed subcontractor of a hearing by the awarding authority on the prime contractor's request for substitution. Harding Lawson Associates Reno, Nevada The consultants were evaluated based on the capability of their pavement management software and its interface with Geographic Information System (GIS), their experience in using the software, and their expertise and qualifications in evaluating and performing network level pavement management surveying. Harding Lawson Associates was found to be highly qualified and they meet the City's requirements for providing pavement management services. The responsible CONTRACTOR/engineer shall sign all plans, specifications, estimates (PS&E) and engineering data furnished by him/her and where appropriate, indicate his/her registration number. 26. The PAVER program will provide the City with: • Pavement Inventory, • Pavement Condition Reports. • Report Capabilities. • Pavement Performance Models. • Multi -Year M&R Planning Based on Available Budgets. • Multi -Year M&R Planning Based on a Desired Minimum Network Condition Level. • Additional Fields for Other Features, • Priority Table. • Ability to Combine or Part Pavement Sections. • Ability to Accept Manual or Automated Distress Data. • Built-in GIS/Mapping Capabilities. • Graphics Capabilities Etc. A pavement management system is a tool that will help engineers make cost effective pavement maintenance and rehabilitation decisions based on engineering facts. A PMS provides a way to schedule and plan maintenance and rehabilitation. A PMS is a long term planning tool that will result in an overall improvement of the City's pavement network condition and will also result in savings for the City by applying the appropriate M&.R activity at the appropriate time. There are several components or elements that are essential to a pavement management s' stern. These elements will be discussed in :he following sections. 1.1 PAVEMENT INVENTORY DATA HLA will begin the implementation by performing records review and network identification of pavement sections. In order to develop a pavement inventory suitable for the pavement management system and pavement evaluation. HLA proposes to interview City personnel and review any existing pavement records. Then. with close coordination from the City personnel. HLA will identify the pavement network for the City. Assistance and input from the City personnel will be very important during the records review and network development. HLA will also review the City's current pavement maintenance. repair and rehabilitation practices and will discuss their performance with City personnel. 1.1.1 Records Review HLA will perform a brief records review and inventory to document the historical data available regarding roadway construction, cross section. pavement rehabilitation. maintenance, traffic. use. era. and previous pavement management system. The first element of records review will be to look at as -built or design drawings and records, if any. If the records are available. the date of construction. cress section and construction limits will de collected. This data identifies when roads were constructed and their existing pavement structures. HLA will also interview City personnel. Very often. Cites void timers ha. e Hardin_ Lawson Associates extensive knowledge and can provide valuable information regarding road construction and history. The construction data will be input in the PAVER computer program for storage and future use. 1.1.2 Network Identification HLA will develop a detailed inventory of the City pavements and will divide the pavement network into management units or sections. HLA will break the City's streets into management units to be identified by the pavement management program. HLA will include all the arterials. collectors, residential and local streets and other misc. streets in the City's pavement network such that every single street in the City will be included in the database and will have at least one section. The pavement inventory will be discussed with the City personnel and will include all street and sections data as follows: • Street or Branch Name • Section beginning and end • Pavement Section length. width. area • Last construction date • Surface type • Geographical location • Functional classification • Section category • Traffic Other inputs. such as: • Sidewalks • Curb and guners • Gutters • Spandrels • Drainage • Traffic • Siuna_e • Pavement distresses • Etc. may be input after the pavement condition surveys are performed. HLA will use a copy of the Cit.'s Base map for roadways to create a Pavement Management Map. HLA will draw in the section limits and identification names. The resulting Map will be in a format compatible or ready to be interfaced with the City's GIS using ArcView software. The Map will be delivered to the City at the end of the project (edits to :his map will be finalized after verification during the pavement inspections). All the network data will be input into the PAVER pavement management computer program. Data will be checked and verified during the pavement condition surveys. 