EXPLANATION This project has been designed in cooperation with CDC to provide home ownership
opportunities and to serve as a catalyst for new housing development in the surrounding area. The project
involves the construction of six three-story, three -bedroom, two -bath single-family homes. The third
bedroom, located on the first floor, is designed to be available for an office for an in -home business. Each
home includes a one -car garage with tandem parking in the driveway. The project involves a subdivision so
that each home will be located on its own lot. The lots range in size from 1,819 to 2,219 square feet in size.
The homes will be attached, but there will be approximately six inches of airspace between homes.
The proposed homes have pitched, composition shingle roofs with an accent gable feature and bay windows in
the front of the structure and an accenting hipped roof over third -story windows at the rear of the structure.
Decks are proposed on the second and third floors. The structures will have a masonite siding exterior that
simulates the appearance of wood siding.
The project complies with the General Plan, Subdivision Ordinance, and Design Guidelines. The proposed
zone variances will allow small -lot townhouse home ownership similar to Brick Row. The Planning
Commission voted to approve the project and responded to citizen concerns raised at the public hearing by
\\a,..dding a requirement that CC&Rs be recorded to ensure maintenance of the properties.

RECOMMENDING APPROVAL OF A TENTATIVE SUBDIVISION MAP
TO DIVIDE ONE VACANT LOT INTO SIX
AND APPROVING A CONDITIONAL USE PERMIT
TO ALLOW SIX LIVE/WORK RESIDENCES AND
A VARIANCE TO ALLOW TANDEM PARKING AND
A REDUCTION IN MINIMUM LOT SIZE AND
MINIMUM LOT WIDTH AT THE

