Proposed Resolution Resolution No. 2001-90 A-200 (Rev. 9/80) COUNCIL AGENDA STATEMENT RESOLUTION FOR APPROPRIATION/EXPENDITURE OF C.L.E.E.P. FUNDS The Police Department recommends the purchase of ergonomically engineered Dispatch Work Stations from Omni Pacific. The proposed Resolution would authorize the waiver of the bid process and purchase of ergonomic engineered workstations and to upgrade file servers for the Police Dispatch Center. Purchasing ordinance #1480, section 12a4, authorizes the bidding requirements to be waived "when Council determines that due to special circumstances, it is to the City's best interest to purchase a commodity or enter into a contract without strict compliance to the bidding procedure. The following special circumstances exist: 1. Omni -Pacific, through their subcontractor Parron Hall, has offered this equipment at a competitive price and no significant price advantage would be gained by competitive bidding. 2. The equipment is being offered through Omni -Pacific with full maintenance and support. 3. Parron Hall has been sub -contracted to coordinate the dismantling and disposal of the old existing dispatch center consoles. Lack of Significant Price Advantage from Competitive Bidding The largest single item cost for using the C.L.E.E.P. funds is the purchase and installation of ergonomic engineered workstations from Omni Pacific. These workstations are electrically controlled and the operator can fit the workstations to their physical dimensions. The sole purpose of the special workstations is to decrease the number and severity of repetitive stress and carpal tunnel syndrome injuries. With the increased flexibility these workstations afford, dispatchers can change the height and location of the various components so they lessen the possibility of strain or injury. The Police Department received three bids for the work on the ergonomic workstations. Parron Hall submitted the lowest bid for the work, which included the dismantling and disposal of the old work stations. The other vendors would subcontract that work to another vendor. The bid from Parron Hall to complete the work was $31,617.63, which was $1,788.00 less than the other vendor. Parron Hall has completed similar work for other law enforcement agencies in the county, only installing a different style of workstation. Parron Hall is a local company that offers full maintenance and support for the products they offer. The Police Department has purchased equipment from Parron Hall in the past. 4 RESOLUTION NO. 2001— 90 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DISPENSING WITH THE BIDDING PROCESS AND AUTHORIZING ACCEPTANCE OF A PROPOSAL FROM OMNI-PACIFIC FOR ERGONOMICALLY ENGINEERED DISPATCH WORK STATIONS WHEREAS, on May 22, 2001, the City Council authorized the appropriation and expenditure by the National City Police Department of the California Law Enforcement Equipment Program (C.L.E.E.P.) funds to purchase equipment and upgrade existing systems, via Resolution No. 2001-79, and WHEREAS, the Police Department is in need of ergonomically engineered dispatch work stations; and WHEREAS, the City Council has determined to waive the formal bidding requirements as authorized in Section 2.60.220(d) of the National City Municipal Code, and award a contract to Omni Pacific for ergonomically engineered dispatch work stations based on the following special circumstances: 1. Omni -Pacific, through their subcontractor Parron Hall, has offered this equipment at a competitive price and no significant price advantage would be gained by competitive bidding; 2. The product is being offered through Omni -Pacific with full maintenance and support; 3. Parron Hall has been subcontracted to coordinate the dismantling and disposal of the old existing dispatch center consoles. NOW, THEREFORE, BE IT RESOLVED that the City Council finds special circumstances to exist, and that it is in the City's best interest to purchase from Omni -Pacific, and does hereby dispense with the bidding process, and authorizes acceptance of a proposal from Omni -Pacific for ergonomically engineered dispatch work stations. The decision was made in order to avoid a $300,000 budget shortfall for the coming year. Although the shortfall affects the entire library system, the South County branch is the only branch being targeted for closure. The South County is the second -fasted growing region in the San Diego County and provides access to codes, statutes, court forms, practice guide and other materials to help individuals handle simple legal matters and is essential in referring patrons to materials that can assist them. Neither the downtown library nor the Internet can replace these services. This closure is opposed by the South Bay Bar Association as well as the minority and ethnic bar association in San Diego County including La Raza Lawyers Association, Earl B. Gilliam Bar Association, Pilipino-American Lawyers of San Diego, and the Native American Lawyers Association. Change Order Number one was written to add additional work for the emergency reconnection of two sewer laterals located at 801 Civic Center Drive that were interrupted during the installation of the Navy sewer main. The installation of the Navy line took place in the distant past. It appears that these two properties have not been