BACKGROUND REPORT
The applicant proposes to operate a tattoo and body piercing parlor in a 960 square -foot lease space in the
Highland View Center, at 914 East 8th Street. The shopping center contains various businesses, including a
restaurant, dry cleaner, convenience store, and office uses. Single-family homes border the shopping center on
the east. Commercial uses are adjacent to the center on the south and west, as well as across E. 8th Street to the
north.
As shown on the attached map, the shopping center is made up of two buildings placed in an L-shape. The
proposed tattoo parlor would be sited at the corner of the center, behind the front building, and would not be
visible from E. 8th Street. Parking is provided in front of the buildings, off E. 8th Street, and an additional
parking area is located behind the shopping center.
No parking impacts are anticipated since the shopping center has more parking than required by Code. Also,
noise from this type of business is generally minimal, and the completely enclosed suite has no windows
facing existing homes to the east. A recommended condition of approval will limit the hours of operation
from l l am to l l pm, as proposed by the applicant.
There are currently no tattoo parlors in National City. A Conditional Use Permit (CUP) is required for the use
in the General Commercial (CG) zone. However, several zones in the City allow this use without discretionary
approval.
At City Council request, the Planning Department reviewed State, County and local agency policies
regarding tattoo operations. The California Department of Health Services has established extensive
standards for the operation of tattoo parlors, which are enforced by the County Health and Human Services
Agency. These standards address sterilization of instruments, use of stencils, disposal of bio-hazardous
waste, etc. (see attached). The Municipal Code defers to the County of health related issues. Staff contacted
and obtained tattoo requirements from Imperial Beach, Chula Vista and the City of San Diego. These cities
have age requirements for patrons (18 in Imperial Beach and Chula Vista, and 21 in San Diego) and a
minimum square footage requirement in San Diego of 150 square feet. However, currently there is a
moratorium in Imperial Beach for tattoo parlors. Tattoo parlors are allowed in Chula Vista and San Diego
in some commercially zoned areas without any discretionary approvals.
The National City Police Department has been contacted for comments regarding the proposal. They have
indicated that there are no police problems with tattoo parlors, but that there is a public perception problem
with the use.
The Planning Commission voted to approve the project at their December 18, 2000 meeting. The applicant
and the property owner spoke in favor of the proposal. There was no other public testimony. Findings and
conditions for approval are included in the attached Planning Commission Resolution..
Recently, staff was informed by a citizen that this business is in operation, and photos were shown of signs
stating "open for business". Staff has contacted the applicant to remind him that he cannot conduct the
business until the CUP is approved and a business license is obtained. This requirement was also made
clear to the applicant prior to his application for the CUP.
RESOLUTION NO. 04-2001
A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A CONDITIONAL USE PERMIT
FOR A TATTOO PARLOR
AT 914 E. 8TH STREET, SUITE 213.
APPLICANT: MICHAEL SHIPLEY.
CASE FILE NO. CUP-2000-29
WHEREAS, the Planning Commission of the City of National City considered a
Conditional Use Permit application for a tattoo parlor within a shopping center at 914 E. 8th
Street at a duly advertised public hearing held on December 18, 2000 at which time oral and
documentary evidence was presented; and,
WHEREAS, at said public hearing the Planning Commission considered the staff report
contained in Case File No. CUP-2000-29 which is maintained by the City and incorporated
herein by reference along with evidence and testimony at said hearing; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State
law and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation of
public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City f
National City, California, that the testimony and evidence presented to the Planning Commission
at the public hearing held on December 18, 2000, support the following findings:
1. That the site for the proposed use is adequate in size and shape, since the shopping
center is large enough to accommodate a tattoo parlor and the necessary parking
area.
2. That the site has sufficient access to streets and highways that are adequate in width
and pavement type to carry the volume and type of traffic generated by the proposed
use, since the use will take place in an existing shopping center served by East 8th
Street, an arterial street.
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties, since it will be conducted in an entirely enclosed building in an existing
shopping center, and the proposed use will be located within a suite in the corner of
the shopping center, not visible from the street or adjacent properties.
4. That the proposed use is deemed essential and desirable to the public convenience
and welfare, since it will provide a service currently not available in National City.
BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved
subject to the following conditions:
1. This Conditional Use Permit authorizes a tattoo parlor with body piercing, in
conformance with Exhibit A, Case File No. CUP-2000-29, dated November 21,
2000, and the following conditions of approval.
2. All required State and/or County permits shall be obtained prior to operation of the
tattoo and body piercing parlor.
3. The tattoo and body piercing parlor shall be maintained at all times in a sanitary
condition and all equipment used in operation shall be properly sterilized prior to
each use.
4. Fire Department access to the site shall be maintained at all times.
5. Plans submitted with any application for a building permit must comply with the
1998 California Building, Plumbing, Electrical, and Mechanical Codes and the
California Title 24 handicapped and energy regulations.
6. Before this Conditional Use Permit shall become effective, the applicant and the
property owner both shall sign and have notarized an Acceptance Form, provided by
the Planning Department, acknowledging and accepting all conditions imposed
upon the approval of this permit. Failure to return the signed and notarized
Acceptance Form within 30 days of its receipt shall automatically terminate the
Conditional Use Permit. The applicant shall also submit evidence to the satisfaction
of the Planning Director that a Notice of Restriction on Real Property is recorded
with the County Recorder. The applicant shall pay necessary recording fees to the
County. The Notice of Restriction shall provide information that conditions
imposed by approval of Conditional Use Permit are binding on all present or future
interest holders or estate holders of the property. The Notice of Restriction shall be
approved as to form by the City Attorney and signed by the Planning Director prior
to recordation.
7. This permit shall become null and void if not exercised within one year after
adoption of the resolution of approval unless extended according to procedures
specified in Section 18.116.190 of the National City Municipal Code.
8. Hours of operation shall be from 11am to 11pm, seven days a week.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council.
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on
the day following the City Council meeting where the Planning Commission resolution is set for
review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of
that City Council meeting. The City Council may, at that meeting, appeal the decision of the
Planning Commission and set the matter for public hearing.

ARTICLE 1. DEFINITIONS AM) GENERAL PURPOSE
SEC. 66.301. STATEMENT OF PURPOSE.
The purpose of this Chapter is to provide for the regulation of *tattoo 44 parlors and
mobile *tattoo 41 vehicles operating in the unincorporated territory of the County of San
Diego to prevent communicable disease which may be spread through improper
tattooing techniques.