WHEREAS, application was made for approval of a tentative subdivision map to divide
one vacant lot into six with a conditional use permit to allow six live/work residences and a
variance to allow tandem parking and a reduction in minimum lot size and minimum lot width at
the northeast corner of 9th Street and A Avenue on property generally described as:
Lots 7 to 10 inclusive, Block 2 in W.C. Kimball's Subdivision of 10 acre Lot 1 of Quarter
Section 154 of Rancho De La Nacion, in the City of National City, County of San Diego,
State of California, according to Map thereof No. 105, filed in the Office of the County
Recorder of San Diego County, March 10, 1887.
WHEREAS, the Planning Commission of the City of National City, California,
considered said applications at a duly advertised public hearing held on June 19, at which time
the Planning Commission considered oral and documentary evidence; and,
WHEREAS, at said public hearing the Planning Commission considered the staff report
contained in Case File Nos. S-2000-1, CUP-2000-10, Z-2000-2 which is maintained by the City
and incorporated herein by reference; along with evidence and testimony at said hearing; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State
law and City law; and,
WHEREAS, the action hereby taken is found to be essential for the preservation of the
public health, safety and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
National City, California, that the testimony and evidence introduced in the staff report and
public hearing for said tentative subdivision map, conditional use permit and variance, support
the following findings:
RECOMMENDED FINDINGS FOR APPROVAL OF
THE TENTATIVE SUBDIVISION MAP
1. The proposed map is consistent with the National City General Plan, since the map
provides for the development of six single-family homes with space for in -home
businesses in the General Commercial zone, where mixed use projects are
permitted; and since the General Plan encourages the opportunities for home
ownership which will be created by the project.
2. The site is physically suitable for the proposed density of development, since the
11,560 square foot lot is virtually flat and can accommodate building pads and yard
areas for 1,600 square -foot homes, and since the site is surrounded by residential
and commercial development similar to the proposed use.
3. The site is physically suitable for the proposed type of development, since similar
housing types such as Brick Row and apartments are located nearby.
4. The design of the subdivision and the proposed improvements are not likely to
cause substantial environmental damage or substantially and avoidably injure fish or
wildlife or their habitat, since no the project is located on a disturbed site in the
center of a downtown area and no unique environmental resources exist on the site.
5. The design of the subdivision and the proposed/required improvements are not
likely to cause serious public health problems, since all necessary public services
will be provided.
6. The design of the subdivision and the proposed/required improvements will not
conflict with easements, acquired by the public at large, for access through or use of
the property within the proposed subdivision, since there will be no alterations or
improvements on existing easements crossing the proposed parcels.
7. The discharge of sewerage waste from the subdivision into the City of National City
sewer system will not result in violation of existing requirements prescribed by the
California Regional Quality Control Board pursuant to Division 7 (commencing
with Section 13000) of the Water Code, as specified by Government Code Section
66474.6.
8. The subdivision has been considered by the Planning Commission with regard to its
effect on the housing needs of the region, and these needs are balanced by the public
service needs of the residents and available fiscal and environmental resources.
9. The design of the subdivision provides, to the extent feasible, for future passive and
natural heating and cooling opportunities in the subdivision, based on consideration
of local climate, topography, property configuration and other design and
improvement requirements without requiring reduction in allowable density or lot
coverage.
RECOMMENDED FINDINGS FOR APPROVAL
OF THE CONDITIONAL USE PERMIT
1. That the site for the proposed use is adequate in size and shape, since the project site
is located in a relatively dense and compact urbanized downtown area where
projects of similar density and scale are located.
2. That the site has sufficient access to streets and highways that are adequate in width
and pavement type to carry the volume and type of traffic generated by the proposed
use, since the project will have direct access to existing streets and proximity to
highways, and since the project density, home -business option, and location near
commercial uses will encourage decreased dependence on vehicular travel.
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties, since the proposed live/work project is compatible with existing
residential and commercial uses nearby.
4. That the proposed use is deemed essential and desirable to the public convenience
and welfare, since the proposed use provides quality housing that will
complement the adjacent Heritage Square neighborhood and may serve as a
catalyst for new development or rehabilitation in an older area of the City.
RECOMMENDED FINDINGS FOR APPROVAL
OF THE ZONE VARIANCE
1. That because of special circumstances applicable to the property, including size,
location and surroundings, the strict application of Title 18 of the. Municipal Code
(Zoning) deprives such property of privileges enjoyed by other property in the
vicinity and under the identical zone classification, since the property is adjacent to
historic homes and other structures built prior to existing zoning laws.
2. That the requested variance is subject to such conditions which will assure that the
adjustment authorized will not constitute a grant of special privileges inconsistent
with the limitation upon other properties in the vicinity and zone in which such
property is situated, since the design will be compatible with Design Guidelines and
conditions will ensure that the commercial component of the project is compatible
with the surrounding neighborhood, and since the variances regarding lot width, lot
size, and tandem parking, are needed to achieve home ownership opportunities
similar to others in the area at the allowable density under the Zoning Ordinance and
General Plan.
3. That the variance does not authorize a use or activity which is not otherwise
expressly authorized by the zoning regulations governing the parcel of property,
since mixed use development is a permitted use in the CG (General Commercial)
zone with the issuance of a Conditional Use Permit.
BE IT FURTHER RESOLVED that based on the findings hereinbefore stated, said
tentative subdivision map for division of to divide one vacant lot into six with a conditional use
permit to allow six live/work residences and a variance to allow tandem parking and a reduction
in minimum lot size and minimum lot width at the northeast corner of 9th Street and A Avenue is
hereby approved subject to the following conditions:
1. Plans must comply with the 1998 editions of the California Building Code,
Mechanical Code, Plumbing Code, and Electrical Code, and the California Title
24 energy and handicapped regulations.
2. A drainage plan shall be submitted for review and approval by the City Engineer
showing all of the proposed and existing on- and off -site improvements. The plan
shall be prepared in accordance with the City's standard requirements by a
Registered Civil Engineer. In particular, the plan shall show the following: finish
floor elevations of all buildings, entire site drainage system (including roof
drains), finish surface elevations (all areas), and adjacent alley elevations.
3. A separate street improvement plan shall be submitted, prepared by a Registered
Civil Engineer, showing all of the existing and proposed improvements. The
plans shall be in accordance with the City requirements, and shall show the
following: the reconstruction of the curbing on 9th Street. This will involve the
removal of the existing curb in its entirety and replacement with 6" type "G" curb
and gutter and the complete removal and replacement of sidewalk along each
property frontage. The work will also require performing the necessary street
pavement repairs adjacent to the new gutter, alley apron, and alley consisting of
any combination of removal/replacement and/or overlays to insure a uniform and
smooth finish pavement. The plan shall show profiles of the new curb and flow
line, including the driveway curb openings. The plan shall also show proposed
sidewalk and curb gutter elevations on both streets. The maximum cross slope on
the new sidewalk shall be 2%. A checklist for preparation of plans may be
obtained from the Engineering Department.
4. All surface run-off, including landscaping adjoining the public right-of-way, shall
be collected by approved drainage facilities, and directed to the street by sidewalk
underdrains or a curb outlet. Adjacent properties shall be protected from surface
run-off resulting from this development. There are a total of three curb drains on A
Street. If these are to be utilized with the proposal, they should be shown
accordingly on the drainage plan, otherwise, remove them from the public right-of-
way.
5. The property owner, or its successors and assigns shall be responsible for the
maintenance, repair, or reconstruction of all irrigation and landscaping
improvements installed within the public right-of-way, and shall adjust the
sprinkler heads so as to prevent overspray upon the public sidewalk or streets.
The proposed sprinkler heads shall be installed behind the sidewalk, and the
irrigation mainline upon private property only, as required by the City. The
property owner, its successors or assigns shall remove and relocate all irrigation
items from the public right-of-way at no cost to the City, and within a reasonable
time frame upon a written notification by the City Engineer.
6. For PVC irrigation lines in the public right-of-way, a metallic identification tape
shall be placed between the bottom layer of the finished surfaced and the top of
the lines.
7. At a minimum, the off-street parking area shall be 2-inch A.C. over 4-inch Class
II aggregate base. The street pavement sections shall be in accordance with
National City Standard Drawing G-24 with National City Modifications.
8. A sewer permit and payment of sewer fees will be required. The method of
sewage collection and disposal shall be shown on the drainage and street
improvement plans. Any sewer lateral in the City right-of-way shall be 6 inches
in size with a clean -out, unless approved otherwise. A sewer stamp "S" shall be
provided on the curb to mark the location of the lateral. Separate water and sewer
laterals shall be provided to each lot.
9. Concrete pavement repair will be required. The work shall be as follows: crack -
seal the alley surface, and repair uneven edges along the alley property line.
10. All unused driveways shall be removed and replaced with a full height curb and
sidewalk. All driveways both new and existing shall be clearly shown and
identified on the plans along with the width, location, and type for the driveways.
11. A permit shall be obtained from the Engineering Department for all improvement
work within the public right-of-way and the drainage construction on private
property.
12. A cost estimate shall be submitted with the plans. A performance bond equal to
the approved cost estimate for all of the proposed grading, drainage, street
improvements, and landscaping work shall be posted. Three percent (3 %) of the
estimated cost shall also be deposited with the City as an initial cost for plan
checking and inspection services at the time the plans are submitted. The deposit
is subject to adjustment.
13. A final map is required. The final map/parcel map shall meet all of the
requirements of the Subdivision Map Act, and the National City Municipal Codes
including certification, acknowledgment, complete boundary information and
monumentation.
14. A title report shall be submitted to the Engineering Department with the final
map.
15. The developer shall bond for the monumentation, the public improvements and
the on -site drainage and landscaping improvements through an agreement with the
City prior to the approval of the final map. In lieu of bonding, the developer may
elect to complete all work first, prior to map review and approval.
16. All utility distribution facilities within the boundaries of the subdivision, and
within the half street abutting the new subdivision, shall be placed underground.
It is recommended that the existing power pole abutting the new subdivision in
the alleyway be placed underground.
17. The final map shall be recorded prior to issuance of any building permit.
18. All new property line survey monuments shall be set on private property, unless
otherwise approved.
19. The developer shall submit an approval letter from Sweetwater Authority stating
fire flow requirements have been met. If additional improvements are needed, the
developer shall enter into an agreement for the water improvements with the
Authority prior to obtaining the final map approval.
20. A detailed landscape and irrigation plan, including plant types, method of
planting, etc. shall be submitted for review and approval by the Planning Director.
The landscape plan shall reflect the use of drought tolerant planting and water
conserving irrigation devices.
21. Except as modified by conditions of approval, development plans shall be
submitted for review and approval of the Planning Director in conformance with
Exhibit A, case file. No S-2000-1, dated Mar. 29, 2000, and Exhibit A -Revised,
case file no. CUP-2000-10/Z-2000-2, dated May 17, 2000.
22. Before the Conditional Use Permit and Variance shall become effective, the
applicant and the property owner both shall sign and have notarized an Acceptance
Form, provided by the Planning Department, acknowledging and accepting all
conditions imposed upon the approval of this permit. Failure to return the signed
and notarized Acceptance Form within 30 days of its receipt shall automatically
terminate the Conditional Use Permit and Variance. The applicant shall also submit
evidence to the satisfaction of the Planning Director that a Notice of Restriction on
Real Property is recorded with the County Recorder. The applicant shall pay
necessary recording fees to the County. The Notice of Restriction shall provide
23. The Conditional Use Permit and Variance shall become null and void if not
exercised within one year after adoption of the resolution of approval unless
extended according to procedures specified in Section 18.116.190 of the Municipal
Code.
24. Approval of the tentative map expires two (2) years after adoption of the
resolution of approval at 5:00 p.m. unless prior to that date a request for a time
extension not exceeding three (3) years has been filed as provided by Section
66452.6 (e) of the California Government Code.
25. Businesses in live/work units shall be limited to office uses.
26. The back-up space for the driveway serving unit #1 shall be modified to provide
adequate room for a vehicle to back out of the driveway and then proceed forward
toward the main gate at the alley with no more than one backward and one forward
motion.
27. An 18-foot minimum driveway width is required at the alley.
28. The developer shall provide a declaration of covenants, conditions and
restrictions, running with the land, setting forth privileges and responsibilities,
including maintenance and allowable colors of structures and other improvements,
including, but not limited to, buildings, fencing and driveways on the property,
prior to approval of the final map. Said CC&R's shall be subject to approval as to
content and form by the City Attorney, Planning Director and. Executive Director,
Community Development Commission. The CC&R's shall grant the City the
authority but shall not obligate the City to assume maintenance of the properties
and assess the full cost, including overhead costs therefor, as a lien or special tax
assessment against the properties if said properties are not adequately maintained.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council.
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on
the day following the City Council meeting where the Planning Commission resolution is set for
review, except and unless in regard to the Conditional Use Permit or Variance an appeal in
writing is filed with the City Clerk prior to 5:00 p.m. on the day of that City Council meeting.
The City Council may, at that meeting, appeal the decision of the Planning Commission and set
the matter for public hearing.

