DESCRIPTION OF THE PROPOSED PROJECT A. Proposed Transaction The proposed development site (Site) is bounded by 8th Street, National City Boulevard, Roosevelt Street, and Plaza Boulevard, and is bisected by 9th Street. Per the DDA, the Commission shall cause the vacation of 9°i Street, and the parcelization of the Site into three or more legal parcels to create a large, relatively flat, and rectangular site of approximately 3.4 acres. The Developer intends to purchase the Site and develop an educational facility of approximately 58,000 square feet (SF), plus about 8,000 SF of retaiVcommercial space, plus a parking structure containing an estimated 453 spaces, with an additional 80 surface spaces. The Project is projected to attract up to 5,200 college students, plus faculty and staff. In addition, the facility will provide professional staff training to numerous Countywide professionals. B. Commission Responsibilities Infrastructure and Parking Account • The Commission shall establish an account (Account) for the purpose of holding infrastructure and parking funds. • The Commission shall deposit $4,500,000 into the Account prior to the start of construction for Phase I. This amount is comprised of a parking contribution of $2,500,000, and the Developer's purchase price of $2,000,000. • Funds deposited into the Account shall be disbursed in the following priority: • First, to reimburse the Commission for all costs related to the design, engineering, and construction of the Commission Improvements and the Infrastructure Improvements, but not the mass grading and the remedial work undertaken by the Commission (see discussion below). The cost of these improvements is estimated to total $2,000,000. • Secondly, the remaining amount, estimated at $2,500,000, will be used to reimburse the Developer for a portion of the costs related to the construction of the parking improvements. Page 2 Commission Improvements and Remedial Work • Prior to dosing, the Commission shall have completed and paid for the construction of the Commission Improvements identified as follows: • Vacation of Ninth Street, which currently bisects the Site; • Termination or relocation of utility easements in or adjacent to Ninth Street; • Removal of any existing above -ground, and as necessary, below -ground improvements on the Site; and • Mass grading of the Site in accordance with the Mass Grading Plan to be prepared at the Developer's expense. > In addition, prior to dosing the Commission shall have caused the Site to be subdivided at its sole cost and expense into three (3) or more legal parcels. The parcels are intended to accommodate the proposed phases of the Developer Improvements. > Prior to dosing, the Commission shall have completed the Remedial Work in accordance with the approved Master Work Plan. Commission Infrastructure Improvements • Following the dosing date, the Commission shall construct at its sole cost and expense, the following Infrastructure Improvements: • The design and construction of traffic lanes, and street and signal improvements for intersections immediately adjacent to the Site, that are directly affected by the Developer Improvements; • The construction of on -site sidewalks, landscaping, lighting, and street furniture along National City Boulevard between Plaza and 8th Street, Roosevelt between 8th and Plaza, and along Plaza and 8th Street between Roosevelt and National City Boulevard; and • Installation of underground utilities with lateral lines stubbed to locations at the boundaries of the Site. Developer Responsibilities • The Developer shall construct, or cause to be constructed, at its sole cost and expense, Phase I, Phase II, and Phases III/IV of the Developer Improvements, defined as follows: ■ Phase I shall consist of the following: ➢ Construction of an approximately 41,000-SF building for educational/ administrative uses, inclusive of approximately 8,000 SF of ground floor retail/commercial space; ➢ The development of an approximately 19,000-SF landscaped pad on the corner of 8th Street and National City Boulevard, including sidewalks and streetscape improvements. ➢ Construction of a multi -level parking structure containing 453 spaces, and surface parking containing approximately 80 spaces. In total, an estimated 533 parking spaces will be provided. • Phase II will consist of a two-story, 22,500-SF building, and will be located on the aforementioned 19,000-SF pad at the corner of National City Boulevard and 8th Street. The building will be used for retail and educational purposes. • Phases IIl/IV may consist of a combination of educational, retail, and multi -family residential uses, compatible with, and designed to support, the educational activities and expansion of the existing educational facility. • In the event the Developer fails to perform, the Commission has the option to reacquire the Site. If the Commission chooses to exercise this right, the Commission will pay the Developer a reacquisition amount determined as follows: the sum of (1) $13.10 per SF of the parcel(s) being reacquired; plus (2) interest on the foregoing amount at the rate payable by Developer; plus (3) the documented costs of any Developer improvements on the property to be reacquired (excluding costs paid by the Commission or funded from the Account); minus (4) the amount of unpaid principal and interest on any mortgages on the parcel(s) being reacquired. • For a period of 20 years, the Developer will devote at least 51% of the floor space developed on the Site to educational purposes, and up to 49% of the floor space may be used for retail purposes designed to support those educational purposes. ESTIMATED VALUE OF THE SITE AT THE HIGHEST AND BEST USE This section presents an analysis of the fair market value of the Site at the highest and best use of the property. In appraisal terminology, the highest and best use is that use of the property, which generates the highest property value and is physically possible, financially feasible, and legally permitted. Therefore, value at highest and best use is based solely on the value created and not on whether or not that use carries out the redevelopment goals of the City of National City. In considering the highest and best use of the Site, KMA has assumed the property's current land use and zoning designations. The majority of the Site is currently zoned CG (General Commercial), while a minor portion carries a MLR (Light Manufacturing/ Residential) zoning designation. These classifications allow for the development of a broad range of commercial, industrial, and residential land uses. In determining the highest and best use of the Site, the following key factors should be considered: • As an in -fill site, the Site is large, relatively flat, and rectangular in configuration; • This