SEC. 66.302. DEFINITIONS.
The following terms contained in this chapter shall have the following meaning:
(a). APPROVED means acceptable to the Director of the Department of
Environmental Health of the County of San Diego; or the County Health Officer if the
Health Officer is specified.
(b). ASEPTIC TECHNIQUE means practices which prevent and hinder the
transmission of disease producing micro-organisms from one person or place to another
person or place.
(c). BIOHAZARDOUS WASTE means any of the following:
(1) Laboratory waste, including, but not limited to, specimen cultures from
medical and pathological laboratories, cultures and stocks of infectious agents from
research and industrial laboratories, wastes from the production of biological agents,
discarded live and attenuated vaccines, and culture dishes and devices used to transfer,
inoculate and mix cultures or material which may contain infectious agents and may
pose a substantial threat to health.

(2) Recognizable fluid blood elements and regulated body fluids, and
containers and articles contaminated with blood elements or regulated body fluids that
readily separate from the solid portion of the waste under ambient temperature and
pressure. Regulated body fluids are cerebrospinal fluid, synovial fluids, pleural fluid,
peritoneal fluid, pericardial fluid, and amniotic fluid.
(3) Sharps, which are objects or devices having acute rigid corners, edges,
or protuberances capable of cutting or piercing, including, but not limited to hypodermic
needles, blades and slides.
(4) Contaminated animal carcasses, body parts, excrement and bedding of
animals including materials resulting from research, production of biologicals, or testing
of pharmaceuticals which are suspected of being infected with a disease communicable
to humans.
(5)
Any specimens sent to a laboratory for microbiological analysis.
(6) Surgical specimens including human or animal parts or tissues removed
surgically or by autopsy.
(7) Such other waste materials that result from the administration of
medical care to a patient by health care providers and are found by the administering
agency, the Department of Environmental Health, or the local Health Officer to pose a
threat to human health or the environment. If there is a difference in opinion between the
administering agency, the Department of Environmental Health, and/or the local Health
Officer, the local Health Officer's view will prevail.
(d). DEPARTMENT means The County of San Diego Department of
Environmental Health.
(e). ENFORCEMENT OFFICER means the Director of the Department of
Environmental Health or his/her assistant deputies, designees and/or employees.
(f). HEALTH OFFICER means the Health Officer of the County of San Diego
or his/her designees.
(g). MOBILE »TATTOO N VEHICLE means a non -permanent, mobile »tattoo
N establishment, operating at locations remote from the permanent »tattoo H
establishment, from which a »tattoo 41 artists does tattooing for a fee or for other
consideration.
(h). PERMIT means an annual permit issued to a »tattoo 44 parlor or mobile
»tattoo +Vehicle by the Director of the Department of Environmental Health.

(1). TATTOOING means any method of placing designs, letters, scrolls, figures,
symbols, or any other marks upon or under the skin with ink or colors, by the aid of
needles or instruments.

ARTICLE 2. »TATTOO N PARLORS
SEC. 66.303. CUSTOMERS.
(a). No tattooing shall be done on skin surfaces which have rash, pimples, boils,
infections or manifest any evidence of unhealthful conditions.
(b). No »tattoo 44 shall be administered to any person under the age of eighteen (18)
years of age.
(c). No tattooing shall be performed on any person, who has given a history of
jaundice or hepatitis infection within the previous thirty days.

SEC. 66.304. OPERATOR.
(a). The operator shall be free of communicable diseases and have no pustular skin
lesions.
(b). The operator shall not smoke during the »tattoo 44 operation.
(c). The operator shall wear a clean, light-colored, short sleeved smock during the
»tattoo operation. 44
(d). The operator shall wear disposable gloves during the tattooing operation.

(a). Before working on a customer, the »tattoo 44 artists shall cleanse their hands and
arms in the following manner:
(1) Thoroughly scrub hands and fingernails with water, soap and a hand brush.
The upper arms to the elbow shall be scrubbed with soap;
(2) Rinse hands and upper arm with running water;
(3) Rinse hands with an approved antiseptic solution such as seventy per cent
alcohol; and
(4) Hands and arms may be dried with clean, individual, single use towels;
(b). The area of the customer's skin to be tattooed shall be prepared by:
(1) Washing with water and soap. A sterile hand brush, in conjunction with
water and soap, shall be used to produce a clean skin area.
(2) After washing of the skin surface, shaving shall be done with a new single
service blade. The blade shall be discarded, in the proper manner, after use. Re -usable
blade holders shall be sterilized in an autoclave after each use. If disposable blade
holders are used, they may be used on one customer only and then shall be disposed in
an approved manner.

(3) Following shaving, the skin shall be prepared by thoroughly washing with
soap, followed by gentle scrubbing of the skin with 70% isopropyl alcohol or Betadyne
three times, using a separate sterile gauze pad each time.
(4) Petroleum jelly to be used for stencils shall be dispensed from a disposable,
single use collapsible tube or container, approved by the Health Officer or the
Enforcement Officer, and shall be applied on the area to be tattooed with sterile gauze,
sterile tongue blade or sterile applicator stick. The container shall be discarded following
a single use.
(c). During the »tattoo Ii operation, dyes, inks and bodily fluids shall be removed
with sterile material, and properly disposed of at the end of the tattoo opelaation.
(d). The tattooed skin surface shall be treated in the following manner:
(1) The tattooed skin surface shall be washed with a sterile gauze saturated with
70% alcohol solution.
(2) The tattooed skin surface shall be allowed to air dry.
(3) The tattooed skin surface may be treated with Bacitracin Ointment applied
with a sterile applicator from single use tubes of ointment. Un- used portions of the
ointment shall be discarded.
(4) The tattooed skin surface shall be loosely covered with a dry sterile gauze
dressing with adhesive to permit free circulation of air.

SEC. 66.306. STERILIZATION OF »TATTOO H PIGMENTS AND
INSTRUMENTS.
(a). All pigments, dyes and equipment shall be steam sterilized in an autoclave with
at least fifteen (15) pounds pressure per square inch (251 degrees Fahrenheit) for at least
fifteen minutes. Autoclaves shall not be overloaded. Equipment shall be loosely packed
in the autoclave. There shall be sufficient equipment on hand in each establishment to
handle 24 hours tattooing without having to re -sterilize.
(b). Instruments and equipment that shall be steam sterilized shall include, but not
limited to:
Dyes, pigments Needle tubes
Paper towels, napkins Needles
Charcoal Wiping cloths

(c). All equipment shall be thoroughly cleaned before being sterilized. Instruments
shall be cleaned with soap or detergents by use of a brush. Interior of needle barrels shall
be brushed. After cleaning, equipment shall be thoroughly rinsed under running fresh tap
water.
(d). Each piece of equipment shall be individually wrapped with paper in an
approved method for autoclaving. Metal foil may not be used. Tattooing needles shall be
threaded through the metal tube that attaches to the tattooing vibrator and shall be placed
in a glass (or plastic) test tube with a cotton plug for autoclaving. Gauze may be placed
at bottom of test tube to prevent damage to needle tips. Wiping tissues shall be sterilized
in a single pack to be used for one tattoo Only and lien be discarded.
(e). All packs shall be marked with temperature recording tape or labels.
(f). The packages in which equipment is sterilized shall be dated with date of
autoclaving. Equipment shall not be used 30 days or more after autoclaving, without
being re -sterilized.
(g). Dyes or inks shall be used from squeeze bottle containers in which the dyes or
inks have been sterilized in an autoclave. Dye shall be kept in a sterile condition and the
dye bottles filled with dye shall be autoclaved at least once a week or more often, if
necessary, to keep the dye in a sterile condition. Re -filling of partially depleted squeeze
bottle containers with dyes or inks shall necessitate subjecting the bottle and its contents
to the sterilization procedure.

