Public works services provided in our community are an integral part of our
citizens' everyday lives; and
The support of an understanding and informed citizenry is vital to the efficient
operation of public works systems and programs such as water, sewers, streets and
highways, public buildings, and solid waste collection; and
The health, safety, and comfort of this community greatly depends on these facilities
and services; and
The quality and effectiveness of these facilities, as well as their planning, design, and
construction is vitally dependent upon the efforts and skill of public works officials;
and
The efficiency of the qualified and dedicated personnel who staff public works
departments is materially influenced by the people's attitude and understanding of
the importance of the work they perform.

A Public Hearing is required prior to the establishment of a fair market value purchase price
for the sale of land by the CDC. This is to comply with the requirements of the California
Community Redevelopment Law, Health & Safety Code, and Section 33433. This law also
requires a Summary Report Pertaining to the Sale of Real Property (attached) relative to sale
price. The report must be available for the public to review prior to a Public Hearing. Notice of
the review and hearing must be published in accordance with government code
requirements. These requirements have been met.
This is the time and place for the Public Hearing.

PERTAINING TO THE SALE OF REAL PROPERTY
RELATIVE TO SALE PRICE
Public Review Period
May 3,2000 to Public Hearing May 16,2000
This Report is prepared in order to comply with the requirements of the California Community
Redevelopment Law Health & Safety Code Section 33433 a copy of which is attached as Exhibit
"A" to this report.
Note:
The Community Development Commission of the City of National City (hereinafter, the
"CDC"), is both a Redevelopment Agency and Housing Commission organized under the Health
& Safety Code, California Community Redevelopment Law.
Michael J Hennessey (hereinafter, the "Developer") is an individual of the Hennessey Group,
17581 Irvine Boulevard, Suite 108, Tustin, California 92780.
Paul Desrochers, Executive Director of the CDC, prepared this Report.
A Copy of the proposed Disposition and Development Agreement (DDA) is on file in the CDC
office. This agreement is subject to change and will be modified particularly with regard to the
covenant discussed in Section 4 of this report.
1. Description of Proposed Transaction
The CDC proposes to convey the Site to the Developer for construction and operation of a
combined Convenience Store, Fast Food Outlet and Gas Station on a 49,443 square foot parcel
bounded by 8th Street on the South, Roosevelt Ave. on the east, Interstate Route 5 (1-5) on the west
and 7th Ave on the north.
The proposed DDA will contain details of the transaction between the CDC and the Developer
including the schedule of performance, method of financing, and other issues relative to
development of the site.
The CDC has purchased or has in escrow all parcels that make-up the proposed site to be conveyed
to the developer. A public alley bisects the site and needs to be vacated; likewise, a portion of 7th
Street will be vacated and added to the site. Both the alley and street make up the entire 49,443 sq
ft parcel.

It is proposed that the CDC convey the parcel to the Developer for a purchase price of $572,550
(11.58 per sq ft x 49,443 sq ft.). The Site Map and Site Plan are shown as Exhibit "B".
2. Developer Responsibilities
The proposed DDA requires the Developer to:
• Construct a 5,000 sq. ft. +/- building to house a combined convenience store and fast food
outlet, a gasoline station with six islands, landscape and paving. All such plans and
specifications must be in accordance with City of National City (design review) Planned
Development requirements and accepted (City and County), underground storage tanks,
engineering and building construction codes.
• Submit evidence for approval by the CDC that the tenant is contractually bound to operate the
proposed facilities at the subject site.
• The Developer will be required to deposit in escrow the purchase price ($572,550) less the
$2,500 deposit for the Exclusive Right to Negotiate, which will be applied, to the purchase
price. Escrow will close and the developer will take title when the building permit for
construction is secured.
• The Developer shall commence construction within 30 days after the close of escrow.
• The Developer shall complete construction of improvements on the site within 180 days after
commencement of construction.
3. Cost incurred by the CDC to acquire subject property
The cost to acquire said property is as follows:

• The Morgan and Smith properties are in escrow at the time of writing of this report. The cost to relocate the tt-nart
and Goodwill cost is estimated at this time.