Site is bounded by a variety of existing commercial and residential uses; • The Site is located at the crossroads of two major arterials; and • The Site lacks direct freeway exposure, but benefits from its close proximity to the freeway. The upper floors will be visible from the freeway and will enjoy views to the Bay and Strand. Based on these considerations, KMA concludes that the highest and best use of the subject Site is retail development. KMA has reviewed comparable commercial land sales in the South Bay area, and generally finds these transactions to range in value from $10 to $15 per SF. Given the Site's size and location, KMA estimates that the fair market value of the Site at its highest and best use is approximately $15 per SF, or $2,156,000. ESTIMATED FAIR RE -USE VALUE OF THE INTEREST TO BE CONVEYED This section presents an analysis of the fair re -use value of the interest to be conveyed to the Developer subject to conditions, covenants, and restrictions contained in the proposed DDA. In estimating the fair re -use value of the parcel, KMA has reviewed the requirements that set specific conditions with respect to scope of development, the schedule of performance, and method of financing. A review of comparable transactions involving educational institutions over the past two years suggests that they are of minimal relevance in establishing fair re -use value for the subject Site. Extensive adjustments to the comparables would be required to establish comparability. Therefore, reliance has been placed on the income, or the residual land value approach, which is a recognized method for valuing real property. Analysis of the development economics of the Site, reported separately to the Commission by KMA, indicates that pursuant to the terms and conditions under which the Commission will convey the Site, the fair re -use value of the Site is negative $500,000. PURCHASE PRICE WHICH THE DEVELOPER WILL BE REQUIRED TO PAY Under California Community Redevelopment Law, the Commission is obligated to publicly disclose information sufficient for a comparison of the purchase price contained in the proposed DDA with the estimated fair re -use value. In order to facilitate such a comparison, KMA has separately evaluated the financial terms contained in the proposed DDA. The Commission will convey the Site to the Developer for $2,000,000. The Commission will provide $2,500,000 in financial assistance to the Project. The Commission is entitled to participate in a pro rata portion of capital proceeds received from a lease transaction with SDSU. At this time, the Commission cannot determine when, or if, SDSU will participate in the proposed development, or any terms of such participation. Therefore, KMA conservatively estimates zero revenues to the Commission from this provision at this time. In total, then, KMA estimates that the effective compensation to the Commission is negative $500,000. EXPLANATION WHY SALE OF THE PROPERTY WILL ASSIST IN ELIMINATION OF BLIGHT The Project Area is characterized by an array of blighting factors, including: • The age, obsolescence, deterioration, mixed character, or shifting uses of existing buildings within the Project Area. • The subdividing and sale of lots of irregular form and shape, and inadequate size for proper usefulness and development. • A prevalence of depreciated values, impaired investments, and social and economic maladjustment. • The defective design in character or physical condition of existing buildings. Not all of these conditions are present throughout the Project Area. The Commission's redevelopment efforts have successfully alleviated blighting conditions in some portions of the Project Area. However, many of these conditions are still apparent in the area surrounding the subject Site. Implementation of the proposed development can be expected to assist in the alleviation of blighting conditions through the following: • Elimination of conditions of economic dislocation such as incompatible land uses and fragmented ownership parcels. • Consolidation of irregular parcels into a site appropriate for development. • Expansion, renovation, and relocation of businesses within the Project Area. Page 8 Summary Report Section 33679 of the Health and Safety Code Pursuant to Proposed DDA Between the CDC and Southwestern Community College District March 19, 2002 (a) Estimated amount of taxes to be used to pay for land and construction of any publicly owned building, including interest payments. hi the related Summary Report for Section 33433, KMA, Inc. estimates total costs incurred by the CDC to acquire the Site and provide parking and infrastructure improvements at $10,867,801. SCCD will pay the CDC $2,000,000 as purchase price for the Site leaving a balance of $8,867,801 as the estimated amount of taxes being used by the CDC to pay for land and construction of certain publicly owned improvements. (b) Facts supporting the determinations required to be made by the legislative body pursuant to Section 33445. Determination #1: The buildings, facilities, structures, and other improvements are of benefit to the National City Redevelopment Project (NCRP) Area, where the project will be located, for the following reasons: • Removal of blighted buildings and property including adult theater, pawnshop, gasoline station, and several automotive uses. • Benefit of a $20 million real estate investment into blighted downtown district including high quality architecture and urban design. • The economic spin-off of creating a higher education facility that will attract a daily attendance of over 3,000 students and teachers to Downtown National City. • The location advantage to those National City residents that want to better their quality of life through participation in higher education. Determination #2: There are no other reasonable means available to the community to finance the buildings, facilities, structures, or other improvements this project will bring for the following reasons: • State funding and grants for the creation of higher education facilities, such as this one, are limited or non-existent. • Funds from City resources are not available for this type of project. • Funds from the federal government are also very limited or non-existent. • Fees from students and tenants are insufficient to cover capital costs. Attachment "3" Determination #3: The payment of funds for the acquisition of land or the cost of buildings, facilities, structures, or other improvements will assist in the elimination of one or more blighting conditions inside the project area for the following reason: The project will involve the removal of several blighted and highly dilapidated buildings including an adult theater, pawnshop, gasoline station, and several automotive uses. Council