SEC. 66.307. PREPARATION OF STENCILS.
(a). Re- usable stencils shall be sanitized by immersion in a chlorine solution
containing no less than 100 parts per million (ppm) of chlorine (one ounce of household
bleach (5.25%) with one quart of water). The sanitizing solution may not be used for
more than thirty minutes after preparation.
(b). The stencil shall be scrubbed with soap and a brush after use to remove all
accumulations of carbon and vaseline in the etched grooves of the stencil. The stencil
shall be dried on a clean towel.
(c). The dried stencil shall be sanitized by immersing in the chlorine solution, design
side down for at least ten minutes.
(d). The sanitized stencil shall be rinsed in tap water and may be air dried or blot
dried with clean, sterile paper towels. The stencil shall be stored in a clean folder or
envelope.

(e). Prior to use, each pre -cleaned stencil shall be wiped with a piece of sterile gauze
soaked in 70% isopropyl alcohol. The stencil shall be allowed to air dry while other
preparatory steps are being taken.

SEC. 66.308. USE OF DYES AND INKS.
(a). Dyes or inks shall be from an approved source of supply. The »tattoo 41 parlor
permittee shall submit to the Enforcement Officer in writing, the source of the dyes and
inks used in their establishment.
(b). Dyes or inks to be immediately used in tattooing shall be dispensed from the
sterile dye bottles into sterile paper cups. Upon completion of the tattooing, the paper
cups and remaining dye shall be discarded in the appropriate manner. Any dye in which
a needle was dipped shall not be used on another customer.
(c). Styptics shall be single use only. Styptic material shall be dispensed only from
single use containers, then discarded after use on one customer.

SEC. 66.309. INFECTIONS.
All infections resulting from the practice of tattooing shall be

(b). The information required in subsection (a) shall be permanently recorded, in ink
or indelible pencil, in a bound book kept solely for this purpose. This book shall be
available at reasonable hours for examination by the Enforcement Officer and shall be
kept in the establishment for a minimum of six months.

SEC. 66.311. »TATTOO N PARLORS -- SANITATION REQUIREMENTS.
(a). The premises of a »tattoo N parlor shall be maintained in a clean and sanitary
manner at all times, free from vermin or rodent infestation and excessive dust and dirt.
(b). The walls and ceilings shall be easily cleanable, smooth surfaced and light-
colored. All walls and ceilings shall be kept in a clean condition and in good repair.
(c). The floor surfaces shall be of smooth, non -absorbent material and constructed so
as to be easily cleanable. The floors shall be kept in a clean condition and in good repair.
(d). Adequate lighting and ventilation shall be provided.
(e). Each »tattoo N establishment shall have a sink for the exclusive use of the
»tattoo H artist for hand washing and preparing the customers for tattooing. The sink
shall be supplied with hot and cold running water under pressure to a mixing type faucet,
a soap dispenser with soap, and single use paper towels from a dispenser.
(f). Water closet and hand basin shall be available on the premises for use by
customers and »tattoo 11 artists. The plumbing fixtures and toilet room shall be
maintained in a sanitary condition and in good repair.

(g). All needles and instruments shall be stored in a manner so as to provide
protection from contamination after sterilization. Adequate storage shall be provided for
all needles and instruments.
(h). Operating tables shall be constructed of metal or white enamel or porcelain
finish, or stainless steel. The operating tables shall be separated from observers and
waiting customers by at least ten feet.
(i). No smoking shall be permitted in the tattooing area.
(j). Tattooing shall be the only activity conducted in a »tattoo H parlor
establishment.
(k). Adequate, approved containers shall be provided for the disposal of wastes.
(1). Instruments, dyes, inks, pigments, carbon, stencils and other paraphernalia used
in the i*ttoo plArlor shall be stored exclusively in approved closed cabinets.
(m). No animals shall be allowed in the »Tattoo N Parlor at anytime.

SEC 66.312. DISPOSAL OF BIOILAZARDOUS WASTES.
Potentially biohazardous waste materials generated by »Tattoo 14 Parlor
Establishments and Mobile »Tattoo 14 Vehicles shall be disposed of in the following
manner:
(a). Sharps, which are objects or devices having acute rigid corner, edges, or
protuberances capable of cutting or piercing, including, but not limited to, hypodermic
needles, »tattoo 44 needles, blades, and slides shall be disinfected and disposed of, by
one of the following methods:
(1) By a cold disinfection method when used strictly in accordance to
instructions, and which has been approved by the State Department of Health Services.
The sharps disposed of in this manner may be disposed of via the municipal solid waste
hauler. Prior to pick- up by the municipal solid waste hauler, the cold disinfection
container shall be stored in a locked trash dumpster or a secured trash area to prevent
tampering.
(2) By disposal via a Permitted Biohazardous Waste Hauler or a State of
California Authorized Medical Waste Hauler, who possesses a permit from the
appropriate regulatory agency.

(3) By autoclaving the sharps to be disposed of for at least thirty minutes at 15
(fifteen) pounds per square inch (psi) at a temperature of 251 degrees Fahrenheit, bound
in packs with temperature sensitive indicating tape. Once sterilized, the sharps must be
contained before disposal in the municipal landfill.
(4) Other disposal methods approved by the State Department of Health
Services, the Enforcement Officer or the County Health Officer.
(b). Gauze, wipes, tissues, unused dyes and inks, and other non- sharp (s) used in a
tattooing operation shall be contained and secured on site, to prevent unauthorized
access. This material shall be disposed of, in the municipal landfill, by a licensed solid
waste hauler (general trash hauler).

