Proposed Notice of Exemption A-200 (9/80) BACKGROUND REPORT The applicant has requested a Code amendment to allow transitional housing for the homeless in multi -family residential zones. The proposed amendment would enable philanthropic or nonprofit charitable organizations to house homeless families and provide supportive services in apartment buildings in those zones. Under current Code this use would be classified as an institutional use not permitted in residential zones. The proposed amendment would apply to all property zoned for multi -family residential use in the City. Currently, the use is allowed by right in institutional zones and with a conditional use permit in commercial zones. South Bay Community Services is interested in using an existing apartment complex at 1125-1137 B Avenue for transitional housing. Tenants would pay rent, but would receive extra resources and assistance and have a time limit on residency. Standard rental agreements would not be used. The attached letter describes the benefits the project would receive from being located in a residential area. The applicants spoke in favor of the project at the Planning Commission hearing and requested a swift decision since they are in escrow for the site. A continuance was not acceptable to the applicant. The Housing Element of the General Plan identifies a goal of providing adequate housing for households with special needs. Although the proposed Code amendment is more specific than any policies of the General Plan, it would further this goal. Requiring a conditional use permit would meet the General Plan goal of citizen participation. A CUP requirement would also allow the public, the Planning Commission, and the City Council to review transitional housing proposals on a case -by -case basis. At the public hearing, Commissioners discussed the abundance of low-income housing, and expressed concern that the proposed amendment would expand opportunities for low-income housing rather than meeting the need for additional moderate- to middle -income housing. The Commission voted to recommend denial of the proposed amendment based on General Policies that encourage a mix of housing for all income types, since the amendment would encourage low-income housing and potentially discourage future middle - income housing. Those Commissioners who voted against denial of the amendment wanted additional time and information to evaluate the request. The Commissioners had indicated an interest in visiting an existing property in Chula Vista owned by South Bay Community Services and in seeing crime reports from the area. Commissioners also wanted to have more information to compare transitional housing with homes for battered women, a permitted use in single-family homes. RECOMMENDED FINDING FOR DENIAL 1. That the proposed Code amendment is not consistent with the General Plan, since the General Plan identifies the need to provide a wide range of housing opportunities, and since there are a disproportionate number of low -income -residents in National City. The Code amendment would not further the General Plan goal of encouraging production of housing affordable to the moderate and middle income ranges. RECOMMENDED FINDING FOR APPROVAL 1. That the Code amendment is consistent with the General Plan, since the Housing Element of the General Plan contains goals to provide adequate housing for households with special needs. The Conditional Use Permit requirement will carry out General Plan policies that call for protection of established neighborhoods, where transitional housing proposals could be expected. PROPOSED AMENDMENT 1. Add the following definition: 18.04.685 Definition "Transitional Housing" means multiple -family residential housing operated by philanthropic institutions with on -site management and supportive services offered to its recently homeless residents. 2. Add transitional housing to Use Group 11 (CUP required) NATIONAL CITY PLANNING DEPARTMENT October 29, 1999 National City Planning Department 1243 National City Blvd. National City, CA 91950 RE: South Bay Community Services/Code Amendment Application Dear Planning Commissioners: South Bay Community Services ("SBCS") hereby requests an amendment to the Land Use Code to permit transitional housing in the RM-1-PD zone without the need for a conditional use permit. This application is made in connection with SBCS's proposed project at 1125-1137 B Avenue, a nine -unit residential building. "Transitional housing" is temporary housing with supportive services, limited occupancy of up to two years, and designed for the recently homeless with the ultimate goal of moving them to permanent housing as quickly as possible (Cal. Code Regs., Title 25, Section 7950). It is important to note that transitional housing is operated similarly to conventional rental properties. Transitional housing is not a group living situation nor is it institutional in nature. Each family has their own apartment and pays rent. With respect to the proposed project, there will be a resident manager living on site. Transitional housing is appropriate in the RM-1-PD zone because in order for homeless families to transition into permanent living and self-sufficiency, they need normalcy and an environment that promotes growth and encouragement to accomplish their goals, such as can only be found in residential neighborhoods. Access to libraries, community centers, public transportation, freeway access, shopping, schools and job opportunities is critical for such families and their children. The only difference is that these families would receive extra resources and assistance and would have a time limit