finish pavement. The plan shall show profiles of the new curb and flow line, including the
driveway curb openings The plan shall also show proposed sidewalk and curb gutter
elevations on both streets. The maximum cross slope on the new sidewalk shall be two
percent (2%). A check list for preparation of plans may be obtained from this office.
(Ordinance 1473, 1491, 1734, 1927, 1954, 92-2033, 99-2164 and Appendix Chapter 33
CBC).

3. All surface run-off, including landscaping irrigation within the public right-of-way, shall be
collected by approved drainage facilities and directed to the street by sidewalk underdrains
or a curb outlet. Adjacent properties shall be protected from surface run-off resulting from
this development. There are total of three (3) curb drains on "A" Street. If these are to be
utilized with the new site, show accordingly on the drainage plan; otherwise, remove from
the public right-of-way (Ordinance 99-2164).
4. The property owner, or its successors and assigns shall be responsible for the maintenance,
repair, or reconstruction of all irrigation and landscaping improvements installed within the
public right-of-way, and shall adjust the sprinkler heads so as to prevent over spray upon the
public sidewalk, or the streets. The proposed sprinkler heads shall be installed behind the
sidewalk, and the irrigation mainline upon private property only, as required by the City.
The property owner or, its successors or assigns, shall remove and relocate all irrigation
itemsand existing trees from the public right-of-way at no cost to the City, and within a
reasonable time frame upon a written notification by the City Engineer (Ordinance 99-2164).
5. For P.V.0 irrigation lines in the public right-of-way, a metallic identification tape shall be
placed between the bottom layer of the finished surface and the top of the lines (Ordinance
99-2164).
6. As a minimum, the off-street parking area shall be 2 inch A.C. over 4 inch Class II aggregate
base. The street pavement sections shall be in accordance with National City Standard
Drawing G-24 with National City Modifications (Ordinance 99-2164).
7. A sewer permit and payment of sewer fees will be required. The method of sewage
collection and disposal shall be shown on the drainage and street improvement plans. Any
sewer lateral in the City right-of-way shall be 6 inches in size with a clean -out, unless
approved otherwise. A sewer stamp "S" shall be provided on the curb to mark the location
of the laterals. Separate water and sewer laterals shall be provided to each lot. (Ordinance
1489; 92-2033; 93-2052).
8. Concrete pavement repair will be required. The work shall be as follows: Crack -seal the
alley surface, and repair uneven edges along the alley property line.
9. The unused driveway on 9th Street shall be removed and replaced with full height curb, and
sidewalk All driveways (new and existing) shall be clearly shown and identified on the
plans. The widths, locations and type of driveways shall also be shown.
10. A permit shall be obtained from the Engineering Department for all improvement work
within the public right-of-way and the drainage construction on private property. (Ordinance
1473, 1491, 1734, 1927, 1954, and 92-2033).

