Torres has been interviewed by the City Council and has expressed a desire to serve
on the above -subject Commission.
If there are no objections, I recommend we appoint Mr. Torres to serve an unexpired
term on the Civil Service Commission which ends on September 30, 2002. This item
will be placed on the Council Agenda for the meeting of November 23, 1999.

EXPLANATION The applicant proposes to add the sale of distilled spirits at an existing Value King grocery
store that is currently permitted to sell beer and wine. Value King is located in an existing 2.12-acre shopping
center southeast of the intersection of 8th and Palm. No expansion is proposed as part of the project. The sale of
beer and wine has been licensed at this location since 1968; however, there is currently no CUP on file and thus
no City conditions regulate alcohol sales at the site.
The Planning Commission denied the Conditional Use Permit based on findings that the use would have an
adverse effect on surrounding properties, since the site is in an area with a high crime rate, and that the use is
not essential to the public convenience or welfare. The Commission found that there is an undue
concentration of alcohol sales in the area, including an existing liquor store in the same shopping center.
One citizen spoke in opposition to the project at the public hearing. She stated that crime often occurs near
businesses that sell alcohol, and that the City does not need more alcohol sales. A citizen who lives adjacent to
the site spoke in favor of the project. The attorney for the applicant stated that the expanded use would allow the
market to compete on a level playing field with other supermarkets, and that the applicant is willing to accept the
recommended conditions of approval. The Police Department spoke in opposition to the project and stated that
research has shown a nexus between alcohol sales and crime, particularly violent crime.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF NATIONAL CITY, CALIFORNIA,
DENYING A CONDITIONAL USE PERMIT APPLICATION FOR
THE SALE OF DISTILLED SPIRITS IN ADDITION TO THE
PERMIFIED SALE OF BEER AND WINE AT AN EXISTING
GROCERY STORE AT 1750 E. 8th STREET

WHEREAS, the Planning Commission of the City of National City, California
considered a conditional use permit application at the public hearing held on October 18, 1999, at
which time oral and documentary evidence was presented; and,
WHEREAS, at said public hearing the Planning Commission considered the staff report
contained in Case File No. CUP-1999-2, which is maintained by the City, and incorporated
herein by reference; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State
and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation of
public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Planning Commission of the City
of National City, California, that the testimony and evidence presented to the Planning
Commission at the public hearing held on October 18, 1999, fail to support findings, required by
the Municipal Code for granting any conditional use permit, that the proposed use will not have
an adverse effect on adjacent or abutting properties, and that the proposed use is deemed
essential and desirable to the public convenience or welfare.
BE IT FURTHER RESOLVED by the City Planning Commission of the City of National
City, California, that the testimony and evidence presented to the Planning Commission at the
public hearing held on October 18, 1999, support the following findings:
1. That the proposed use will have an adverse effect on adjacent or abutting properties,
since the site is in a crime reporting district with a higher than average crime rate
and since the availability of alcoholic beverages has been identified by researchers
as contributing to criminal activity.
2. That the proposed use is not deemed essential and desirable to the public
convenience or welfare, since the vicinity of the proposed use has been deemed to
have an "undue concentration" of businesses offering alcoholic beverages for sale.
BE IT FURTHER RESOLVED that the Planning Commission hereby denies conditional
use permit application no. CUP-1999-2.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council; and,
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on
the day following the City Council meeting where the Planning Commission resolution is set for
review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of
that City Council meeting. The City Council may, at that meeting, appeal the decision of the
Planning Commission and set the matter for public hearing. The time within which judicial
review of this decision may be sought is governed by the provisions of Code of Civil Procedures
Section 1094.6.

