CHIEF OF POLICE
EXPLANATION The local canine academy is run by the San Diego Police Department. Prior to
placement into the academy, all dogs must be evaluated and tested by SDPD personnel. To,
maintain consistency in the process, and take advantage of the SDPD expertise in selecting dogs
suitable for police work, it is imperative that we obtain the dogs from SDPD's current approved
vendor pool. Historically, this has been our practice. However, time is of the essence in meeting
academy dates, and in an effort to speed up the procurement process, formal standardization of
the process is required.
Purchasing Ordinance #1480, section 12, subsection a(5), allows the bid process to be waived
when the particular type or make of commodity being purchased has been standardized by the
City Council or City Manager.

WHEREAS, the local police canine academy is run by the San Diego Police
Department (SDPD) whose personnel must evaluate and test all dogs before placement in the
academy; and
WHEREAS, to maintain consistency in the process, and take advantage of the
SDPD expertise in selecting dogs suitable for police work, it is imperative that the National City
Police Department obtain police canines from SDPD's current approved vendor pool; and
WHEREAS, Section 2.60.220(E) of the National City Municipal Code provides
that the Purchasing Agent may dispense with the requirements of bidding when the commodity,
furnishing, type of materials or equipment has been standardized by order of the City Manager or
the City Council.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City does hereby establish standardized procedures for the purchase of police canines
from SDPD's current approved vendor pool.
BE IT FURTHER RESOLVED that Resolution No. 2001-5 approved on January
16; 2001, which designated Aderhorst International as the supplier of police canines, is hereby
rescinded.

EXPLANATION
As allowed by Purchasing Ordinance #1480, Section 16, this award will be
made as a result of competitive bids solicited by the City of San Diego,
where Dion International, was determined to be the lowest responsive,
responsible bidder, and.was awarded their bid for multiple trucks,
including three (3) 2000-gallon capacity water trucks. One such truck
was budgeted in National City's Vehicle C.I.P. program for this fiscal
year.
The City of San Diego moiled bids to ten (10) potential bidders, and
Dion International submitted the only response. The bid contained a
'public agency clause', and Dion agreed to allow other public agencies
to buy at the awarded price.
The City of San Diego bid fully complies with Section 11 of Ordinance
#1480.
Total cost is $68,385.05 (including tax and delivery).

WHEREAS, the City of San Diego has issued an award, based on competitive
bidding to the lowest responsive, responsible bidder, Dion International Trucks, Inc., for the
purchase of three (3) 2000-gallon capacity water trucks; and
WHEREAS, one 2000-gallon capacity water truck was budgeted in National City's
Vehicle Capital Improvement Plan program for this fiscal year; and
WHEREAS, the Purchasing Agent has determined that the bidding procedures
followed by the City of San Diego fulfill the competitive bidding requirements of Chapter 2.60
of the National City Municipal Code, and that it would be beneficial to take advantage of the
City of San Diego's bidding process for the purchase of this vehicle; and
WHEREAS, in accordance with National City Municipal Code Section 2.60.260,
Cooperative Purchasing, of Chapter 2.60, Purchasing System, authority exists to purchase
equipment based on a price established by competitive bidding by another public jurisdiction.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City that the Purchasing Agent is hereby authorized to execute on behalf of the City, a
purchase order between Dion International Trucks, Inc., and the City of National City for the

of which was a 'no bid'. Bids were opened and read publicly on Ftiday,
March 23, 2001 at 3:00 p.m. A rep from National City Ford was present
for the opening.
Total for all six(6) vehicles is $155,839.00, including tax & delivery.