to live in the apartment. The people in this transitional housing development would meet all the criteria for living in a residential zone. In order to allow transitional housing in the RM-1-PD zone we would propose that the current Code definition of "Philanthropic Institution" be amended to add "transitional housing" to the list of exclusions from the definition. Sheldon, Assistant Director DATE: January 19, 2000 RE: ACQUISITION AND REHABILITATION PROJECT AT 1125-1137 "B" AVENUE MANAGED TRANSITIONAL HOUSING This memo represents my recommendation to the City Council for approval of the proposed code addition 18.04 defining "Transitional Housing". South Bay Community Services (SBCS) is an approved Community Housing Development Organization (CHDO) and has demonstrated the ability to provide quality services in a cost-effective manner. This office has approved a "Certification of Consistency with the Consolidated Plan" form regarding this project. The proposed project is presently a social and physical blight to the immediate and surround- ing neighborhood. It is extremely unlikely that normal market forces would find it feasible to undertake this type of project. SBCS, in its unique position as a quality affordable housing provider, can assemble the financial package necessary to undertake the acquisition, rehabili- tation, and management services required. Because of the funding request being made by SBCS, a detailed Disposition and Development Agreement (DDA) will be provided for CDC approval. The DDA will include management objectives and individual occupancy agreement forms, as well as financial and construction time lines. From a community development perspective, this project is in the best interest of the sur- rounding area and this community. Approval is recommended. According to Mr. Tofan, mechanics from around the block park their vehicles all day in front of his property leaving no parking for his customers. He stated they also park vehicles that they are repairing for days waiting for parts. Mr. Tofan also stated that he is losing business because his customers find no parking in the area. (-ITEM TITLE A Resolution Authorizing City Council to Declare an Emergency for the Repair and Restoration of Three Structures Damaged by a Sewage Overflow PREPARED BY Joe Smith EXPLANATION DEPARTMENT Public Works On December 18, 1999, three residential properties located at 2401, 2409, and 2415 East 4`h Street were damaged by a sewer overflow, causing them to be uninhabitable. This overflow was caused by a blockage in the City's mainline sewer system. All properties required water removal, disinfecting affected areas, removal and replacement of flooring, replacement of dry wall, and other miscellaneous repairs and painting. It was also necessay to relocate one of the residents to a hotel, while the work was being done. The restoration and repairs costs were completed at a cost of approximately $52,000. Presently the Engineering Division is in the process of developing a project to have both the Sewer System and the Storm Drainage System evaluated for potential problems. Once this is completed, this will provide the City with a comprehensive maintenance plan. In order to pay the above costs, it is necessary for the City Council to approve a Resolution declaring this an emergency in accordance with Section 13 of Ordinance No. 1480, National City Municipal Code. BOARD / COMMISSION RECOMMENDATION N/A ATTACHMENTS ( Listed Below ) Resolution No. 2000-7 Resolution A-200 (9/80) RESOLUTION NO. 2000-7 RESOLUTION ON THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AFFIRMING THE DECISION OF THE CIVIL SERVICE COMMISSION IN THE MATTER OF Tim APPEAL OF VIVIANE FT TG WHEREAS, on November 1, 1999, in National City, California, an open hearing was held by the Civil Service Commission of the City of National City upon the request of the appellant, Viviane Elig, pursuant to Government Code Section 54957, to consider her appeal of a 10-hour suspension without pay as a Police Office with the City of National City; and WHEREAS, after said open hearing, the Civil Service Commission deliberated in private and thereafter rendered a written decision containing its FINDINGS and CONCLUSIONS AND RECOMMENDATIONS; and WHEREAS, the Civil Service Commission certified its findings and decision to the appellant Viviane Elig, the appointing authority, and the City Council on November 10, 1999; and WHEREAS, a copy of the decision of the Civil Service Commission is attached hereto as Exhibit "A"; and WHEREAS, a written request for council review was timely filed with the Personnel Officer after the Commission had certified its findings and decision; and WHEREAS, the Personnel Officer thereafter had a transcript of the hearing before the Civil Service Commission prepared and distributed to the members of the Council, the appellant, Viviane Elig, and the appointing authority; and WHEREAS, Rule 810 of the Civil Service Rules of the City of National City provides that within sixty (60) days after submittal of a written request for Council review, the council shall affirm, revoke or modify the Commission's action, such Council action to be final and conclusive; and WHEREAS, a copy of the record of the proceedings before the Civil Service Commission, including said transcript of the testimony, copies of all documentary evidence and other exhibits were transmitted and made available to the City Council; and WHEREAS, at its regular meeting on January 18, 2000, the City Council then considered the Matter of the Appeal of Viviane Elig in open session pursuant to her request under Government Code Section 54957, and thereafter deliberated upon said matter in closed session, made its findings and announced in open session that the appeal had been denied. Resolution No. 2000-7 Page 2 of 3 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the Council makes the following findings: 1. That the only issue before the City Council was whether or not the facts and circumstances surrounding the violations of the National City Civil Service Rules as described in the record of the Civil Service Hearing indicated that the decision of the Civil Service Commission should be affirmed, revoked or modified. 