ARTICLE 3. MOBILE »TATTOO N VEHICLES
SEC. 66.313. MOBILE »TATTOO N VEHICLES.
In addition to complying with the requirements of Article 2, excepting for Section
66.311(f), Mobile »Tattoo N Vehicles and »Tattoo h Artists working from a Mobile
»Tattoo HJehicle shall also comply [with] all of the following requirements:
(a). Mobile »Tattoo 44 Vehicles which do not have on board sterilization
equipment shall have sufficient utensils and equipment on hand in each Mobile »Tattoo
44 Vehicle to handle one day's tattooing without having to re -sterilize.
(b). Tattooing performed pursuant to this section shall be done only from an
enclosed vehicle such as a trailer or mobile- home. No tattooing of the skin shall be
performed outside of the enclosed vehicle.
(c). No animals shall be allowed in the Mobile »Tattoo 44 Vehicle at any time.
(d). The Mobile »Tattoo 44 Vehicle shall be used only for the purposes of
tattooing.
(e). The Mobile »Tattoo 44 Vehicle shall be equipped with a sink for the
exclusive use of the »tattoo 44 artist for handwashing and preparing customers for
tattooing. The sink shall be supplied with hot and cold running water under pressure to a
mixing type faucet, a soap dispenser with soap and single use paper towels from a
dispenser. An adequate supply of potable water shall be maintained for the Mobile
»Tattoo \ithicle at all times tattooing is being performed.

(f). All liquid wastes shall be stored in an adequate storage tank with a capacity
at least fifty per- cent greater than the capacity of the on -board potable water. Liquid
wastes shall be disposed of at approved trailer dump sites.
(g). The Mobile »Tattoo 44 Vehicle shall be maintained in a clean and sanitary
condition free of vermin, at all times. Doors shall be self- closing and tight- fitting.
Openable windows shall have tight -fitting screens.
(h). There shall be approved restroom facilities within 200 feet of the Mobile
»Tattoo Vehicle. 44
(i). There shall be adequate light and ventilation in each Mobile »Tattoo 44
Vehicle.
(j). Mobile »Tattoo 44 Vehicles which are not associated with »Tattoo 44 Parlor
Establishments operating in the County of San Diego shall maintain on -board steam
sterilization equipment meeting the requirements of Section 66.306 (a) of this chapter.
All equipment requiring sterilization shall be sterilized using the on board sterilization
equipment.

ARTICLE 4. ENFORCEMENT
SEC. 66.314. PLANS.
Every person proposing to construct a »Tattoo 44 Parlor Establishment or Mobile
»Tattoo 44 Vehicle, shall file a copy of the plans thereof, with the appropriate plan
review fee, prior to construction, with the Director of the Department of Environmental
Health, for review and written approval prior to commencing the work and in advance of
the issuance of any building, plumbing or electrical permit.

SEC. 66.315. INSPECTION.
For the purposes of this chapter, the Enforcement Officer may at all reasonable
times enter all parts of a »Tattoo 44 Parlor Establishment or Mobile »Tattoo 44 Vehicle to
make examination and investigation to determine the sanitary condition of the
establishment or vehicle and whether this chapter or rules and regulations are being
violated.

SEC. 66.316. PERMIT REQUIRED.
It shall be unlawful for any person to engage in the business of operating a »Tattoo
Si Parlor Establishment, or a Mobile »Tattoo 14 Vehicle without first applying for and
receiving approval of a permit from the Director of the Department of Environmental
Health.

SEC. 66.317. APPLICATION FOR PERMIT.
The permit required by this chapter shall be applied for and issued as prescribed in
Title 6, Division 5 of this Code. Every person applying for a permit shall pay the annual
permit fee set forth in Title 6, Division 5, Section 65.107 of this Code.

SEC. 66.318. VIOLATION INFRACTION -- MISDEMEANOR.
(a). Except as provided in subsection (b), any person violating any provision of this
chapter shall be deemed guilty of an infraction.
(b). Any person convicted of a third or subsequent violation of this chapter within
two years from the date of the first conviction shall be deemed guilty of a misdemeanor.
(c). Each day on which a violation occurs or continues shall constitute a separate
offense.

BACKGROUND REPORT
This Conditional Use Permit (CUP) is requested in order to legalize a boardinghouse that has been
converted without permits from a two-story, 2,160 square foot home. The proposal would use the
home's five bedrooms as guestrooms, and its two bathrooms, living room, kitchen and dining area
would be used as common area. The applicant proposes to allow one person per room. Meals would
not be provided, and there would be no resident manager. An offsite property manager would visit the
property daily to perform routine cleanup and maintenance.
The house is situated on a 6,750 square foot lot on the northeast corner of 8th Street and J Avenue, in the
CG (General Commercial) zone. Although the existing structure appears to be a single-family home, the
large parking area, which occupies the entire rear yard to the north and side yard to the east of the home,
lends the property a more commercial appearance. Adjacent properties and properties along 8th Street are
also zoned General Commercial; however, most of these are used for residential purposes, including a
mix of single -and multi -family residences.
The project site has been the subject of code enforcement and Building and Safety Department
enforcement action due to Building Code, Housing Code, and Health and Safety Code violations. An
inspection of the home in May 2000 revealed that it had been added on to and modified without any
permits, including Building Permits as well as the CUP, to create a nine -bedroom boardinghouse.
According to a tenant there were 15 total occupants at that time, including three young children. Since
then much of the illegal construction has been removed, although the structure does not comply with
minimum requirements for habitability due to a lack of heating, electrical concerns, and other Code
violations.
Based on the history of violations on the property, it is questionable whether the use would be maintained
in compliance with CUP conditions. During a December inspection, bunk beds or multiple beds were
present in some of the rooms. Also, it would be relatively easy for the owner to add interior partitions
and once again create a nine -bedroom facility, and the proposed limitation on the number of residents
would be difficult to enforce. The lack of a resident manager is also a concern, and is referenced in the
attached recommended findings for denial.
At the Planning Commission public hearing, citizens voiced concerns regarding the poor appearance of the
property and the lack of a resident family for the boardinghouse, as further detailed in the attached letters.
After discussion, the Planning Commission voted to approve the project with the added conditions that
tenants rent at least month -to -month, that a sign with the manager's phone number be posted, and that City
inspections of common areas be allowed at will. Other conditions of approval adopted by the Planning
Commission would require a redesigned parking layout, substantial landscape improvements, and
improvement to the exterior of the home.
Large, older homes such as this one can be difficult and costly to maintain. To increase cash flow,
sometimes owners will rent out rooms or convert the structures to other uses, such as recovery facilities, at
times without permits as was the case with this property. Building and Safety and Planning staffs are
currently taking enforcement action against another illegal boardinghouse. There may be others in the
community. The outcome of this case will serve as a precedent in handling similar situations in the future.