DECLARING NATIONAL CITY FORD THE LOWEST
RESPONSIVE BIDDER AND AUTHORIZING THE PURCHASING
AGENT TO ISSUE A PURCHASE ORDER FOR VARIOUS
PICK-UP AND SPORT UTILITY VEHICLES
WHEREAS, the Purchasing Agent of the City of National City did in open
session on March 23, 2001, publicly open, examine and declare all sealed proposals or bids for
two (2) Ford F150 pickup trucks, one (1) Ford F250 pickup truck with service body, and three
(3) Ford Expedition sport utility vehicles.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby rejects all said bids except that herein mentioned, and hereby awards the
contract for two (2) Ford F150 pickup trucks, one (1) Ford F250 pickup truck with service body,

EXPLANATION
TO APRIL 3, 2001 CITY COUNCIL A-200
The CDC has actively been seeking reuse opportunities for the closed Fedco building at
the southwest corner of Highland Avenue and Plaza Boulevard since the store closed in
September 1999. In December 2000, the owner of the Fedco site and K-Mart
representatives approached CDC staff with a proposal to demolish the 35 year -old
building and construct a new 180,000 square foot Super-K-Mart at this location.
In order to facilitate development of this site, three adjoining parcels under a separate
ownership (Mitchell Investments) must be integrated in the overall development to
address ingress/egress needs, parking, and removal of obsolete structures. The Super
K-Mart proposed for the Fedco site is significantly larger than the existing 140,000
square foot Fedco building, andrequires a portion of the Mitchell property to meet
parking needs. The Mitchell property contains two buildings, one of which is estimated
to be 25% vacant, the second which is approximately 50% vacant. A portion of the
Mitchell property is unpaved and onsite drainage is a problem. The CDC sees the
Super K-Mart project as an opportunity to redevelop the entire Fedco/Mitchell site, and
bolster the entire Highland Avenue commercial corridor.
On December 22, 2000, the CDC invited Robert Shapiro, representing the Mitchell
Investments ownership, to participate in the redevelopment of the Fedco/Mitchell site.
After extending the deadline for Mr. Shapiro to submit his redevelopment proposal, the
CDC received a proposal from Mr. Shapiro on March 1, 2001. Mr. Shapiro's proposal
only involved the redevelopment of the Mitchell property, and did not address the Fedco
parcel. Staff analysis of Mr. Shapiro's proposal indicated that the proposal was
substantially less desirable to the CDC, both in terms of economic returns to the CDC
and City General Fund, but also the overall land use plan and its compatibility with the
Super K-Mart proposal. Mr. Shapiro's proposal did not allocate the additional land
needed to accommodate parking for the Super K-Mart, address existing topography
problems, or provide for integration of the development among the various parcels - a
problem which has plagued the Highland Avenue corridor for decades.
Accommodating Mr. Shapiro's proposal would have jeopardized the development of the
Super K-Mart, since a smaller store was not of interest to K-Mart. As a result of these
issues, the CDC voted unanimously to reject Mr. Shapiro's proposal on March 6, 2001.
The next step in the redevelopment of the Fedco/Mitchell site involves acquiring the
Mitchell property to accommodate the Super K-Mart project. Although the CDC is
seeking to reach an accord with Mr. Shapiro on the purchase of the property, the CDC
cannot rule out the possibility that the use of eminent domain may be necessary to
facilitate the Super K-Mart project.

Currently, the Redevelopment Plan limits the CDC's use of eminent domain to certain
non -single family residential locations within the Project Area. These locations are as
follows:
• All parcels located immediately east and adjacent to National City Boulevard,
between Division Street and the south City limits.
• All parcels located immediately west and adjacent to National City Boulevard,
between Division Street and State Route 54.
• All parcels located immediately west and adjacent to Civic Center Drive, between
Interstate 5 and National City Boulevard.
• All parcels located immediately south and adjacent to Civic Center Drive,
between Interstate 5 and National City Boulevard.
• All parcels located immediately north and south and adjacent to 8th Street,
between Interstate 5 and "D" Avenue.
• All parcels located immediately south and adjacent to East Plaza Boulevard,
between E Avenue and Highland Avenue.
• All parcels west of Interstate 5, excepting the San Diego Unified Port District
property.
Because the Redevelopment Plan does not permit the use of eminent domain on the
Fedco/Mitchell site, the CDC would need to amend the Plan to expand its eminent
domain authority to this location.
CDC staff has prepared the 2001 Amendment to the Redevelopment Plan that would
add solely the Fedco/Mitchell site to the list of properties subject to eminent domain
(refer to map, Attachment No. 2). No other properties are affected by the proposed
Amendment. The CDC is currently preparing the necessary materials to present the
Amendment at a joint CDC/City Council public hearing, during which Mr. Shapiro, or any
other member of the public, may testify as the merits of the proposed Amendment.
Amendment of the redevelopment plan as proposed would authorize the CDC to
potentially acquire all property interests necessary for the Super K-Mart project.
However, the plan amendment does not commit the CDC to any property acquisitions;
rather, authorization for the CDC 's acquisition of any particular property would be
accomplished pursuant to a necessity hearing.
Redevelopment Law permits the City Council and CDC to conduct a joint public hearing
on the 2001 Amendment. As set forth in the Law, both the City Council and CDC are
required to adopt resolutions setting the date and time of the joint public hearing to
consider the Amendment and the pertaining documents and evidence. As stated in the
resolution, the joint public hearing is scheduled for the City Council/CDC meeting on
Tuesday, June 5, 2001, at 3:00 p.m. (or as soon as possible thereafter). Further, the