1.2 PA VEME_'v T CONDITION ASSESSMENT HLA will perform a visual pavement condition survey using the Pavement Condition Index (PC:) methodology. Structural evaluation of the pavement sections using a Dvnatest falling weight deflectometer, and roughness measurement. in terms of the international Roughness Index (IRI). using a Dynatest Road Surface Profiler. may be perflor?ned if necessary. 1.2.1 Pavement Inspections HLA proposes to perform PC1 pavement condition surveys on section. Every sin=ie least one representat e every pavement street will have at nspection. HLA recommends inspection of one representative :OC-feet :Or.: by :ui Harding Lawson Associates sample for each 1.000 feet of pavement length in a section. This inspection will provide a general condition of the pavements and the basis for the M&R Plan. Once the M&R Plan has been developed. HLA recommends a more detailed project level inspection on all sections scheduled for the first year of the M&R Plan, and/or on all the sections with the highest priority. HLA will use two experienced inspectors to complete the pavement condition surveys within a reasonable time frame. The inspectors will first drive the entire section length and then select a representative 100 foot long sample to survey. All distresses and their severity within the sample will be identified and measured. The data will be recorded on inspection sheets. to preserve as permanent records. and later input into the computer program to calculate the corresponding PCIs. During this time. the general condition of any other features. such as sidewalks. curbs. gutters. shoulders. drainage. etc. may be considered or inventoried according to the City's needs. If a pavement section exhibits an area with significantly different condition than the rest of the section. an additional or special sample will be identified and inspected. These additional samples are flagged and although the distresses are included in the PCI calculations. the quantities are not extrapolated over the entire section. Safety is always of great concern for HLA. Pavement inspectors will have periodic meetings to discuss safety items and address any potential safety problems. The vehicles to be used by the inspectors will have visible warning yellow blinking lights to alert the public of their presence. High traffic areas will be inspected at off-peak hours or dur: tc weekends. If necessary. arran_ements for traffic control devices will be mace. HLA can provide additional hands-on training to City personnel. free of charge. while performing pavement inspections. City personnel can observe or assist HLA inspectors and receive valuable training without any additional cost to the project. if the City so desires. HLA's project manager. Mr. Jose Patroni will be one of the inspectors out in the field. Thus, should any technical. schedule. or general project questions or concerns arise. the project manager will be able to make quick decisions. minimizing any potential delays in the work. This approach also provides the City officials with the confidence that they are getting the highest level of pavement evaluation services. Most of HLA inspectors are experienced engineers who not only can identify distresses, but also can understand the cause of distresses and their relation to pavement behavior. 1.2.2 Data Input and PCI Calculations All the data collected during the pavement condition inspections will be double checked and input into the PAVER computer program. Any additional data gathered will also be input into the PAVER pavement network database. Once the pavement distress data is input in the computer, the program will be used to calculate the PCI for each sample inspected and for the corresponding pavement section. Reports will be generated and checks will be performed to assure that the database is complete and error free. PCI and inventory reports will be submitted to the City. 1.2.3 Pavement Performance Modeling HLA will use the PAVER system to perform family curve analysis and establish pavement performance. The PAVER program uses the family curve prediction Hardinu Lawson Associates models to estimate pavement conditions in the future. The number of families to be developed will depend on the City's needs. surface types. pavement ranks. traffic and use. 1.3 PAVEMENT RANKING, MAINTENANCE POLICIES AND REHABILITATION STRATEGIES HLA will rank the pavement sections based on their surface condition, traffic, and pavement rank. The PAVER program priority table will be used to assign priorities to the pavement sections. The priority table defines the order in which pavement sections need to be maintained or rehabilitated. HLA will coordinate with the City_ to setup maintenance policies. HLA will review the performance of the existing rehabilitation strategies with the City and recommend new strategies. if necessary. 1.4 MULTI YEAR MAINTENANCE AND REHABILITATION PLAN HLA will use the PAVER program to develop a Multi Year M&R Plan for the City of National City using the City's future estimated funding projections. The M&R Plan will provide the City with candidate pavement sections for maintenance and rehabilitation planning purposes. 