A RESOLUTION OF THE PLANNING COMMISSION
OF THE CITY OF NATIONAL CITY, CALIFORNIA,
APPROVING A CONDITIONAL USE PERMIT
TO ALLOW A BOARDINGHOUSE AT 1009 E. 8TH STREET.

WHEREAS, the Planning Commission of the City of National City considered a
Conditional Use Permit application to allow a boardinghouse at 1009 E. 8th Street at a duly
advertised public hearing held on November 20, 2000, and continued to the meeting of
December 4, 2000 at which time oral and documentary evidence was presented; and,
WHEREAS, at said public hearings the Planning Commission considered the staff report
contained in Case File No. CUP-2000-21 which is maintained by the City and incorporated
herein by reference along with evidence and testimony at said hearings; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State
law and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation of
public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
National City, California, that the testimony and evidence presented to the Planning Commission
at the public hearings held on November 20 and December 4, 2000, support the following
findings:
1. That the site for the proposed use is adequate in size and shape, since the proposed
use will be completely contained within an existing structure on the property.
2. That the site has sufficient access to streets and highways that are adequate in width
and pavement type to carry the volume and type of traffic generated by the proposed
use, since the proposed use is located on an arterial street and is not substantially
more intense than the existing use.
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties, since the proposed use will be residential in appearance and will be
conditioned to have an attractive appearance.
4. That the proposed use is deemed essential and desirable to the public convenience
and welfare, since the facility will provide needed housing opportunities.
BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved
subject to the following conditions:
1. Plans submitted with any application for a building permit must comply with the 1998
California Building, Plumbing, Electrical, Mechanical, and the California Title 24
Handicapped and Energy regulations.
2. All exterior electrical wiring shall be enclosed in a chase or located within building walls.
3. Smoke detectors shall be installed in all sleeping rooms and hallways leading to them. All
cooking and cooking equipment shall be located in the kitchen. Cooking on hotplates,
stoves, microwaves, etc. is prohibited in guest rooms.
4. An exterior stairway shall be provided to comply with Fire Department requirements.
5. Approximately 90' of standard gutters shall be provided in accordance with City standards.
6. A permit shall be obtained from 'the Engineering Department for all improvement work
within the public right-of-way, and for any grading construction on private property.
7. Street improvements along property frontages shall be kept free from weed growth.
Existing weeds in the sidewalk and pavement area along the sidewalks and fences shall be
removed.
8. Before this Conditional Use Permit shall become effective, the applicant and the property
owner both shall sign and have notarized an Acceptance Form, provided by the Planning
Department, acknowledging and accepting all conditions imposed upon the approval of this
permit. Failure to return the signed and notarized Acceptance Form within 30 days of its
receipt shall automatically terminate the Conditional Use Permit. The applicant shall also
submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on
Real Property is recorded with the County Recorder. The applicant shall pay necessary
recording fees to the County. The Notice of Restriction shall provide information that
conditions imposed by approval of Conditional Use Permit are binding on all present or
future interest holders or estate holders of the property. The Notice of Restriction shall be
approved as to form by the City Attorney and signed by the Planning Director prior to
recordation.
9. This permit shall become mill and void if not exercised within one year after adoption of the
resolution of approval unless extended according to procedures specified in Section
18.116.190 of the Municipal Code.
10. This Conditional Use Permit authorizes the use of the property as a five -bedroom
boardinghouse with a maximum occupancy of one person per bedroom. All plans
submitted for permits associated with the facility shall conform with Exhibits A -Revised
and B, CUP-2000-21, dated 11/2/2000, except as modified by conditions of approval
11. The property shall be vacated within 30 days after approval of the Conditional Use Permit.
The property shall not be occupied until all Building Code and Health, and Safety Code
violations have been corrected and improvements required to comply with the conditions of
this permit are completed.
12. The parking are must be redesigned to comply with Code requirements and new plans
submitted for approval of the Planning Director. Parking spaces shall not be located in the
setback areas and all parking spaces shall comply with minimum size and aisle width
requirements.
13. A detailed landscape and irrigation plan shall be submitted that includes plant types, method
of planting, etc. The landscape plan shall include the removal of weeds in yard and
parkway areas and shall show landscaping in all required setback areas; a minimum three-
foot wide landscape strip around the home; and a minimum three-foot wide landscape strip
along the north and east property lines, except for areas adjacent to existing drive aprons.
14. The exterior of the home shall have an appearance in compliance with Design Guidelines,
which may include wood shingles on the second floor and shiplap wood siding on the first
floor with stucco accent features at the porch area. Exterior plywood shall be removed and
replaced with materials that match the remainder of the home. Any siding in disrepair shall
be repaired or replaced. The home shall be painted to have a neutral color scheme such as
brown with white trim, or as approved by Planning Department staff for compatibility with
the neighborhood.
15. Rooms shall be rented for no less than month -to -month occupancy. Daily or weekly rentals
shall not be permitted.
16. A small sign with the name and phone number of the off -site manager shall be posted on the
property. The sign shall be subject to Planning Department review.
17. The property owner shall allow the City to conduct inspections of the common areas of the
facility at will.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council.
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on
the day following the City Council meeting where the Planning Commission resolution is set for
review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of
that City Council meeting. The City Council may, at that meeting, appeal the decision of the
Planning Commission and set the matter for public hearing.

Dear Sir:
We are the owners of the adjoining property at 1017 —1023 E. 8th St.. We have owned this
property for approximately 20 years. During this time we have seen the property at 1009 E. 8th
undergo several major changes in its use. Twenty years ago it was the AARON AMBULANCE
CO. and the building was declared a Historical Bldg. The owner at that time claimed that he
could not make any major changes to the building because of the " Historical Building
Designation". Since then it has had physical changes from an apartment house and now to a
rooming house. At one time it was a orchid nursery. We had an ongoing problem with
cockroaches that were attracted to the soil, bark and potting materials. Another time there was a
out of town construction contractor that lived in part of that building who stored all his bldg.
materials there. That is no longer a problem but is an example of the different uses and the
unsightly scene this property projects. It belongs out in the country but not in the city.
Last December we sent a letter to the property owner in which we expressed our concern over the
blighted condition of the property. We, however, did not receive an answer/ response back from
Mr. Delrosari. (See attachment) Incidentally, when we have had problems we have spoken either
to the occupants or registered a complaint with the city.
It appears that the construction, which has been going on has been done by amateurs, the painting
done by uncaring amateurs and the color choices chosen from a bargain rack with no
consideration for color compatibility. In other words, the building is an eyesore and the owner
should be embarrassed over it's appearance.
Now he wants the city's approval to turn it into a rooming- house which it already is. We would
hope that the City of National City's "Planning Dept." would require that the building conform
to it's intended use, either as a private home or apartments. The Building Dept. should have some
control over the shoddy work done on this structure. A "drive by" from either you or a member
of your staff would confirm what we have tried to describe in this letter. As landlord for the four
families at 1017-23, we strive to provide them with decent housing and an appealing
environment.