11. A cost estimate shall be submitted with plans. A performance bond equal to the approved
cost estimate for all of the proposed grading, drainage, street improvements, and landscaping
work shall be posted. Three percent (3%) of the estimated cost shall also be deposited with
the City as an initial cost for plan checking and inspection services at the time the plans are
submitted. The deposit is subject to adjustment (Ordinance 99-2164, 1473, 1491, 1734,
1927, 1954, 92-2033).
12. A Final Map is required. The final map/parcel map shall meet all of the requirements of the
Subdivision Map Act, and the National City Municipal Codes including certification,
acknowledgment, complete boundary information and monumentation (Ordinance 99-2164,
1473, 1491, 1734, 1927, 1954, 92-2033, 94-2088)
13. A title report shall be submitted to the Engineering Department with the final map.
14. The developer shall bond for the monumentation, the public improvements and the on -site
drainage and landscaping improvements through an agreement with the City prior to the
approval of the final map. In lieu of bonding, the subdivider may elect to complete all work
first, prior to map review and approval.
15. All utility distribution facilities within the boundaries of the subdivision, and within the half
street abutting the new subdivision, shall be placed underground. It is recommended that the
existing power pole abutting the new subdivision in the alleyway be placed underground.
(Ordinance 92-2033).
16. The final map shall be recorded prior to issuance of any building permit.
17. All new property line survey monuments shall be set on private property, unless otherwise
approved.

This letteris in response to a notice of a tentative subdivision map, a proposed
Conditional Use Permit, a proposed Zone Variance and an Initial Study for the subject
property within the Sweetwater Authority service area. There is a 6-inch water main
located on the east side of "A" Avenue adjacent to the proposed development. The
Authority's records indicate that there is no water service to this property. Enclosed is a
copy of 1/4 SEC. 154 map which shows the water facilities.
At this time, we cannot comment on the adequacy of the existing system to provide fire
protection for this project. As plans develop for structures, the Owner must submit a
letter to the Authority from the appropriate fire agency stating fire flow requirements.
Based on this requirement, this project may result in the need for new water
systems or substantial alteration to the existing water system. The Authority
recommends that your Agency work with ours to determine if the existing water facilities
are adequate to meet the added demandsprior to issuing a building permit.
Please note that Sweetwater Authority requires a ten -foot horizontal separation
between sewer and water laterals.
If the Owner provides the required fire flow information and enters into an agreement
with the Authority for water facility improvements, if required, water service can be
obtained at a pressure ranging from a maximum of 90 p.s.i. to a minimum of 80 p.s.i.

categorically exempt project (§15303, New Construction or Conversion of Small Structures).

space. The total floor area of all six homes will be less than 10,000 square feet. Since the site is
in an urbanized area, all necessary public facilities to serve the use are available. The property
has been previously developed, and is not environmentally sensitive. An Initial Study was
prepared in 1997 for a more intense development proposed for the site involving eight units. The
previously drafted Initial Study supports the conclusion that there is no possibility that this
project could have a significant impact on the environment.

JUSTIFICATION
Section 18.116.020 of the National City Municipal Code states that before any conditional use
permit, planned development permit or planned unit development permit is granted, the applicant
must show the existence of the following facts:
1. That the site for the proposed use is adequate in size and shape; and
2. That the site has sufficient access to streets and highways that are adequate in
width and pavement type to carry the quantity and quality of traffic generated by
the proposed use; and
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties; and
4. That the proposed use is deemed essential and desirable to the public convenience
or welfare.
The above findings must be incorporated into each staff report for a Conditional Use Permit,
Planned Development Permit or Planned Unit Development Permit presented to the decision
making body. Each of the findings must be found to exist. As the applicant, you are not required
to provide justification of these findings; however, the information can be useful to Planning
Staff when compiling their report. Please provide any additional information which may be

ZONE VARIANCE JUSTIFICATION
Before granting any zone variance, the decision making body is required by law to make a
written finding of facts that the below conditions apply. Any evidence you desire to submit
substantiating these may be attached.
California Government Code Section 65906 - variance from zoning ordinances
Variances from the terms of the zoning ordinance shall be granted only when,
because of special circumstances applicable to the property, including size, shape,
topography, location or surroundings, the strict application of the zoning ordinance
deprives such property owner of privileges enjoyed by other property owners in the
vicinity and under identical zoning classifications.
Any variance granted shall be subject to such conditions as will assure that the
adjustment thereby authorized does not constitute a grant of special privileges
inconsistent with the limitations upon other properties in the vicinity and zone in which
such property is situated.
A variance shall not be granted for a parcel of property which authorizes a use or
activity which is not otherwise expressly authorized by the zone regulations governing
the parcel of property.
This is a priority project of the City Community Development
Commission, which is deeding the property to the developer and providing
financial assistance to the project.
The use and design of the project will be more compatible with
historic National City, which is located immmdiately to the South.