4. Estimated Value of the Site at the Highest and Best Use Value
• The Developer has submitted an estimate of the residual land value, which is included as
Exhibit "C" of this document. The analysis concludes that the income and cash invested at 12%
supports a residual land value of $572,496 the same as what is proposed. The method used to
calculate this value is based on estimated costs of financing and construction.
• The income derived from the property has not been verified; the Developer is not able to
provide the lease between him and the tenant.
• Sales of vacant commercial land within the city and elsewhere indicate a value in the range of
$12.00 per square foot, or close to the proposed selling price.
• Comparables of sales for land uses similar to what is proposed by the developer range from a
low of $9.98 per sq ft to $42.80 per sq ft.; the value proposed for the subject property is $11.58
(refer to Exhibit "D").
• The average price per square foot for the CDC to assemble the subject property is $20.00 per
square ft., a difference of $8.42 per sq. ft. or $416,310.
• With the wide range in valuations and the lack of knowledge of the income potential
(Developer's lease with Jack -In -The -Box) a value of no less than $20.00 per sq. ft. is placed
on the property for the use proposed.
• A COVENANT ATTACHED TO REAL PROPERTY (Covenant) as part of the DDA will
support a purchase price of $572,550. For the period commencing upon the date the Covenant
is recorded the Developer shall not make any sale nor cause any lien or encumbrance on the
property without concurrently making payment to the CDC in an amount not to exceed 75% of
the proceeds of said sale or refinancing above the actual Developer's verified cost as provided
in the DDA. The CDC share will not exceed the deferred purchase price of $416,310. Both the
Developer's cost and the CDC's share may be adjusted to reflect cumulative changes in the
cost of living (using the Consumer Price Index for All Urban Consumer's (CPI), U.S. City
Average All Items). This Covenant will expire Five Years from the date of the recording of the
Covenant.
• The Covenant along with the selling price $572,550 will assure that the value of the property
is sold at a fair price and any realized "windfall" profits are not gained at the public's expense.
5. Highest and Best Use
• The subject site is adjacent to Interstate Route 5 (1-5) where in excess of 200,000 vehicles pass
daily. Three of the four access points to and from the freeway are adjacent to the site. The other
access point is two blocks distant. Approximately 22,000 vehicles pass the site on the surface
streets. An older service station on a site one-third the size is across the street. A Higher
Education Center with a current enrollment of 1,600 students and five lodging facilities are

located within a three -block radius. No fast food or convenience stores are located within a
mile of the site.
• With the aforementioned conditions the proposed combined Fast Food/Convenience Store and
Gas Station is the highest and best use of the site. Adequate signing and lighting will attract
customers from the freeway and surface streets.
• Other uses such as a full service restaurant or a free standing fast food restaurant or other
commercial uses would not be as successful as the proposed use due to the shape of the
property, noise from the freeway, and/or insufficient size to attract a major user.
6. Explanation of Why Sale of the Property Will Assist In Elimination of Blight
• The site consists of small parcels of mixed uses. Currently in place is a small used car lot that is
below the minimum size allowed by Code. There is no landscaping, and the office structure is
small and outdated. On the adjacent site a former Chevron Gas Station is occupied by a vapor
recovery system and is otherwise vacant. The properties along Roosevelt Street are the site of
several dilapidated residential structures purchased by the CDC and now razed because of the
blighting conditions including substandard living units.
• The site will be developed with a modem, well -lighted facility, the first of it's kind in the South
San Diego Bay Region. The completed facilities will complement the near -by hotels and
encourage other visitor serving uses as well as provide residents with needed services.

(c) For the purposes of this section, "small business" shall have the same meanie as .defined
in Section 11342* of the Government Code.
(d) This section hall apply only to a project area that is located within the City of Healdsburg,
the City of Long Beach, the. City of Los Angeles, the City of Oakland, othe

. Any agency operating within one of those cities which uses the authority granted�� 11
separately identify those actions in the annual report to its legislative body prep pursuant
Section 33080.1. . .
(e) No agency may amend a redevelopment plan to increase the tax increment revenue limit
'pursuant to Section 33333.2 or 33333.4 for the purpose of -implementing this section..
33427.1. This article shall remain in effect only until July 1, 1999, and as of that date is
repealed, unless a later enacted statute, which is enacted before July 1, 1999, deletes or extends that
date. However, loan guarantees made pursuant to this article chill remain in effect for the duration
of the loan guarantee as if this article were still in effect.
Article 11. Property Disposition, Rehabilitation and Development
33430. (a) Except as otherwise provided in subdivision (b), an agency may, within the survey
area or for purposes of redevelopment, sell, lease, for a period not to exceed 99 years, exchange,
subdivide, transfer, assign, pledge, encumber by mortgage, deed of trust, or otherwise, or otherwise
dispose of any real or personal property or any interest in property.
(b) Any interest acquired by an agency in property described in Section 33032 1 chill be used
only for public purposes. [Note: Section 33032.1 was repealed by Chapter 1336 of the Statutes of
1976.]
33431. Any lease or sale made pursuant to Section 33430 may be made without public bidding
but only after a public hearing, notice of which shall be given by publication for not less than once
a week for two weeks in a newspaper of general circulation published in the county in which the land
lies.
33432. Except as provided in Article 9 (commencing with Section 33410) of this part, an
agency chill lease or sell all real property acquired by it in any project area, except property
conveyed by it to the community or any other public body.. Any such lease or sale chill be
conditioned on the redevelopment and use of the property in conformity with the redevelopment plan.
33433. (a) (1) Except as provided in subdivision (c), before any property of the agency
acquired in whole or in part, directly or indirectly, with tax increment moneys is sold or leased for
development pursuant to the redevelopment plan, the sale or lease chill first be approved by the
legislative body by resolution after public hearing. Notice of the time and place of the hearing shall
be published in a newspaper of general circulation in the community at least once per week for at least
two successive weeks, as specified in Section 6066* of the Government Code, prior to the hearing.

