This is the time and date set to consider the reallocation of $49,131.82 in 1995-96 program year CDBG funds from the Graffiti Program to the Library Electrical Rehabilitation Project ($6,000), the Graffiti Truck Replacement Fund ($30,000), the Casa de Salud Rehabilitation Project ($631.82), and the Camacho Gym Re -roofing Project ($12,500). Please see Attachment No. 2 for a summary of these reallocations. No new projects are being proposed at this time. Public Works and Building & Safety staffs will be present at today's meeting to answer any questions with regard to the individual projects. Environmental Review N/A Financial Statement No affect. Eiser, III City Attorney Traffic Safety Committee Acenda Item Request: #1- In the planning of the Paradise Creek Educational Park for the area behind Kimball School, several issues relating to traffic and safety have came up. The dead- end of Hoover Avenue is the location for a Gateway entrance to the park. The City Council has authorized the construction of sidewalks to enhance the end of the street. Grants from outside the city have been acquired to design a new, more attractive fence in the area. But the problem is that some trucks have been using this dead end for a parking lot. A few businesses have worked out in the public right of way by either storing materials such as steel beams or maintained trucks and vehicles right on the street. For these illegal practices to cease there is a need for much enforcement of the laws pertaining to these matters. But there is also a permanent solution required. After consulting with the City Engineering Department the idea that was the most appropriate for all concerned was to install signs and green curb paint along both sides of Hoover Avenue that limit parking on the street for a period of two hours, seven days a week,24 hours a day. This would give the visitors to the park a place to park their vehicles without the obstruction of large trucks or their trailers. As well, the businesses adjacent to Hoover would be able to unload their delivered materials and move them on to their premises. #2- An exciting part of the Park will be an Observation Station along 18th Street where Paradise Creek flows under the street. Once again, money from outside sources will be utilized to enhance and beautify part of our community. The Observation Station will consist of new fences, interpretive,educational signs similar to the types one sees at the San Diego Zoo, and a shelter and park bench (similar to a bus bench, only facing the creek,) for parents and grandparents to rest while the children observe the wildlife. Along 18th Street it would only appear sensible to restrict parking along a short section of the street near the park bench to protect the bench and people using it,to avoid any cars from parking too dose to the bench, also to allow for the public to see the site from a distance. The shelter and bench will be brightly colored to attract the casual passerby's eye and draw them into the world of the creek's flora and fauna. We don't want to obstruct the view of this new investment in our city. Red curb would work to meet all of these concerns. That Section 18.98.170 of the National City Municipal Code is amended to read as follows: 18.9'8.170 Sale of gasoline as an accessory use. A. The sale of gasoline as an accessory use to a permitted use shall require the issuance of a conditional use permit. B. The sale of gasoline as an accessory use will be allowed only in zones in which the sale of gasoline as a principal use is allowed. Section 3. That Section 18.98.190 of the National City Municipal Code is amended to read as follows: 18.98.190 Sale of nonautomotive products at service stations. The sale of nonautomotive products in service stations is permitted as follows: A. Such products must be displayed within an enclosed permanent building. B. The display area shall be a maximum of two hundred sixteen cubic feet, except that a conditional use permit may be issued pursuant to Chapter 18.116 of this title to authorize additional areas of display, where such use is otherwise permitted by this title. The sale of any alcoholic beverages is prohibited, regardless of the display area, unless specifically authorized by a conditional use permit in accordance with Chapter 18.116 of this title. That the City Council finds that the Code amendment is consistent with the General Plan, since the General Plan contains policies which encourage adoption and review of appropriate regulations and procedures, and the amendment will bring the Code into conformance with applicable State laws. The attached report, along with the memorandum from the Police Department and the Council Resolution of approval, was reviewed at that time. The matter was continued to obtain information on plans to complete the parking lot at the northwest corner of 7th Street and Roosevelt Avenue. This Church has been informed of this. In addition, the Church has been asked to have a representative at the November 4 Council meeting and respond to questions. A copy of a letter sent to them on September 10 is attached. A telephone call was made reminding them of the need for their attendance. The report evaluates each condition of approval to determine if the conditions are being complied with. The Council was pleased that the church is no longer drawing the large crowds that previously were impacting adjacent properties. They expressed an interest however, in learning when the church would be improving the parking lot at the corner of 7th Street and Roosevelt Avenue. DiCerchio Chief of Police FROM: Ray Allen, Lieutenant SUBJECT: Universal Church of God, 330 National City Boulevard After receiving the memorandum from Roger Post, Planning Director, regarding the Universal Church of God dated 8-8-97, I had the Crime Analysis Bureau conduct a study to determine if the Police Department received any complaints about the Universal Church of God or responded to any traffic complaints associated with the church. I received a report from Beverly Sturk, Crime Analysis Bureau Technician, who completed a check of all dispatch calls received for the last year. The Police Department did not have any complaints logged for that specific address. I checked with P.E.O. Sarmiento to determine if he issued any parking citations at that location or responded to any reports of parking problems within the last year. P.E.O. Sarmiento did not issue any citations in the area of the church and he thought the area was considerably free of parking related problems compared to when the church first opened. Regarding the expansion of the operating hours of the church, I do not think the noise from the church services would be a problem because of the construction of the building. The only problem would possibly be parking related due to the other businesses in the area and the limited number of street parking that is available in the area. When the church first opened and the Police Department received a complaint, the church leaders were very cooperative and assisted in the resolution of the problems, usually related to parishioners parking in the "truck parking only" spaces. Before this Conditional Use Permit shall become effective, the applicant shall sign and have notarized an Acceptance Form, provided by the Planning Department. acknowledging and accepting all conditions imposed upon approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the Conditional Use Permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the county. The Notice of Restriction shall provide information that conditions imposed by approval of Conditional Use Permit No. 1995-17 are binding on all present and future interest holders or estate holders of the property.