resolution authorizes staff to proceed with the necessary activities to prepare, publish,
and mail the joint public hearing notice.
The Law requires that the Agency transmit a copy of the notice of the joint public
hearing to all property owners, residential tenants, and business owners via first-class
mail no later than 30 days prior to the public hearing. In addition, the joint public
hearing notice needs to be published for three successive weeks in a newspaper of
general circulation.
In addition, it is requested, by motion, that the Planning Commission review the
proposed Amendment prior to the Public Hearing.

CALLING FOR A JOINT PUBLIC HEARING
ON THE PROPOSED 2001 AMENDMENT
TO THE REDEVELOPMENT PLAN FOR THE
NATIONAL CITY REDEVELOPMENT PROJECT
WHEREAS, the City Council of the City of National City ("City Council") did
duly pass and adopt a Redevelopment Plan for the National City Redevelopment Project
("Plan"); and,
WHEREAS, the Community Development Commission of the City of National
City ("CDC") has formulated an amendment to the Plan ("2001 Amendment"); and,
WHEREAS, pursuant to Sections 33458 and 33355 of the California Community
Redevelopment Law, Health and Safety Code Sections 33000 et seq., a joint public hearing on
the 2001 Amendment may be held with the consent of the City Council and CDC.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
National City hereby authorizes and consents to holding a joint public hearing with the
Community Development Commission on -June 5, 2001, at 3:00 p.m., or as soon as possible
thereafter, for the purpose of considering the proposed 2001 Amendment to the Redevelopment
Plan for the National City Redevelopment Project, and directs staff to give notice of the joint
public hearing in the form and manner required by the California Community Redevelopment
Law.

SUPPORTING LEGAL CLARIFICATION OF
PREFERENTIAL RIGHTS UNDER SECTION 135 OF
THE METROPOLITAN WAFER DISTRICT ACT
WHEREAS, the San Diego County Water Authority ("Water Authority")
provides wholesale water service to 23 member public agencies in the San Diego region; and
WHEREAS, the Water Authority has responsibility to provide imported water
supplies to meet the needs of the region's $103 billion economy and to sustain the quality of life of
the region's nearly three million people; and
WHEREAS, the City of National City depends and relies upon the Water Authority
to provide all or a substantial portion of its water supply needs; and
WHEREAS, the Water Authority is a member agency of the Metropolitan Water
District of Southern California ("MWD") and is currently dependent on it for all of the water supply
it imports to serve the needs of the Water Authority's own members including the City of National
City; and
WHEREAS, for over 50 years MWD has promised, assured and represented to the
Water Authority and the public it serves that it would provide them with sufficient water to meet
their stated needs; and
WHEREAS, in good faith reliance on MWD's past assurances, the Water Authority
expanded its territory, built public works and made its own oscarances that it would provide the San
Diegoregion with a reliable supply of water; and
WHEREAS, the City of National City has relied upon the assurances of a continuing
and reliable water supply from the Water Authority and MWD for the adoption and implementation
of a comprehensive, long-term general plan for the development of its community; and
WHEREAS, MWD was created under the Metropolitan Water District Act ("the
MWD Act"); and
WHEREAS, Section 135 of the MWD Act establishes a "preferential right" to
MWD's water supplies for each of MWD's 26 member agencies based on each agency's payment
of MWD's capital costs and operating expense; and
WHEREAS, as currently interpreted and applied by MWD, a member agency's
preferential right to water under Section 135 bears no relationship to its payment of MWD's capital
costs and operating expense or to its stated water needs; and