2. That appellant was employed by the City as a Police Officer with the National City Police Department on May 26, 1999. 3. That by the testimony and exhibits admitted, substantial evidence was presented to establish that Viviane Elig on May 26, 1999, in violation of Police Department Regulation 5.0 had failed to perform at an expected level or standard in a responsible and timely manner, and that her conduct was unacceptable for an employee of her tenure, in that she failed to take appropriate action on the occasion of a crime under conditions deserving of police attention. 4. That appellant committed the acts described above, and no evidence serves to mitigate the seriousness of this violation. 5. That the nature and gravity of this violation is of the most compelling nature, requiring discipline by the Department in that appellant's performance of duty was unacceptable and therefore constitutes misconduct of substantial gravity and repetition to justify the discipline imposed. 6. That the aforementioned conduct of Viviane Elig constituted violations of the following Civil Service Rules: a) Rule VIII, Section 802(a). Violation of Department written policy and procedure. b) Rule VIII, Section 802(d). Incompetence, inefficiency or ineffectiveness in the performance of duty. 7. That appellant Viviane Elig has been provided reasonable notice and opportunity to respond to the charges against her. 8. That all procedural requirements of the Civil Service Rules have been met. Resolution No. 2000- 7 Page 3 of 3 BE IT FURTHER RESOLVED that based on the above findings, the City Council orders that the Decision of the National City Civil Service Commission be affirmed as follows: That appellant Viviane Elig be suspended without pay for ten (10) hours from her employment with the City of National City Police Department. BE IT FURTHER RESOLVED that the time period within which judicial review of this decision must be sought is governed by Code of Civil Procedure Section 1094.6. BE IT FURTHER RESOLVED that the Secretary of the Civil Service Commission shall forthwith serve a certified copy of this Resolution upon the appellant, Viviane Elig, and execute a certificate of service to be kept with the official records of the City in connection therewith attesting to the date of service. ELIG The above captioned matter concerning the discipline of Viviane J. Elig (the "Appellant") as an employee of the City of National City came for hearing on November 1, 1999, before the Civil Service Commission of the City of National City in the Main Conference Room of City Hall at 1243 National City Blvd., National City, California 91950. Appellant's discipline is governed by the California's Public Safety Officers Procedural Bill of Rights (California Government Code Sections 3300 through 3311, inclusive) (the "Act"). In accordance with Section 3304(b) of Act the Appellant was provided the opportunity for the administrative appeal of a decision to impose punitive action (as that term is defined Section 3303 of Act) following an investigation into Appellant's conduct surrounding a series of events occurring on May 26, 1999. Appellant was present and represented by Everett L. Bobbitt, Law Office of Everett L. Bobbitt, San Diego, throughout the hearing. The City was represented by Assistant City Attorney Rudolf Hradecky. Serving as Legal Advisor to the Commission was Special Counsel Morgan L. Foley. The following members of the Commission constituted a quorum and participated in this hearing and decision: Chairperson Kathy J. Smith, Rita Helms, and Frank Pekarek. The Civil Service Commission heard testimony and examined the evidence offered by the parties, and the cause was submitted for decision. The Civil Service Commission being fully advised, unanimously makes findings of fact as follows: FINDINGS OF FACT 1. The Appellant, is employed by the City as a Police Officer and was employed in that capacity on May 26, 1999. 1 EXHIBIT A 2. Substantial evidence was presented to demonstrate that Appellant violated National City Police Department Rules and Regulations Rule 5.0, Performance of Duty ("Rule 5.0"), by failing to conduct a complete investigation into the recovery of a motor vehicle, which motor vehicle was reported by San Diego Police Department to be stolen and possibly in the possession of two identified suspects residing in National City. Appellant's conduct, which occurred while on patrol on May 26, 1999, supports the charge that she violated Rule 5.0 by failing to take appropriate action on the occasion of a crime, and failing to take appropriate action under conditions deserving police attention, thereby performing below the expected level or standard commensurate with her position, training, and tenure in the Police Department. 