I am hereby responding to your letter of April 28, 2000. This correspondence should be
considered a letter of clarification, or amendment, to the applications noted above.
Addressing the issues you raised in your letter, in the order that you raised them, please
note the following:
1. A). The variance application is hereby amended to include a request for approval of
an 8' fence separating the rear alley driveway that accesses garages from the parking
lot of the adjacent commercial business. In addition, approval is requested to allow
tandem parking, whereby cars could be parked both in the garage of each unit, as well
as the driveways in front of those garages. These 2 requests were inadvertently made
in the CUP application instead of the variance application.
B) The CUP application is needed to allow mixed -use (i.e. residential and in -home
businesses) on the commercial lot. The request sections of the CUP, Variance
applications, and background section of the Initial Study are hereby amended to
note the following: The in -home, businesses to be permitted will be of a
professions/office nature, consistent with the businesses located in the adjacent
Brick -Row community. The ground level space and entry may be used as direct
access to the place of business. Alternatively, that ground level space may be used
as a third bedroom, without any business being run out of the unit.
2. The CUP and Variance applications are hereby amended to note that the six units will
actually have an air space of approximately 6" between them. There will not be any
common side -walls shared by units. The air space will be covered on the front and
rear facades with the same material that is used as the facing on the units, thereby
making the units appear to be attached.

4. The Variance and CUP applications should be amended to allow the following
exceptions to Design Regulations:

The justification of these exceptions relates to the nature and goals of the project. The
Developer and the National City Community Development Commission (the current
owner of the property and a significant source of funding for the subject project) wish
to facilitate a home ownership project, which is aesthetically and functionally
consistent with the Brick Row area, adjacent to the project. From the street, the
subject units will look like a slightly more modern version of their Brick Row
neighbors. The height, density and setbacks will be similar to that in Brick Row and
will be consistent with that common in an urban downtown of a medium size city.
The minimum front yard setback, again consistent with Brick Row, permits the
flexibility of entry to the units, in order to allow for the operation of in -home
businesses (also a goal of the project).
5. The site plan and floor plans are, in fact, inconsistent, in that the wall plane will
actually vary (as shown in the floor plans), while the site plan shows a flat continuous
wall. As we are just beginning design work in -earnest and the existing concept floor
plans will be changing, we request that the site and floor plans be made consistent by
the time we submit a full set of construction drawings to the City.
I have attached a revised set (20 copies) of drawings, including site plan, elevations,
landscape plan, and floor plans (conceptual). The drainage and street improvement plans
are being completed by Nasland Engineering, under contract with the CDC and are not
presently included in this package. Please note that the building facades will not have
"wood siding", as noted in your letter (item #11). The siding will be made of a masonite
material that will simulate wood, but in fact requires much less maintenance.

EXPLANATION The Community Development Commission requested the rezoning for the 1.3-acre parcel
at the north end of Sheryl Lane (Parcel 1 on the location map). CDC intends to develop the vacant property
with three single-family homes, and requested the change to a Single -Family Residential zone appropriate for
the area, although the development is permitted under the existing Tourist Commercial zoning. The
surrounding neighborhood on Sheryl Lane and E. 16th Street is zoned RS-3-PD and is developed primarily
with single-family homes. The area is separated from commercial uses to the north on Plaza Boulevard by a
drainage channel and does not have the close freeway access typical of Tourist Commercial areas.
Prior to the public hearing, the Planning Commission initiated a zone change for the entire CT-PD zoned
area, which includes the CDC property and two other parcels: a vacant, 0.04-acre parcel on the west side of
Sheryl Lane (Parcel 2), and a 1.75-acre vacant property south and east of the CDC property and west of
Interstate 805 (Parcel 3). Prior to setting the matter for hearing, staff contacted the owners of all three
parcels and expected support for the rezoning; however, the owners of the larger parcel (Parcel 3) asked at
the public hearing that their property remain under CT-PD zoning since they are unsure how they will develop
the property. There was no other public testimony at the public hearing. The Planning Commission voted to
recommend rezoning of only the CDC property (Parcel 1) and the small parcel (Parcel 2). The Commission
�ound no urgency to rezone Parcel 3 due to the existing Planned Development overlay.

The reasoning behind our opposition is summarized as follows:
The land use change reduces the potential land use options available to the
property at some point in the future in accordance with market demands.
This is viewed as a detriment to the value and use of the land.
As best as we can determine, it is apparent that the there is no genuine
justification for the land use change to single family residential development
as such use is already permitted by the existing zoning classification.

On July 10, 2000, seven bids were received and opened for the Kimball Park Bowl
Open-air Amphitheater Renovation, Specification No. 99-8. The project includes
removal and replacement of the existing concrete improvements, and construction of
new concrete improvements, such as, colored concrete pavement, cast in place
monument with granite memorial, concrete structure surface repair, and installation of
stair, galvanized pipe handrail, landscaping and irrigation improvements.
The contract bid consists of a Base Bid and an Additive Bid. The contract documents
specify that the work to be awarded to the lowest responsive bidder based on the Base
Bid work. The Additive Bid work will be included based upon the available funding.
Staff has reviewed the bid documents and found the lowest responsive bidder, Ronald
Locke Construction qualified to perform the Base Bid work for the total cost of
$197,842.00. Ronald Locke Construction is also the lowest bidder to perform the
Additive Bid work for the total cost of $45,976.00. The Bid Opening sheet is attached
for further review.
Currently, the total available Community Development Block Grant (CDBG) funds for
this project is approximately $204,112.00.
The total cost for the Base Bid work is estimated at $227,518. This amount includes the
proposed lowest Base Bid amount ($197,842) plus 15% ($29,676) for contingencies
(inspection, material testing, surveying, etc.).
In order to do the Additive Bid work an additional $52,872.40 ($45,976.00 plus 15%
contingency) will be also needed. This would make the total project cost $280,390.40.
Presently, staff recommendation is to award the contract to Ronald Locke Construction
for the Base Bid work at $197,842.00 and re -scope the project to meet the available
funds for contingencies (based on the contract specifications, the project can be re-
scoped more or less within 25% of the contract cost).
In the interim, we have requested additional CDBG funds from the Community
Development Center to do the entire work. If these funds become available the work
should be expanded accordingly.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City does hereby authorized the Mayor to execute an Agreement between the City of

in Kimball Park. Said agreement is on file in the office of the City Clerk.