WHEREAS, MWD's interpretation and application of Section 135 is inconsistent
with its own promises, assurances and representations to provide water to meet the Water
Authority's stated needs; and
WHEREAS, through June 30, 2000, the Water Authority has paid MWD nearly $3
billion to pay the capital costs and operating expense of MWD water works, representing twenty-
two percent (22%) of all member agencies' total historical payments to MWD; and
WHEREAS, of this amount, only $514 million is counted by MWD in its
calculation of the Water Authority's preferential right under Section 135, resulting in an entitlement
to less than fifteen percent (15%) of MWD's water supply, and
WHEREAS, this calculation leaves the Water Authority with a preferential right to
less than one-half of the water supply it purchases, year in and year out, from MWD — a shortfall of
about 300,000 acre feet of water; and
WHEREAS, by way of contrast, through June 30, 2000, the City of Los Angeles has
paid MWD approximately $1.6 billion to pay the capital costs and operating expense of MWD
water works, representing twelve percent (12%) of all member agencies' total historical payments to
MWD; and
WHEREAS, of this amount, $792 million is counted by MWD in its calculation of
Los Angeles' preferential right under Section 135, resulting in an entitlement to more than twenty-
two (22%) of Metropolitans' water supply, and
WHEREAS, this calculation leaves the City of Los Angeles with a preferential right
to about two times as much water as its regular water purchases from MWD; and
WHEREAS, the City of Los Angeles claims that its right to purchase water from
MWD is governed by Section 135 as currently interpreted and applied by MWD, and may be
exercised at any time, in the sole discretion of Los Angeles, notwithstanding the availability to it of
alternative water supplies and irrespective of any resulting reductions in supplies delivered to the
Water Authority, and
WHEREAS, MWD's current revenue policies and programs allocate MWD's
capital costs and operating expenses as though Section 135 rights do not exist, thus leaving the
Water Authority with the obligation to pay the capital costs and operating expense of water supplies
that are subject to claims by Los Angeles; and
WHEREAS, past payments by the Water Authority to MWD pale in comparison to
the future revenues and indebtedness that are projected to meet the water supply demands of MWD
member agencies, in excess of $4 billion over the next 20 years; and

WHEREAS, the Water Authority has made numerous efforts to resolve the dispute.
over preferential rights through MWD board processes and committees, mediations and facilitations
over the years, all without sucrPss; and
WHEREAS, the Water Authority has filed an action in the San Diego Superior
Court (Case No. GIC 761526), in an effort to finally resolve the controversy and achieve certainty
as to its MWD supply reliability and cost.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
National City as follows:
1. The foregoing recitals are true and correct;
2. The City of National City hereby expresses its support of the actions taken by the
San Diego County Water Authority to seek legal clarification of preferential rights
under Section 135 of the Metropolitan Water District Act;
3. The City Clerk shall send this resolution to the Water Authority and to MWD for
due consideration.

AND A COMPREHENSIVE STATE ENERGY STRATEGY
WHEREAS, the City of National City ("City") is concerned over the increasing
impact of energy rates and availability to our residents and businesses; and
WHEREAS, the City is concerned about recent actions being taken to resolve the
energy crisis in the State of California; and
WHEREAS, the City has become increasingly concerned by the apparent inability
of the State to provide and communicate feasible short and long-term solutions to the energy
crisis facing the City of National City, the San Diego region, and the State of California; and
WHEREAS, the State, up to this point, has not provided the information to the
City necessary for us to make informed judgments regarding the proposal to purchase
transmission lines and other energy related actions by the State; and
WHEREAS, the City is increasingly concerned about the impact that the energy
crisis will have on the City of National City, the San Diego region, and the State economy,
especially given the State's propensity to balance budget shortages to our detriment which will
impact our ability to provide necessary local services and infrastructure to our constituents; and
WHEREAS, the City has a number of unanswered questions about the purchase
of the transmission lines including the cost of the system, inappropriate subsidization of the
utilities (especially if lease backs are involved), long-term costs associated with maintenance,
and other costs.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City opposes the State proposal to acquire transmission lines of Pacific Gas and
Electric, Southern California Edison, and San Diego Gas and Electric without necessary
information and a comprehensive State energy strategy.
BE IT FURTHER RESOLVED that this position be communicated to the
Governor and the State Legislature.