Appeal of City Planning Commission Decision
Dear Mr, Cain;

This letter shall constitute a formal appeal of the
decision of the Planning Commission to deny approval of a
Conditional Use Permit authorizing the sale of Distilled
Spirits at the referenced Value King Supermarket.
This appeal is based upon, inter alia, the following
grounds;
1-The four Commissioners who voted to deny the CUP
stated that they were opposed to any new licenses within
the City limits and refused to consider the specific facts
surrounding this case.
2-The applicant, who presently is authorized to sell
beer and wine, agreed to submit the new CUP and the
existing license to sell beer::and wine to all the new
conditions. The current license was issued so long ago that
no conditions apply at this time.
The issuance of a new CUP for the sale of Distilled
Spirits would allow the City, specifically the Police
Department, to apply all modern conditions to the existing,
non -conforming license for beer and wine sales.
3-The applicant is a modern Supermarket which needs to
compete fairly with other similar businesses, such as
Ralph's and Sav-On. The City has granted these competitors
of the applicant CUP's which allow the sale of Distilled

We request that the National City, City Council grant an
appeal of the Planning Commission's decision to deny
ValueKing's Conditional Use Permit for the sale of

EXPLANATION
Ms. Stella Giannos of 725 "B" Avenue has requested the installation of a
10' red no parking zone south of her driveway in order to improve sight
distance and driver's visibility. According to Ms. Giannos, trucks and
delivery vans which often park adjacent to her driveway cause the view of
the motorists to be obscured from approaching vehicles.
The Traffic Safety Committee has approved the removal of a diagonal parking
space and the installation of an additional 10 foot red no parking zone
(20' total).

WHEREAS, Stella Giannos of 725 `B" Avenue has requested the installation of a
red no parking zone south of her driveway in order to improve sight distance and driver's
visibility; and

motorists' view of approaching vehicles; and
WHEREAS, at its meeting on November 10, 1999, the Traffic Safety Committee
approved the removal of one diagonal parking space south of the driveway at 725 `B" Avenue

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of

DISCUSSION:
Ms. Stella Giannos at 725 "B" Avenue has requested the installation of a red no parking zone
adjacent to the driveway serving her property in order to improve sight distance and driver's
visibility. According to Ms. Giannos, commercial vans, vans and delivery trucks which often park
adjacent to her driveway at 725 "B" Avenue causes the view of motorist from her apartments to be
blocked from on coming traffic. The requester desires to have a diagonal parking space removed
and an additional 10 foot red zone installed.
Staff has investigated the site and has found that there is two red No Parking zones existing on both
sides of her driveway, however visibility is still limited. Removing one diagonal parking space
would improve visibility at this location. This is based on deceleration, speed and reaction time at
25 M.P.H. (Stopping sight distance), it takes 90' to stop a vehicle safely.
STAFF RECOMMENDATION:
We recommend removing a diagonal parking space and installing a 10 foot long red zone (20' total).

I would like to request that the red curb line in front of my apartment complex be extended for the
following reasons.
I manage a small apartment complex. There are four units. Each tenant and I have one car. Five of us
share one driveway with only one way to exit and enter, exiting several times a day.
For some time now our view when we back out has been blocked by vans, trucks and delivery trucks.
Cars that should not be there use this red area as a parking spot, and delivery trucks use it as a loading
zone.
This results in our driveway and view being blocked and obstructed. My tenants have complained to
me, so I am asking your help to resolve this matter.

EXPLANATION
Ms. Cheryl Rostron of 326 Civic Center Drive has requested the installation
of a 3' red no parking zone west of her driveway in order to improve sight
distance and driver's visibility. According to Ms. Rostron commercial vans
which often park adjacent to her driveway cause the view of the motorists
to be obscured from approaching vehicles.
The Traffic Safety Committee has approved 3' of red no parking zone west of
her driveway and this will improve visibility.

WHEREAS, at its meeting on November 10, 1999, the Traffic Safety Committee
approved a 3-foot red no parking zone west of the driveway of 326 Civic Center Drive.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the City Engineer is authorized to install a 3-foot red no parking zone west of
the driveway of 326 Civic Center Drive.

