HUD requires that the City formulate a 2001-02 Consolidated Plan Annual Plan or "Action Plan" to explain what activities the City will undertake during the next year to address priority needs in terms of local objectives that have been identified in the 2000-2005 Consolidated Plan (five- year plan). In other words, HUD wants to know what activities of the new five-year strategic plan will be accomplished in 2001-02. A draft of the 2001-02 Action Plan has been prepared in accordance with HUD regulations. These plans are currently in draft form and have been released for a 30-day public review period from April 2 through May 3, 2001. No public comments were received. Each year the City completes a process to solicit and approve programs and projects eligible for federal funding. The Department of Housing and Urban Development (HUD) has informed the City that $1,460,000 in Community Development Block Grant (CDBG) and $702,000 in HOME Investment Partnership Act (HOME) funds will be available for the Consolidated Plan program year 2001-02. Applicant's plans Background Report: The applicant proposes to pave and fence an 11,500 square foot vacant area for use as a vehicle storage facility. The area includes four parcels in the MLR (Light Manufacturing Residential) zone on the west side of Harding Avenue between Civic Center Drive and 14t' Street. Single-family homes are adjacent to the property on the south and east across Harding Avenue. Cozine's liquor store is north of the property and a warehouse building is located to the west, across an alley. The property owner intends to lease the site to a local moving company. Moving trucks will most likely exit the property in the mornings and returning in the evenings. Vehicles including semi -trucks and trailers, bobtails, flatbed trucks, and box vans will be stored on the property. Vehicular access will be through a gated entrance west of the property on the alley. A ten -foot emergency access gate off Harding Avenue will be installed to satisfy Fire Department requirements. A six-foot setback area on Harding Avenue will be landscaped with trees, shrubs, and groundcover in accordance with the attached landscape plan. The remainder of the site will be enclosed with a six-foot chain link fence containing redwood slats for screening. Conditions of approval as adopted by the Planning Commission include a required five- foot landscaped setback (not shown on the submitted plans) between the project site and an existing single-family home to the south. This was required despite opposition from the applicant. There is currently a beautification project underway on Civic Center Drive. While the storage yard project is not located on Civic Center Drive, stored vehicles will be partially visible from that street. The applicants proposed landscaping, however, may improve the view of the property. Possible benefits from the project include occupation of a site commonly used for illegal dumping and the merger of four existing substandard parcels (as required by conditions of approval). The minimal improvements of paving and fencing the vacant land may allow for a more compatible permanent development in the future. Additionally, while the proposed use may not be compatible with the residential character of the area, attached conditions of approval limit the hours of operation and prohibit vehicle repair and outdoor storage of items other than vehicles at the site. The Planning Commission voted to approve the project at their March 5, 2001 meeting. The applicant spoke in favor of the project. There was no public testimony. Recommended findings for the project and conditions of approval are those included in the attached Planning Commission Resolution. Possible findings for denial are also attached. RESOLUTION NO. 08-2001 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NATIONAL CITY, CALIFORNIA, APPROVING A CONDITIONAL USE PERMIT FOR A VEHICLE STORAGE LOT ON VACANT PROPERTY NORTH OF 1330 HARDING AVENUE. APPLICANT: J. VERNON MYERS. CASE FILE NO. CUP-2001-01 WHEREAS, the Planning Commission of the City of National City considered a Conditional Use Permit application for a vehicle storage lot on vacant property north of 1330 Harding Avenue at a duly advertised public hearing held on March 5, 2001, at which time oral and documentary evidence was presented; and, WHEREAS, at said public hearing the Planning Commission considered the staff report contained in Case File No. CUP-2001-01 maintained by the City and incorporated herein by reference along with evidence and testimony at said hearing; and, WHEREAS, this action is taken pursuant to all applicable procedures required by State law and City law; and, WHEREAS, the action recited herein is found to be essential for the preservation of public health, safety, and general welfare. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of National City, California, that the testimony and evidence presented to the Planning Commission at the public hearing held on March 5, 2001, support the following findings: 1. That the site for the proposed use is adequate in size and shape, since the four vacant parcels are large enough to accommodate the proposed use and landscaping. 2. That the site has sufficient access to streets and highways that are adequate in width and pavement type to cany the volume and type of traffic generated by the proposed use, since the site is connected via an alley to Civic Center Drive, a collector street with nearby access to north and southbound Interstate 5. 