EXPLANATION
Sweetwater Authority would like to relocate; the:public faucet at El Toyon Park to
an area along 4th Street, just above the athletic field.
We have reviewed this location and offer the following for your consideration:
1. The site on 4th Street appears to present several problems that should be addressed
a. It is on 4th Street, a busy, and often, high-speed street.
b,: There is no parking except for street parking.
c. This site has potential to serve as a skateboard playground.
2. We recommend the faucet be relocated towards the East, adjacent to the athletic
field restrooms and parking lot on "U" Avenue. This would provide easier access,
no high-speed traffic to contend with and an off-street parking area.

The Sweetwater Authority Governing Board has directed staff to proceed with the purchase of
property, presently owned by Mr. Robert Abrigo, at Division Street and "R" Avenue. This is
shown on the attached sketch. Access to our property containing two groundwater wells and a
public faucet is from Division Street and requires crossing
Mr. Abrigo's property. Mr. Abrigo's property has experienced numerous occasions of illegal
dumping of trash. Therefore, upon dosure of escrow, the Authority proposes to fence the entire
site to prevent further illegal encroachment.
To maintain use of the public faucet, the Authority proposes to relocate it to the City's property
on Fourth Street. This is also shown on the attached sketch. The Authority will be responsible
for designing and building a new faucet at its expense. Our Engineering staff will be in contact
with your Engineering staff to discuss this in greater detail.
This action will result in not allowing public access to the faucet for approximately six months.
We request the City's support of the temporary outage.

EXPLANATION
The applicant is proposing to pave and fence vacant property in the Light
Manufacturing Residential (MLR) zone for an outdoor vehicle storage lot. A local moving company is
expected to store its vehicles on the new lot. The site will be utilized daily by trucks exiting the property
in the morning and returning in the afternoon and evening. Stored vehicles will consist of semi -trucks
(including individual trailers), bobtails, flatbeds, and box vans. Vehicular access to the property will be
from an alley to the west. A pedestrian and Fire Department emergency access gate will be located on
Harding Avenue.
The proposed vehicle storage lot will be located next to a residence and in a block where several homes
are located. Conditions of approval will require a landscaped area between the adjacent home and
storage lot, as well as chain link fencing with redwood slats around the entire lot. Vehicles will be
allowed to operate on the property only between 6:00am and 11:00pm.
In addition, the Planning Commission specified conditions prohibiting vehicle repair, storage of
inoperable vehicles, and outdoor storage of items other than vehicles at the site. At the Planning
Commission public hearing there was no public testimony except from the applicant.