did not support the draw against the loan. Consequently, the design and construction support contract was approved but not funded. After the meeting, staff directed the consultant not to start any work on the project until funding to pay for the consulting services was identified. To date no work has been performed under the contract terms. On March 11, 2002, the City Council met to discuss funding of the Fire Station Facility design and construction. At the meeting, a motion was made and passed unanimously to put the Fire Station Facility project on hold due to uncertain economic forecasts. Eiser, III City Attorney BACKGROUND REPORT Previous Discussion At the February 5 Council meeting, members of the public made a presentation regarding the potential benefits of the Mills Act for the City. The Mills Act is a State law that allows cities to enter into contracts with owners of historic buildings. These contracts provide property tax relief to the owners, in exchange for an agreement to maintain and if necessary repair or restore their historic buildings. The tax relief is an additional incentive for owners to invest in their structures. The Council asked staff to review the law and report on the potential costs and benefits of Mills Act participation to the City. Mills Act Details The Mills Act allows the City to enter into a contract with the owner of any historic structure that is on an official National, State, or City historic list. The contracts are not limited to single-family dwellings —any type of structure on the tax rolls may qualify. The tax reduction created by the Mills Act is specified in State law. The County Assessor is responsible for re-evaluating the property value based on the capitalization of income method. This method considers the income -producing (rental) potential of a property rather than its resale value, and generally results in a tax reduction of between 15% and 60% for properties assessed under Proposition 13. The State estimates that the average tax reduction is approximately 50%. Properties last assessed prior to enactment of Proposition 13 would not benefit from Mills Act contracts; properties that were recently improved or sold would likely have the greatest tax reduction. The potential fiscal impact on the City is discussed below. State law requires the contracts to provide for the preservation of the property and for its restoration/rehabilitation where necessary, in compliance with the California Office of Historic Preservation regulations, the U.S. Secretary of the Interior's Standards for Rehabilitation, and the State Historical Building Code. Contracts must provide for necessary inspections by the Assessor and State Board of Equalization. They are binding on future property owners, and must include a provision requiring the property owner to provide notice of the contract to the State. The City may require a fee to cover the costs of administering the program. Mills Act contracts must have a minimum term of 10 years. They are automatically extended for one year on the anniversary date so that the contract always has a 10-year length. Either the City or the property owner may opt not to renew the contract, which would cause it to expire after the 10-year term. The City may cancel the contract following a public hearing if the contract is breached or the property is allowed to deteriorate. If cancelled, the owner must pay a fee of 121/4% of the property's value. State law grants the City the authority to utilize the Mills Act without adopting any new policies or procedures. Other cities have adopted Ordinances or Resolutions authorizing Mills Act contracts, included a reference to the Mills Act in the General Plan, or simply begun to enter into contracts. In San Diego County, property taxes cover the period from July 1 to June 30, and are based on the assessed value as of January 1. Mills Act contracts must be recorded with the County no later than December 31 to affect the tax bill for the upcoming cycle. National City Historic Resources The City Council has adopted a "List of Identified Historic Sites in National City", which was most recently updated with a 1998 Resolution. There are 30 sites on the list, which includes the four on the National Register of Historic Places. One of these sites, Brick Row, covers ten properties under separate ownership. The list should probably be updated again since it does not contain the Coronado Belt Line Right -of -Way, which was recently placed on the California Register of Historical Resources, or the Stein Farm. In 1993-1994 a consultant hired by the Community Development Commission (CDC) developed a list of historic structures in the City. A product of the survey is an unofficial list, not adopted by Council, which identifies 174 properties as having potential local or national significance and 1,183 properties surveyed due to their recognized age. Financial Analysis The approval of Mills Act contracts would result in a decrease in property tax revenue received by the City. The City's share of the property taxes collected by the County varies in different areas of the City. CDC staff estimates that the City's share is approximately 18% of the total National City property tax collected. In addition, the Community Development Commission receives tax increment funds in the redevelopment area. The total property taxes collected for fiscal year 2000/2001 for the City's eligible historic properties was $59,113. The City's share of this tax is roughly $10,600. If each of the eligible properties were to have approved Mills Act contracts, the estimated 50% tax reduction would result in approximately $5,300 annually of lost property tax revenue to the City. Most of the older homes in the City are west of Interstate 805 and are in the redevelopment area. CDC advises that although a dollar amount for the potential loss of tax increment funds is not available, it is likely minimal. The Mills Act would not affect City or CDC -owned properties such as the Historic Depot that are not subject to property tax. Other properties that are not on the tax rolls, such as churches, would also be unaffected. Although the impact of potential Mills Act contracts on tax revenue would be minimal, the program could create a demand for additional properties to be added to the historic list. If large numbers of properties with potential historic value, as identified in the 1990s study discussed above, are added to the historic list, the burden on City revenues would be more significant. Potential Procedures There are five jurisdictions in Sari Diego County that currently allow Mills Act contracts. These include the Cities of Chula Vista, Coronado, Escondido, La Mesa, and San Diego. Staff contacted these and other participating Southern California