3. The level of discipline imposed by the City of National City in dealing with Appellant's conduct described above must demonstrate that the conduct is not tolerated, and to ensure that she exercises greater care in the future. This is particularly important in light of evidence that Appellant's most recent evaluation, only one month prior to the incident of May 26, 1999, highlighted Appellant's lack of care in conducting investigations that do not appeal to her. The fact that Appellant's conduct on May 26, 1999 is consistent with the negative comments in her evaluation is a matter of due concern to the City, requiring the City to take appropriate discipline to collect such behavior. The Commission believes that suspension for a period of ten (10) hours, without pay, is appropriate under the circumstances. 4. The Appellant was provided reasonable notice and opportunity to respond to the charges against her. 5. All procedural requirements of the Act and the Civil Service Rules have been met. STATEMENT OF DECISION The Civil Service Commission finds that the conduct of Viviane J. Elig, in the Findings of Fact section of this document, constitutes unacceptable and unsatisfactory performance, in violation 2 EXHIBIT A of Rule 5.0 of the National City Police Department. The Civil Service Commission considered testimony and evidence presented by Viviane J. Elig and the City during the appeal hearing. After careful consideration, the information presented and evaluated substantially supports the City's decision to impose disciplinary action and the Civil Service Commission is satisfied that the Appellant's behavior was of sufficient gravity so as to uphold the imposition of a ten (10) hour suspension without pay. Viviane J. Elig's appeal of the Captain Short's decision of August 18, 1999 is denied. Judicial Appeal Notice to Viviane J. Proposition 14 provides $350 million dollars in bond money for building and renovating public libraries. I have attached a sample resolution of support for Proposition 14. I would appreciate your placing a resolution on the Council agenda. If approved, National City Council would join the many California cities and counties that support Proposition 14. I would be happy to provide you with further information. Sample Resolution Proposition 14 — California Reading and Literacy Improvement and Public Library Construction and Renovation Bond Act of 2000 WHEREAS, public libraries are a supplement to the formal system of free public education and deserve adequate financial support from government at all levels; and WHEREAS, a viable statewide system of public libraries is essential to assist the schools, support children and to serve the general public in all local communities; and WHEREAS, community public libraries are an important partner in providing a quality education for children and ensuring lifelong learning opportunities for all citizens; and WHEREAS, the public interest is served by providing adequate resources to properly fund public library facilities and services; and WHEREAS, local public libraries throughout California need additional funding for the construction of new libraries and for the expansion and renovation of existing library facilities to better serve their communities; and WHEREAS, the California State Library recently conducted a statewide survey which identified a need for over 425 local library projects at a cost in excess of $2 billion; and WHEREAS, first priority is given to projects which are joint ventures between public libraries and the schools; and WHEREAS, the California State Legislature and the Governor approved SB3, the California Reading and Literacy Improvement and Public Library Construction and Renovation Bond Act of 2000, authorizing $350 million in State bonds to fund grants on a 65% state — 35% local match basis; and WHEREAS, this measure will appear on the March 7, 2000 statewide ballot as Proposition 14, and, if approved by California voters, will provide significant funding to address California's public library construction needs; NOW, THEREFORE, BE IT RESOLVED BY THE (NAME OF AGENCY) that the (name of agency) endorses Proposition 14 on the March 7, 2000 ballot, encourages voters in the (city/county) to votein favor of this measure and directs the (city/county) Clerk (or appropriate officer) to forward a copy of this Resolution at the earliest possible date after its adoption to the (California State Association of Counties, League of California Cities, the California Contract Cities Association or Independent Cities Association, school association, etc. — as appropriate). 1/25/00 Model Resolution Resolution of the City/County of Opposing SB 329 (Peace) WHEREAS, California Senator Steve Peace has amended Senate Bill 329 to establish the San Diego Regional Infrastructure and Transportation Agency in the San Diego region which would carry out the responsibilities of the San Diego County Air Pollution Control District, the San Diego Association of Governments, the San Diego Metropolitan Transit Development Board, the North San Diego County Transit Development Board, and the San Diego Unified Port District; and WHEREAS, the bill would create a newly elected regional governing body from separate "wards" throughout the region to govern the consolidated agencies that are currently governed by local elected city and county officials or, in the case of the Port District, their appointees; and WHEREAS, the [City/County of 1 believes that the bill violates the principal of local control by eliminating cities and the County from transportation and land use decisions which are within the purview of the agencies to be consolidated; and WHEREAS, there has been no information or justification offered providing adequate rationale for such a radical shift in regional leadership and decision -making; and WHEREAS, structural change in regional and subregional government which adds a new "layer" of government should be analyzed and reviewed by the cities and