WHEREAS, the Planning Commission of the City of National City considered a
Conditional Use Permit application for a vehicle storage lot on vacant property north of 1330
Harding Avenue at a duly advertised public hearing held on March 5, 2001, at which time oral
and documentary evidence was presented; and,
WHEREAS, at said public hearing the Planning Commission considered the staff report
contained in Case File No. CUP-2001-01 maintained by the City and incorporated herein by
reference along with evidence and testimony at said hearing; and,
WHEREAS, this action is taken pursuant to all applicable procedures required by State
law and City law; and,
WHEREAS, the action recited herein is found to be essential for the preservation of
public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
National City, California, that the testimony and evidence presented to the Planning Commission
at the public hearing held on March 5, 2001, support the following fmdings:
1. That the site for the proposed use is adequate in size and shape, since the four vacant
parcels are large enough to accommodate the proposed use and landscaping.
2. That the site has sufficient access to streets and highways that are adequate in width
and pavement type to carry the volume and type of traffic generated by the proposed
use, since the site is connected via an alley to Civic Center Drive, a collector street
with nearby access to north and southbound Interstate 5.
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties, since conditions of approval will limit the hours of operation and since
required landscaping and fencing will screen and buffer the use from an adjacent
home and residences across Harding Avenue.
4. That the proposed use is deemed essential and desirable to the public convenience
and welfare, since the use will provide needed vehicle storage for a nearby moving
business. In addition, the use will provide control of a vacant area that has been
plagued by dumping violations in the past.
BE IT FURTHER RESOLVED that the application for Conditional Use Permit is approved
subject to the following conditions:
1. This Conditional Use Permit authorizes an outdoor vehicle storage facility, and shall
conform with Exhibit A, Case File No. CUP-2001-01, dated January 25, 2001,
except as modified by conditions of approval.
2. To satisfy Fire Departments, a gate that opens to a minimum width of ten feet shall
be provided off Harding Avenue for emergency access. A rolling type with a Knox
Key or with a padlock is acceptable.
3. A drainage plan shall be submitted to the satisfaction of the City Engineer showing
all of the proposed and existing on -site and off -site improvements. The plan shall
be prepared by a Registered Civil Engineer, or other qualified professional, and
shall be in accordance with City requirements.
4. All surface run-off, including landscaping irrigation within the public right-of-way,
shall be collected by approved drainage facilities and directed to the street by
sidewalk underdrains or a curb outlet. Adjacent properties shall be protected from
surface run-off resulting from this development.
5. The property owner, or its successors and assigns shall be responsible for the
maintenance, repair, or reconstruction of all irrigation and landscaping
improvements installed within the public right-of-way. Sprinkler heads_shall be
adjusted so as to prevent overspray upon the public sidewalk or the street. The
proposed sprinkler heads shall be installed outside of the sidewalk, and the irrigation
mainline upon private property only, as required by the City Engineer. The property
owner or, its successor or assigns, shall remove and relocate all irrigation items from
the public right-of-way at no cost to the City, and within a reasonable time frame
upon written notification by the City Engineer.
6. For P.V.C. irrigation lines in the public right-of-way, a metallic identification tape
shall be placed between the bottom layer of the finished surface and the top of the
lines.
7. Street improvements along the property frontage shall be kept free from weed
growth.
8. All existing survey monuments, including any benchmark, within the boundaries of
the project shall be shown on the drainage or improvement plans. If disturbed, they
shall be restored by a licensed land surveyor or civil engineer after completion of the
work. A Corner Record shall be filed with the County of San Diego Recorder. A
copy of the documents filed shall be given to the National City Engineering
Department.
9. A permit shall be obtained from the Engineering Department for all improvement
work within the public right-of-way.
10. Street improvements shall be in accordance with City standards. Abandoned
driveway aprons on Harding Avenue shall be replaced with curb, gutter and
sidewalks.
11. The existing substandard lots (APNs 559-035-10,11,12,13) shall be merged into one
parcel prior to the use of the property.
12. Redwood slats shall be inserted into the chain link fence surrounding the parcels for
screening.
13. The hours of vehicle operation shall be limited to between 6am and 1 1pm, daily.
14. A 5-foot landscaped setback is required between the proposed storage lot and the
adjacent single-family home to the south. A detailed landscape and irrigation plan
including both the front and side yards shall be submitted for approval by the
Planning Department prior to development of the site. Approved landscaping shall
be installed prior to operation of the vehicle storage lot.
15. An approved business license shall be required for any business using the vehicle
storage lot.
16. Before this Conditional Use Permit shall become effective, the applicant and the
property owner both shall sign and have notarized an Acceptance Form, provided by
the Planning Department, acknowledging and accepting all conditions imposed
upon the approval of this permit. Failure to return the signed and notarized
Acceptance Form within 30 days of its receipt shall automatically terminate the
Conditional Use Permit. The applicant shall also submit evidence to the satisfaction
of the Planning Director that a Notice of Restriction on Real Property is recorded
with the County Recorder. The applicant shall pay necessary recording fees to the
County. The Notice of Restriction shall provide information that conditions
imposed by approval of Conditional Use Permit are binding on all present or future
interest holders or estate holders of the property. The Notice of Restriction shall be
approved as to form by the City Attorney and signed by the Planning Director prior
to recordation.
17. This permit shall become null and void if not exercised within one year after
adoption of the resolution of approval unless extended according to procedures
specified in Section 18.116.190 of the Municipal Code.
18. The repair of vehicles shall not be allowed on the storage lot at any time.
19. The outdoor storage of items other than vehicles shall not be allowed at any time.
20. Non -operable or wrecked vehicles shall not be stored on the site at any time.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to the
applicant and to the City Council.
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on the day
following the City Council meeting where the Planning Commission resolution is set for review, unless
an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of that City Council
meeting. The City Council may, at that meeting, appeal the decision of the Planning Commission and
set the matter for public hearing.

