CUP-1999-2) PREPARED Jon Cain - Assistant PlannePEPARTMENT Planning EXPLANATION The applicant proposes to add the sale of distilled spirits at an existing Value King grocery store that is currently permitted to sell beer and wine. Value King is located in an existing 2.12-acre shopping center southeast of the intersection of 8th and Palm. No expansion is proposed as part of the project. The sale of beer and wine has been licensed at this location since 1968; however, there is currently no CUP on file and thus no City conditions regulate alcohol sales at the site. The Planning Commission denied the Conditional Use Permit based on findings that the use would have an adverse effect on surrounding properties, since the site is in an area with a high crime rate, and that the use is not essential to the public convenience or welfare. The Commission found that there is an undue concentration of alcohol sales in the area, including an existing liquor store in the same shopping center. One citizen spoke in opposition to the project at the public hearing. She stated that crime often occurs near businesses that sell alcohol, and that the City does not need more alcohol sales. A citizen who lives adjacent to the site spoke in favor of the project. The attorney for the applicant stated that the expanded use would allow the market to compete on a level playing field with other supermarkets, and that the applicant is willing to accept the recommended conditions of approval. The Police Department spoke in opposition to the project and stated that research has shown a nexus between alcohol sales and crime, particularly violent crime. CUP-1999-2 WHEREAS, the Planning Commission of the City of National City, California considered a conditional use permit application at the public hearing held on October 18, 1999, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the Planning Commission considered the staff report contained in Case File No. CUP-1999-2, which is maintained by the City, and incorporated herein by reference; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety and general welfare. BE IT FURTHER RESOLVED by the City Planning Commission of the City of National City, California, that the testimony and evidence presented to the Planning Commission at the public hearing held on October 18, 1999, support the following findings: 1. That the proposed use will have an adverse effect on adjacent or abutting properties, since the site is in a crime reporting district with a higher than average crime rate and since the availability of alcoholic beverages has been identified by researchers as contributing to criminal activity. 2. That the proposed use is not deemed essential and desirable to the public convenience or welfare, since the vicinity of the proposed use has been deemed to have an "undue concentration" of businesses offering alcoholic beverages for sale. BE IT FURTHER RESOLVED that the Planning Commission hereby denies conditional use permit application no. CUP-1999-2. BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the applicant and to the City Council; and, BE IT FINALLY RESOLVED that this Resolution shall become effective and final on the day following the City Council meeting where the Planning Commission resolution is set for review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of that City Council meeting. The City Council may, at that meeting, appeal the decision of the Planning Commission and set the matter for public hearing. The time within which judicial review of this decision may be sought is governed by the provisions of Code of Civil Procedures Section 1094.6. This appeal is based upon, inter alia, the following grounds; 1-The four Commissioners who voted to deny the CUP stated that they were opposed to any new licenses within the City limits and refused to consider the specific facts surrounding this case. 2-The applicant, who presently is authorized to sell beer and wine, agreed to submit the new CUP and the existing license to sell beer::and wine to all the new conditions. The current license was issued so long ago that no conditions apply at this time. The issuance of a new CUP for the sale of Distilled Spirits would allow the City, specifically the Police Department, to apply all modern conditions to the existing, non -conforming license for beer and wine sales. 3-The applicant is a modern Supermarket which needs to compete fairly with other similar businesses, such as Ralph's and Sav-On. The City has granted these competitors of the applicant CUP's which allow the sale of Distilled C. GIANNOR, TEL. 477-6427) PREPARED BY: Adam Landa, Engineering Department DISCUSSION: Ms. Stella Giannos at 725 "B" Avenue has requested the installation of a red no parking zone adjacent to the driveway serving her property in order to improve sight distance and driver's visibility. According to Ms. Giannos, commercial vans, vans and delivery trucks which often park adjacent to her driveway at 725 "B" Avenue causes the view of motorist from her apartments to be blocked from on coming traffic. The requester desires to have a diagonal parking space removed and an additional 10 foot red zone installed. Staff has investigated the site and has found that there is two red No Parking zones existing on both sides of her driveway, however visibility is still limited. Removing one diagonal parking space would improve visibility at this location. This is based on deceleration, speed and reaction time at 25 M.P.H. (Stopping sight distance), it takes 90' to stop a vehicle safely. STAFF RECOMMENDATION: We recommend removing a diagonal parking space and installing a 10 foot long red zone (20' total). EXHIBITS: 1. RECEIVED Date di: I would like to request that the red curb line in front of my apartment complex be extended for the following reasons. I manage a small apartment complex. There are four units. Each tenant and I have one car. Five of us share one driveway with only one way to exit and enter, exiting several times a day. For some time now our view when we back out has been blocked by vans, trucks and delivery trucks. Cars that should not be there use this red area as a