connected to the City's sewer since the Navy's work. The contract price due to change order number one has been increased in the amount of $11,622.44 from the current contract price of $13.675.00 to a new contract price of $25,297.44. The original amount allocated to perform the JJ Auto Repair Project was $16,400.00. This amount has been exceeded due to the emergency repair work needed at 801 Civic Center Drive (Contract Change Order No. 1). MJC Construction was already mobilized and performing similar type of work under contract with National City. Exhibit "B" Resolution No. 2001 - 95 PARADISE CREEK ENHANCEMENT PLAN RESOURCE ENHANCEMENT ELEMENTS MITIGATION AND MONITORING PROGRAM The Mitigation and Monitoring Program for the Paradise Creek Enhancement Plan to be carried out by the City of National City consists of the following features designed to reduce or mitigate significant impacts of the proposed resource enhancement project elements. 1) POTENTIAL SIGNIFICANT IMPACT Biological and Water Resources — Construction Impacts: A. Prior to project commencement, the City of National City will contact the California Department of Fish and Game and consult with the Department on appropriate actions (including handling and interim storage) for salvaging for reuse on the site the vegetation and soils of the .07 acres of salt marsh that will be impacted as a result of construction activities. B. The City of National City will limit grading of the proposed wetland/enhancement areas to the dry season (June and July). All areas to be graded will be marked (stakes, flagging, or gypsum) by a Restoration Specialist. A grading plan will be created to ensure the proper soils and hydrology and to protect water quality. • C. To mitigate disturbance of existing wetlands, the City of National City will create new wetlands on site at a ration of 8.5:1. D. The City of National City shall ensure that soils in areas affected by demolition, grading, or temporary access within the wetland habitat will be decompacted and left in a plantable state. E. The City of National City shall ensure that all recontouring within the wetland will be performed in a manner to maintain established tidal flows. 2) POTENTIAL SIGNIFICANT IMPACT Biological Resources — Streambed Alteration: Prior to the commencement of any activity that will divert, obstruct, or change the natural flow or the bed, channel,or bank (which may include associated riparian resources) of Paradise Creek, or use material from the streambed, the California Department of Fish and Game shall be provided a Streambed Alteration Agreement pursuant to Section 1600 et. seq. of the Fish and Game Code. The document will fully identify impacts to Paradise Creek and associated resources and identify adequate avoidance, mitigation, monitoring and reporting commitments. The primary goal of this project is to increase the comfort of visitors to City Hall and employees of City Hall in spite of the "energy savings" measures that are being implemented to the HVAC system, specifically changing the heating and cooling set points. The budget amount being recommended for this project will allow us to replace approximately half of the Civic Center windows. That Chapter 10.31 is repealed. Section 2. It is the purpose and intent of the City Council to enact regulations governing the consumption, use or possession of alcoholic beverages and open containers in those areas that are not expressly regulated by the Business and Professions Code or Vehicle Code, and which are thereby permissible for local regulation. The City Council finds and determines that such local regulation is both reasonable and necessary in order to protect the public health, safety, and welfare in those venues that impact the local citizenry. 10.30.020 Definitions. Within this Chapter 10.30, the following definitions shall apply: A. "Alcoholic beverages", as defined by Business and Professions Code Section 23004, means and includes alcohol, spirits, liquor, wine, beer, and every liquid or solid containing alcohol,. spirits, wine or beer, and which contains one-half of one percent or more of alcohol by volume, and which is fit for beverage purposes either alone or when diluted, mixed or combined with other substances. B. "Open alcoholic beverage container" shall mean and include any can, bottle or other receptacle containing an alcoholic beverage, which has been opened, or the seal of which has been broken or removed, or the contents of which have been partially removed. C. "Iiighway" is as defined by Vehicle Code Section 360, and means a way or place of whatever nature, publicly maintained and open to the use of the public for purposes of vehicular travel. A "highway" includes a street. 10.30.030 Consumption or possession of open alcoholic beverage container —Prohibited in parks and adjacent public places. A. It is unlawful for any person in any city park or in any adjacent city -owned public place to consume any alcoholic beverage or to possess an open alcoholic beverage container. B. The City Manager shall cause signs to be posted at each pedestrian and vehicle entrance of a City park advising of this prohibition. Installation of signage shall not be a prerequisite to enforcement or prosecution. 