(2) The agency shall make available, for public inspection and copying at a cost not to
exceed the cost of duplication, a report no later than the time of publication of the first notice of the
hearing mandated by this section. This report shall contain both of the following:
(A.) A copy of the proposed sale or lease.
(B) A summary which describes and specifies all of the following:
(i) The cost of the agreement, to the agency, including land acquisition costs,.
clearance costs, relocation costs, the costs of any improvements to be provided by the agency, plus.
the expected interest on any loans or bonds to finance the agreements.
(ii) The estimated value of the interest to be conveyed or leased, determined at the
highest and best uses permitted under the plan.
(iii) The estimated value of the interest to be conveyed or leased, determined at the
use and with the conditions, covenants, and development costs required by the sale or lease. The
purchase price or present value of the lease payments which the lessor will be required to make during
the term of the lease. If the sale price or total rental amount is less than the fair market value of the
interest to be conveyed or leased, determined at the, highest and best use consiste t with
explanation of the

redevelopment plan, .then the agency shall provide as part of the summary �
reasons for the difference.
(iv) An explanation of why the sale or lease of the property will assist in the
elimination of blight, with reference to all supporting facts and materials relied upon in making this
explanation. '
(v) The report shall be made available to, the public no later than the time of
publication of the first notice of the hearing mandated by this section.
(b) The resolution approving the lease or sale shall be adopted by a majority vote• unless the
legislative body has provided by ordinance for a two-thirds vote for that purpose and shall contain a.
finding that the sale or lease of the property will assist in the elimination of blight or provide housing
for low- or moderate -income persons, and is consistent with the implementation plan adopted pursuant
to Section 33490. The resolution shall also contain one of the following findings:
(1) The consideration is not less than the fair market value at its highest and best use in
accordance with the plan.
(2) The consideration is not less than the fair reuse value at the use and with the covenants
anti conditions and development costs authorized by the sale or lease.
(c) (1) Subdivisions (a) and (b) shall not apply to the sale or lease of a small housing project,
as defined in Section 33013, if the legislative body adopts a resolution that authorizesthe eaagenc
y to
sell or lease a small housing project pu rsnant to this subdivision. The agency may sell
e a small
housing project pursuant to this subdivision if, prior to the sale or lease, the agency holds a public
hearing pursuant to Section 33431. Any 'agency that has sold or leased a small housing project
pursuan to thissubdivision shag, within. 30 days after the end of the agency's fiscal year in which the ..-
sale or lease occurred, file a report with the legislative body which discloses the name of the buyer,

33434. If any property acquired in whole or in part from the redevelopment revolving fund is
to be sold or leased by the agency the sale or lease shall be first approved by the legislative body by
resolution adopted after public hearing. Notice of the time and place of the hearing shall be published
once in the official newspaper of the community at least one -week -prior to -the heari g.-The resolution
shall be adopted by a majority vote unless the legislative body has provided by ordinance for a two-

thirds vote for such purpose.
33435. Agencies shall obligate lessees and purchasers of real property acquired in
redeVelopment projects and owners of property improved as a part of a redevelopment project to
refrain from restricting the rental, sale, or lease of the property on the basis of race, color, religion,
sex., marital status, ancestry, or national origin of any person. All deeds, leases, or contracts for the
sale, lease, sublease, or otherntr'ansfer of any clauses hereafter redevelopment in a prescribed project
shall contain or be
subject to the nondiscrimination nonsegregation

EXPLANATION SPECIFICATION NO. 99-3
This Change Order is written to adjust the bid quantities to the actual
quantities of work completed for each bid item and to add work items 33,
34, and 35.
This project was initially bid utilizing full depth replacement of the base
material and a standard asphalt cap to repair failed pavement sections. In
many areas the existing base material that had been marked for removal and
replacement, was determined to be suitable for reuse with recompaction
prior to placement of the required asphalt section. The existing asphalt
in many areas was found to vary from 2" to 7" thick. Engineering judgement
was used to determine the best method to provide an adequate structural
section for each of the various street sections repaired as part of this
project. For these reasons, the amount of base material used in bid items
6 and 7 was significantly less than the bid quantity. In the same respect,
the amount of asphalt used for reconstruction of the structural section in
bid items 8 through 11 was increased due to the existing thickness of the
asphalt.
Due to the quality of the asphalt pavement overlay provided by the
contractor, it was determined that bid item 18, Seal Coat, was not needed
and could be deleted from the project.
Bid Item 31, Traffic Striping, was bid as a lump sum item and included the
replacement of all traffic striping and thermoplastic markings as is. Many
of the existing legends (words and symbols to direct pedestrian and traffic
flow) are painted on as opposed to thermoplastic markings. The Public
Works/Engineering Department desires for safety and maintenance reasons to
change the painting of the legends to thermoplastic. The additional cost
to change the existing painted legends to thermoplastic is $2,260.50 as
shown by item 33.
Work item number 34 was deemed appropriate due to the need to construct
concrete rings as opposed to the use of grade rings to raise the manhole
covers to finish grade. The additional cost to raise these five manhole
covers is $2,224.00.
Work item number 35 consisted of the repair of a small sink hole that
developed in Euclid Avenue adjacent to the curb and gutter over what
appeared to be an abandoned concrete drainage culvert. The area was
excavated, grouted, covered and recompacted. The cost for this repair is
$726.39, based upon time and materials.