1.5 GIS MAPPING HLA will link the Citvs PAVER database to a CAD map (either AutoCad or IntergraphiMicroStation format) obtained from the City's base map. In this way_ all the PAVER data can be graphically shown using ESRI's Arc View software. HLA will use ArcCad in order to develop ciosed polygons for each pavement section. It is not necessary for the City to have a GIS already in place in order to do the PAVER linkage. HLA can link the PAVER darahase to the City's base map to create a mini GIS for the pavement data only. which can be viewed using ArcView. HLA can also provide customized buttons to enhance ArcView capabilities. If additional effort. programming or involvement is desired or required. GIS group can be called upon to perform the additional tasks necessary to do the work. 1.6 FINAL REPORT HLA will provide the City with copies of a written report. The report will describe the tasks performed and the results of the implementation of the pavement mana_ement system. the Multi Year M&R Plan. and recommendations for fc:ure updates and for continuing use of :he program. The report will include :he pavement surface assessments for a.. the streets in the City. HLA will also provide the Cite w_ an error -free PAVER pavement management system database. The database will cc-:ain all the pertinent pavement data coi:e_ted during the implementation, branch and section data, inspection data and the Year M&R Plan. HLA will also provide the City with the PAVER-GIS pavement management linkage so all the data included in the PAVER database can be graphically shown in a GIS. HLA will deliver all maps and files necessary to view the GIS linkage so the City can use and update it as necessary. 1.7 TRAINING HLA will provide 32 hours of training to the City personnel on the interpretation, use and implementation of the PAVER pavement management system. This training will be conducted in City offices, using the City's pavement database. If more training is necessary or desired, HLA will make arrangements to do so. City of National City Grant Agreement 98-033 Page 3 AUTHORIZATION The signature of the Executive Officer of the Conservancy on this agreement certifies that at its August 20, 1998 meeting, the Conservancy adopted the resolution included in the staff recommendation attached as Exhibit B. This agreement is executed pursuant to that authorization. City of National City Grant Agreement 98-033 Page 4 Standard Provisions WORK PROGRAM Prior to commencement of the project, the grantee shall submit a detailed work program to the Executive Officer for review and written approval as to its consistency with the terms of this agreement. The work program shall include: 1. The specific tasks to be performed. 2. A schedule of completion for the project, specifically listing the completion date for each project component and a final project completion date. 3. A detailed project budget. The project budget shall describe all labor and materials costs to be incurred to complete each component of the project. For each project component, the project budget shall list all intended funding sources including the Conservancy's grant, and all other sources of monies, materials, or labor. If all or part of the project to be funded under this agreement will be performed by third parties ("contractors") under contract with the grantee, then the grantee shall, prior to initiating any request for contractor bids, submit the bid package for review and written approval of the Executive Officer. Upon approval by the Executive Officer, the grantee shall proceed with the bidding process. Prior to final selection, the grantee shall submit to the Executive Officer for written approval the names of all contractors that the grantee intends to hire. The grantee shall then comply with the above paragraph regarding submission and approval of a work program prior to implementation. The work program shall have the same force and effect as if included in the text of thie agreement. However, the work program may be modified without amendment of this agreement upon the grantee's submission of a modified work program and the Executive Officer's written approval of it. If this agreement and the work program are inconsistent, the agreement shall control. The grantee shall carry out the project in accordance with the approved work program. City of National City Grant Agreement 98-033 Page 5 COORDINATION AND MEETINGS The grantee shall coordinate closely with Conservancy staff and other involved entities, including local, state and federal agencies, and shall participate in meetings and other communications as necessary to ensure coordination. WORK PRODUCTS All materials and work products produced by the grantee as a result of this agreement are the property of the Conservancy. COSTS AND DISBURSEMENTS Upon determination by the Conservancy that all "CONDITIONS PRECEDENT TO COM ENCJ MENT OF PROJECT AND DISBURSEMENT" have been fully met, the Conservancy shall disburse to the grantee, in accordance with the approved project budget, a total amount not to exceed the amount of this grant, as follows: Disbursements shall be made on the basis of costs incurred to date, less ten percent, upon the grantee's satisfactory progress in accordance with the approved work program and upon submission of a "Request for Disbursement" form, which shall be submitted no more frequently than monthly but no less frequently than quarterly. Disbursement of the ten percent withheld shall be made upon (1) the grantee's satisfactory