cities for input. The city staffs that were contacted strongly recommended that the City provide for the review of Mills Act contracts by a I-listoric Resources Board or similar body, unless the applicant submits detailed information prepared by a historic preservation architect describing the structure's value. Other cities also suggested that periodic inspections be conducted to ensure that the properties are actually being preserved or restored and to verify that they are not being allowed to deteriorate. Since Mills Act contracts are discretionary, the City can weigh the benefit of each contract individually. In addition to the suggestions above, the City could require applicants to submit documentation demonstrating the need for a Mills Act contract for the property, photos of the structure, and a maintenance/restoration plan. This would provide a benchmark for the City to verify that Mills Act contracts are benefiting the City. Staffing Impacts/Fees Other cities have been consulted for estimates regarding the amount of staff time involved in processing Mills Act contracts. Based on this information, a fee of roughly $550 would provide full cost recovery. Fees charged by participating cities in the region range from $0 to $400. Current City/CDC staff does not include a historic preservation officer, historic preservation architect, or other similarly qualified historic professional. The input of the National City Historic Society could be obtained for the individual contracts. The Council could solicit CDC staff input for properties in the redevelopment area. Also, CDC staff has experience in rehabilitating properties and could perform follow-up inspections to verify that the homes are maintained and/or restored in compliance with the contracts. Staff resources are available for the processing of the Mills Act contracts based on the current historic list, unless numerous applications are submitted at one time. In addition, if large numbers of structures are added to the official list, the burden on staff resources may be significant. General Plan Consistency The City's General Plan policies state that "The City will continue to encourage and assist efforts for the preservation, maintenance and restoration of historically significant buildings and sites." Mills Act contracts would carry out this policy by providing a financial incentive for individual property owners to maintain and restore historic structures. It is unlawful for an owner or handler of any dog required by this title to be licensed to suffer, allow or permit such dog to be within the city limits without the license tag issued for that dog, or without a collar or harness around its neck to which is attached the metal license tag issued pursuant to Section 8.12.030, except when the dog is securely contained. in a motor vehicle or upon the owner or handler's property. D. Pursuant to the authority of Food and Agricultural Code Section 31621, as an alternative abatement proceeding for a potentially dangerous or vicious dog, the animal control officer may post a notice on the property from which the dog was impounded advising the owner, or its handler when the owner cannot be ascertained, that the dog will be declared a vicious dog and be euthanized after its impound or as soon thereafter as is practicable, unless the owner or handler, during the interim, requests an administrative hearing to contest the determination. A duplicate copy of the notice chall be mailed to the owner, or the handler if the owner cannot be ascertained, by certified mail and first class mail with return address. The request for the hearing may be verbal or written, or both. The animal control officer or the head of the department shall immediately cause a hearing to be held following the procedures of Penal Code Section 597.1. Any city officer or official, other than the animal control officer ordering the impound, may conduct the hearing. The hearing shall be informal in nature and the formal rules of evidence shall not apply. The hearing shall be limited to the question of whether the dog is potentially dangerous or vicious, and whether or not the dog should be euthanized or some alternative method for its care and custody be provided. The notice of decision shall be served personally on the owner, or by maul, certified and first class with return address; receipt of either shall constitute service of notice. Failure to receive the notice shall not affect the validity of service or the proceedings. Failure to request the hearing within the time allowed shall constitute a waiver of the right to contest the determination or the euthanization of the dog. The owner or handler chap be liable for all costs and fees pursuant to Section 8.04.030. E. The animal control officer shall order the euthanization of any dog determined to be dangerous or vicious pursuant to this section. Euthanization may occur immediately only upon the waiver of the hearing; otherwise, it may occur only after the expiration of the..leea.1 l►olding veriodfive-working-days-following the date of the service of the notice of decision under subsection D of this section and no appeal has been filed with the Superior Court. If an appeal is filed, the dog shall remain in impound pending the decision on the appeal. 8.16.085 Unvaccinated dogs. C. The animal control officer shall impound any dog that does not bear evidence of current vaccination, or for which proof of vaccination cannot be produced, or for which reasonable cause exists to believe that the dog is infected with rabies. Disposition or return of the dog shall be in accordance with Section 8.04.020, except that a dog which has bitten a human shall-.r _be impounded and kept under observation for fourteerr-te(j0) calendar_ days at the expense of the owner pending verification of the existence or nonexistence of rabies. 8.16.100 Yard fences required. A. It is unlawful to allow a dog to run loose in any yard in the city unless the yard in which the dog is maintained is fully enclosed with-by_,fences f sufficient height, strength, onstruction, and ptQ1 er maintenance to-aQas to restrain and contain the animal within the yard or enclosure and prevent the animal from escaping therefrom. Chapter 8.24 KENNELS 8.24.010 Kennel defined. A kennel is definedSection 18.04.368. 