10.30.040 Exception —City buildings within city parks. Notwithstanding the provisions of Section 10.30,030, the City Council may allow the sale or use of alcoholic beverages in a city -owned building located within a public park in conjunction with an application for a temporary use permit pursuant to chapter 15.60. 10.30.050 Consumption or possession generally —Unlawful.. It is unlawful for any person upon any public street, sidewalk, alley, plaza, public parking lot, private parking lot open to the public or any undeveloped area within the city limits to consume any alcoholic beverage or (""— to possess an open alcoholic beverage container without a permit duly issued by the City Manager. 10.30.060 Consumption or possession in vehicles —Unlawful. A. It is unlawful for any person inside any vehicle not on a highway within the city limits to consume any alcoholic beverage or to possess an open alcoholic beverage container. B. Subsection A shall not apply to an open alcoholic beverage container that is securely locked within a car trunk or locked exterior compartment of any other vehicle. C. The provisions of this Section 10.30.060 are intended to apply only on private property with public access; public parking lots; private parking lots open to the public; or on undeveloped areas within the City limits. 10.30.070 Required signage at' licensed premises. A. The owner, operator or proprietor of any premises licensed by the Alcoholic Beverage Commission for the on -premises or off -premises sale of alcoholic beverages shall post signs in compliance with the requirements and specifications of Section 10.30.070B on each exterior wall of the licensed premises that faces a vehicle parking lot, to read as follows: WARNING It is unlawful to drink an alcoholic beverage or to possess an open alcoholic beverage container in public or in a public parking lot. NCMC 10.30.050 and 10.30.060. 2001 Ordinance 2 Title 10 Alcoholic Beverages B. The sign required by Section 10.30.070A shall be a minimum of 18" in width and 24" in height, with black lettering at least 1" in height against a white background.( One sign shall be posted for each 50-foot portion of each facing wall. The bottom of the sign shape at least 5 feet above the surface of the parking area. The Chief of Police may allow a variance from the height and separation requirements when necessary due to site conditions. C. The sign required by Section 10.30.070B is exempt from the sign regulations of Title 18 of the National City Municipal Code. D. Any ABC licensee who posts a sign under the provisions of Business and Professions Code Section 25612.5(C) shall be exempt from the provisions of Section 10.30.070A. 10.30.080 Violation —Penalty. Violation of sections 10.30.030, 10.30.050 or 10.30.060 is a misdemeanor. Violation of any other mandatory provision of this Chapter 10.30 is an infraction for a first violation, or for a second violation occurring within thirty (30) days of the first violation; otherwise, a second or subsequent violation shall be charged as a misdemeanor. It is appropriate to respond to the speakers when considering adoption of the ordinance. Three speakers voiced their opinion on the matter. Two of the persons who spoke (Mr. Jordan Kitrownik representing Land Grant Development Company and Mr. Robert Shapiro) did not oppose the amendment but asked that consideration be given to their proposal to redevelop the entire site with a Gigante Supermarket as the anchor. The third speaker, Mr. Ray Johnson, representing three unnamed city residents, stated that the proposed Negative Declaration was not sufficient because it did not reflect the proposed project. In response, the CDC Board will be given the opportunity at their Regular Meeting of June 19, 2001 to consider the amount of time, if any, for the Shapiro/Land Grant proposal to be prepared and submitted. This action is not related to the amendment of the Redevelopment Plan. Regardless of whether the CDC determines to support the proposed of K-Mart or the Shapiro/Land Grant Group, it may be necessary to use eminent dQmaain as authorized by the Redevelopment Plan Amendment to redevelop the site. Mr. Johnson's suggestion that the Negative Declaration prepared for the Ordinance was not adequate is incorrect. As stated above, the ordinance change does not relate to any land use proposal; rather it supports the amendment to the Redevelopment Plan, which authorized the use of eminent domain. Traffic, air and noise and related issues will be the subject of evaluation once a plan is submitted for review. It is important to understand that the amendment to the Redevelopment Plan does not relate to any specific land use. Also included with this report is a comment letter from Hassaim Y. Salloum of the Department of Toxic Substances Control concerning the Negative Declaration for the National City Redevelopment Plan Amendment and a response from the CDC. The Negative Declaration as approved by the CDC/City Council for the Redevelopment Plan Amendment Plan amendment is sufficient and legally supported by the California Environmental Quality Act (CEQA) and consistent with the Health & Safety Code relating to Redevelopment Plan Amendment. ORDINANCE NO. 2001 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING THE REDEVELOPMENT PLAN FOR THE NATIONAL CITY REDEVELOPMENT PROJECT THROUGH THE ADOPTION OF THE 2001 AMENDMENT TO THE REDEVELOPMENT PLAN