BY AND BETWEEN
THE CITY OF NATIONAL CITY
AND
BROOKWOOD LANDSCAPE, INC.
THIS AGREEMENT is entered into this day of , 2000,
by and between the CITY OF NATIONAL CITY, a municipal corporation (the "CITY"), and
BROOKWOOD LANDSCAPE, INC. (the "CONTRACTOR").
RECITALS
WHEREAS, the San Diego Padres Baseball Club has offered to donate to the
CITY the installation of a Little League ball field in Kimball Park; and
WHEREAS, the CITY desires to accept the offered donation and installation of
a Little League ball field (see Exhibit "A") by the aforementioned CONTRACTOR, who will
perform the work on behalf of the San Diego Padres Baseball Club; and
WHEREAS, the CITY has determined that the CONTRACTOR is qualified by
licensing experience and ability to perform the services as specified in Exhibit "A", and the
CONTRACTOR is willing to perform such services.
NOW, THEREFORE, THE PARTIES HERETO DO MUTUALLY AGREE
AS FOLLOWS:
1. ENGAGEMENT OF CONTRACTOR. The CITY hereby agrees to engage
the CONTRACTOR and the CONTRACTOR hereby agrees to perform the services
hereinafter set forth in accordance with all terms and conditions contained herein.
The CONTRACTOR represents that all services required hereunder will be
performed directly by the CONTRACTOR or under direct supervision of the CONTRACTOR.
The CONTRACTOR's services, together with all equipment, materials and
labor, are being donated without charge to the CITY.
2. SCOPE OF SERVICES. The CONTRACTOR will perform services as set
forth in the attached Exhibit "A".
3. PROJECT COORDINATION AND ADMINISTRATION. Jim Ruiz
hereby is designated as the Project Coordinator for the CITY and will monitor the progress and
execution of this Agreement. The CONTRACTOR shall assign a Project Director(s) to
provide supervision and have overall responsibility for the progress and execution of this
Agreement for the CONTRACTOR. Glen Wilhite and Mark Wilhite hereby are designated as
the Project Directors for the CONTRACTOR.
4. LENGTH OF AGREEMENT. Installation to be completed within four to six
weeks from commencement of construction. Starting date to be determined.
5. INDEPENDENT CONTRACTOR. Both parties hereto in the performance of
this Agreement will be acting in an independent capacity and not as agents, employees,
partners or joint venturers with one another. The CONTRACTOR is not an employee of the
CITY and is not entitled to any of the rights, benefits, or privileges of the CITY's employees,
including but not limited to medical, unemployment, or workers' compensation insurance.
This Agreement contemplates the personal services of the CONTRACTOR and
the CONTRACTOR's employees, and it is recognized by the parties that a substantial
inducement to the CITY for entering into this Agreement was, and is, the professional
reputation and competence of the CONTRACTOR and its employees. Neither this Agreement
nor any interest herein may be assigned by the CONTRACTOR without the prior written
consent of the CITY. Nothing herein contained is intended to prevent the CONTRACTOR
from employing or hiring as many employees as the CONTRACTOR may deem necessary for
the proper and efficient performance of this Agreement.
6. CONTROL. Neither the CITY nor its officers, agents or employees shall have
any control over the conduct of the CONTRACTOR or any of the CONTRACTOR's
employees except as herein set forth, and the CONTRACTOR expressly agrees not to
represent that the CONTRACTOR or the CONTRACTOR's agents, servants, or employees
are in any manner agents, servants or employees of the CITY, it being understood that the
CONTRACTOR, its agents, servants, and employees are as to the CITY wholly independent
contractors and that the CONTRACTOR's obligations to the CITY are solely such as are
prescribed by this Agreement.
7. COMPLIANCE WITH APPLICABLE LAW. The CONTRACTOR, in the
performance of the services to be provided herein, shall comply with all State and Federal
statutes and regulations, and all ordinances, rules and regulations of the City of National City
whether now in force or subsequently enacted.
8. LICENSES. PERMITS. ETC. The CONTRACTOR represents and covenants
that it has all licenses, permits, qualifications, and approvals of whatever nature that are legally
required to practice its profession. The CONTRACTOR represents and covenants that the
CONTRACTOR shall, at its sole cost and expense, keep in effect at all times during the term
of this Agreement, any license, permit, or approval which is legally required for the
CONTRACTOR to practice its profession.
9. STANDARD OF CARE. The CONTRACTOR, in performing any services
under this Agreement, shall perform in a manner consistent with that level of care and skill
ordinarily exercised by members of the profession currently practicing under similar conditions
and in similar locations.

