Purchasing ordinance #1480, Section 12a4, authorizes the bidding requirement to be waived "when
Council determines that due to special circumstances, it is the City's best interest to purchase a
commodity or enter into a contract without strict compliance to the bidding procedure." This proposed
purchase is within those guidelines.
This new system created by the Automated Regional Justice Information System (ARJIS) will create a
separate law enforcement network, replacing the existing system. The new system involves
infrastructure improvements within ARMS agencies in partnership with improvements at San Diego Data
Processing Center (SDDPC). This upgrade is not only necessary to replace badly outdated and obsolete
hardware (purchased in 1986), but it is also required to meet California Department of Justice mandates
which must be in place by December 31, 1999. ARJISNet supports ARJIS enhancements and
applications such as CAL -Photo, CAL -Gang and Mapping. It implements a DOJ trusted network behind
a firewall, provides a more secure network and provides secure links to DOJ and to other counties.
ARMSNet will also support future ARMS agencies' growth and will improve network management and
trouble shooting. ARMS and SDDPC, in partnership, are the only providers of this system.

Financial Statement The project will not impact the current budget as funding is available to
accomplish the transition to the new system. There will be no negative impact to future budgets since
costs to support ARMSNet should be approximately the same as present support costs for the system

RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NATIONAL CITY AUTHORIZING THE

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National
City hereby determines that special cirrnmetances exist in the present case, and authorizes the Purchasing
Agent to waive the bidding process and approves the purchase of ARJISNET hardware, software and
infrastructure from ARJIS and SDDPC.

Re: MIS Review of ARJISNet Software and Hardware Purchase
I have reviewed the request by the Police Dept to purchase ARJISNet hardware,
software and infrastructure from ARJIS and SDDPC, and to waive the normal bid process.
This proposal seeks to install a Frame Relay T1 communication line, purchase
communication equipment and installation/setup services necessary to link the National
City Police Dept with the ARJIS and DOJ law enforcement network.
I concur with the hardware, software and infrastructure purchase, and with the request
that the purchase be by "sole source" acquisition.
I would like to offer the following additional points:
1. PD has identified available funding source within their current budget to
handle this purchase, which we estimate to be approximately $10,500.
2. The final hardware, software and infrastructure requirement list should be
subjected to MIS approval and purchase.
3. Waiving of the bid process should be limited to the ARJISNet communication
infrastructure and equipment (including necessary software to setup the
communication equipment), and the installation/setup services. It should not
include personal computers, printers and desktop communication software.
4. Desktop communication software originally necessary for the implementation
of the ARJISNet (approximately valued at $8,000) is already available from
MIS and 20 licensed copies can be provided to PD at no cost.

Attached is the ARJISNET Connectivity cost estimate submitted by Pam Scanlon
dated 4/6/99. The grand total of the estimate is $10,141.68. This estimate does
not include the communications software, computers or printers. Also note the
PC installation labor is an estimate.
The funding for ARJISNET can come from account #001-411-000-297
($16,000.00 balance in account.) An intrabudget transfer will need to be
completed to the account you specify.

EXPLANATION
Christmas in July has submitted the attached letter requesting that
their current lease for the property at 2101 Hoover Avenue be modified.
The reason being they want to construct a building on the property. They
propose three options:
1. Provide a 10 year lease, with two five-year extensions, at the current
yearly rate. ($1.00)
2. Donate the property to Christmas in July.
3. Sell the property to Christmas in July for an amount not to exceed
$20,000.
Christmas in July believe that any of these options would provide them with
enough security in the land to justify the construction of a building.
To sell the land the procedures are outlined in the City Council Policy
901, "Sale of Surplus Real Property" and the City Attorney memo,
"Procedures for Disposition of City Property".