WHEREAS, the City Council of the City of National City ("City Council") has adopted and subsequently amended the Redevelopment Plan for the National City Redevelopment Project ("Redevelopment Plan"), on November 18, 1969 by Ordinance No. 1233, on June 24, 1975 by Ordinance No. 1471, on April 13, 1976 by Ordinance No. 1505, and on December 13, 1977 by Ordinance No. 1610, and subsequently amended on December 1, 1981 by Ordinance No. 1762, on May 22, 1984 by Ordinance No. 1821, on April 16, 1985 by Ordinance No. 1851, on June 18, 1991 by Ordinance No. 91-2013, and on June 18, 1995 by Ordinance No. 95-2095, incorporated herein by reference, and has designated the Redevelopment Plan as the official redevelopment plan for the National City Redevelopment Project ("Project"); and WHEREAS, the Community Development Commission of the City of National City ("CDC") has requested that the City Council consider the 2001 Amendment to the Redevelopment Plan ("2001 Amendment") in order to provide the authority to acquire by eminent domain four additional parcels within the National City Redevelopment Project Area ("Project Area"), namely, Assessor's Parcel Numbers 556-560-41, 556-560-42, 556-560-43 and 556-560-44; and WHEREAS, the CDC has previously certified an Environmental Impact Report prepared in connection with the Redevelopment Plan; and WHEREAS, the Planning Commission of the City of National City ("Planning Commission") has reviewed the 2001 Amendment, has determined that it is consistent with the General Plan of the City of National City, and has recommended in favor of the approval of the 2001 Amendment; and WHEREAS, pursuant to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.), the Guidelines for Implementation of the California Environmental Quality Act (14 Cal. Code Regs. Section . 15000 et seq., and the local procedures adopted by the CDC pursuant thereto, the CDC has prepared and completed a proposed Negative Declaration for the 2001 Amendment; and WHEREAS, pursuant to Section 33452 of the Community Redevelopment Law ("the Law"), public notice has been duly given, and a full and fair public hearing has been held on the proposed 2001 Amendment. Ordinance No. 2001 - Page Two NOW, THEREFORE, the City Council of the City of National City does hereby ordain as follows: Section 1. The 2001 Amendment to the National City Redevelopment Plan, a copy of which is attached hereto as Exhibit No. 1 and incorporated herein by this reference, is hereby adopted and approved. Section 2. Based upon the evidence contained in the Report to the City Council for the 2001 Amendment to the National City Redevelopment Plan, incorporated herein by reference, the City Council does hereby find, determine, and declare as follows: (a) The Project Area is a blighted area, the redevelopment of which is necessary to effectuate the public purposes as set forth in the Law. (b) The Redevelopment Plan would redevelop the Project Area in conformity with the Law and in the interests of the public peace, health, safety, and welfare. (c) The adoption and carrying out of the Redevelopment Plan is economically sound and feasible. (d) The Planning Commission and the City Council have determined that the 2001 Amendment is consistent with the City of National City's ("City") General Plan, including, but not limited to the Housing Element of the General Plan, which substantially complies with the requirements of Article 10.6 (commencing with Section 65580) of Chapter 3 of Division 1 of Title 7 of the Government Code. (e) The carrying out of the Redevelopment Plan would promote the public peace, health, safety, and welfare of the community and would effectuate the purposes and policy of the Law. (f) The condemnation of real property is necessary to the execution of the Redevelopment Plan and adequate provisions have been made for payment for property to be acquired as provided by law. (g) The CDC has a feasible method for the relocation of families and persons displaced from the Project Area, to the extent that implementation of the Redevelopment Plan may result in the temporary or permanent displacement of any occupants of Project Area housing facilities. Ordinance No. 2001 - Page Three (h) There are, or shall be provided, in the Project Area or in other areas not generally less desirable in regard to public utilities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe, and sanitary dwellings equal in number to the number of and available to the displaced families and persons and reasonably accessible to their places of employment. Families and persons shall not be displaced prior to the adoption of a relocation plan pursuant to Sections 33411 and 33411.1 of the Law. Dwelling units housing persons and families of low or moderate income shall not be removed or destroyed prior to the adoption of a replacement housing plan pursuant to Sections 33334.5, 33413, and 33413.5 of the Law. (j) Inclusion of any lands, buildings, or improvements which are not detrimental to the public health, safety, or welfare is necessary for the effective redevelopment of the area of which they are a part; that any area included is necessary for effective redevelopment and is not included for the purpose of obtaining the allocation of tax increment revenues from the area pursuant to Section 33670 of the Law without other