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
APPROVING CHANGE ORDER NUMBER ONE FOR
THE NATIONAL CITY STREET RESURFACING PROJECT
(Spec. No. 99-3)
WHEREAS, on November 16, 1999, the City Council approved a contract between
the City and Southland Paving, Inc. for the National City Street Resurfacing Project in the amount
of $1,077,322.90; and
WHEREAS, Change Order No. 1 reduces the contract by $74,413.67 by adjusting
the bid quantities to the actual quantities of work completed for each bid item and adding work
items 33, 34 and 35.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City, California, that Change Order No. 1 of the contract with Southland Paving, Inc. for
the National City Street Resurfacing Project is hereby approved.

CONTRACT ADJUSTMENT:
As a result of this change order the contract price is adjusted as follows:
1. The contract price is reduced in the amount of $74,413.67 from the current contract price
of $1,077,322.90 to a new contract price of $1,002,909.23.
2. The contract time is unchanged. The contract completion date was previously established as
Thursday, May 18, 2000.
This change order shall be considered full compensation for furnishing and installing the materials, labor,
tools and equipment, profit, overhead, and all incidentals for performing the work described above.
Southland Paving, Inc. will not be entitled to damages or additional payment for delays as described in
the 1997 edition of Standard Specifications for Public Works Construction, Section 6-6.3, for performing
the work as described above.

EXPLANATION
A copy othe Summary Report Pertaining To the Sale of Real Property (Report) is included with the
Agenda item relative to the Public Hearing held this date on this subject. The Report concludes that the
Fair Market Value of the property for sale to the Hennessey Group is $572,550 when the Covenant
described in the Report is executed and recorded as part of the sale. The 75% of the proceeds and the
five-year duration of the Covenant are acceptable to the Developer. These items could be removed as an
alternate if the Commission is of the opinion that the fair market value is diminished with these caveats.
State Law requires that the Commission make one of the following findings:
a) The consideration is not less than the fair market value at its highest and best use in
accordance with the Plan; or,
b) The consideration is not less that the fair reuse value at the use and with the covenants and
conditions and development costs authorized by the sale or lease.

WHEREAS, the Community Development Commission of the City of National
City (CDC) has entered into an Exclusive Right To Negotiate for the sale of real property with
the Hennessey Group, the Developer, for development of a parcel of land bounded by 8th Street
on the south, Roosevelt Avenue on the east, Interstate Route 5 (1-5) on the west and 7`h Avenue
on the north; and
WHEREAS, the developer proposes to construct a combination convenience
store, fast food operation and gas station at the site; and
WHEREAS, in accordance with the California Community Redevelopment
Law, Health and Safety Code Section 33433 (Law) a Summary Report Pertaining to the Sale of
Real Property Relative to Sale Price (Summitry Report) must be available for public review
and a public hearing regarding said sale price must be held and certain findings made prior to
the sale of the property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the Notice of Public Hearing and Summary Report have been prepared and
executed in accordance with the requirements of the Law.
BE IT FURTHER RESOLVED that a public hearing regarding the sale price for
the real property was held by the City Council on May 16, 2000.
BE IT FURTHER RESOLVED that the City Council hereby finds that with a
sale price of $572,550 and a Covenant attached to Real Property as described in the Summary
Report, that said consideration is not less than the fair reuse value at the use and with the
covenants and conditions and development costs authorized by the sale.
BE IT FURTHER RESOLVED that the City Council hereby finds that the sale
will assist in the elimination of blight.