Dear Mayor Waters and City Council:
May 5, 1999
Christmas in April * National City (aka) Christmas in July (CD) is a 501(c)(3) public
benefit corporation that is also a local Community Housing Development Organization
(CHDO). Since 1991, when the program started as a Chamber of Commerce Committee,
the15 member Board of Directors has always enjoyed a solid mix of community leaders
and low-income National City homeowners. Our mission is to provide home -owner
housing assistance for very low-income, elderly, and handicapped families throughout the
community. At this time we have rehabilitated over 120 homes and constructed 5 new
homes in our effort to keep National City families living independently in safe and secure
properties.
Again this year we are selecting 10 to 15 homes upon which to concentrate our volunteer
efforts. At a recent Board Retreat we reaffirmed our long-term goal of rebuilding
National City homes "one house at a time". We accomplish the annual work program by
enlisting the various local service clubs, businesses and the men and women of the
United States Navy in physically and financially helping one another.
We now find it timely to make a small but important step in expanding our program. The
City has, since 1992, provided Christmas in July with a one dollar per year ground lease
for the property at 2101 Hoover Ave. With the security of that lease, we purchased the
former National City Credit Union Building which is attached to the site and use two
steel containers to store materials. -The Board now wishes to expand the program by
constructing a building on the site, which will provide space for storage, administration,
construction, and skill training. However, there is reluctance to construct without greater
security of the land. CIJ would therefore like to propose that the City agree to one of the
following changes:

• Provide a ten-year lease with two additional five-year lease extensions at the present
lease rate.
• Donate the property to CU for its continued use of providing the City with housing
assistance to low-income owner -occupants. With this option a Grant Deed reverter
clause could be included. The reverter would put the property and improvements back
into the ownership of the City if the property were no longer used for its intended
purposes.
• Sell the property to CU for a price not to exceed S20,000.
The second piece of property we would like to secure has been an expense and liability to
the City for many years. It is located at 1915 Palm Ave. and reachable via a 10 foot wide
easement extending approximately 100 feet east from Palm Ave. The drive is just north
of a smaII house located at 1917 Palm Ave. The City owns the property because of a
purchase it made in 1957 from the estate of Frank R. Holzmann. The property extends
across the Las Palmas Golf Course to the Las Palmas Elementary School property. The •
majority of the land is for the use of the golf course; and the remainder is of no
significant value to the City. The old abandoned 500 square -foot house has been boarded
up due to complaints by the neighbors. The Public Works Department has scraped and
maintained the sloping yard for many years.
In 1996 Christmas in July expressed an interest in the property and was granted City
permission to have volunteers erect aluminum fence poles around the yard down to the
golf course fence. Activity stopped at that time because of the need to secure a legal
description of the surplus land. Please be advised that a survey has not been completed in
proper form to support the severance of the surplus property from the golf course use. -
It is requested that the City donate this property to CU in its "as is" condition after
completing its annual vegetation scraping. CU will than take over responsibility and
insurance of the property. _
We appreciate the alliance that has been forged between the City and CU over the last
nine years. Together we can continue to make home ownership a reality for National City
families and extend the time our elderly and handicapped families are able to enjoy Their
homes. rather than being required to accept alternate forms of living accommodations.

Policy
The following steps are to be followed to Sa1P City -owned pieces of
property:
1. Obtain other City Departments' comments for the sale of the property.
2. Secure preliminary title reports for the property.
3. Prepare plats and legal descriptions for the property.
4. Request the City Council (Real Estate Committee) to declare the
property surplus and direct the staff to sell it. -
5. If applicable, send a written offer to sell or lease the property to
the other government agencies (Government Code Section 54222).
6. Order a letter of apprais1

The proceeds from the sale will be spent on beautification or improvement
projects throughout the City.

INTRODUCTION
The purpose of this memorandum is to outline the procures far disposition of real property by the
City. The procedures that are discussed are different from those required when the CDC disposes of
real property. The procedures for cities are for the most part set forth in the Government Code;
those for redevelopment agencies are found in the Health and Safety Code. At the present time, the
CDC stag has been charged with handling the sale of parcels of surplus City property lcr in the
200 block of South Clairmont Avenue.