We have received complaints from our tenants regarding that property, about dogs constantly
barking in the past, loud banging from working on cars and loud mufflers on a truck that parks
near their bedroom. Roaches, attracted to the plants. (Now we have a pesticide contract).
Those tenants have all moved now. We are opposed to any changes at 1009 E. 8th Street if what it
looks like now is any comparison. We have been told that the real owner lives out of state. They
now have an "absent -tee landlord situation". This is not good for any of the other surrounding
neighbors, property owners or the neighborhood environment itself. We question how lax they
are with their background checking, as we do rent to families with children. At present many
stray cats seem to stay around that property as their place of residence. Again, we are opposed to
this request for a conditional use permit at 1009 E. 8`11 St., National City, for the above noted
reasons.

Dear Mr. Post and Commissioners,
We planned on attending the meeting tonight re: the above mentioned property. However,
we both have been very sick with the flu and are unable to be there in person. Please consider
this letter and the attached photos when you consider this item on your agenda.
Since the last meeting, we have noticed a lot of activity at the property in question. I believe it
was Tuesday, November 21' that the boldest transformation took place. The White, royal blue/
and flamingo paint job on the siding was painted over. Now it is a big bold flamingo colored
building. (minus the royal blue/ white but not a color most people would pick for a building like
this).
Hopefully the owners will be able to keep senior citizens in the rented rooms. We would not like
to see it rented to young women that could use it as a brothel. The gaudy color would certainly
make it stand out and suggest the type of activity available. Our tenants will advise us of any
increase in traffic in and out of this property.
Please keep us advised of any future meetings and/or changes concerning the above.

Explanation:
In response to Governor Davis' declaration of emergency on January 17, 2001 and a
directive for municipalities to reduce their energy consumption by five percent and seek a
seven percent conservation goal, the City of National City has implemented energy
conservation measures and is committed to immediately reducing electrical energy by a
minimum of five percent.
The electricity supply and price challenge faced by California is not one that will be
resolved in the short term. Governor Davis' administration and the Legislature are
working with utility companies, generators and consumer groups to come up with a long-
term solution to the immediate price and supply situation, and to develop longer -term
strategies that address both conservation and the development of new electricity sources.
However, California continues to be faced with an urgent need to immediately reduce
electricity use. In fact, our ability to attract electricity supplies from outside the state is in

By implementing these and other energy saving measures, the City expects to comply
with the required energy savings directive. This report is presented to Council to advise
of the current situation and to request their approval of the Resolution in committing to
energy conservation measures as California addresses the electrical energy challenge.

WHEREAS, California faces unprecedented energy challenges and severe
electricity supply shortages; and
WHEREAS, the importance of immediate energy conservation efforts cannot be
overstated; and
WHEREAS, Governor Gray Davis has asked all Californians to seek a
conservation goal of reducing electricity use by 7%; and
WHEREAS, to demonstrate California's commitment to conserve electricity, the
Governor has directed State agencies to immediately reduce electricity use in State facilities by
5% and has asked cities to do the same; and
WHEREAS, the City of National City has implemented proactive measures to

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the City Manager is hereby directed to take actions to immediately reduce

WHEREAS, said policy provides that the City Manager will review all proposed

Purpose
Funds from federal, state, local and private sources are important resources that
need to be included in the City's financial plan. The following policy provide a
framework for City-wide coordination of grant activities among departments, and
an opportunity to determine the immediate and long term financial consequences of
accepting funding. This policy shall cover all departments of City government.
Policy
I. The City Manager's Office will act as a clearinghouse for all grant applications.
Any City department intending to apply for funding from a federal, state, local or
private source shall obtain approval from the City Manager's Office in advance of
the filing of any grant application. This shall be done by submitting the "Request to
Apply for Federal, State, and Local Government Grants or Private Funds" form.
II. The City Manager's Office will review the "Request to Apply for Federal, State,
and Local Government Grants or Private Funds" to ensure that proposals are
coordinated with the City's existing programs, ensure that administrative, reporting
and evaluation requirements are adequately addressed by the requesting
department, and evaluate the immediate and long term financial consequences of
the proposal. The City Manager's Office may request additional information or
presentations from requesting departments.
III. After reviewing the department's request, the City Manager may, at his/her
discretion, decide whether to approve the solicitation of outside funding. On a
periodic basis, the City Manager will inform the City Council of any decisions
approving solicitation of outside funding. On a case -by -case basis, the City
Manager may also chose to refer individual "Request to Apply for Federal, State,
and Local Government Grants or Private Funds" to City Council for consideration.

IV. For those proposals for outside funding which are allowed to go forward, the City
Manager shall additionally determine at his/her discretion whether the grant or
private funding request is best authored by City Staff or by other sources including

made to employ outside grant writers, a "Letter of Authorization" will be sent from

EXPLANATION: The City applied for a reimbursement offered by the Public Utilities
Commission, administered through SDG&E, for retrofitting City traffic signals with
green LED signal heads, yellow LED flashing beacons, and pedestrian LED indicators.
The LEDs are much more efficient light source than the existing incandescent bulbs.
According to the literature, LEDs use approximately 40% of the amount of electric
energy that incandescent bulbs require.
National City retrofitted its 68 traffic signals with red LEDs approximately three years
ago. At that time green and yellow LEDs were not available. Green and yellow LEDs
have now been approved for use in traffic signals. Retrofitting the green LEDs should
result in an overall savings in electricity used by traffic signals of approximately 10%.
This reimbursement program, coupled with the current cost of electricity, makes the
payback period resulting from this retrofit project relatively short. This project will result
in energy conservation, which over the long term will be a significant savings.
The total cost of the project, including materials and labor, is $234,000. The cost to
National City to retrofit the traffic signals is approximately $68,000. Approximately
$166,000 will be reimbursed through this program by SDGE. These amounts are
estimates and subject to some change.
The work must be accomplished by June 1, 2001 in order to receive the
reimbursements. We plan on purchasing the LED fixtures through the City of El
Cajon's, contract with their LED supplier. The El Cajon contract resulted from the
competitive bid process where Synchronex, Inc. was determined to be the lowest
responsive, responsible bidder. Synchronex, Inc. has agreed to the `Public Agency
Clause' contained in the bid, which allows other public agencies to buy the LEDs at the
awarded price. Purchasing Ordinance #1480, Section 16, allows this method of
procurement. The Purchasing Department will coordinate the purchase. Public Works
will then have Southwest Signal, our signal maintenance contractor, install the LEDs.
In this way we believe we can meet the June 1, 2001 deadline. If the work is
accomplished after June 1, the reimbursement amount is reduced by approximately
50%; therefore the timing is critical