parking spot, and delivery trucks use it as a loading zone. This results in our driveway and view being blocked and obstructed. According to Mrs. Rostron, commercial vans which often park adjacent to her driveway at 326 Civic Center Drive causes the view from her property to be obscured. The requester desires to have her property street frontage painted red. Staff has discussed the above with Mrs. Rostron and has determined that a 3' red curb would resolve the problem. This is based on deceleration, speed and reaction time at 30 M.P.H. (stopping sight distance), it takes 125' to stop a vehicle safely. Please see attachment for a sample. This new sewer bill is a result of converting our old sewer software to the Tresun utility billing software. The Tresun sewer billing system is a new Window -based Y2K-compliant utility billing system. In addition to getting a system upgrade, the Finance Department expects to even better our customer service to the citizens. The new upgraded Y2K compliant billing system will provide customers a certain comfort level, which assures them that their bills are being processed through a new Windows -based Y2K-compliant billing system. Efficiencies achieved in the Utility Billing Division as a result of the upgrade will allow staff more time to address customer inquiries faster and more time to find ways to streamline internal processes. Resolution No. A-200 (Rev. 9/80) REPORT ON FIRE STATION PROJECT On 09/07/99 the City Council authorized a Fire Department Space Needs Analysis Study as the first phase of the Fire Station Project. The results of this study were to be submitted to the City Council along with Staff recommendations related to the next step in the process and to seek further City Council direction at that time. To address several City Council concerns, which were communicated to Staff at the 09/07/99 City Council meeting regarding the Project, the scope of the study was expanded to include the use of existing facilities and a confirmation of any findings made in the study by obtaining an independent second opinion. The Fire Department Space Needs Analysis Study has been completed and is documented in the attached "Space Needs Analysis Report". The study reflects a need for 29,420 square feet of space to meet current and future space needs. In addition, the first task associated with "including the existing facility in the planning process" has been completed and documented in the attached "Preliminary Structural Report". STAFF RECOMMENDATION 1. Complete Phase II of the Fire Department Space Needs Analysis consisting of "Site Evaluation" and "Budgetary Estimates". A. Evaluate "Current Site and Facilities", including neighboring properties immediately to the west, to determine feasibility of locating a 29,420 square foot facility on this site. B. Evaluate site located at 1400 National City Boulevard (previously the Colonial Ford property) to determine feasibility of locating a 29,420 square foot facility on this site. C. Complete "Preliminary Concept Site Plans" for each of the above two sites. D. Complete a "Functional Format Cost Estimate" for each of the above two sites. E. Refer the "Preliminary Structural Report" to the City Engineer for confirmation and opinion. F. We have also performed a brief limited review of the available structural drawings. No quantitative analysis or assessment has been performed. The purpose of our review was to determine what possible structural seismic deficiencies might exist. The facility is serving as a headquarters fire station, and as such is deemed an "Essential Facility" under current code requirements. The building consists of conventional wood frame construction, a concrete slab -on -grade and conventional spread footings. The date of the original construction is about 1953, with a one-story addition constructed in 1976 and a later second -story addition added in 1987. Evidence of past seismic upgrading was not noted. During the site review, no significant signs of structural distress were noted. Based on the past seismic performance of buildings with this type and vintage of construction, certain building components have been identified as the likely candidates for seismic problem areas that can contribute to structural distress and failures. The primary area of seismic weakness with this building would likely be the lack of adequate plywood shear walls, especially within the original portion of the construction. There are most likely other areas of seismic weakness but those areas have not been identified in this review. Since the construction of the original building in 1953, the code -required seismic design force levels have significantly increased. These seismic force increases are further amplified by the proximity of this structure to an active earthquake fault. The closest known active earthquake fault to this building site is the Rose Canyon Fault. This building site is 5 kilometers from the Rose Canyon Fault and lies within the "Near Source Zone" as defined by the 1997 Uniform Building Code. When a building lies within the "Near Source Zone", the force effects of the earthquake on the structure are amplified. ant By: DASSE; 1 949 450 0448; Oct-30-99 4:42PM; Page 3/3 Mr. Don Iler October 29, 1999 Page 2 Based on our limited review, it is our opinion that the potential exists for significant structural damage to this facility during a moderate to severe earthquake generated by the Rose Canyon Fault. It is therefore our recommendation that this facility be seismically upgraded to the requirements of the current code. Prior to making a decision on seismic upgrading, it is recommended that further detailed study of the facility be conducted. Further studies will more accurately define the structural areas of vulnerability, develop conceptual strengthening schemes and assist in estimating the cost of construction for the implementation of the recommended strengthening. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the City Council does hereby adopt and implement the last, best one-year offer made by the City's representatives to the MEA until a memorandum of understanding is adopted.