A c:a may purchase, 1r;� receive, hold and enjoy real and personal property ec e-tthlly in any
way it chooses, provided its control and disposition is for the common bP1P=+t (Goverment Code §
37350). The city's planning agency must prepare a report that indicates disposition of the property
conforms with the general plan. (§ 65402). Property which was de icater pursuant to the
Subdivision Map Act after January I, 1990 must be conveyed back to the ortina1 subdivider if not
use for the purpose orig*nnily dedicated. (§ 66477..5).
When a city council rinds the public interest and convenience require the sale of residential real
propert-y for less than Fair market value, it may pass an ordinance providing for such sale. The
orrtinarce shall set forth the procedure to be followed in completing such sales, including the
qualifications required of a purchav-- of such- property, and tra11 contain provisions rewiring that
the purchaser reside in the property, for a specified length of time and must rehabilimare the property
as specified in the ordinance. Only persons of low Or Moderate income may purchase such property.
(§§ 37362, 37363).
When a city council determines that real property owned or to be purchased by the city can be used
:o provide housing for persons of low or moderate income, and that this use is in the site's best
interests, the city may dispose of the property at less then fair market value, or purchase real
property, to provide affordable housing under terms and conditions best suited to provide such

development or ope.sdon of such housing within whose jurisdic::en the surplus land is
located. Housing sponsors (meaning an individual or entity which may own, construct or
rehabilitate a housing development) shall, upon written request, be sent a written offer to sell
or'Pr cf- surplus Iand for the purpose of developing low- and moderate -income housing.
(b) A wrtten offer to sell or 1=se for park and recreational purposes or open -space
purposes shall be se .t:

(1) To any park or recreation department of any city within which the land may be
situated.
(2) To any park or recreation department of the county within which the land may be
situated.
(3) To any regional park authority having jurisdiction within the area in which the land
is situated.
(4) To the State Resources Agency or any agency which may succeed to its powers.
(c) A written offer to sell or lease land suitable for school facilities construction or use
by a school district for open -space purposes shall be sent to any school district in whose
jurisdiction the land is located.
(d) A written offer to sell or lease far ente-prise zone purposes any surplus property in an
area designated as an "enterprise zone" be sent to the nonprofit neighborhood enterprise
association corporation in that zone.
(e) A written. offer to sell or lease any surplus property in a desim+nt-i progam area, as
defined in subdivision (i) of Government Code § 7082, cha ii be sent to the program area
agent.
(f) The entity or association desiring to purchase or 1e: se the surplus land for low- and
moderate -income housing purposes, or for park or re ,...don purposes, or for open -space
purposes, or for public school purposes, or for enterprise zone purposes, ghat1 notify in
writing the city of its intent to purchase or lease the land within 60 days after receipt of the
agency's notification of intent to sell the land.
§ 54223 provides that if an entity has received notice and dP,T:-es to buy the land, the disposing city
and the entity may enter into good faith negotiations to deter fie a if-1 price or lease terms. If the
price or terms c nnot be reached after 60 days, the land may be disposed of as the city sees fit. §
542.27 establishes priorities for the sale or lease of land when more than one entity is interested in
purchase or leasing Pursuant to § 54220.5, the failure of a city to comply with § 54222 does not
invalidate a sale to purc.'r , s r for value.
DISPOSITION OF FARIC.A.ND
Alte_nadve requirements may apply to disposition of land that is dedicated and/or used far park
purposes. _
Pursuant to Government Code § 37111, a city council may, by a 4/5 vote, provide for constriction
of a civic center or other public buildings on land purchased for park purposes. Under § 37111.1,
park land may be devoted to any other municipal purpose after a noticed public hmring and a 4/5
vote by the city council, provided that an equal or meter amount of -lard has been acquired for park
purposes within the last three years, and the proposed use of the park land conforms to the general
plan.
Government Code §§ 3 - 38462 establish a procedure for a city to discontinue the use as a park
and dispose of land which it owns and is dedicated or piac d in use for park. purposes. These
statutes require the city council to hold a public herring on the proposed sale, at which time written
protests submitted before the henning shall be considered. The city council may ove.:ale the protests

)v a 213 vote, and call a special election on the question of discontinuance and abandonment of the
Dark. If a majority of the votes are in favor of it, the city council shall adopt an ordinance providing
that the use of the land for park purposes is discontinued and abandoned. Tne city may then dispose
-)f the property as it may dispose of other cry property no longer required for municipal purposes.
There is an exception to the above procedure where a minor pordon of a park is exchanged for
:ondguous privately owned land of equal or greater value or area; in such cases, no special elerdon

