DiCerchio, Chief of Police A Police Department The Federal Office of Juvenile Justice and Delinquency Prevention (OJJDP) has made Accountability Incentive Block Grant funds available through the California Office of Criminal Justice Planning (OJJP). The San Diego region will obtain a total of $1,074,917 to be distributed proportionately to the various law enforcement agencies based on a formula using law enforcement expenditures and crime arrest data for each unit of local government. The FY 2000/2001 allocation for the City of National City is $20,670, with a cash match of $2,297. There are several purpose areas established by OJJDP for the spending of the allocated money. The San Diego County Board of Supervisors has proposed that each local entity, transfer their share of the funds to the county of San Diego. The County would meet the 10% cash match requirement for each agency. Last year, the City of National City and nine other cities committed their JAIBG allocations to the County for use in expanding the Regional Juvenile Information System (REJIS), by the development of a Juvenile Court web site to provide information on juveniles to local law enforcement. The final links with the school districts to provide information on grades and attendance will be completed in mid -February. Maintain and expand the Community Response Officer Program (CROP) in which Deputy Probation Officers are stationed in and/or shared between thirteen law enforcement stations. A portion of the funds and realignment of current CROP assignments will allow for the addition of three Deputy Probation Officers for additional coverage for North Inland and Coastal cities, East County cities, and the South Bay cities (National City and Chula Vista). CROP is designed to increase communications, provide information on juveniles, and perform community outreach activities. 2. Maintain and expand the Regional Juvenile Information System (REJIS) which will incorporate a web site, making information accessible to local law enforcement. The system incorporates certain school districts that provide information on juveniles regarding grades and attendance. The expansion of this system will include participation by additional school districts. 3. Complete Feasibility Study, review recommendations and take action as appropriate under funding limitations. Collect data on program outcomes to include: technology upgrades, CROP program services, and the Community Resource/Drop Off Center services. The interest of the National City Police Department correlates with that of the county. Based on the economy of scale NCPD realizes that the funds would be a much better benefit to the organization if used by the County of San Diego on the above regional projects. The Police Department therefore recommends approval of the Resolution to transfer National City's FY 2000/2001 Juvenile Accountability Incentive Block Grant funds to the County of San Diego. The State of California and OCJP disclaim responsibility for any such liability. WITNESSETH WHEREAS, ADVERTISER has special experience and knowledge in directing and sponsoring the Annual Maytime Band Review for the City of National City, and WHEREAS, it is the desire of the CITY to employ said Maytime Band Review Corporation as its agent for the purpose of advertising the City, all pursuant to the Government Code of the State of California, and WHEREAS, it has been found by said City that the annual Maytime Band Review will publicize and advertise said City, the City Council does further find and does hereby determine that the expenditure of the sum of $13,000.00 for the conducting of the Maytime Band Review is proper for the purpose hereinafter set forth. NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: 1. That the CITY hereby agrees to pay ADVERTISER the sum of $13,000.00 (thirteen thousand dollars) subject to the terms, conditions and restrictions imposed by the agreement; 2. CITY agrees to pay ADVERTISER, said sum in three installments of $4,333.33 on or before March 1, and April 1, and $4,333.34 on May 1. All such sums paid to be substantiated by itemized statement of monies actually spent or liabilities incurred; 3. That said sum includes funds required by ADVERTISER to furnish necessary insurance for the Maytime Band Review and for the CITY's ad in the souvenir program; 4. That the term of this agreement shall expire on June 30, 2001; 5. That it is hereby mutually agreed that no part of any money paid by the CITY to ADVERTISER shall ever by used to pay any part of the salaries of its officers; 6. That the ADVERTISER will have full control and authority in producing and putting on the Maytime Band Review. The CITY shall review and approve all parade routes and shall separately authorize any auxiliary use of City facilities such as parks, buildings, or other public property; 7. It is distinctly understood and agreed that the entire sum paid ADVERTISER by CITY pursuant to this agreement shall actually be paid out by ADVERTISER for the sole purpose of conducting the activities in promoting and producing the Maytime Band Review; 8. That additional monies received from sale of souvenir program, concessions and bleachers over and above the cost of putting on the Maytime Band Review may be retained by the Maytime Band Review Corporation; 9. The ADVERTISER agrees to indemnify, defend, and hold harmless the City of National City, its officers, employees and volunteers, against and from any and all liability, loss, damages to property, injuries to, or death of any person or persons, and all claims, demands, suits, actions, proceedings, costs or attorneys' fees, of any kind or nature, including workers' compensation claims, of