8.24.020 Kennel permits. A. Applications to maintain a kennel shall be processed as conditional use permits through the planning commission. Applications shall be denied if impermissible with the zoning of the property, or, if the operation and maintenance of a kennel at that location, with due consideration for noise, sanitation and drainage, would be incompatible with, and-oj inimical to, existing uses on contiguous parcels, and contrary to public health and welfare. Chapter 8.32 KEEPING OF BIRDS AND ANIMALS 8.32.015 Restrictions on keeping certain other.animals, birds and reptiles. A. It is unlawful to keep, possess or maintain any animal, bird or reptile, except as follows: 7. The procedures set forth in Sections 8.16.050 and 8.16.055 shall be utilized in responding to noise complaints and requests for abatement, in so far as applicable, under this section. ORDINANCE NO. 2002 — AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AMENDING TITLE 8 OF THE NATIONAL CITY MUNICIPAL CODE RELATING TO ANIMALS BY AMENDING CHAPTERS 8.04 (ANIMAL CONTROL AND IMPOUNDMENT), 8.12 (DOG LICENSES), 8.16 (DOG REGULATIONS), 8.24 (KENNELS), AND 8.32 (KEEPING OF BIRDS AND ANIMALS) BE IT ORDAINED by the City Council of the City of National City that Title 8 of the National City Municipal Code is amended as follows: Section 1. That Chapter 8.04 is amended by amending sections 8.04.010, 8.04.015, 8.04.020 and 8.04.030 to read as follows: 8.04.010 Administration and authority. A. The city manager, through the chief of police, is authorized to maintain field services and maintain or contract for an animal shelter and related animal control services, subject to city council approval. Within this chapter, the term "animal control office?' shall also include personnel of a contracting agency, as the context may require. B. Persons designated animal control officers by the chief of police, and employees of a contracting agency, are authorized to impound stray animals and any animal whose possession, care or custody is in violation of state law or this title, and effect quarantines in accordance with statutory quarantine procedures. Animal control officers and qualified employees of a contracting agency shall exercise all powers and authority conferred by the penal code, and investigate and enforce the provisions of state law and this code. Animas control officers and qualified employees of a contracting agency are authorized to euthanize animals in a humane manner when necessary for public health or safety or the well being of the animal in accordance with state law. Animal control officers are authorized to carry firearms in the discharge of their duties in accordance with state humane laws. Notwithstanding the foregoing, animal control officers shall not seize or impound a dog for violation of the restraint requirements of this code when the dog has not strayed from and is upon private property owned by the dog owner or the person who has a right to control the dog, or upon private property to which the dog owner or person who has a right to control the dog has a right of possession. (C through F — NO CHANGE). 8.04.015 Definitions. A. Within this Title 8, the following definitions apply: A. "Animal" means any non -human biped or any quadruped, reptile, amphibian or bird. See also "large animal," `large bird," or a dog or cat. B. "Assistance animal" means any animal trained for and used by a disabled person to assist that person in dealing with his or her disability. C. "Assistance dog" means any service dog, guide dog, signal dog or other dog trained and used by and licensed to a disabled person to assist that person in dealing with his or her disability. Assistance dogs are also described in Food and Agricultural Code Section 30851. It shall also include a dog being trained for such service. D. "At large" or "run at large" means to be untethered or unleashed and not confined to the limits of the owner's or handler's property or securely confined within or upon a motor vehicle, or not under the physical control of an owner or handler when the animal is upon any property other than that of the owner or person responsible for the animal. E. "Cat" means only a domesticated feline (felts domestictys) of either sex. It specifically excludes any feral cat, wildcat, leopard, puma, ocelot, lion, tiger, jaguar, or any other feline considered ferae naturae regardless of its actual or alleged state of domesticity. F. "Dog" means only a canine (cants familiaris) of either sex. It specifically excludes a wolf (lupine), fox (canid), coyote (cants la trans) or any canine hybrid. G. "Handle?' means any person in possession of an animal, or who is charged with or is exercising the care, control and custody of the animal. It includes the person who owns the animal when that person is exercising the care, custody and control of the animal. H. "Large animal" means any animal, other than a dog or cat that is expected to attain a body weight at maturity that exceeds twenty-five pounds in weight. It includes, without limitation: horse, mule, donkey, burro, jackass, pony, oxen, cattle (bull, cow or calf), hog, pigs (including potbelly pigs), sheep, goats, any non -human primate (monkey, chimpanzee, ape, simian, etc.), llama, alpaca, dromedary. I. "Large bird" means any emu, cassowary, ostrich; any turkey, flightless fowl or any other avian exceeding three pounds in weight; or any raptor (hawk, owl, falcon, etc.). J. "Leash" means a cord or strap of leather, canvas or other strong, non- elastic material that does not exceed six feet in length, with a hook or snap at one end and a loop or handle at the other which is designed to be held by a human hand. K. "Noise disturbance" and "noise sensitive zone" are as defined in Sections 12.04.480 and 12.04.500 respectively. L. "Not On a Leash". See "unleashed." M. "Rooster" means a male chicken regardless of size. N. "Run At Large". See "at large." O. "Small animal" or "small bird" means airy animal or bird that is not a large animal or large bird. P. "Stray" means an animal that is "at large'. Q. "Unleashed" or "not on a leash" means that any dog or other animal is not attached to a leash, or is attached to one end of a leash the other end of which is not fastened to a stationary object or is held by a person who lacks the physical ability to restrain the dog or animal. It shall be rebuttably presumed that any person weighing less than the weight of the dog or animal being restrained lacks the physical ability to restrain it. 8.04.020 Impoundment. disposal and return of animals. Impounded animals shall be handled and returned or disposed of as follows: A. The animal control officer shall make reasonable efforts to notify the owner of any dog or animal bearing a license tag or indicia from which ownership can be readily determined. Notification and all pre -seizure or post -seizure impound hearings shall be provided in accordance with applicable provisions of Government Code Section 53074, Penal Code Section 597.1, and subsection E of this Section. 