STAFF REPORT
AN ORDINANCE AMENDING TITLE 7 OF THE NATIONAL CITY
MUNICIPAL CODE BY AMENDING CHAPTER 7.06 RELATING TO
ABANDONED BUILDINGS AND FACILITIES.
BACKGROUND:
In 1995 the City Council adopted Chapter 7.06 of the National City Municipal Code to
regulate abandoned buildings. Vacant buildingstend to attract vagrants, transients, drug
and other criminal activity, and have a documented history of fires. In addition, they are
often not maintained, accumulate trash, junk and debris resulting in infestations of rats
and other vermin. City staff identifies the abandoned buildings, notifies the owners and
has the buildings boarded. Staff then monitors the buildings to make sure that they
remain boarded.
In spite of the City's efforts, abandoned buildings continue to be a blight to the city.
Boarding the buildings addresses the problem of transients, however the owner will board
the building and a short time later the boards are taken off and the transients return. The
City then notifies the owner again and the cycle continues. Many of these buildings are
also unsightly. The exterior of the building and the yards are not regularly maintained.
To address the continuing problems associated with these buildings the Development
Services Group consisting of staff from the Fire, Police, Planning, Engineering, and
Building Departments and the City Attorney and Community Development Commission
met to discuss the problem of abandoned buildings in National City. This group felt that
revisions in the current law are necessary to address the problems. Many of the changes
are editorial in nature. Other changes address the additional problems associated with the
appearance of the property and give the City the ability to purchase the property if the
owners desire.
SUMMARY OF CHANGES
Section 7.06.010 D
This section states that loose paint is a health and safety hazard. This change came as a
result of the awareness of the dangers of lead based paint for the children. Due to the age
of many of the houses in National City the presence of lead based paint is a possibility.
Maintaining the exterior paint of the building will prevent children from ingesting lead
paint, which has peeled or chipped off and fallen to the ground. Not only will
maintaining the exterior paint prevent possible injury to children, it will enhance the
appearance of the building.
Section 7.06.030
The actual specifications for boarding the structure are now incorporated into this section.
The specifications state the type of attachment and the thickness of the boards. In
addition, it states that the boards must be painted the predominate color of the structure.
For commercial structures opaque window coverings may now be used in lieu of boards
and long as the windows are not broken. Also added in this section is the requirement for
the property owner to maintain the property free of weeds, litter and rubbish.
Section 7.06.090
The previous ordinance established a vacant building monitoring fee, however, an
amount was not determined. This section now sets the fee at $100 a year. This will
allow the Building and Safety Department to recover the cost of inspecting the building
four times per year. These inspections are necessary to prevent the removal of the boards
and to notice the owner if the exterior and yard are not maintained.
Section 7.06.120
This section establishes a revolving fund account, which the City may use to purchase
abandoned buildings, which the owner wishes to sell. Currently the owner has three
options once he is notified. He can 1) fix the building and board or occupy it, 2) pay the
fines and/or go to jail or 3) if the owner cannot afford to fix the property, he has the
option to apply for a rehabilitation loan with the CDC. This section of the ordinance will
give the owner a fourth option after they have failed to comply with any of the above
options. If the owner wishes to sell the property to the City the property will be appraised
and the City will purchase the property.
In order for the City to purchase properties a fund is proposed. The Spot Blight Removal
Fund would be initially funded with matching City and CDC funds. The City funds
would come from the sale of surplus land at Clairmont Ave. near Melrose St. The CDC
funds will come from the sale of land at 16th St and Euclid Ave. and the low -mod housing
fund. After the initial funding, additional funds would be generated from the sale of the
abandoned property after the building is demolished. Matching funds would be
appropriate since the abandoned buildings occur both inside and outside the
Redevelopment Area.
The ordinance was reviewed by the Advisory and Appeals Board and the CDC Housing
Committee and approved.

7.06.010 Purpose and intent —Findings. It is the purpose and intent of the City
Council to establish procedures to minimize or eliminate blight and adverse threats to the public
health, safety and welfare caused by improper maintenance of abandoned or vacant structures,
and to establish penalties and enforcement mechanisms to bring such properties into compliance.
The City Council finds and determines that:
A. Vacant buildings which have become unsecured or dilapidated, or which are
partially destroyed for an unreasonable period of time, attract undesirable individuals including
vagrants and criminals who use the buildings for illicit drug activity and other unlawful

or which are partially destroyed for an unreasonable period of time, or which have been damaged
by fire or decay or otherwise, and which cannot be repaired so as to conform to the requirements
of Title 15 of this code, creates blight, which often spreads to surrounding areas.
C. The existence of vacant buildings which have become unsecured or dilapidated,
or which are partially destroyed for an unreasonable period of time, or which have been damaged
by fire or decay or otherwise and cannot be repaired so as to conform to the requirements of Title
15 of this code, constitutes a threat to the public health, safety and welfare, because such
conditions invite vandalism, arson, drug dealing, other crime problems and fire hazards, and
create unsightliness and blight that depreciates property values.
D. The existence of vacant buildings which become unsightly because of
deteriorated, weathered, chipped, cracked, or peeled paint creates an economic disincentive to
the value of surrounding property. Paint that is loose or falling to the ground causes a potential
health and safety violation due to possible lead -based paint that could be ingested by children,
causing sickness, mental retardation, and possibly death.
E. Unless corrective measures are undertaken to cure and prevent such public
nuisances, such serious threats to the public health, safety and welfare will continue to exist.
Therefore, the need to correct such conditions is sufficiently great so as -to outweigh the potential
benefits of inaction, if any, to the owners of such vacant buildings.
7.06.020 Definitions. For the purposes of this chapter, "abandoned building" means
a building that is vacant, and which:
A. Has become unsecured or dilapidated; or
B. Is partially destroyed and remains so for a period in excess of six months; or
C. Has been damaged by fire, decay or otherwise, and cannot be repaired so as to
conform to the requirements of Title 15 of this code; or
D. Because of its physical condition invites vandalism, arson, drug dealing, and other
crime problems; or
E. Because of its physical condition constitutes a refuge for vagrants; or
F. Because of its physical condition constitutes a fire hazard; or
G. Because of its physical condition creates blight and depreciates surrounding
property value; or
H. Has been determined by the director of building and safety to constitute a
"dangerous building" as defined in the Uniform Code for the Abatement of Dangerous
Buildings, as adopted pursuant to Title 15 of this code; or
I. On at least three occasions within a twenty -four -month period, has been
barricaded and thereafter became unsecured so that persons could enter it.
7.06.030 Abandoned buildings —Maintenance and barricading. A. Any abandoned
building shall be substantially barricaded by its owner in a manner specified by the director of
building and safety to prevent unauthorized entry.
B. All gas and electric utility services shall be disconnected within five days of
vacation of a building. Reconnections will require approval by the department of building and
safety.