completion of the project, compliance with the "PROJECT COMPLETION" section of this agreement, and submission of a fully executed final "Request for Disbursement" form; and (2) the Conservancy's acceptance of the project. The grantee shall request disbursements by filing with the Conservancy fully executed "Request for Disbursement" forms (available from the Conservancy). The grantee shall submit the final form within thirty days after the completion date provided in the "TERM OF AGREEMENT" section, above. The grantee shall state on the form its name and address, the number of this agreement, the date of the submission, the amount of the invoice, the period during which the work was actually done, and an itemized description of all work done for which disbursement is requested. The form shall be signed by an authorized representative of the granter. Additionally, each form shall be accompanied by any supporting invoices or other source documents from contractors that the grantee engaged to complete any portion of the project funded under this agreement, and by written substantiation of completion of the portion of the project for which disbursement is City of National City Grant Agreement 98-033 Page 6 COSTS AND DISBURSEMENTS (Continued) requested. With each form, the grantee shall also submit a supporting progress report summarizing the current status of the project and comparing it to the status required by the work program (budget, timeline, task, etc). Failure to fully execute and submit a "Request for Disbursement" form, including attachment of supporting documents, will relieve the Conservancy of its obligation to disburse funds to the grantee unless and until all deficiencies in the form are rectified. EXPENDITURE OF FUNDS AND ALLOCATION OF FUNDING AMONG BUDGET ITEMS The grantee shall expend funds in the manner described in the approved project budget_ The allocation of the Conservancy's total grant among the items in the project budget may vary by as much as ten percent without approval by the Executive Officer. Any difference of more than ten percent must be approved in writing by the Executive Officer. The Conservancy may withhold payment for changes in particular budget items which exceed the amount allocated in the project budget by more than ten percent and which have not received the approval required above. The total amount of this grant may not be increased except by amendment to this agreement. Any increase in the funding for any particular budget item shall mean a decrease in the funding for one or more other budget items unless there is a written amendment to this agreement. PROJECT COMPLETION The grantee shall complete the project by the completion date provided in the "TERM OF AGREEMENT" section, above. Upon completion of the project, the grantee shall supply the Conservancy with evidence of completion by submitting: (1) the enhancement plan and any other work products specified in the work program for the project; and (2) a fully executed final "Request for Disbursement" form. Within thirty days of grantee's compliance with this paragraph, the Conservancy shall determine whether the project has been satisfactorily completed. If the Conservancy determines that the project has been satisfactorily completed, the Conservancy shall issue to the grantee a letter of acceptance of the project. The project shall be deemed complete as of the date of the letter of acceptance. City of National City Grant Agreement 98-033 Page 7 EARLY TERMINATION AND FAILURE TO PERFORM Prior to the completion of the project, either party may terminate this agreement for any reason by providing the other party with seven days notice in writing. If the Conservancy terminates the agreement prior to the completion of the project, the grantee shall take all reasonable measures to prevent further costs to the Conservancy under this agreement, and the Conservancy shall be responsible for any reasonable and non - cancelable obligations incurred by the grantee in the performance of this agreement prior to the date of the notice to terminate, but only up to the undisbursed balance of funding authorized in this agreement. If the grantee fails to complete the project in accordance with this agreement, or fails to fulfill any other obligations of this agreement prior to the termination date, the granter shall be liable for imm i1iate repayment to the Conservancy of all amounts disbursed by the Conservancy under this agreement. The Conservancy may, at its sole discretion, consider extenuating circumstances and not require repayment for work partially completed. This paragraph shall not be deemed to limit any other remedies the Conservancy may have for breach of this agreement. LIABILITY The grantee shall be responsible for, indemnify and save harmless the Conservancy, its officers, agents and employees, from any and all liabilities, claims, demands, damages or costs resulting from, growing out of, or in any way connected with or incident to this agreement, except for active negligence of the Conservancy, its officers, agents or employees. The duty of the grantee to indemnify and save harmless includes the duty to defend as set forth in Civil Code Section 2778. This agreement supersedes the grantee's right as a public entity to