-orlon of a park without a special eiertion if it finds that all or any portion of the purported park has

of a piat or map in the office of the county recorder, or otherwise.
(b) When any such land has been purchased for park purposes and the legislative body finds
that ail or any portion of the land is not appropriar-, convenient, or necessary for park

EXPLAAT.ION Uftristmas in July has requested that National City donate the city -

the attached letter.
A portion of this land is used by the City's Golf Course. In order to
donate some of the land to Christmas in July it must be divided. This will
require a lot split.
This land is currently not on the City's list of surplus land.
To donate the land we suggest following a procedure similar to Council
Policy 901, "Sale of Surplus Property" and the City Attorney's memo,
"Procedures for Disposition of City Property".

:ve mnent Code § 54^222 requires that prior to disposing of any surplus -laud, a city shall send a

(a) A 'written offer- to sell or lease for the purpose of developing low- and moderate- income housing shall be sent to any local public endry which may engage in or assist in the
development or operation of such housing within whose jurisdiction the surplus land is
located. Housing sponsors (meaning an individual or entity which may own, construct or
rehabilitate a housing development) shall, upon written request, be sent a warren offer to sell
or le-le-Te surplus land for the purpose of developing low- and moderate -income housing.
(b) A writ:: offer to sell or lease for park and rem, :bona. pusses or open -space
purposes shall be sent:

(1) To any park or recreation department of any city within which the land may be
situated.
(2) To any park or recreation department of the county within which the land may be
situated.
(3) To any regional park authority having jurisdiction within the area in which the land
is situated.
(4) To the State Resources Agency or any agency which may succeed to its powers.
(c) A written offer to sell or lease land suitable for school facdides construction or use
by a school district for open -space purposes shall be sent to any school district in whose
jurisdiction the land is located.
(d) A written offer to sell or lease for enterprise zone purposes any surplus property in an
area designated as an 'enterprise zone" shall be sent to the nonprofit neizhbonccod enterprise
association corporation in that zone.
(e) A written offer to sell or lease any surplus property in a designated prog,,zam area, as
defined in subdivision (i) of Goverment Code § 7082, ahai7 be sent to the program area
agent.
(f) The entity or association desiring to purchase or lease the surplus land for low- and
moderate -income housing purposes, or for park or re: -ee ion purposes, or for open -space
purposes, or for public school purposes, or for enterprise zone purposes, chail notify in
writing the city of its intent to purchase or lease the land within 60 days after receipt of the
agency's notification of intent to sell the land.
§ 54223 provides that if an entity has received notice and dP-:res to buy the tared, the disposing city
and the entity may enter into good faith negotiations to dete---..ine a sales price or lease terms. If the
pcce or terms cannot be reached after 60 days, the land may be disposed of as the city secs fit. §
54227 esmblishes priorities for the sale or lease of land when more than one entity is interest in
purchase or leasing Pursuant to § 54230.5, the failure of a ±v to comply with § 54222 does not
invalidate a sale to purchaser for value.
DISPOSITION OF PARK. aND
Alternative requirements may apply to disposition of land that is dedicated and/or used for park
purposes.
Pursuant to Government Code § 37111, a city council may, by a 4/5 vote, provide for consamc 4,ion
of a civic center or other public buildings on land purchased for park purposes. Under § 37111.1,
park land may be devoted to any other municipal purpose after a noticed public hearing and a 4/5
vote by the dry council, provided that an equal or greaser amount of land has been acquired for park
purposes within the last three years, and the proposed use of the park land conforms to the general
plan. -
Gove:---ent Code ee 3 ' ' - 38462 establish a procedure for a cry to discontinue the use as a park
and dispose of land which it owns and is dedicated or piad--in use for park. purposes. These
statutes require the city council to hold a public herring on the proposed sale, at which dine written
protests submitted before the herring shall be considered. The city council may ove.^ale the protests