C. Unauthorized entry into or occupancy of an abandoned building is prohibited.
D. Specifications and orders by the director of building and safety for barricading a
building may include any of the following:
1. Boarding of doorways, crawl spaces, windows and openings are to be
accomplished by use of one-half inch (1/2") or thicker exterior grade plywood, fastened by lag
screws or one-way bolts to the frame or a cross brace, or both;
2. All barricades shall be painted to match the dominant exterior color of the
elevation of the building on which the barricade is placed. The dominant exterior color shall be
that color that occupies at least 60% of the particular elevation;
3. In the case of commercial buildings located on main or secondary
thoroughfares, opaque window coverings may be allowed by the director in lieu of a barricade,
provided all the windows are maintained, and, if broken or cracked, replaced within 72 hours.
The director may require broken or cracked windows to be replaced in lieu of barricading.
E. Abandoned buildings shall be maintained free of weeds, litter and rubbish at all
times. Violations shall be abated and cost recovery allowed as provided in this chapter and
related chapters for abatement of public nuisances.
7.06.040 Abandoned buildings —Nuisance —Abatement. Any building determined
by the director of building and safety to be an "abandoned building" under the provisions of this
chapter, is a public nuisance and shall be abated in accordance with the procedures for abatement
of public nuisances and recovery of costs therefor set forth in Chapter 1.36 of this code. The
Uniform Code for the Abatement of Dangerous Buildings may be used where the building
qualifies as a "dangerous building" under that code.
7.06.050 Demolition and restoration required. All work requiring a demolition
permit pursuant to Title 15 of this code shall include the required removal of all foundations and
basements and restoring the site to natural grade and condition. Failure to comply with such a
permit or any order by the director of building and safety is a violation of this chapter.
7.06.060 Evacuating and barricading damaged buildings. The director of building
and safety may order and/or accomplish the immediate evacuation and barricading of any
building thought to be structurally damaged by seismic activity, wind, tsunamis, flooding, decay,
structural failure, dysfunction of sanitation systems or infestations of insects or vermin wherein
persons therein would be endangered. The director may employ the provisions of Chapter 1.36
or other provisions of law allowing for summary abatement, when necessary.
7.06.070 Abandoned furniture and other materials. A. Any furniture, appliances,
clothing, signs, or new or used materials of any sort placed upon private property without
specific permission of the property owner or tenant, or upon public property without specific
permission of the agency to whom the property belongs, is deemed to be abandoned.
B. Property owners including public agencies, upon giving reasonable notice to the
owners of such materials where that is possible, may take possession of such abandoned
materials and dispose of them in accordance with law.
C. Upon receipt of notice by the city that abandoned materials are present on private
property, the owners of the materials or the property shall promptly remove them. Failure to
comply with such notice is a violation of this code.

Chapter 7.06
7.06.080 Maintenance and rehabilitation of boarded or vacant buildings. A. Except
as provided in subsection C of this section, the owner of any boarded building, whether boarded
by voluntary action of the owner or as a result of enforcement activity by the city, shall cause the
boarded building to be rehabilitated for occupancy within ninety days after the building is
boarded.
B. Except as provided in subsection C of this section, no person shall allow a
building designed for human use or occupancy to stand vacant for more than ninety days.
C. An owner may permit a building to be boarded without being rehabilitated for
occupancy or to stand vacant for more than ninety days; provided, that one of the following
conditions applies:
1. The building is the subject of an active building permit for repair or
rehabilitation and the owner is progressing diligently to complete the repair or rehabilitation; or
2. The building meets all codes, does not contribute to blight, is ready for
occupancy, and is actively being offered for sale, lease, or rent; or
3. The director of building and safety determines that the building is not
likely to contribute to blight because the owner is actively maintaining and monitoring the
building. Active maintenance and monitoring shall include:
a. Maintenance of landscaping and plant materials in good condition,
b. Maintenance of the exterior of the building, including but not
limited to paint and finishes, in good condition,
c. Regular removal of all exterior trash, debris, and graffiti,
d. Maintenance of the building in continuing compliance with all
applicable codes and regulations,
e. Prevention of criminal activity on the premises, including but not
limited to use and sale of controlled substances, prostitution and criminal street gang activity.
7.06.090 Vacant building monitoring fee. A. Fee Imposed. An annual building
monitoring fee as set forth in the National City Fee Schedule adopted by the City Council shall
be paid by every owner of a vacant building. The fee shall be periodically reviewed and adjusted
by resolution of the city council. The fee shall not exceed the estimated reasonable costs of
monitoring the vacant building. The fee shall be payable as to any residential or nonresidential
building which:
1. Is boarded up by voluntary action of the owner or as the result of
enforcement activity by the city; or
2. Is vacant for more than ninety days for any reason.
B. Fee Waiver. The vacant building monitoring fee shall be waived by the director
of building and safety upon a showing by the owner that:
1. The owner has obtained a building permit and is progressing diligently to
repair the premises for occupancy; or
2. The building meets all applicable codes and is actively being offered for
sale, lease or rent; or
3. Imposition of the fee would impose a substantial economic hardship on
the owner or would hinder the rehabilitation of the building.
C. Procedure.
1. The vacant building monitoring fee shall be billed to the owner of the
property and mailed to the owner's address as set forth on the last equalized assessment roll of
the county assessor.

