Agenda Iten aunt 4/13/99 Council Meeting Resolution No 99-61 RESOLUTION NO.99 -61 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING THE BOARD REFORM BILL FOR THE SAN DIEGO COUNTY AIR POLLUTION CONTROL DISTRICT WHEREAS, the San Diego County Air Pollution Control District Board, which governs the Air Pollution Control District (APCD), is currently made up of the five members of the San Diego County Board of Supervisors; and WHEREAS, the decisions of this Board are critically important to public health and the environment because San Diego is still in severe non -attainment of federal air pollution standards, and health risks from air toxics are a threat to many San Diego communities; and WHEREAS, every other California air district in a major urban area is governed by a diverse board made up of representatives of city, county, and in some cases, public interests; and WHEREAS, individual communities and cities may suffer from localized impacts from air pollution, making it critical for the incorporated cities to be represented on this Board; and WHEREAS, greater diversity on this Board means greater arrPgs for all San Diego residents to the decisions of this important body; and WHEREAS, the current composition of the San Diego APCD Board does not reflect the diverse population and interests of San Diego residents; and WHEREAS, the only mechanism for reforming the composition of the APCD Board to ensure that it is more representative of the San Diego community and interests of the incorporated cities is through amendment to state legislation. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City does hereby resolve to support California legislation to reform the San Diego County Air Pollution Control Board to include: • three representatives from the San Diego County Board of Supervisors; • three representatives from the City of San Diego; • three representatives from other incorporated cities within the County of San Diego, one from the South County, one from the North County and one from the East County; • one member, who shall be either a physician who has training and experience in the health effects of air pollution, an environmental engineer, a chemist, a meteorologist, or a specialist in air pollution control, appointed by the Governor of California; • one member, who shall be a public member, appointed by the Speaker of the California Assembly; • one member, who shall be a public member, appointed by the California Senate Committee on Rules. The APCD Board governs the Air Pollution Control District and is currently made up of the five member of the San Diego County Board of Supervisors. The composition of the San Diego APCR. Board does not reflect the diversity of San Diego residents, nor is it consistent with the makeup of the Boards of tine other large air districts; it also lacks technical expertise and general public participation . What is the Air Pollution Control District Board? The Board is responsible for adopting the rules and regulations of the APCD, adopting the budget and setting the policy for this agency. Tn= Board also appoints the members of the APCD Hearing Board, white s the authority to grant regulatory variances to industrial dischargers, ate the members of the APCD Citizens Advisory Committee, which revir>as all air pollution rules, prior to adoption by the Board. The decisions of this Board are critically important to public health as San Diego is still in severe non -attainment of federal air pollution standar—,:s, and health risks from air toxics are a threat to many communities. Why is the APCD Board out of step with the rest of California? Every other California air district in a major urban area is governed a diverse board made up of representatives of city, county, and in some cases, public interests. A change in state law in 1994required all caurav air districts to diversify their membership to include city representatives. The intent of this legislation was clearly to ensure that these boards adequately represented the urban population within these counties. San Diego County was the only county with a large urban population o be exempted from this legislation. As a result of the exemption, San Diego's current APCD Board does not reflect the diversity of residers_ living in San Diego County, and under -represents the vast population living within the urban core of the City of San Diego. Furthermore, the current APCD Board does not include any represent— ..'u 1 from public members or members possessing special technical expertise. By contrast, the South Coast Air Quality Management District Board, which governs air pollution regulations in the Los Angeles air basin, includes state -level appointees which either possess specific technical expertise, or are public members. Due to the regional nature of air pollution issues in the San Diego/Pijuana Region, it is important to have this limited state -level attention to local air pollution issues. What's•the Solution? San Diego residents deserve to be represented by a diverse APCD Board. The only way to accomplish this is to amend current state law to require diversification of the APCD Board EHC is sponsoring legislation which would ensure that all people within the County of San Diego have adequate representation by this important body. There are several alternative structures which could accomplish this goal. EHC's Proposed Structure EHC's Proposed structure for this Board would be as follows: • 3 representatives from the County Board of Supervisors • 3 representatives from the City of San Diego • 3 representatives from other incorporated cities within the County of San Diego • I member appointed by the Governor of California. (b) The San Diego County district ahail be governed by a district