GOVERNMENTAL AGENCY PARTICIPATION AGREEMENT

LED Traffic Signal Incentive Program
THIS AGREEMENT ("Agreement"), dated and effective as of the date signed by the Governmental Agency
below, sets forth certain agreements by and between San Diego Gas & Electric ("SDG&E), a California corporation
and City of National City ("Governmental Agency"), either or both of which may also be referred to as "Party" or
"Parties" to this Agreement.
WHEREAS, the California Public Utilities Commission ("CPUC"), by ruling of the Assigned Commissioners and
Administrative Law Judge on the Summer 2000 Energy Efficiency Initiative, D. 00-07-017, dated August 21, 2000
("Ruling"), SDG&E was directed to offer a Lighting Emitting Diode ("LED") traffic signal rebate program to
governmental agencies in SDG&E's service territory;
WHEREAS, SDG&E has developed the LED Traffic Signal Incentive Program to encourage Governmental
Agencies to replace red and green incandescent traffic signal lamps, yellow flashing beacons and pedestrian signals
(Lamp(s)) with energy -efficient LED traffic signal lamps pursuant to the terms and conditions of this Agreement,
and
WHEREAS, Governmental Agency would like to participate in the Program pursuant to the terms and conditions of
this Agreement:
NOW, THEREFORE, in consideration of the mutual premises and the mutual promises of each party herein
contained, the parties agree as follows:
1. Governmental Agency agrees to:
(a) Replace incandescent traffic and pedestrian signal lamps with Lamps as set forth in Paragraph 2 below and
further described in Attachment 1.
(b) Provide SDG&E with a complete copy of the Governmental Agency's invoice for the purchase of the
Lamps. Governmental Agency's invoices(s) shall include, as to each Lamp: intersection location, Lamp
description and quantity, and installation date using the LED Traffic Signal ReplacementNerification
Report (Attachment 2). Collectively, the invoice and Replacement/Verification Report are the Replacement
Documentation.
(c) Cooperate with SDG&E in the verification by SDG&E or its agent of both the purchase and replacement of
the Lamps.
(d) Pay any taxes, which may be imposed on Governmental Agency, as a result of Governmental Agency's
receipt of the Incentive hereunder.
2. SDG&E agrees to:
(a) pay a maximum individual incentive of $65 for each red Lamp, $175 for each green Lamp, $125 for each
yellow flashing beacon, $70 for each combination pedestrian signal and $25 for each pedestrian hand
replaced before June 1, 2001. The maximum incentive will be reduced be 50% for lamps replaced between
June 1 and December 15, 2001. Lamp, for purposes of this Agreement, shall include all traffic signal balls,
arrows and pedestrian signals replaced. The actual incentive payment will be confirmed by SDG&E
verification and will be based on the actual number of Lamps replaced. Under no circumstances will
SDG&E's incentive payment exceed the actual invoice purchase price of the Lamps replaced.

(b) Reserve incentive funds, as shown on the LED Traffic Signal Rebate Form submitted earlier, until the
earlier of the replacement completion or June 1, 2001. If the actual lamp replacement exceeds the quantity
shown on the Lamp Specification Form, incentives will be paid for the higher amount, based on availability
of unreserved incentive funds.
3. SDG&E's payment to Governmental Agency of the incentive is completely contingent upon receipt by SDG&E
of a complete copy of the Governmental Agency's invoice and completed Replacement/Verification Report
(Attachment 3). No incentives will be paid for incomplete or late submissions.
4. The funding approved by the CPUC for this Program is limited and will be reserved and paid on a first -come,
first -serve basis to qualified Governmental Agencies.
5. SDG&E will transmit payment of the Governmental Agency's invoice to the Governmental Agency, within 30
days after SDG&E receives Governmental Agency's invoices, provided that Governmental Agency has
satisfied all requirements of this Agreement and the invoice is correct.
6. All Replacement Documentation, correspondence and other submittals required to be submitted by
Governmental Agency to SDG&E under this Agreement shall be mailed first class mail, postage prepaid, to:

7. SDG&E is regulated by the California Public Utilities Commission ("CPUC") and administers this Program
under the auspices of the CPUC. SDG&E and the CPUC reserve the right to audit and examine Replacement
Documentation and all other records relating to Governmental Agency's participation in the Program for a
period of five years after completion of the Program.
8. SDG&E may terminate this Agreement and immediately cease any payments to Governmental Agency if, in
SDG&E's reasonable determination, Governmental Agency breaches any provision of this Agreement. If
SDG&E takes legal action to recover any incentives paid to Governmental Agency for which Governmental
Agency is not otherwise entitled to payment under the terms of this Agreement, then SDG&E will be entitled to
recover all costs relating to such legal action, including, but not limited to, reasonable attorney's fees (including
in-house and outside counsel). SDG&E may also terminate this Agreement upon order of the CPUC. In such
case, Governmental Agency will be paid all incentives earned for qualifying Lamp replacements prior to the
effective date of said termination.
9. SDG&E is entering into this Agreement solely as an administrator with respect to verification of performance
and disbursement of incentive funds. The selection, purchase and replacement of Lamps are the sole
responsibility of Governmental Agency. Governmental Agency shall indemnify SDG&E, its current and future
parent companies, affiliates, subsidiaries, their officers, agents and employees against all loss, damage, expense
and liability resulting from injury to or death of persons, including, but not limited to, employees of
Government Agency or injury to property, including, but not limited to, damage to property of Governmental
Agency, provided such injury to persons or damage to property are due or claimed to be due to the negligent
acts or omissions of Government Agency, its officers, employees, agents or any other person or persons under
its direct supervision and control. Government Agency shall on a SDG&E's request defend any action, claim, or
suit asserting a claim covered by this indemnity. Government Agency shall pay all costs that may be incurred
by SDG&E in enforcing this indemnity including reasonable attorneys fees including in-house and outside
attorneys.
In addition to the above, Government Agency will cause its subcontractors to defend, indemnify and hold
SDG&E harmless to the same extent as provided in the preceding paragraph.
10. SDG&E reserves the right to disqualify the Governmental Agency due to an incomplete submission or if, in its
sole judgement the Lamps installed are different than the Lamps identified in the Lamp Specification Form.