2. Any owner billed may apply for a waiver for the grounds set forth in
subsection B of this section by submitting a written statement of the grounds for the waiver,
together with the owner's daytime telephone number, to the director of building and safety
within thirty days after the billing is mailed to the owner. The director of building and safety
shall review the written statement and may contact the owner to discuss the application of the
waiver. The director of building and safety shall prepare a written decision regarding the waiver
request, which shall be mailed to the owner.
3. An owner aggrieved by the decision of the director of building and safety
relating to an application for a waiver may appeal the director's decision to the advisory and
appeals board by submitting a written notice of appeal to the director of building and safety as
set forth in Section 15.04.060 of this code. The decision of the board shall be final.
4. If the fee is not paid within sixty days after billing, or within sixty days
after the decision of the director of building and safety or the advisory and appeals board
becomes final, the city council may thereupon order that the fee be specially assessed against the
property, it shall confirm the assessment and thereafter order said assessment to be collected at
the same time and in the same manner as ordinary real property taxes are collected. The
assessment shall be subject to the same penalties and the same procedure and sale in the case of
delinquency as is provided for ordinary real property taxes. All laws applicable to the levy,
collection, and enforcement of real property taxes are applicable to the special assessment.
7.06.100 Administrative penalty. A. Administrative Penalty Imposed Any owner
of a building which remains boarded in violation of Section 7.06.080(A) or any owner of a
building which remains vacant in violation of Section 7.06.080(B) shallbe liable for an
administrative penalty in an amount not to exceed two hundred fifty dollars per building for the
first violation. If the building is not brought into compliance within thirty (30) days following
notification, the owner shall be liable for an administrative penalty not to exceed five hundred
dollars per building, for the second and all subsequent violations. Each succeeding thirty (30)
day period when the building remains in violation shall constitute a new violation.
B. Action by Advisory and Appeals Board. The administrative penalty shall be
imposed by the advisory and appeals board upon the recommendation of the director of building
and safety after the owner shall have been afforded a hearing before the board. The hearing shall
be conducted in accordance with the appeal provisions of Section 15.04.060 of this code. In
setting the penalty, the board shall consider the severity of the blighting conditions on the
property and the owner's efforts, or lack thereof, to remedy the problem. The decision of the
board shall be final.
C. Penalty —Payment. The administrative penalty shall be due and payable within
thirty days after the decision of the board. If the penalty is not paid within forty-five days after
the decision of the board, the city council may thereupon order the penalty be a personal
obligation of the property owner or that it be specially assessed against the property involved, or
both. If the city council orders that the penalty be specially assessed against the property, it shall
confirm the assessment and thereafter said assessment may be collected at the same time and in
the same manner as ordinary real property taxes are collected and shall be subject to the same
penalties and the same procedure and sale in case of delinquency as provided for ordinary real
property taxes. All laws applicable to the levy, collection, and enforcement of real property
taxes are applicable to the special assessment.

The City Council may also cause a notice of lien to be recorded. The notice shall, at a
minimum, identify the record owner or possessor of the property and set forth the last known
address of the record owner or possessor, the date on which the penalty was imposed by the
board, a description of the real property subject to the lien, and the amount of penalty. The
notice of lien shall be recorded without payment of fee.
D. Penalty waiver. The administrative penalty shall be waived if the advisory and
appeals board finds that imposition of the penalty would create a substantial economic hardship
on the owner, would hinder the rehabilitation of the building, or the owner rehabilitates the
property within a designated period of time.
E. Right of Judicial Review. Any person aggrieved by a decision of the advisory
and appeals board or City Council may obtain judicial review of said decision by filing an appeal
to be heard by the San Diego County Superior Court in accordance with the timelines and
provisions set forth in California Government Code Section 53069.4.
7.06.110 Nuisance —Criminal penalty. In addition to the administrative penalties
specified in Section 7.06.100, the owner, occupant, or agent of any lot or premises within the city
who permits or allowsthe existence of an abandoned building as defined in this chapter, or who
violates any mandatory provision or prohibition of this chapter upon any lot or premises owned,
occupied, or controlled by said person, is guilty of a misdemeanor and upon conviction thereof is
punishable as prescribed in Section 1.20.010.
7.06.120 Demolition and blight removal account. The City shall establish a
revolving fund account designated for "Demolition and Blight Removal". The City may use this
fund for the purchase of blighted or abandoned property or buildings maintained in violation of
this chapter. Any person maintaining a building in violation of this chapter may offer the
property for sale to the City at the property's fair market value. All fees, costs and expenses
shall be borne by the buyer and seller according to customary real estate sales practice. The City
shall pay for the property appraisal necessary to establish the fair market value based on the
condition of the property, to be performed by an appraiser acceptable to both parties. The City
may enter into separate arrangements with other public entities for acquisition, management and
disposition of the property.