board consisting of 12 members appointed as follows: (1) One:member appointed by the Governor, with the advice and consent of the Senate. This member Shp1I be either a physician who has training and experience in the health effects of air pollution, an environmental engineer, a chemist, a meteorologist, or a specialist in air pollution control. (2) One: member appointed by the Senate Committee on Rules. This member shall be a public member, and may not be a locally elected official. (3) One -member appointed by the Speaker of the Assembly. This member shall be a public member, and may not be a locally elected official. (4) Three members which are appointed by and are members of the San Diego County Board of Supervisors. (5) Three members which are appointed by and are members of the San Diego City Council. (6) Three members appointed by the incorporated cities, other than the City of San Diego, within the County of San Diego. These cities shall organize a city selection committee for this purpose. The members appointed shall be either a mayor or a member of the city council of one of the incorporated cities. (c) Except as otherwise provided in this section, the San Diego County Air Pollution Control District is a county dist for all purposes of this chapter. (d) The term of each :ember of the San Diego County Air Pollution Control Board shall be two years and until his or her successor is appointed, except as provided in subsection (e). Any vacancy on the board shall be: filled within 60 days of its occurrence by the appointing authority. Waters, Mayor APRIL 27, 1999 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING SECTION 11.16.010 (SPEED ZONES DESIGNATED) OF THE NATIONAL CITY MUNICIPAL CODE ESTABLISHING SPEED ZONES ON "NII AVENUE BETWEEN 18TH AND 24TH STREET EXPLANATION Section 40802 (b) and 22357 of the State of California Vehicle Code (CVC) permit local authorities, through an ordinance, to establish speed limits greater than the prima facie limit of 25 MPH when, on the basis of an engineering and traffic survey, the local authority determine that a speed greater than 25 MPH would facilitates the orderly movement of vehicular traffic and would be reasonable and safe. Speed limits on "N" Avenue between 18th Street and 24th Street, is a new street section which should be added to the existing list of surveyed streets. It is recommended that, based on an engineering and traffic survey that was conducted in March_ 25, 1999 in accordance with Section 8- 03.3 of the State Traffic Manual, that Sections 11.16.010 (Speed Zones Designated) of the National City Municipal Code be amended to read as follows: 11.16.010 Speed Zones Designated C. Waters - Mayor April 22, 1999 Mr. Bill Wilson, General Manager and Members of the Stadium Authority Qualcomm Stadium 9449 Friars Road San Diego, CA 92108 SUBJECT: POLICE TACTICAL RESPONSE TO QUALCOMM STADIUM GATHERING AFTERMATH For several years, there has been an annual low -rider car show held at what is now Qualcomm Stadium. It has been a practice for thousands of participants and spectators from the show to cruise Highland Avenue in National City following the event at the stadium. This has been encouraged by sponsors of the event, such as a local radio station, and the numbers of cruisers have steadily grown over the years. Commonly, over 10,000 vehicles have crowded into National City. In past years, this after event cruising on Highland Avenue has generated major problems for the National City Police Department. Those problems have ranged in severity from public intoxication and fighting to gang related murders.. Additionally, residents in nearby neighborhoods and merchants along Highland Avenue have been subject to substantial disruptions of their lives and businesses as a result of this annual event. For those reasons, the Police Department has, for several years, employed closure and rerouting tactics to discourage the cruisers and spectators, to reduce grid lock conditions, particularly in residential neighborhoods, and to reduce concentrations and large gatherings of problematic persons and groups. All these police activities not only require extremely careful and time consuming planning, but are also highly labor intensive in their execution. This year, the equipment (including a command van), material and human resources employed to address the problem were substantial. The National City Police Department called on the San Diego County Sheriffs Office's Gang Unit for assistance. That unit provided 17 deputies, including a lieutenant and two 3ecycled Paper sergeants (all on overtime). Personnel from the City of National City included Police personnel and four civilian employees from Public Works. In total, sixty- eight (68) people were deployed over several hours to deal with the problem. Not counting time spent in planning, a total of 412 man-hours were used, over 200 of which were at overtime pay. As in past years, dealing with this event greatly strained the resources *of this Police Department and cost the City of National City thousands of dollars. In addition, though informational letters were hand distributed to merchants by members of the Department's Neighborhood Policing Team prior to the event, nearly fifty businesses along Highland Avenue were negatively affected by the crowds and street closures and thousands of National City residents were forced to deal with a wide range of disturbances and disruptions which, temporarily but very negatively, impacted their peace and the quality of their lives. We are asking that you consider the impact of this type of event on the health and safety of the citizens of National City, as well as the cost to the taxpayers when determining if such an event will be allowed in the future.