or by anyone whomsoever, in any way resulting from or arising out of the ADVERTISER's performance of this Agreement. Box 1298 National City, CA 91951 Dear Randy: Once again we are requesting National City's Antique Fire Engine to be in the Maytime Band Review Parade on Saturday, May 5, 2001, 10:30 a.m. As usual, the new Miss National City would be riding on the fire truck. The Parade again starts at 28th and Highland, proceeds north on Highland Avenue to 16th Street, west on 16th to "D" Avenue. The driver and fire engine should be at the parade formation area by 10 a.m. that morning. The beautiful fire engine makes a good addition to our parade. As you are aware, Newport proposes to upgrade existing tanks and other facilities at the National City Marine Terminal and establish a fuel terminal operation. Our operation will generate additional license tax, property tax, employee related tax and sales tax revenues for National City, as well as Additional lease revenues for the Port of San Diego. The production of these new revenue. sources will provide a general economic benefit and "win —win" for all parties directly involved and a clear economic benefit for National City and the citizens of San Diego County. We are currently working with WestPac Pipelines and their attorneys at the firm of Cooper, White, & Cooper, an experienced law firm that has worked on many similar projects in California. Through Cooper White & Cooper and with oversight by your office, we are developing business and legal strategies aimed at maximizing the local tax collected by National City. In addition, Cooper White & Cooper is directly consulting with the California State Board of Equalization to develop approved methods of sales transactions that will maximize sales tax revenues for National City. Once we have developed a methodology that is acceptable to the Board of Equalization, we will discuss in detail these methods with our prospective customers who will market their products through the National City Marine Terminal. Newport can then quantify the approximate amount of these specific sales and generate a projected revenue expectation for National City. As you know, Bob Filner represents the 50`h District that encompasses the southern half of the City of San Diego and the South Bay cities of Chula Vista and National City. Staff has made a number of inquiries regarding this Bill. The Legislative Analyst of the City of Chula Vista will be recommending that City Council support the Bill at a future Council meeting, but it is not yet docketed. At the time this report was prepared, the City of San Diego had not responded. The League of California Cities will not be recommending a position on H.R. 268. This request was only recently received and therefore, staff has not had adequate time to review and recommend a position on H.R. 268. ADDITIONAL REFUND AUTHORITY UNDER FEDERAL 2 POWER ACT. 3 Section 206 of the Federal Power Act (16 U.S.C. 4 824e) is amended by adding the following at the end there- 5 of: 6 "(e)(1) The provisions of this subsection shall apply 7 only to refunds of rates and charges in effect pursuant 8 to a rule or order of the Commission providing for market- 9 based rates and charges for a transmission or sale of elec- 10 tric energy subject to the ,jurisdiction of the Commission. 11 The provisions of subsection (b) concerning refunds shall 12 not apply to such rates and charges. 13 "(2) When the Commission has found, after notice 14 and opportunity for a hearing, on its own motion or upon 15 complaint, that any rate or charge referred to in para- 16 graph (1) is unjust, unreasonable, unduly discriminatory 17 or preferential, the Commission shall order a refund of 18 the portion of such rate or charge that exceeds the rate 19 or charge that the Commission finds to be just, reasonable 20 and not unduly discriminatory or preferential. Such re- 21 fund shall include interest from the date on which the rate 22 or charge was paid. 23 "(3) No order providing for a refund under this sub- 24 section may be issued with respect to amounts paid prior 25 to the date 2 years before the date on which the notice •HR 268 III 3 1 referred to in paragraph (2) is published in the Federal 2 Register." 3 (b) EFFECTIVE DATE. —The amendment made by 4 subsection (a) shall not apply to any complaint filed before 5 August 1, 2000. 6 (c) SAVINGS PROVISIONS. —Nothing in the amend- 7 ment made by subsection (a) shall affect any authority 8 of the Commission (or of any court) existing before the 9 enactment of this section, including any such authority to 10 issue any rule or order relating to market -based rates, to 11 approve or fix rates and charges, or to order refunds of 12 any rate or charge. 13 SEC. 3. ESTABLISHMENT OF COST -BASED RATES FOR 14 WHOLESALE SALES OF ELECTRICITY IN THE 15 WESTERN UNITED STATES. 16 (a) EXERCISE OF AUTHORITY TO ESTABLISH MAX- 17 IMUM PRICES.- 18 (1) DETERMINATION ON ITS OWN M0= 19 TION.