OF THE AMENDMENTS TO CHAPTER 7.06 OF THE NATIONAL CITY
MUNICIPAL CODE
WHEREAS, the Advisory and Appeals Board of the City of National City at its
meeting of February 17, 2000, after proper notification, conducted a hearing to consider
the recommended amendments to Chapter 7.06 of the National City Municipal Code; and
WHEREAS, the amendments are necessary to improve the enforcement ability of
the city when abandoned buildings are identified; and
WHEREAS, the amendments are necessary to allow the owners of an abandoned
building to offer the building for sale to the city at fair market value; and
WHEREAS, after review and discussion, the Board determined that the
amendments submitted be approved and forwarded to the City Council with a
recommendation for adoption by the City Council.
NOW, THEREFORE, BE IT RESOLVED that the Advisory and Appeals Board
recommends approval of the code amendments as submitted, and that such amendments
be adopted by the City Council.

STAFF REPORT—CALIFORNIA INFRASTRUCTURE AND ECONOMIC DEVELOPMENT
BANK LOAN PRELIMINARY APPLICATION
BACKGROUND:
The Fire Station Study began on September 9, 1999, when the City Council authorized a study of Fire
Department space needs and as a result a "Fire DepaiIntent Space Needs Analysis", and "Site Plan
EvaluationBudgetary Estimates" were completed. On April 4, 2000, Council provided further direction
to Staff that included keeping Site Plans "A" (current fire station site including properties to the West, and
15th Street to the North) and "C" (current fire station site including properties to West and 15th Street to
the North, and utilizing the existing facility as non -essential office spaces), fine tune the costs, funding
and financing, and to come back in 90 days with preliminary information. Phase III of the Fire Station
Study will provide a revision of "Site Plan Evaluation/Budgetary Estimates" for Site Plan "C", a short
written overview and recommendations regarding phased construction, and seismic analysis including
cost estimates to retrofit the existing Fire Station to essential building standards.
FUNDING PLAN AS PRESENTED ON 4/4/00:
CDBG Section 108 Loan:
The CDBG Section 108 Loan will fund approximately $6,000,000 or 75% of the Project costs. The
Section 108 Loan Application takes approximately 6-8 months to complete and submit to the Department
of Housing and Urban Development (HUD). Upon approval of the Loan, the City will have a year to
draw from the loan. The annual debt service on the Section 108 Loan would be approximately $485,000
over a 20-year loan period, which would be included in the City's Annual CDBG Program. Staff recently
learned that 100% of the Fire Station Project could be financed with the Section 108 Loan.
Community Development Commission (CDC) staff are currently drafting a report to the Fire Chief that
will discuss Project costs under HUD guidelines, describe Section 108 debt service costs and its impact to
the City's Consolidated Plan and other CDBG-funded projects, and the possible need to amend the City's
five-year "General Plan".
California Infrastructure and Economic Development Bank (CIEDB) Loan:
The California Infrastructure and Economic Development Bank (CIEDB) Loan will fund approximately
$2,000,000 or 25% of Project costs with annual debt service of approximately $162,000 over a 20-year
loan period. The annual debt service for the CIEDB Loan would be included in the City's Annual
Operating Budget and funded by the City's General Fund. Staff recently learned that a 30-year loan term
and a larger loan amount are also available.
The Preliminary Application to the CIEDB's Loan Program does not commit any sources of repayment
at this stage. On May 2, 2000, staff received confirmation from Roma Cristia-Plant, who is the Loan Unit
Manager of the CIEDB Loan, that the City is not committed to any repayment during the preliminary
application stage, must complete a Resolution to submit a Loan Application, and must draft a legal letter
indicating authority to repay the CIEDB Loan. (See Appendix "A" for e-mail and samples) The sole
purpose of the Preliminary Application is for CIEDB staff to determine whether or not the applicant and
proposed project meet statutory eligibility criteria. Applicants meeting the eligibility criteria will be
invited to submit a Loan Application, at which time staff will present the Loan Application to Council for

consideration. Upon submittal of the Loan Application, the CIEDB Board will then review and either
approve or deny the Loan Application. After Board approval, the Applicant will execute loan documents
prior to receiving disbursements.
Staff Recommendations:
1. Authorize and direct the Finance Director to provide information to Fire Department Staff to
complete the "Preliminary Application" within the next 30 days.
2. Authorize and direct Staff to submit a completed CIEDB Loan Preliminary Application for
$2,000,000 or approximately 25% of Project costs.

repayment at this application stage. The purpose of the Preliminary Application is for the
CIEDB staff to determine whether or not the applicant and proposed project meets our
statutory eligibility criteria. Those applicants meeting the eligibility criteria will be invited
to submit a Loan Application. The CIEDB Board will then review and either approve or
deny Loan Applications presented by staff. After Board approval, the Applicant will
execute loan documents prior to receiving disbursements.
The data on our web site prior to 4/25/00 was a draft of staffs proposal on amendments
to the Criteria, Priorities and Guidelines for the Program. The Board voted on the staff
proposal and made a few more changes on 4/25/00. As such, the data that was
available for public viewing has been removed from our web site, and replaced with the
Board approved document. You can obtain this information from the loan program's web
site found at: <http://commerce.ca.qov/ciedb/revolvinofund/>.
The only document that is not up on our web site is the loan application. We have
several versions depending upon the repayment stream proposed to repay our loan. If
requested, I can send a copy of the appropriate Loan Application to you for you to
review. However, we will not accept a completed loan application from anyone unless
they have submitted a Preliminary Application and have been invited to submit a Loan
Application.