2 Animals — Title 8 B. Unless irremediably suffering from a serious illness or severe injury or being a newborn animal requiring maternal care that is impounded without its mother, animals shall be held for the period specified by state law, unless sooner claimed and delivered to the owner after satisfaction of redemption and licensing requirements and, when required by Penal Code Section 597.1, demonstration that the owner can and will provide the necessary care. An unlicensed animal may be released from impound following the satisfaction of redemption requirements, without licensing, provided the owner is issued a written notice to license the animal within twenty-one (21) calendar days from the date of release, failure of which will subject the owner to citation. If the animal continues to remain impounded beyond the legally required holding period, the animal control officer or contracting agency may dispose of the animal pursuant to subsection D of this section. C. Animals that are irremediably suffering from a serious illness or severe injury or newborn animals requiring maternal care that are impounded without their mother shall be euthanized and disposed of in a humane, sanitary manner in accordance with applicable humane, health and safety law. The animal control officer or contracting agency may use discretion in determining whether an animal is within the definition of this section, and may use the services of a veterinarian in making that determination. Adoptable and treatable animals may be retained for disposition pursuant to this section. D. After the period specified by state law has elapsed following impoundment, the animal control officer or contracting agency may sell or transfer any unclaimed animal at private or public sale or auction, or release the animal to an animal rescue or adoption organization in accordance with state law. Dogs four months of age and older shall be vaccinated against rabies prior to any transfer under this section, unless exempted from such vaccination requirement by a California licensed veterinarian. Animals that cannot be reasonably transferred under this section shall be euthanized in a humane manner. E. Upon impoundment of an animal wearing a license tag, identification listing the owner's name and address, or indicia from which ownership can be readily determined, the animal control officer shall ensure a notice is promptly posted at the owner's address of record, or mailed or personally delivered to the owner of record that the animal is in the custody of the contracting agency. The notice shall conform to the requirements of Government Code Section 53074 and include a statement that the owner may within five (5) calendar days from the date of service request a hearing as to the legality of the impoundment. Such request shall be in writing and must be received by the animal control officer within the specified time period. The time during which the animal shall not be disposed of other than by return to the owner shall be extended until the conclusion of the hearing. If at the conclusion of the hearing the impoundment is found to be unjustified, the animal shall be returned to the owner without charge. If the animal is returned to the owner prior to the hearing, any fees other than vaccination or licensing fees paid by the owner to the animal control officer or contracting agency as a result of an unjustified impoundment shall be refunded to the owner. 8.04.030 Animal shelter and field cost recovery fees. A. Animal control officers shall charge such fees for animals under their custody and control as are established in the National City Fee Schedule for field operations. Impound fees and related custodial and administrative charges shall be as provided for by the National City Fee Schedule, or the applicable fee schedule of any public or private agency with which the City has contracted for shelter services. 3 Animals — Title 8 B. Animal sheltering fees and cost recovery fees shall be assessed against any owner or person responsible for the care, custody or control of an animal for the city's direct or contracted costs of impoundment, capture, rescue, treatment, medication, food, disposal or euthanization; provided, however, that the animal control officer, the city finance officer, or the contracting agency may waive cost recovery when it is not cost effective. The city finance officer and the contracting agency shall be responsible for the collection of respective fees. Section 2. That Chapter 8.12 is amended by amending Sections 8.12.010, 8.12.020 and 8.12.040 to read as follows: 8.12.010 License required. A. Except as provided in subsection B of this section, it is unlawful to own or maintain a dog over the age of four months within the city limits unless the dog,is licensed in accordance with this chapter. B. Any person owning or maintaining a dog over the age of four months validly licensed in another jurisdiction shall be exempted from licensing for a period not to exceed thirty continuous days from the dog's first arrival in the city, provided satisfactory proof by way of written declaration under penalty of perjury establishing the date of entry is presented to the animal control officer by the owner or person responsible for the dog upon demand by that officer. A. All dogs over the age of four months must be vaccinated as a prerequisite to the issuance of a license. B. Each license applicant shall provide the information required on the license application form approved by the city manager, and shall furnish proof that the dog has been vaccinated for rabies with vaccine approved for use in California by a licensed veterinarian, unless the owner or person in possession of the dog submits a certificate from a licensed veterinarian issued within the preceding fifteen days stating that the rabies vaccination would be likely to seriously injure the dog. Any dog so exempted from rabies vaccination shall be kept restricted to the enclosed yard of its owner, except when confined within a motor vehicle. Certificates of exemption shall be renewed every sixty days if required by a licensed veterinarian. 4 Animals — Title 8 Section 3. That Chapter 8.16 is amended by amending sections 8.16.020, 8.16.050, 8.16.070, 8.16.085, 8.16.100 and 8.16.110 to read as follows: 8.16.020 Dogs at large or unlicensed. A. It is unlawful for an owner or handler of a dog to allow that dog to run at large within the city limits. A dog is not at large when confined within a motor vehicle. (B and C - NO CHANGE). 8.16.050 Barking dogs. A. It is unlawful for an owner, handler or custodian to allow any dog to howl, bark or make other sounds characteristic of that species to create a noise disturbance across a residential or commercial real property line or within a noise sensitive zone between the hours of 10 PM and 7 AM daily for more than three (3) minutes, or at other times for more than ten (10) consecutive minutes or for more than a total of fifteen (15) minutes within any sixty (60) minute period. Any such noise disturbance also constitutes a public nuisance. (B through G - NO CHANGE). 