indemnity (see Gov. Code Section 895.2) and contribution (see Gov. Code Section 895.6) as set forth in Gov. Code Section 895.4. The grantee waives any and all rights to any type of express or implied indemnity or right of contribution from the State, its officers, agents or employees, for any liability resulting from growing out of, or in any way connected with or incident to this agreement. Nothing in this agreement is intended to create in the public or any member of it rights as a third party beneficiary under this agreement. City of National City Grant Agreement 98-033 Page 8 AUDITS/ACCOUNTING/RECORDS The grantee shall maintain standard financial accounts, documents, and records relating to implementation of the project. The grantee shall retain these documents for three years following the date of final disbursement by the Conservancy under this agreement, regardless of the termination date. The documents shall be subject to examination and audit by the Conservancy and the Bureau of State Audits during this period. The grantee may use any accounting system which follows the guidelines of "Generally Accepted Accounting Practices" published by the American Institute of Certified Public Accountants. NONDISCRIMINATION During the performance of this agreement, the grantee and its contractors shall not unlawfully discriminate against, harass, or allow harassment against any employee or applicant for employment because of sex, race, religion, color, national origin, ancestry, disability, medical condition, marital status, age (over 40) or denial of family -care leave, medical -care leave, or pregnancy -disability leave. The grantee and its contractors shall ensure that the evaluation and treatment of their employees and applicants for employmeutt are free of such discrimination and harassment. The grantee and its contractors shall comply with the provisions of the Fair Employment and Housing Act (Government Code Section 12900 et seq.) and the applicable regulations (California Code of Regulations, Title 2, Section 7285.0 et seq.). The regulations of the Fair Employment and Housing Commission regarding Contractor Nondiscrimination and Compliance (Chapter 5 of Division 4 of Title 2 of the California Code of Regulations), are incorporated into this agreement. The grantee and its contractors shall give written notice of their obligations under this clause to labor organizations with which they have a collective bargaining or other agreement. This nondiscrimination clause shall be included in all contracts and subcontracts entered into :o perform work provided for under this agreement. INDEPENDENT CAPACITY The grantee, and the agents and employees of the grantee, in the performance of this agreement, shall act in an independent capacity and not as officers or employees or agei5 of the State of California. TIMELINESS Time is of the essence in this agreement. EXECUTIVE Or ICER'S DESIGNEE The Executive Officer shall designate a Conservancy project manager who shall have authority to act on behalf of the Executive Officer with respect to this agreement. The Executive Officer shall notify the grantee of the designation in writing. AMENDMENT Except as expressly provided in this agreement, no change in this agreement shalt be valid unless made in writing and signed by the parties to the agreement. No oral understanding or agreement not incorporated in this agreement shall be binding on any of the parties. LOCUS This agreement is deemed to be entered into in the County of Alameda. The objectives of creek en- hancement would be to expand tidal wetland habitat and to re- store existing habitat that is still functioning but has been dis- turbed by erosion, impaired water quality, invasion by exotic vegetation, and other human -induced impacts. Compatible public access would be incorporated into the plan. The City envisions enhancement of this reach of Paradise Creek as the centerpiece of a nature education facility and pe- destrian corridor. The subject reach of the creek runs within 200 feet of Kimball Elementary School, which has already be- gun using the tidal wetlands as an outdoor science classroom and is developing plans for more extensive use. The creek cor- ridor is also already in use as an informal trail between the downtown and adjacent residential areas. The City would like to encourage pedestrian use, which provides a convenient route V11-1 EXHIBIT B to downtown businesses and public transportation, while also protecting the adjacent wetlands. The vision and enthusiasm of local residents has spurred the City to undertake these improvements revolving around Para- dise Creek and has mobilized the support of elected represen- tatives. The City responded to the public's interest by funding preparation of a conceptual plan for the creek and for a nature education facility (Exhibit B). In addition, the National Park Service has contributed technical assistance with program de- velopment; the County of San Diego has provided funds for creek clean-up; and the San Diego Unified Port District gave Kimball Elementary School science equipment for creek study. Now the City wishes to proceed to implementation of its con- ceptual plan. The next step toward that end is preparation of the detailed creek enhancement plan that