11. SDG&E MAKES NO REPRESENTATION OR WARRANTY AS TO THE
QUALITY, SAFETY, RELIABILITY, USE, APPLICATION OR EFFICIENCY OF
THE LAMPS OR ANY COMPONENTS THEREOF. SDG&E MAKES NO
WARRANTY OF ANY KIND WITH RESPECT TO THE LAMPS, WHETHER
EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR
PURPOSE.
12. Governmental Agency represents that it has read and understands the Program requirements as set forth in this
Agreement and Governmental Agency agrees to strictly comply with all provisions contained herein.
13. This Agreement shall be effective on the date it is completely executed by both parties. Purchase and
replacement of Lamps must be completed on or before December 15, 2001. If Governmental Agency cannot
provide proof of Governmental Agency's purchase of the Lamps and proof that the Lamps are replaced and
operational on or before December 15, 2001, this Agreement shall terminate automatically on such date.

LED Traffic Signal Rebate Program Requirements
San Diego Gas & Electric
The LED Traffic Signal Rebate Program was approved by the California Public Utilities Commission (CPUC) as part of an initiative to reduce
peak energy demand during the summer months. Rebates for LEDs installed before June 1, 2001 will be twice as high as those awarded
for LEDs installed after that date. The program will extend until December 15, 2001.
The actual amount of a rebate will be the purchase price of the LED shown on an invoice, up to the maximum listed in the chart below. Spare
LEDs are not eligible for incentives. Installation labor costs will be the responsibility of the participant and will not be reimbursed through this
rebate program. Lamps purchased must adhere to the Power Demand ranges as specified in the table below. Lamps deemed to be above
the maximum wattage ratings are not eligible for the LED incentive.
Installed lamps must be hard -wired (type 1) replacements, with the exception of the pedestrian hand. New LEDs must replace incandescent
lamps.

reserved funds, together with a letter of confirmation. Applicants will have 90 days from the date of the letter of confirmation to show progress
on their pro jack San Diego Gas & Electric reserves the right to release reserved funds to new applicants or to adjust the amount

San Diego Gas & Electric is pleased to announce t a new LTD Traffic Signal Rebate Program effective September 11, 2000. The
program has been established to encourage the retrofit of traffic signals with LED (Light Emitting Diode) lamps to save energy. Funds are
available to cities and governmental agencies on a first -come, first -served basis. This program is funded by California utility customers
and administered by the state's investor -owned utilities, under the auspices of the California Public Utilities Commission.

EXPLANATION
City Attorney
Pursuant to the direction of the City Council, a retainer agreement with the law firm of
Sullivan, Wertz, McDade & Wallace is submitted for approval. Under the retainer agreement, the law
firm would act as independent counsel, investigator and advisor to the City in connection with the legal
issues arising from the litigation entitled Fred R. Soto v. George H. Waters and Janice Martinelli.
Sullivan, Wertz, McDade & Wallace has also requested approval of a conflict of interest
waiver. It appears that there is no actual conflict of interest arising from the firm's representation of
the City and its client listed on the conflict of interest waiver.

APPROVING A RETAINER AGREEMENT

BE IT RESOLVED that the City Council of the City of National City hereby
approves a retainer agreement with the law firm of Sullivan, Wertz, McDade & Wallace to act as

the City in connection with legal issues arising from litigation involving members of the City Council.
In fulfilling our duties, we will coordinate our activities with, and report to your office.
We believe that a clear understanding between attorney and client with respect to fees is
fundamental to a good long-standing relationship between them. The purpose of this letter is to ensure
that you are fully informed of the following terms and conditions which will apply to the legal services
we will perform. After you review the terms, please call me with any questions you may have. If the
tel uls are clear, and you aeree to the terms, please sign, date and return one of the enclosed originals of
this agreement in the envelope provided.
Our fees for legal service rendered in this matter, and in any matters which we may undertake
on the City's behalf, unless otherwise agreed, will be calculated on an hourly basis and will be billed
to you monthly. The hourly billing rate for attorneys within this office, of course, varies based primarily
on the experience level of the attorney. The present range is from $175 to $325 per hour. It is our policy
to have the legal services performed in each case by attorneys at the lowest rate consistent with a high
quality of legal services. while my current billing rate is $325 per hour, as a courtesy to the City, we

will place a ceiling of $250 per hour as a maximum for any attorney involved in this matter. From time
to time, it is necessary to adjust these hourly rates to compensate for increased experience factors or
inflationary cost increases in our economy. This will not be done more than once a year.
Legal assistants and law clerks may also work on your matter. Their hourly rates range from
$35-$85 per hour.
Our statements for legal services rendered cover a billing period through the end of the previous
month, and are due and payable upon receipt. Recognizing that most legal services are performed
outside of the view of the client and during times he is not present, it is our policy to describe the
services performed in a detailed fashion so that you may be able to understand fully the services and
charges. If there are any questions relating to the services or the charges, we will be pleased to discuss
them with you at the earliest possible time after receipt of the statement. If we do not hear from you,
we will assume that you have no questions.
The statement will also contain charges for costs expended by our firm on your behalf. Such
costs include telephone, copying (S.25 per page), postage, messengers ($.21 per mile, $5.00 minimum),
travel, and other usual services and materials. You will be responsible for the payment of these costs
and expenses as they are incurred.
Statements become delinquent if not paid within 30 days of receipt, and you agree to pay a
monthly service charge equal to 1.5% per month (I8% per annum) of the outstanding balance as
liquidated damages until paid.
ARBITRATION. If both of us initial this paragraph, any dispute arising under or related to this
agreement shall be resolved by binding arbitration under the Code of Civil Procedure, including any
claim for legal malpractice and any dispute over our fees. This means that we each give up the right to
file a lawsuit in a court, to have the matter resolved by a judge or jury, and to file an appeal. Do not
initial this paragraph unless you are sure you want any legal malpractice or other claim decided by
neutral arbitration, and unless you are sure you want to give up your right to go to court.

EXPLANATION
This is a request from the Pentecostal Missionary Church of Christ (2410 E 8th St) to
conduct a parade on February 18, 2001 from 2:30 p.m. until 4:00 p.m. The event will
consist of a motorcade with 30-45 cars with balloons and banners. There will also be
several floats.
The motorcade will start from the church and go to Division St, then National City Blvd.,
24'h St, Highland Ave, Plaza Blvd and 4th St. The motorcade will end at the location of the
church. The church will hire a motorcade patrol to accompany the parade.
The application and the event qualify for a waiver of fees pursuant to City Council Policy
No. 704.
The same event was approved by the Council last February 16, however this year the event
has been expanded. There were no problems with the event last year.