8.16.070 Potentially dangerous or vicious dogs -Regulations and prohibitions. (A through C - NO CHANGE). D. It is unlawful to allow a dog to run loose in any yard in the city unless the yard in which the dog is maintained is fully enclosed by fences of sufficient height, strength, construction, and proper maintenance so as to restrain and contain the animal within the yard or enclosure and prevent the animal from escaping therefrom. Subject to the height limits prescribed in Chapter 18.50 of this code, a fence shall be considered insufficient to contain a dog unless the height of the fence is at the least the greater of four feet in height or the height of the dog to be contained measured at its shoulders plus twelve inches. B. An animal control officer is authorized to impound any dog previously observed running at large that had returned to its owner or handler's property while the officer was in pursuit or when the officer had observed or received credible information that the dog's behavior constituted a public nuisance or a clear and present danger to human or animal safety, and the dog cannot be kept safely secured within the yard, a house or an enclosure or pen on that property, or the owner or custodian refuses to properly secure the dog on the property. C. Violations of section 8.16.100(A) shall be assessed a minimum fine of one hundred dollars ($100), if the violation is not corrected within ten (10) calendar days from the date of citation. 8.16.110 Assistance and sentry dogs. A. In general, the regulations of this title as they may relate to assistance dogs and assistance dogs in training, shall be interpreted and administered in a way as to afford maximum compliance with the spirit and intent of the Americans With Disabilities Act. B. The provisions of Government Code section 121875, et seq. pertaining to the registration of "sentry dogs", as that term is defined in Government Code section 121880, shall be administered by the Chief of Police or designated animal control officer, and all required permits shall be issued and fees paid in accordance with the National City Fee Schedule. Owners of businesses qualifying as sentry dog businesses shall also obtain any other permits and licenses as may be required by state law or the Municipal Code. Section 4. That Chapter 8.24 is amended by amending Sections 8.24.010 and 8.24.020 to read as follows: 8.24.010 Kennel defined. A kennel is as defined in Section 18.04.368. 8.24.020 Kennel permits. A. Applications to maintain a kennel shall be processed as conditional use permits through the planning commission. Applications shall be denied if impermissible with the zoning of the property, or, if the operation and maintenance of a kennel at that location, with due consideration for noise, sanitation and drainage, would be incompatible 6 Animals - Title 8 with, or inimical to, existing uses on contiguous parcels, and contrary to public health and welfare. B. Once approved, the kennel permit may be renewed annually upon payment of the annual licensing fee established in the National City Fee Schedule, provided the kennel is maintained in accordance with Chapters 8.24 and 8.32. Section 5. That Chapter 8.32 is amended by amending Sections 8.32.015 and 8.32.020 to read as follows: 8.32.015 Restrictions on keeping certain other animals, birds and reptiles. A. It is unlawful to keep, possess or maintain any animal, bird or reptile, except as follows: 1. Only one pig not exceeding one hundred pounds in weight or twenty-four inches in height at the shoulder may be kept on any tract or parcel of land of at least twenty thousand square feet in area. 2. Only horses, cows, goats, sheep, burros, mules, jackasses, llamas, or alpacas may be kept, possessed or maintained, either alone or in combination with each other, not to exceed a total of five combined, on a parcel of land with a minimum of at least a twenty thousand square feet area. 3. Any combination of the following classes of animals, not to exceed a total of thirty, with each class limited by a maximum of four adult rabbits, five chinchillas, twenty hamsters, twelve chickens, four turkeys, four ducks, four geese, twenty pigeons, or twenty parakeets or similar small domestic ornamental or song bird, may be kept on any property zoned for single family residential use. 4. Domesticated rats or domesticated mice, or any combination not to exceed a total of twenty may be kept in cages or similar enclosures on any property used for residential purposes. The mice or rats may be kept in addition to any other animal or combination allowed by this section. 5. Any number of domesticated mice or domesticated rats, or combination, may be kept at any laboratory or pet shop properly located in a zone allowing for such use, provided the animals are kept under humane sanitary conditions in cages or enclosures which are designed to prevent them from being at large. 6, a. Roosters that have been surgically de -crowed may only be kept on a parcel of land of at least a twenty thousand square feet area. The total number of surgically de - crowed roosters shall not exceed five, and may be maintained in combination with other chickens on the same parcel, not to exceed the total allowed by subsection (AX3) of this section. b. Surgically de -crowed roosters may be kept in combination with any other animal or combination of animals regulated and allowed by this subsection. 7. Except as provided in chapter 8.24, a maximum of three dogs and three cats over the age of four months may be kept on any property used for single-family residential dwelling. 8. A maximum of two dogs or two cats over the age of four months or a combination not to exceed two may be kept or maintained in any one dwelling unit located within a mobile home park, multifamily dwelling or apartment or condominium complex, if allowed by the regulations of the owner or condominium association. 7 Animals - Title 8 9. Large birds not exceeding a total of two may be kept on any parcel pursuant to a permit issued by the animal control officer. 10. In addition to any animals allowed by subsection A of this section, a resident of a dwelling unit located in a mobile home park, multifamily apartment or dwelling or condominium may keep a maximum of two small ornamental birds or song birds, if allowed by the regulations of the owner or condominium association. 11. No more than three cats, each exceeding four months of age, shall be kept on any parcel of land within the city. 12. Only one reptile, lizard, or nonvenomous snake not exceeding six feet in length or twenty-five pounds in weight, may be kept on any property, either alone or in combination with any other animal or combination allowed by this section. (B and C — NO CHANGE). 