EXPLANATION
This project involves construction of a 2,800 square foot, one-story auto body repair building on a property in
the Commercial Automotive (CA) zone. There are three existing buildings on the property on the north half
of the lot. The buildings are primarily used for auto body repair, with a deli in the northmost building along
24th Street. The south portion of the lot where the building is proposed has recently been paved and is used for
new vehicle storage.
The new structure will be constructed with split -face block to match the adjacent building, and will have
roll -up doors, two facing south to 25th Street, and two others facing west to the alley. Conditions of
approval will require the building to have a full, red tile mansard roof to match the other buildings on the
property. The new building will not contain any spray paint booths, and work will take place inside the
building. The applicant has proposed hours of operation between 7:00 a.m. and 7:00 p.m.
There are residential uses located to the east across A Avenue and to the south across 25th Street. One letter
of opposition received from a neighboring property owner expressed concern regarding fumes, paint residue,
vulgar language, and parking availability at the adjacent, existing body shops. The Planning Commission
discussed these issues with the applicant and was advised that they were being addressed.

. WHEREAS, the action recited herein is found to be essential for the preservation of
public health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
National City, California, that the testimony and evidence presented to the Planning Commission
at the public hearing held on March 19, 2001, support the following findings:
1. That the site for the proposed use is adequate in size and shape, since the property is
large enough to accommodate the proposed use and the necessary parking.
2. That the site has sufficient access to streets and highways that are adequate in width
and pavement type to carry the volume and type of traffic generated by the proposed
use, since the property is served by 25th Avenue and is in close proximity to
National City Boulevard, an arterial street.
3. That the proposed use will not have an adverse effect upon adjacent or abutting
properties, since the proposed automotive use complies with the Commercial
Automotive zoning and General Plan designation for the property and since the bay
doors for the use will not face the adjacent residential zone.
4. That the proposed use is deemed essential and desirable to the public convenience
and welfare, since the use will support an existing automotive dealership in the
Commercial Automotive zone designated for such use.
BE IT FURTHER RESOLVED that the application for Planned Development Permit is
approved subject to the following conditions:
1. This Planned Development Permit authorizes an auto body shop. Except as
required by conditions of approval, all plans submitted for permits associated with
the project shall conform with Exhibit A -Revised, Case File no. PD-2000-11, dated
1/24/2001.
2. Plans submitted with any application for . a building permit must comply with the
1998 California Building, Plumbing, Electrical, and Mechanical Codes and the
California Title 24 handicapped and energy regulations.
3. All surface runoff, including roof drainage, shall be collected by approved drainage
facilities and directed to the street by sidewalk underdrains or a curb outlet.
4. A sewer permit will be required. The method of sewage collection and disposal
shall be shown on the plan. Any new sewer lateral in the City right-of-way shall be
6-inch in size with a cleanout. A sewer stamp "S" shall be provided on the curb to
mark the location of the lateral.
5. The driveway apron on 25th Street shall be removed and replaced as required by the
City Engineer.
6. Street improvements shall be in accordance with City standards. All missing street
improvements shall be constructed (13' x 110' alley and alley apron), and a separate
street improvement plan shall be submitted.
7. Fire Department access shall be maintained at all times.
8. A trash enclosure shall be provided in accordance with City standards. It shall have
an exterior to match the building.
9. An accurate landscape plan, including plant types, methods of planting, etc. shall be
submitted for review and approval by the Planning Director. The landscape plan
shall reflect the use of drought tolerant planting and water conserving irrigation
devices.
10. Hours of operation shall be limited to 7:00 a.m. to 7:00 p.m.