3. That the proposed use will not have an adverse effect upon adjacent or abutting properties, since conditions of approval will limit the hours of operation and since required landscaping and fencing will screen and buffer the use from an adjacent home and residences across Harding Avenue. 4. That the proposed use is deemed essential and desirable to the public convenience and welfare, since the use will provide needed vehicle storage for a nearby moving business. In addition, the use will provide control of a vacant area that has been plagued by dumping violations in the past. BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved subject to the following conditions: 1. This Conditional Use Permit authorizes an outdoor vehicle storage facility, and shall conform with Exhibit A, Case File No. CUP-2001-01, dated January 25, 2001, except as modified by conditions of approval. 2. To satisfy Fire Departments, a gate that opens to a minimum width of ten feet shall be provided off Harding Avenue for emergency access. A rolling type with a Knox Key or with a padlock is acceptable. 3. A drainage plan shall be submitted to the satisfaction of the City Engineer showing all of the proposed and existing on -site and off -site improvements. The plan shall be prepared by a Registered Civil Engineer, or other qualified professional, and shall be in accordance with City requirements. 4. All surface run-off, including landscaping irrigation within the public right-of-way, shall be collected by approved drainage facilities and directed to the street by sidewalk underdrains or a curb outlet. Adjacent properties shall be protected from surface run-off resulting from this development. 5. The property owner, or its successors and assigns shall be responsible for the maintenance, repair, or reconstruction of all irrigation and landscaping improvements installed within the public right-of-way. Sprinkler heads shall be adjusted so as to prevent overspray upon the public sidewalk or the street. The proposed sprinkler heads shall be installed outside of the sidewalk, and the irrigation mainline upon private property only, as required by the City Engineer. The property owner or, its successor or assigns, shall remove and relocate all irrigation items from the public right-of-way at no cost to the City, and within a reasonable time frame upon written notification by the City Engineer. 6. Background Report The property owner/appellant is asking for density and off-street parking variances in order to legalize the conversion of a four -car garage into an 800 square foot, one - bedroom apartment. The apartment, currently unoccupied, is adjacent to the alley behind a four -unit apartment building with no remaining parking at the southwest corner of 18th Street and J Avenue. The RM-1-PD Multi -Family Residential Zone permits only three apartments on the 6,670 square foot parcel. However, the four -unit building would be considered lawful nonconforming. The Code would also require 8, parking spaces for five units, while the garage conversion eliminated the only off-street parking on the property. The building was originally built in 1952 with four garage spaces. Many years ago, a rental office was allowed to occupy a portion of the garage. Replacement parking had been required but not provided, and the apartment use followed shortly thereafter. The property is one of five similarly developed, adjoining parcels on J Avenue. Altogether, they contain 20 apartments, and they are all owned by the appellant. The other properties have four -car garages which serve each four-pex. Because of the common ownership, staff discussed the possibilities of replacing the lost parking space as well as merging the parcels. However, a merger was not agreeable to the owner. Without combining lots, the corner parcel could potentially be sold with five units and no parking. There are other apartment complexes in the area built prior to current Code standards and nonconforming with regard to the required number of parking spaces. There are also single-family homes nearby. Although on -street parking may be found, this could become more scarce as additional units may be proposed in the Multi -Family Residential Zone. State law, as well as City Code, allows for variances only if justified by special circumstances applicable to the property and if not granting any special privilege. The required findings for approval, without reasons for support, are attached separately for Council review. The Planning Commission denied the variances and found no unusual circumstances or conditions that would justify them, as other properties in the same area and also in the RM-1-PD Zone are required to maintain off-street parking. There was no public testimony at the Commission hearing other than from the property owner. The Commission also considered the City's enforcement program focusing on garage conversions completed without permits. Approval of the proposal would create a precedent for other garage conversions to exceed density requirements and eliminate required parking. The work consists of removing an existing shallow conduit and replacing it with a 2-inch PVC (Schedule 40) conduit. The conduit was lowered from 6-inch to 36-inch depth with a new sweep. Discussion: During the site excavation the contractor damaged the conduit and lateral service line. The service was disconnected for the safety purposes till it was repaired. The lateral served the Kimball Park Bowl Amphitheater. The lateral was not shown on the construction plans due to the lack of record information during the plan preparation and not located by the San Diego Dig Alert representatives in the field prior to the construction. The restoration cost was negotiated with the contractor excluding