DISCUSSION:
Mrs. Cheryl Rostron of 326 Civic Center Drive has requested the installation of a red no parking
zone adjacent to the driveway serving her property in order to improve sight distance and driver's
visibility. According to Mrs. Rostron, commercial vans which often park adjacent to her driveway
at 326 Civic Center Drive causes the view from her property to be obscured. The requester desires
to have her property street frontage painted red.
Staff has discussed the above with Mrs. Rostron and has determined that a 3' red curb would resolve
the problem. This is based on deceleration, speed and reaction time at 30 M.P.H. (stopping sight
distance), it takes 125' to stop a vehicle safely.
STAFF RECOMMENDATION:
We recommend a 3 feet red curb be painted immediately west of her driveway.

EXPLANATION
The Fire Department has requested the installation of a 90' red no parking
zone at 2525 Highland Avenue for emergency vehicles. In the past two weeks
the Fire Department has responded to seven emergency calls. With vehicles
parked in front of 2525 Highland Avenue, this requires emergency vehicles
to park in the right lane, causing a bottle neck down to one lane. This
creates a hazard for fire personnel and citizens alike.

WHEREAS, there have recently been numerous emergency calls to this location
and the vehicles parked in front of 2525 Highland Avenue cause emergency vehicles to park in
the right lane of traffic, creating a hazard for fire personnel and citizens alike; and
WHEREAS, at its meeting on November 10, 1999, the Traffic Safety Committee
approved a 90-foot red no parking zone at 2525 Ifighland Avenue.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the City Engineer is authorized to install a 90-foot red no parking zone at 2525

EXPLANATION Senior Accountant Finance
On December 1, 1999, the Finance Department will start mailing out sewer bills to customers
using a new sewer bill form. Please see attachment for a sample. This new sewer bill is a result of
converting our old sewer software to the Tresun utility billing software. The Tresun sewer billing
system is a new Window -based Y2K-compliant utility billing system.
In addition to getting a system upgrade, the Finance Department expects to even better our
customer service to the citizens. The new upgraded Y2K compliant billing system will provide
customers a certain comfort level, which assures them that their bills are being processed through a
new Windows -based Y2K-compliant billing system. Efficiencies achieved in the Utility Billing
Division as a result of the upgrade will allow staff more time to address customer inquiries faster
and more time to find ways to streamline internal processes.

REPORT ON FIRE STATION PROJECT
On 09/07/99 the City Council authorized a Fire Department Space Needs Analysis Study as the first phase of the
Fire Station Project. The results of this study were to be submitted to the City Council along with Staff
recommendations related to the next step in the process and to seek further City Council direction at that time. To
address several City Council concerns, which were communicated to Staff at the 09/07/99 City Council meeting
regarding the Project, the scope of the study was expanded to include the use of existing facilities and a confirmation
of any findings made in the study by obtaining an independent second opinion.
The Fire Department Space Needs Analysis Study has been completed and is documented in the attached "Space
Needs Analysis Report". The study reflects a need for 29,420 square feet of space to meet current and future space
needs. In addition, the first task associated with "including the existing facility in the planning process" has been
completed and documented in the attached "Preliminary Structural Report".
STAFF RECOMMENDATION
1. Complete Phase II of the Fire Department Space Needs Analysis consisting of "Site Evaluation" and
"Budgetary Estimates".
A. Evaluate "Current Site and Facilities", including neighboring properties immediately to the west, to
determine feasibility of locating a 29,420 square foot facility on this site.
B. Evaluate site located at 1400 National City Boulevard (previously the Colonial Ford property) to
determine feasibility of locating a 29,420 square foot facility on this site.
C. Complete "Preliminary Concept Site Plans" for each of the above two sites.
D. Complete a "Functional Format Cost Estimate" for each of the above two sites.
E. Refer the "Preliminary Structural Report" to the City Engineer for confirmation and opinion.
F. Authorize the City Engineer to conduct a "Value Engineering Review" of all findings and staff
recommendations including:
1. "Fire Department Space Needs Analysis".
2. "Preliminary Concept Site Plans".
3. "Functional Format Cost Estimates".
2. Authorize the City Engineer to further evaluate, prior to 02/15/00, the existing facility to determine
feasibility and costs associated with retrofitting the existing facility to meet seismic requirements.
3. Staff to report to the City Council on or before 03/07/00 providing recommendations and requesting further
direction from Council regarding final .site location and selection ofp rferred preliminag design plan.
4. Based on City Council direction, provided at the 03/07/00 Council meeting, Staff to submit to the City
Council on or before 04/04/00 a `Funding Plan" for consideration.