is the subject of this staff recommendation. VII-2 COASTAL CONSERVANCY Staff Recommendation August 20, 1998 PARADISE CREEK ENHANCEMENT PLAN File No. 98-035 Project Manager. Melanie Denninger STAFF RECOMMENDATION: Staff recommends that the State Coastal Conservancy adopt the following Resolution pursuant to Sections 31270 et seq. of the Public Resources Code: "The State Coastal Conservancy hereby authorizes the dis- bursement of an amount not to exceed fifty thousand dol- lars ($50,000) to the City of National City to prepare a plan for enhancement of the reach of Paradise Creek that is in the vicinity of Kimball Elementary School (as shown on Exhibit A of the accompanying staff recommenc�r4on), subject to the condition that, prior to the disbursement of any funds, the City of National City shall submit for the re- view and approval of the Executive Officer of the Conser- vancy a detailed work program, project budget and timeline for preparation of the enhancement plan and the names and qualifications of any subcontractors to be employed for preparation of the plan." Staff further recommends that the Conservancy adopt the fol- lowing findings: "Based on the accompanying staff report and attached ex- hibits, the State Coastal Conservancy hereby finds than 1. Preparation of the Paradise Creek enhancement :an is consistent with the purposes and criteria set forth in Chapter 6 of Division 21 of the Public Resources Code; 2. The proposed project is consistent with the guidelines and criteria set forth in the Conservancy's Resource Enhancement Program Announcement; and 3. The City of National City has jurisdiction over the -each of Paradise Creek that is the subject of this staff rec- VII-3 ommendation and has requested Conservancy assis- tance." STAFF DISCUSSION: Project Description: Staff recommends that the Conservancy authorize the dis- bursement of an amount not to exceed $50,000 to the City of National City for preparation of an enhancement plan for the one -half -mile reach of Paradise Creek that flows in the vicinity of Kimball Elementary School. The plan will propose detailed measures for expanding tidal wetland habitat and restoring ex- isting disturbed wetlands. In addition, measures will be de- signed for incorporating passive public access that is compati- ble with the wetland habitat. The Paradise Creek enhancement plan will be guided by a con- ceptual design prepared by the City (Exhibit B) that depicts creek habitat restoration and wetland expansion, a boardwalk and other passive public access, and nature education facilities. In addition, the plan will consider the relationship of habitat and trails in this reach of the creek with existing and projected conditions upstream and downstream. The scope and level of detail of the plan are intended to be adequate for conducting environmental review and beginning the permitting process. The City Parks and Recreation Department will manage plan preparation, with volunteer assistance from a citizen who has been instrumental in creating the vision for the project and ad- vancing it to this point, and who is also a City Planning Com- missioner. Other City departments, the elementary school and school district, landowners, citizens, and resource and regula- tory agencies will be consulted in the planning process. Project Financing: The total cost of preparing the Paradise Creek Enhancement Plan is estimated at $65,000. Staff recommends that the City and Conservancy share the cost, with program coordination as- sistance from the public volunteer, in the following manner-. Coastal Conservancy $50,000 National City (est. in -kind) 5,000 National Park Service (est. in -kind) 5,000 Volunteer program coordinator (est.) 5.000 TOTAL $65.000 (The City previously provided $5,000 for preparation of the conceptual plan depicted in Exhibit B.) VII-4 Site Description: The subject reach of Paradise Creek is about 1 mile upstream from Paradise Marsh on the shoreline of San Diego Bay (Ex- hibit A). While the creek carries freshwater runoff, the subject reach is dominated by saltwater, as indicated by the typical saltmarsh vegetation that borders the channel. This reach is a remnant of a coastal wetland that once existed where Interstate 5 and portions of the port and downtown National City have been built (Exhibit C). The project site is approximately one-half mile long and ir- regularly shaped. The channel and banks are about 50 feet wide and the saltmarsh expansion and nature education area add an- other 50 feet or so in width near the upstream end of the project area. The historic wetland habitat values in the project area have been disturbed by a radical reduction in extent, as well as im- pairment of water quality, introduction of exotic vegetation and feral and domestic animals, and virtual elimination of the marsh plain and transitional habit components of the wetland ecosystem. The main surrounding uses include commercial buildings on the south and a public works yard, park, and Kimball Elemen- tary school on the north. The school is already making informal use of the creek for nature education. The City intends to re- configure the public works yard to improve security and main- tenance access to the park and along the creek. Project History: Over the past