10. HOLD HARMLESS. The CONTRACTOR agrees to indemnify, defend, and
hold harmless the City of National City, its officers, employees and volunteers, against and
from any and all liability, loss, damages to property, injuries to, or death of any person or
persons and all claims, demands, suits, actions, proceedings, costs or attorneys' fees, of any
kind or nature, including workers' compensation claims, of or by anyone whomsoever, in any
way resulting from or arising out of the CONTRACTOR's performance of this Agreement.
11. WORKERS' COMPENSATION. The CONTRACTOR shall comply with all
of the provisions of the Workers' Compensation Insurance and Safety Acts of the State of
California, the applicable provisions of Division 4 and 5 of the California Government Code
and all amendments thereto; and all similar state or Federal acts or laws applicable; and shall
indemnify, defend and hold harmless the CITY and its officers, employees and volunteers from
and against all claims, demands, payments, suits, actions, proceedings and judgments of every
nature and description, including attorney's fees and costs presented, brought or recovered
against the CITY or its officers, employees, or volunteers, for or on account of any liability
under any of said acts which may be incurred by reason of any work to be performed by the
CONTRACTOR under this Agreement.
12. INSURANCE. The CONTRACTOR, at its sole cost and expense, shall
purchase and maintain throughout the term of this agreement, the following insurance policies:
a. Automobile insurance covering all bodily injury and property damage
incurred during the performance of this Agreement, with a minimum coverage of $1,000,000
combined single limit per accident. Such automobile insurance shall include non -owned
vehicles.
b. Comprehensive general liability insurance, with minimum limits of
$1,000, 000 combined single limit per occurrence, covering all bodily injury and property
damage arising out of its operation under this Agreement.
c. Workers' compensation insurance covering all of its employees and
volunteers.
d. The aforesaid policies shall constitute primary insurance as to the
CITY, its officers, employees, and volunteers, so that any other policies held by the CITY
shall not contribute to any loss under said insurance. Said policies shall provide for thirty (30)
days' prior written notice to the CITY of cancellation or material change.
e. Said policies, except for the professional liability and worker's
compensation policies, shall name the CITY and its officers, agents and employees as
additional insureds.
f. This Agreement shall not take effect until certificate(s) or other sufficient
proof that these insurance provisions have been complied with, are filed with and approved by
the CITY's Risk Manager. If the CONTRACTOR does not keep all of such insurance policies
in full force and effect at all times during the terms of this Agreement the CITY may elect to
treat the failure to maintain the requisite insurance as a breach of this Agreement and terminate
the Agreement as provided herein.
g. If required insurance coverage is provided on a "claims made" rather
than "occurrence" form, the CONTRACTOR shall maintain such insurance coverage for three
years after expiration of the term (and any extensions) of this Agreement.

h. Any aggregate insurance limits must apply solely to this Agreement.
13. TERMINATION. This Agreement may be terminated with or without cause
by the CITY. Termination shall be effective only upon 5-day written notice to the
CONTRACTOR. During said 5-day period the CONTRACTOR shall perform all services in
accordance with this Agreement.
Termination shall be effected by delivery of written Notice of Termination to the
CONTRACTOR as provided for herein.
In the event of termination, all finished or unfinished Memoranda Reports,
Maps, Drawings, Plans, Specifications and other documents prepared by the CONTRACTOR
shall become the property of and be delivered to the CITY.
14. NOTICES. All notices or other communications required or permitted
hereunder shall be in writing, and shall be personally delivered; or sent by overnight mail
(Federal Express or the like); or sent by registered or certified mail, postage prepaid, return
receipt requested; or sent by ordinary mail, postage prepaid; or telegraphed or cabled; or
delivered or sent by telex, telecopy, facsimile or fax; and shall be deemed received upon the
earlier of (i) if personally delivered, the date of delivery to the address of the person to receive
such notice, (ii) if sent by overnight mail, 'the business day following its deposit in such
overnight mail facility, (iii) if mailed by registered, certified or ordinary mail, five (5) days
(ten (10) days if the address is outside the State of California) after the date of deposit in a post
office, mailbox, mail chute, or other like facility regularly maintained by the United States
Postal Service, (iv) if given by telegraph or cable, when delivered to the telegraph company
with charges prepaid, or (v) if given by telex, telecopy, facsimile or fax, when sent. Any
notice, request, demand, direction or other communication delivered or sent as specified above
shall be directed to the following persons:

Notice of change of address shall be given by written notice in the manner
specified in this Section. Rejection or other refusal to accept or the inability to deliver because
of changed address, of which no notice was given, shall be deemed to constitute receipt of the
notice, demand, request or communication sent. Any notice, request, demand, direction or

other communication sent by cable, telex, telecopy, facsimile or fax must be confirmed within
forty-eight (48) hours by letter mailed or delivered as specified in this Section.
15. MISCELLANEOUS PROVISIONS.
a. Computation of Time Periods. If any date or time period provided for in
this Agreement is or ends on a Saturday, Sunday or federal, state or legal holiday, then such
date shall automatically be extended until 5:00 p.m. Pacific Standard Time of the next day
which is not a Saturday, Sunday or federal, state or legal holiday.
b. Counterparts. This Agreement may be executed in multiple of which
shall be deemed an original, but all of which, together, one and the same instrument.
c. Captions. Any captions to, or headings of, the sections or subsections of
this Agreement are solely for the convenience of the parties hereto, are not a part of this
Agreement, and shall not be used for the interpretation or determination of the validity of this
Agreement or any provision hereof.
d. No Obligations to Third Parties. Except as otherwise expressly provided
herein, the execution and delivery of this Agreement shall not be deemed to confer any rights
upon, or obligate any of the parties hereto, to any person or entity other than the parties
hereto.
e. Exhibits and Schedules. The Exhibits and Schedules attached
counterparts, each shall constitute but hereto are hereby incorporated herein by this reference
for all purposes.
f. Amendment to this Agreement. The terms of this Agreement may not be
modified or amended except by an instrument in writing executed by each of the parties hereto.
g. Waiver. The waiver or failure to enforce any provision of this
Agreement shall not operate as a waiver of any future breach of any such provision or any
other provision hereof.
h. Applicable Law. This Agreement shall be governed by and construed in
accordance with the laws of the State of California.
i. Entire Agreement. This Agreement supersedes any prior agreements,
negotiations and communications, oral or written, and contains the entire agreement between
the parties as to the subject matter hereof. No subsequent agreement representation, or
promise made by either party hereto or by or to an employee, officer, agent or representative
of any party hereto shall be of any effect unless it is in writing and executed by the party to be
bound thereby.
j. Successors and Assigns. This Agreement shall be binding upon and shall
inure to the benefit of the successors and assigns of the parties hereto.
k. Construction. The parties acknowledge and agree that (i) each party is
of equal bargaining strength, (ii) each party has actively participated in the drafting,
preparation and negotiation of this Agreement, (iii) each such party has consulted with or has
had the opportunity to consult with its own, independent counsel and such other professional
advisors as such party has deemed appropriate, relative to any and all matters contemplated
under this Agreement, (iv) each party and such party's counsel and advisors have reviewed this
Agreement, (v) each party has agreed to enter into this Agreement following such review and
the rendering of such advice, and (vi) any rule or construction to the effect that ambiguities are

to be resolved against the drafting party shall not apply in the interpretation of this Agreement,
or any portions hereof, or any amendments hereto.