—The Federal Energy Regulatory Co►n- 20 mission shall issue an order establishing the 21 maximum price for electricity sold at wholesale 22 subject to the jurisdiction of the Commission 23 under the Federal Power Act in the Western 24 Systems Coordinating Council for any period 25 after June 1, 2000, if the Commission deter - .Ent. 268 111 4 1 mines that any rates charged for such wholesale 2 sales of electricity are unjust, unreasonable, un- 3 duly discriminatory or preferential under sec- 4 tion 206 of the Federal Power Act. The Corn- 5 mission may make such determination on its 6 own motion at any time. If the Governor of any 7 State within the Western Systems Coordinating 8 Council submits a petition to the Commission to 9 make such determination with respect to any 10 such rates, within 30 days after receipt of the 11 petition, the Commission shall determine if such 12 rates are unjust, unreasonable, unduly discrimi- 13 natory or preferential under section 206 of the 14 Federal Power Act. 15 (b) MAx[MUivI PRICE. —The maximum price estab- 16 lished by the Federal Energy Regulatory Commission pur- 17 suant to subsection (a) shall be a price based on the sell- 18 er's costs, including a return of and on invested capital, 19 established in accordance with part II of the Federal 20 Power Act. 21 (c) REFUNDS OF PRICES PAID IN EXCESS OF MAX- 22 IMUM PRICE. —Any prices paid in excess of the maximum 23 price established pursuant to this section shall be refunded 24 pursuant to section 206 of the Federal Power Act, as 25 amended by section 2 of this Act. •Hft 268 LH 5 1 (d) PENALTIES. —Any person who violates any re- 2 quirement of this section shall be subject to civil penalties 3 equal to 3 times the value of the amount involved in such 4 violation. The Federal Energy Regulatory Commission 5 shall assess such penalties, after notice and opportunity 6 for public hearing, in accordance with the same provisions 7 as are applicable under section 31(d) of the Federal Power 8 Act in the case of civil penalties assessed under such sec- 9 tion 31. 10 (e) SAVINGS PROVISIONS. BOB FILNER OF CALIFORNIA IN THE HOUSE OF REPRESENTATIVES (Wednesday, January 31, 2001) Mr. FILNER. Mr. Speaker, I rise today to talk about my City of San Diego in the State of California and the incredible energy crisis that we are going through. Yes, we are still experiencing it. We have not yet solved it. I have heard comments from Members of this body and the other body, comments from the White House, which seem to indicate an unwillingness to take action to work with California through this crisis. I say to my colleagues in the Senate and I say to the administration, we are all in this together. If California falls, the rest of the Nation cannot be far behind. We are the largest State in the union. We have experienced rolling blackouts, utilities on the verge of bankruptcy. If my colleagues do not think this has had an impact on our national economy, listen to Alan Greenspan, as he testified to the Senate just last week. He said that California's crisis is not isolated. It is not an aberration, and it is a problem that the whole Nation must address and must address quickly. We should pay heed to Mr. Greenspan. And I say to the President, I think the President is going in the wrong direction on this issue. A hands -off approach by the Federal Government, as the President has suggested, is not going to solve this problem. Yes, we are increasing our generating capacity. Yes, we are redoubling and retripling our efforts to conserve, but an important piece of this problem has been the wholesale prices that have been charged to our utilities and our consumers. The obscene wholesale prices that have been charged. And only the Federal Government, I say to the President, only the Federal Government, through our Federal Energy Regulatory Commission, has the authority to regulate this wholesale price. For the President to say that California must solve its own problems ignores the fact that the generators and marketers of electricity, a seven -member monopoly, in fact, that is based in States like Texas, have run up huge, huge profits, 800 percent, 900 percent in their latest reports. While California, and soon other parts of the Nation, will suffer. Sacramento alone, California alone cannot regulate these wholesalers, I say to the President. This is Washington's responsibility, and it is that responsibility that we must take. I have a bill just introduced today, the California Electrical Consumers Relief Act of 2001, to take that responsibility head on. In a case like San Diego and California, where FERC has already found, through its investigation, our wholesale rates to be unjust and unreasonable, and, therefore, illegal, illegal, I say to the President, in that situation, my bill would establish what is called cost -based rates. That is the costs of generation plus a reasonable profit, for wholesale electricity, not just in California, but throughout the western States. This is a regional problem. We must tackle it regionally. It sets those prices retroactively back to last June when this crisis started. This is not a cap. This is not an arbitrary figure. This is a reasonable rate based on a market -based formula which allows the generators to make a profit, but protects the consumers. Mr. Speaker, FERC knows how to set those rates. They have the rationale. They have the procedure. They should do it, and we should order it. For those rates, under my legislation, that were charged above the legal cost -based rates that we have in California and San Diego and have been paying since last June, my bill requires the refund of those obscene profits, the difference between what was charged us and the cost -based rates that FERC determines should be refunded, a billion dollars to the consumers of San Diego, Mr. Speaker. $12 billion to the State of California. These were ill-gotten gains by a cartel of the large energy generators and marketers, and that money must be returned to the Californians who are suffering. And as we watch the news and as we listen to what is going on, please remember the Governor of California and the California legislature can do a lot about our State's problems, but they cannot order refunds. They cannot set wholesale prices. We ate stuck in California with the economic disaster that that implies, a billion dollars worth of debt in San Diego, $12 billion sucked out of our State by these power generators.