several years, National City residents have been cultivating support for their vision of enhancing the habitat value of the tidal portion of Paradise Creek and of developing a science education facility beside the creek at Kimball Elemen- tary School. The vision has taken specific form as a result of preparation of a City -funded conceptual plan and help with program development from the National Park Service's Rivers, Trails, and Conservation Assistance Program (Exhibit D). The City has also demonstrated its support for implementing its conceptual plan by requesting Coastal Conservancy assistance with preparation of a detailed creek enhancement plan and by tentatively agreeing to reconfigure the adjacent public works yard in order to improve access and security for the project. VII-5 Meanwhile, interim enhancement and science education uses are underway. Teachers and students correct trash from the creek and the County of San Diego provided $5,000 for future clean-ups. The San Diego Unified Port District provided equipment for science study. Kimball Elementary School uses the creek for science study, monitoring water quality, observing the flora and fauna, and analyzing ecosystem functions. Citizen volunteers have been instrumental in creating the creek enhancement and education programs. Two of the most notable activists are Margaret Godshalk, who is a teacher at Kimball Elementary School, and her husband, Ted Godshalk, who is a City Planning Commissioner. Mr. Godshalk has been volun- teering his services as program coordinator and would continue to do so during preparation of the proposed creek enhancement plan. Jim Ruiz, the City's Parks and Recreation Director, would manage plan preparation on behalf of the City. The Na- tional Park Service would also continue to provide technical assistance during plan preparation. PROJECT SUPPORT: As demonstrated by the participation summarize above, and by the attached City Council Resolution (Exhibit (E) and Ietters of support (Exhibit F), the project has wide support from local citizens, the National School District, the City of National City, and local legislators. CONSISTENCY WITH CONSERVANCY'S LBLING LEGISLATION: This resource enhancement planning project is proposed to be undertaken pursuant to Chapter 6 of the Conservancy's ena- bling legislation (Public Resources Code Sections 31251 et seq.). Consistent with Section 31251, the proposed grant is to a local public agency and provides for preparation of a plan to restore and enhance historic wetlands which have suffered a loss of natural values. Consistent with Section 31251.2a, the City of National City has jurisdiction over the subject reach of Paradise Creek and has requested Conservancy assistance. Consistent with Section 31252, the City of National City's con- ceptual plan for the project area identifies the need for marsh VII-6 expansion and enhancement to resolve existing natural resource problems. Consistent with Section 31251.2, the tidal portion of Paradise Creek is partly within and partly outside the Coastal Zone, and the proposed creek enhancement measures would propose measures to improve water quality and other creek conditions in both areas. Consistent with Section 31257, the proposed authorization would provide an amount not to exceed $50,000 for prepara- tion of the creek enhancement plan. CONSISTENCY WITH CONSERVANCY'S .OGRAM GUIDELINES: Cooperation and Support: The City Council has requested Conservancy assistance to complete planning for the tidal por- tion of the creek, and has designated its Director of Parks and Recreation as the project administrator. The Planning Commis- sioner who has been serving as a volunteer program coordina- tor, will continue to provide his services during plan prepara- tion. Staff of the Rivers, Trails and Conservation Assistance Program of the National Park Service expects to continue pro- viding technical assistance during enhancement plan prepara- tion. School district and legislative support is demonstrated by the attached Ietters of support (Exhibit F). Model: The creek enhancement plan will be a model for pro- tection and integration of creek habitat into an urban area and will also demonstrate compatible use of the creek corridor as an amenity for pedestrians and a resource for education. CONSISTENCY WITH THE COASTAL ACT: This resource enhancement planning project is consistent with the California Coastal Act (Public Resources Code Sections 30000, et seq.) In particular, the planning project is consistent with Section 30240(b) in that planning for creek enhancement is intended to protect and improve adjacent, downstream creek and marsh habitat. The project also would be consistent with Section 30240(b) in that planning for adjacent public access would be designed to be compatible with habitat values. COMPLIANCE WITH CEQA: Preparation of the proposed Paradise Creek Enhancement Plan is a project involving only feasibility and planning for possible VII-7 Xti1ti1T B future actions and, thus, is statutorily exempt (California Code of Regulations Section 15262) from review under CEQA. Upon approval of the proposed authorization, staff will file a Notice of Exemption. The plan will, however, be subject to re- view prior to adoption and prior to implementation.