the reconnection cost, which was performed by the City. Attached is a copy of the contractor's proposal. EXPLANATION This public hearing is continued from the April 24th, 2001 City Council Meeting when the Council considered public comment on the housing and community development needs of National City residents. HUD requires that the City formulate a 2001-02 Consolidated Plan Annual Plan or "Action Plan" to explain what activities the City will undertake during the next year to address priority needs in terms of local objectives that have been identified in the 2000-2005 Consolidated Plan (five- year plan). In other words, HUD wants to know what activities of the new five-year strategic plan will be accomplished in 2001-02. A draft of the 2001-02 Action Plan has been prepared in accordance with HUD regulations. These plans are currently in draft form and have been released for a 30-day public review period from April 2 through May 3, 2001. No public comments were received. Each year the City completes a process to solicit and approve programs and projects eligible for federal funding. The Department of Housing and Urban Development (HUD) has informed the City that $1,460,000 in Community Development Block Grant (CDBG) and $702,000 in HOME Investment Partnership Act (HOME) funds will be available for the Consolidated Plan program year 2001-02. Please note the following applicant revisions for the CDBG Program: 1. The National City Police Department has reduced their request amount from $50,000 to $26,000 and the request is for a federal matching grant program called "Cops in Schools 2001." 2. The Boys and Girls Club of National City has withdrawn their proposal request for the Academy of Engineering because the project received alternate funding. When allocating HOME Program funds, the following HUD issues should be noted: 1. HUD requires that 15 percent of HOME funds be set -aside for projects sponsored, owned, or developed by CHDOs. In addition, there is a 5 percent set -aside for CHDO capacity building. Currently, there are four CHDOs that are certified within National City. They are Christmas in July, Habitat for Humanity, MAAC Project, and South Bay Community Services. 2. Staff is recommending that $241,400 of HOME Program funds be allocated for the rehabilitation of Plaza Manor contingent upon the Related Companies providing a Proforma analysis and budget prior to releasing funds. This analysis is required to show the financial "gap" in this project and why the City's financial participation is justified. A business license is required if monies are solicited, admittance charged or food, beverages or merchandise is sold. Each separate vendor must have a separate business license. 2. A list of all participating vendors (with their address, phone number and current National City business license number) is to be submitted to the Revenue and Recovery Division of the Finance Department prior to the event for verification of business license numbers. PUBLIC WORKS 336-4580 1. The event will require a sizable effort from Public Works Street Division in closing off all access to Highland Ave between Plaza Blvd. And 18th Street. 2. "No Parking" signs would be posted mid -week prior to the event and barricade the streets at Highland Ave starting 2 hours before the parade begins, with removal and cleanup after it is over. 3. Public Works does not have the manpower to direct traffic at intersections during the parade. This will need to come from another source. 4. Costs to Public Works Street Division total $2526.70 and include: A. Standard Hours: $209.22 B. Overtime Hours: $1,963.68 C. Equipment: $308.20 D. Materials: $45.60 5. This event is unbudgeted. Four Police officers should be on duty assigned to the Plaza Bonita area. These officers will be on overtime paid by COPAO, the fee would be $43.52 x 4 x 10 officers = $1,740.80. 5. If a parade is conducted additional officers may be required depending on route of parade and number of volunteers available. This event is a celebration of our heritage in conjunction with the 103rd Philippine Independence Day Anniversary. We have previously celebrated this event in San Diego County Administration Building Parking Lot. However, this year we would like to get closer to home here in National City. 3. Since National City has one of the highest concentrations of Filipino - Americans in the United States, we believe that the best location for this event is in National City. 4. The event will be free to the public and it will showcase the rich Philippine Culture. This is an opportunity for the Filipino -Americans to show the citizens of National City and its neighboring communities our Philippine culture and heritage. 5. We are anticipating that this event will bring harmony, love and peace to our community. We also believe that this event will bring visitors to National City, and generate revenues and also promote the City's image through positive community event. 1. Our TUP Application are two separate activities. First is the Community Faire at Plaza Bonita on June 9 and 10, 2001. Second is the Parade at Highland Avenue on June 10, 2001. 1. We have contacted your staff regarding our plans and programs. We are pleased that all the city departments seem to have approved our application with certain conditions. 2. We will conform to all conditions required of us by the City. 3. The approximate City's fee and other expenses for this event $4,832.50. We are a non-profit organization with very limited funds, we can only afford $1000.00 to cover this expenses. We would therefore like to request waiver of fees for the balance of $3832.50.