substanfig justification for its inclusion. (i) (k) The elimination of blight and the redevelopment of the project area could not be reasonably expected to be accomplished by private enterprise acting alone without the aid and association of the CDC. (1) The project area is predominantly urbanized, as defined by subdivision (b) of Section 33320.1 of the Law. (m)The time limitation and, if applicable, the limitation on the number of dollars to be allocated to the agency that are contained in the plan are reasonably related to the proposed projects to be implemented in the project area and to the ability of the agency to eliminate blight within the project area. (n) Though the 2001 Amendment does not propose displacement of permanent housing facilities, the City Council is satisfied that permanent housing facilities would be available within three years from the time occupants of the Project Area are displaced and that, pending the development of the facilities, there will be available to the displaced occupants adequate temporary housing facilities at rents comparable to those in the City at the time of their displacement. A full and fair public hearing having been held on the 2001 Amendment, and . the City Council having considered all evidence and testimony for and against the adoption of the 2001 Amendment and all written and oral objections thereto, and the City Council being fully advised in the premises, all written and oral objections to the 2001 Amendment to the extent not otherwise addressed in the Redevelopment Plan or not otherwise responded to are hereby overruled, and the 2001 Amendment is hereby approved as an amendment to the official redevelopment plan of the Project Area. The Commission received a letter from the State of California Environmental Protection Agency Department of Toxic Substance Control (DTSC). A copy of the letter from DTSC is included as an attachment. The Commission is not required by the California Environmental Quality Act (CEQA) to respond to comment letters to a Negative Declaration. However, in an effort to provide as much information on the project as possible, the Commission has provided a written response to the DTSC letter. The DTSC letter provided ten comments requesting information for the identification of hazardous wastes, either on the site or in the immediate project vicinity, that could impact the project. The DTSC letter also suggested the types of contaminants the investigation should address, including lead paints, asbestos containing materials, etc. The DTSC letter also referred to the environmental document prepared for the project as a Draft EIR. Ms. Rania Zabaneh of DTSC was contacted by telephone on May 31, 2001 to clarify DTSC's comments. To summarize the comments raised by DTSC, the establishment of the authority to use eminent domain proposed by the Commission would not directly result in any development. Therefore, the need to conduct a hazardous waste site assessment in conjunction with the current proposal is premature and unnecessary. Proper site assessment and hazardous waste studies addressing DTSC comments would be appropriate with a development proposal for the property in the future. The Commission acknowledges the comments by DTSC. The issues listed in their letter would be addressed by the City in the future in conjunction with the processing of a development proposal for the property. Mechanical equipment, pool surfaces, and locker room areas havedeteriorated and need rehabilitation. The pool, open eight months of the year, serves a multitude of community residents. The average attendance during the summer months is 250-300; over 900 swimmers attend learn to swim classes. The schools utilize the pool for their aquatic teams. It is a community -wide asset. . With that in mind, last year the City Council authorized the development of a Master Plan for the renovation of the municipal pool at Las Palmas Park. The job of developing this plan was awarded to Jones & Madhavan Architecture Rngineering. A number of meetings were held with the architect and city staff. The attached report provides detailed information including background, Health Code Analysis, Building Code Analysis, Facility Enhancement Opportunities, Construction Costs Estimates, and Recommendations. The recommended renovations total approximately 2 million dollars. These renovations are broken down into four phases: Phase I - $925,000: - Includes new heaters, new pump, new deck, replastering the pool, and replacing the Wading Pool with a Play Feature Pool. Phase II - $200,000: Includes adding a water slide with splashdown pool. Recycled Paper Phase III - $780,000: Includes renovating the locker room areas and parking lot lighting. Phase IV - $60,000: Adding an entry kiosk at the East end. POSSIBLE FINANCING: Last year, the 2000 Park Bond Act was passed which entitles tie City to funding based on a Per Capita allocation. We were just notified that the City will qualify for $663,305. Staff is recommending that these funds be applied to the Renovation of the Pool Project. Although this is nowhere near the total amount necessary to do a 100% complete job, it can be used to begin the badly needed renovation. We will continue to look for additional fiinding fros'n other sources, including other competitive parts of the 2000 Bond Act.