11. A full roof treatment shall be provided to the satisfaction of the Planning
Department in accordance with City Design Guidelines.
12. The existing blank parapet wall at the rear of the proposed building shall be
modified to include a mansard to match the east and west sides of the two-story
building.
13. Four Code -required parking spaces and the access driveway to serve the auto body
shop shall be clearly designated on the plans submitted for Building Permits.
14. Exterior walls of buildings and trash enclosures to a height of not less than 6 feet
shall be treated with "Graffiti Melt Coating" manufactured by Genesis Coatings,
Inc. A similar product may be used, subject to approval from the Building and
Safety Director. Graffiti shall be removed within 24 hours of its observance.
15. Before this Planned Development Permit shall become effective, the applicant and
the property owner both shall sign and have notarized an Acceptance Form,
provided by the Planning Department, acknowledging and accepting all conditions
imposed upon the approval of this permit. Failure to return the signed and notarized
Acceptance Form within 30 days of its receipt shall automatically terminate the
Planned Development Permit. The applicant shall also submit evidence to the
satisfaction of the Planning Director that a Notice of Restriction on Real Property is
recorded with the County Recorder. The applicant shall pay necessary recording
fees to the County. The Notice of Restriction shall provide information that
conditions imposed by approval of the Planned Development Permit are binding on
all present or future interest holders or estate holders of the property. The Notice of
Restriction shall be approved as to form by the City Attorney and signed by the
Planning Director prior to recordation.
16. This permit shall become null and void if not exercised within one year after
adoption of the resolution of approval unless extended according to procedures
specified in Section 18.116.190 of the Municipal Code.
BE IT FURTHER RESOLVED that copies of this Resolution be transmitted forthwith to
the applicant and to the City Council.
BE IT FINALLY RESOLVED that this Resolution shall become effective and final on
the day following the City Council meeting where the Planning Commission resolution is set for
review, unless an appeal in writing is filed with the City Clerk prior to 5:00 p.m. on the day of
that City Council meeting. The City Council may, at that meeting, appeal the decision of the
Planning Commission and set the matter for public hearing.

EXPLANATION
This is a request from the Sweetwater Town & Country Merchants Association to conduct an Easter
Egg Hunt from 11:00 a.m. to 4:00 p.m. on April 14, 2001. The event will be held on the shopping
center parking lot.
The Easter egg hunt will begin at 11:30 a.m. and will last until 1:00 p.m. The Easter eggs will be
hidden in the grass of the parking lot. The free event will also consist of clowns doing face painting,
balloons, painting Easter hats, llama rides and a Easter hat contest where the children can win prizes.
No food or beverages will be served or sold. There will also be Arts & Crafts vendors.
The Association will setup 4 tables for the prizes. They are also requesting permission to hang 4
banners at the entrance to the shopping center.

The above -named corporation is a Non -Profit Mutual Benefit Corpora-
tion, registered and licensed by the Secretary of State, State of
California on July 8, 1987, with National City as its base.
The specific business and purpose of this corporation is to organ-
ize, operate, and maintain a Seniors Fellowship activities in
National City for entertainment, recreation, instruction and to
provide social andcivic opportunities for Seniors 50 and plus, and
because of financial limitations are unable to enjoy such opportuni-
ties for Seniors in the community or general area in which they live;
to promote fellowship and extend acquaintances by means of social
interaction among its members and other participants by means of
ballroom dancing, dinners, musicals and many other kindred forms of
entertainment; and to promote the cultural, social, literary and
general welfare of the members and participants.
In this connection, we are conducting a DINNER -DANCE on Saturday,
April 21, 2001, from 11:45 to 5:00 PM. The next event is also planned
for July 14, 2001, Saturday, same time, of which a n advance reserv-
ation is also requested.
May I therefore request permission to avail of the Community Build-
ing on the dates specified.