Subject: PRELIMINARY STRUCTURAL REPORT

Dear Mr. Iler:
As requested, DASSE made a brief walk-through review of the subject facility on October 28,
1999. We have also performed a brief limited review of the available structural drawings. No
quantitative analysis or assessment has been performed.
The purpose of our review was to determine what possible structural seismic deficiencies might
exist.
The facility is serving as a headquarters fire station, and as such is deemed an "Essential Facility"
under current code requirements. The building consists of conventional wood frame construction,
a concrete slab -on -grade and conventional spread footings. The date of the original construction
is about 1953, with a one-story addition constructed in 1976 and a later second -story addition
added in 1987. Evidence of past seismic upgrading was not noted.
During the site review, no significant signs of structural distress were noted.
Based on the past seismic performance of buildings with this type and vintage of construction,
certain building components have been identified as the likely candidates for seismic problem
areas that can contribute to structural distress and failures. The primary area of seismic
weakness with this building would likely be the lack of adequate plywood shear walls, especially
within the original portion of the construction. There are most likely other areas of seismic
weakness but those areas have not been identified in this review. Since the construction of the
original building in 1953, the code -required seismic design force levels have significantly
increased. These seismic force increases are further amplified by the proximity of this structure
to an active earthquake fault.
The closest known active earthquake fault to this building site is the Rose Canyon Fault. This
building site is 5 kilometers from the Rose Canyon Fault and lies within the "Near Source Zone"
as defined by the 1997 Uniform Building Code. When a building lies within the "Near Source
Zone", the force effects of the earthquake on the structure are amplified.

Based on our limited review, it is our opinion that the potential exists for significant structural
damage to this facility during a moderate to severe earthquake generated by the Rose Canyon
Fault. It is therefore our recommendation that this facility be seismically upgraded to the
requirements of the current code. Prior to making a decision on seismic upgrading, it is
recommended that further detailed study of the facility be conducted. Further studies will more
accurately define the structural areas of vulnerability, develop conceptual strengthening schemes
and assist in estimating the cost of construction for the implementation of the recommended
strengthening.

ADOPTING AND IMPLEMENTING THE LAST ONE-YEAR Ott
OF THE CITY OF NATIONAL CITY TO THE
NATIONAL CITY MUNICIPAL EMPLOYEES' ASSOCIATION
WHEREAS, representatives of the City and of the National City Municipal Employees'
Association (MEA) have met and conferred concerning a Memorandum of Understanding for
FY 1999-2000; and
WHEREAS, the MEA representatives determined that negotiations were at an impasse
after receiving the City's last one-year offer to the MEA on July 26, 1999; and
WHEREAS, according to the National City Employer -Employee Relations Policy, the
matter was considered by the Impasse Mediator at an impasse meeting, and thereafter, the
matter was submitted to the City Council for determination.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National
City that the City Council does hereby adopt and implement the last, best one-year offer made
by the City's representatives to the MEA until a memorandum of understanding is adopted.
Said last offer is entitled "City's Last One -Year Proposal to MEA", and is effective at start of
the first pay period following the adoption of this resolution. Said last offer is attached hereto
as Exhibit "A" and incorporated herein by reference.