TEMPORARY USE PERMIT FEE WAIVER REQUEST
SUPPLEMENTAL QUESTIONNAIRE
City Council Policy No. 704 contains the criteria for granting waivers of T.U.P.
processing fees by the City Council. This Supplemental Questionnaire will be used to
evaluate whether the event or sponsoring organization for a T.U.P. meet the criteria for a
fee waiver. Accordingly, please answer all questions fully and completely.

The City Council shall waive T.U.P. processing fees only in the case of anon -profit
organization, and when such organization can demonstrate that the event for which the
T.U.P. is requested will not generate any income to the organization, or that the net
proceeds of the event for which the T.U.P. is requested result in:
1. direct financial benefit to an individual who resides or is employed
in the city, and who is in dire financial need due to health reasons
or a death in the family; or
2. direct financial benefit to city government such as the generation of
sales tax; or
3. direct financial benefit to a service club, social services agency, or
other secular non-profit organization located within the city such as
Kiwanis, Rotary, Lions, Boys and Girls Club; or
4. direct financial benefit to an organization which has been the direct
recipient of City or Community Development Block Grant (CDBG)
funding.

Article 32 of the Uniform Fire Code. Permit fee, sixty five ($65.00) dollars.
2. Tent/Canopy to be flame retardant, State Fire Marshal seal to be attached.
3. No open flames or smoking inside or adjacent to the tent/canopy. Signs to be posted — NO
SMOKING.
4. Exitways to be maintained in an unobstructed manner at all times. Exitway to be clear of all
obstruction for its entire width.
5. Exitways to be illuminated and posted.
6. Fire extinguishers shall be on the premises, Type 2-A:10-BC, minimum number of fire
extinguishers shall be determined by the Fire Department upon receipt of canopy/tent sizes.
Travel distance not to exceed seventy five (75) feet.
7. Fire safety inspection to be conducted by fire department personnel, prior to opening to the public.
8. Fire Department access roads shall be provided and maintained at all times.
9. Automobiles and other internal combustion engines shall be a minimum distances of thirty (3.0)
feet from all tents and canopies.
10. Fire hydrants shall not be block or obstructed.

The National City Chamber of Commerce and the San Diego Arizona Eastern Railway
("SD&AE") entered into a lease agreement on June 1, 1966, permitting the Chamber to
construct a metal back lit sign on the railroad right-of-way adjacent to northbound I-5. The
Chamber has assigned its lease to Sky Vision Media Network of San Diego, LLC ("Sky
Vision"). The Chamber is desirous of refurbishing the sign so as to provide public service
announcements which will reflect positively on the image of National City and attract visitors,
commerce and tax revenue for the City. The Chamber has entered into an agreement with
Sky Vision for refurbishment of the sign. The SD&AE railway was acquired by the
Metropolitan Transit Development Board ("MTDB"), and Sky Vision must go before the
MTDB and amend specific provisions to the lease in order to properly affect the
refurbishment of the proposed sign. Sky Vision has requested the endorsement of the City in
the proposed refurbishment of the sign. The proposed resolution contains such an
endorsement.

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
ENDORSING THE PROPOSED REFURBISHMENT OF THE SIGN
LOCATED OFF NORTHBOUND I-5
BETWEEN HIGHWAY 54 AND 24TH STREET
WHEREAS, the National City Chamber of Commerce and the San Diego Arizona
Eastern Railway ("SD&AE") entered into a lease agreement on June 1 1966, permitting the
Chamber to construct a metal back lit sign on the rail road right-of-way; and
WHEREAS, the Chamber has assigned its lease to Sky Vision Media Network of San

WHEREAS, after thirty-four (34) years the current sign has become dilapidated and a
blight in a highly visible redevelopment zone, which adversely affects the image of National
City; and
WHEREAS, the National City Chamber of Commerceis desirous of refurbishing the sign
so as to provide public service announcements which will reflect positively on the image of
National City and attract visitors, commerce and tax revenue for the City; and
WHEREAS, the National City Chamber of Commerce Board of Directors has entered
into an agreement with Sky Vision for refurbishment of the sign; and
WHEREAS, the National City Chamber of Commerce is reliant upon future income and
public service announcements in order to promote the City, increase membership and utilize
income for its capital improvement projects; and
WHEREAS, the SD&AE railway was acquired by the Metropolitan. Transit Development
Board ("MTDB") and Sky Vision must go before the MTDB and amend specific provisions to
the lease in order to properly effect the refurbishment of the proposed sign; and
WHEREAS, the City of National City is a member of the MTDB and requests that the
MTDB Board give favorable consideration to the proposed refurbishment of the sign.
NOW THEREFORE BE IT RESOLVED that the City Council of the City of National
City hereby endorses the refurbishment of the proposed Sky Vision sign located off northbound
I-5 between Highway 54 and 24th Street, and requests that favorable consideration be given to
the proposed refurbishment of the sign by the MTDB Board.

assured us of the feasibility of rehabilitating the proposed monument sign within the
confines of the existing platforms.

We hereby, respectfully submit our request fora city resolution to be docketed with the
city council of National City for the scheduled August 1, 2000 meeting seeking the
endorsement of the proposed rehabilitated monument sign.
As you know, the National City Chamber of Commerce has assigned its lease to Sky
Vision Media Network for the refurbishment of the existing marquee sign.
Sky Vision Media Network requires the city of National City to take an official position
of support in order to further expedite our permitting processes with other regulatory
agencies.