county within the San Diego region and the public, and possibly be considered by the voters, in order to gain consensus before its enactment; and all; and WHEREAS, there is no urgency requiring implementation of SB 329 in the near term if at WHEREAS, local governments were not consulted or informed in the preparation of the legislation and can only react to its current content; and WHEREAS, without local government support, and full examination of the costs and need for consolidation there is no justification for an addition of a separate layer of government which has no additional incentives or authority for carrying out existing responsibilities beyond those that currently are in place; and WHEREAS, SANDAG, recognizing the bill as a catalyst for examining regional governance in the San Diego region, proposes to appoint a public -private Task Force to undertake an examination of the issue of regional decision -making and coordination and could recommend alternatives to the current structure, if determined appropriate; and WHEREAS, SB 329 fails to address the relationship between regional and local plans, and therefore does not truly affect implementation of regional plans and programs, and WHEREAS, SANDAG proposes to examine the relationship between regional and local plans to determine if there is a lack of coordination and/or if a better approach is justified; and WHEREAS, Senator Peace also has heard from the public in a series of forums conducted for such purpose, and many additional significant questions and concerns have been raised at these forums which have yet to be addressed; and WHEREAS, the highest priority for legislative action this year should instead focus on state -local fiscal reform and passage of a half -cent transportation sales tax extension; NOW THEREFORE BE TT RESOLVED, that the [City/County of ] finds the bill premature and unacceptable in its current form and therefore must oppose it; and BE IT FURTHER RESOLVED, that Senator Peace is hereby requested to withhold SB 329 from further legislative consideration until a consensus among city, county and state officials, civic and community leaders and the public, on the need for modification or consolidation of government agency authorities and responsibilities in the San Diego region is arrived at. We appreciate the opportunity to present our petition, and thank you in advance for your careful consideration and expeditious response. Petition: to revise building code 15.12, so as to allow the relocating of structures in National City, having originated outside the city limits. History: though not archived in any of the recent ordinances it seems evident that in years past of number of structures moved into the city were substandard, and remain so for far too long before final inspection. Understandably after numerous violations and in response Ito community complaints the city saw it fit to prohibit the introduction or any buildings from outside the city limits, and to regulate more carefully relocations within the city. Argument & Justification for change: Currently the city allows the introduction of modular homes. These are pre -fabricated structures (see 15.12.015) that are "moved on" to city lots by semi trucks, not unlike mobile homes. According to real estate statistics 30% fewer homebuyers will choose a modular home over a conventionally built home. This automatically lowers the sales price of the modular home property, which in turn lowers surrounding property values. We believe that it is correct for the city to allow people to select a modular home, if they so choose too, as there personal residence so long as it adheres to code (15.12.0040). It would follow that a conventionally built house with a potentially higher improvement value should also be considered for relocation regardless of its origin address. After all, why should National City be obligated to consider a sub standard house just because its within city limits. And conversely, why should a superior house, that would beautify and enhance National City be denied consideration. Proposition 14 provides three hundred fifty million dollars in bond money for building new libraries, repairing existing facilities, upgrading telecommunications and electrical systems, improving study conditions, and creating a safe, comfortable environment for library users. Prop. 14 is an investment in literacy, learning and libraries Public libraries have always been centers of lifelong learning and literacy, providing a safe place for children to read and study, and for adults to access learning programs. When it comes to literacy, our 4th graders have ranked next to last on national reading tests. Adult illiteracy hurts our economic competitiveness and is often passed from generation to generation. Prop. 14 returns money to local communities without raising taxes This measure provides 65% in state funding for each approved project, freeing up local money to increase hours, books, and reading programs for children, students and adults. With over 400 library projects needed just to meet current demands, Proposition 14 fills a vital funding need without raising taxes. And by law, this bond money cannot be used by local government for administrative costs -- Proposition 14 maximizes the effectiveness of these critical funds. Prop. 14 provides priority funding to school and library partnerships By strengthening the partnership between libraries and schools, Proposition 14 is a critical element in achieving California's literacy goals and strengthening our entire educational system. Priority funding will go to projects where schools and libraries are working together.