8.32.020 Conditions of keeping or maintaining permitted animals, birds and reptiles. It is unlawful for an owner or other person charged with the keep, care, possession or maintenance of an animal, bird or reptile to fail to comply with the following regulations: (A and L — NO CHANGE). M. No animal or bird shall be allowed to howl, bellow, squawk, or make a sound characteristic of that species which creates a noise disturbance across a residential or commercial real property line or within a noise sensitive zone between the hours of 10 p.m. and 7 a.m. daily for more than three (3) minutes, or at other times for more than ten (10) consecutive minutes or for more than a total of fifteen (15) minutes within any sixty (60) minute period. This provision shall not apply to public zoos. Interference by noise shall also constitute a public nuisance. The procedures set forth in Sections 8.16.050 and 8.16.055 shall be utilized in responding to noise complaints and requests for abatement, in so far as applicable, under this section. Professional 50+ hour academy for volunteer training in addition to other courses for experienced volunteers as well as police and fire personnel. d. TIPTeens program to provide trained youth volunteers for traumatized teens and children in National City. g. Senior Crisis Team to provide follow-up services to elderly, including non -emergency needs. h. Travelers Care to provide assistance to travelers, visitors experiencing a crisis event. i. Major Crisis Response to provide volunteers from surrounding TIP communities to meet the demands of major incidents. 2. TIP, active in 75 communities in the United States, serves the following communities within San Diego County: Alpine, Carlsbad, Del Mar, El Cajon, Encinitas, Fallbrook, La Mesa, Oceanside, Rancho Santa Fe, San Marcos, Santee, Solana Beach, and Vista. 3. The annual fee for TIP is $6,600.00 based on $0.12/capita of 55,000 population served. Additional costs for implementation of the program are pagers and pager monthly fees, training materials at a cost of $25.00 per volunteer, and costs for fingerprinting if this service is not provided by local police agencies or during the TIP academy (Fingerprinting and Department of Justice criminal background checks are usually provided by the San Diego County TIP Chapter at as part of the training academy). National City TIP would require that the following items continue to be provided by the City: one office with desk, chair, file cabinet and telephone. In addition the "TIP" supported Program would require a desk top computer, access to fax, access to copier, access to the City Computer Network and office supplies not to exceed $100 per year. San Diego County TIP has a general liability policy and requires volunteers to have their own health insurance, a driver's license with "clean" record and undergo a background check. None of the public agencies in San Diego County carry the volunteers on their Volunteer Rosters. 6. San Diego County TIP currently has no formal agreement with any of its public agencies. TIP sends a January request to each member city to be included in the next fiscal year's budget and invoices in July for the annual fee. Landa DEPARTMENT Public Works Department/Engineering EXPLANATION At the City Council meeting of March 19, 2002, Laverne Mitchell, Juana Guzman, and Salvador Villacana appeared before the Council to discuss parking concerns they had on 22nd Street between "A" Avenue and "D" Avenue. They complaint about the parking time limits in this area. They also stated that most of the renters have more than one vehicle, so it is necessary for them to park in the street. They are requesting that the signs be changed from "7:00 a.m. to 7:00 p.m." to "9:00 a.m. to 5:00 p.m." This would allow them time to move their vehicles or leave for work. Staff research Residential Parking District "A" and found that the original problem was that the employees from the Mile of Cars were taking all of the street parking during their working hours. The district was establish on August 7, 1984, to eliminate this problem. Based upon the City Council Residential Parking Policy, permits are issued only to residents located within the parking district. Therefore, the renters that are south of 22nd Street would not qualify for permits. The City Council could consider modifying the time limits from "7:00 a.m. to 7:00 p.m." to "9:00 a.m. to 5:00 p.m on 22nd Street. This would have a minimal impact on the overall parking district. However before the City Council makes a decision to change the district hours, they may want to consider a public hearing involving the presidents in parking district "A". A petition for a Residential Permit Parking shall be directed to the Traffic Safety Committee. Before further processing of a request for a Residential Parking Permit District the petition shall be signed by 60% of the owners within the proposed boundaries of the Residential Parking Permit District. The Traffic Safety Committee shall direct the City Engineer to proceed with the processing of this program in conformance with the following stated procedures. SECTION 1. Definitions (a) "Residential area" shall mean a contiguous area consisting of primarily residential uses containing public streets or parts thereof; (b) "Residential permit parking area" shall mean the adjacent public street frontage to a residential area designated as herein provided wherein resident motor vehicles displaying a valid permit as described herein shall be exempt from parking restrictions established pursuant to this policy statement. (c) "Resident vehicle" shall mean a motor vehicle parked in a residential area in which it is registered with the State of California Department of Motor Vehicles or a similar registering entity. (d) "Commuter vehicle" shall mean a motor vehicle, other than one described in subparagraph (e) herein, parked in a residential area in which it is not registered with the State of California Department of Motor Vehicles; (e) "Transient vehicle" shall mean a motor vehicle which has been issued a temporary residential parking permit pursuant to this policy statement. (f) "Motor Vehicle" shall include an automobile truck, recreation vehicle, motorcycle or other motor -driven or self-propelled form of transportation. (g) "Owns" shall mean that a person has at least one -quarter interest in a parcel of real property within a residential permit parking area. (h) "Lease" shall mean that a person pays rent or other remuneration for use of a parcel of real property as his residence or place of business. (i) "Person" shall mean natural person, joint venture, joint stock company, partnership association, club, company, corporation, business trust, organization, or the agent, employee, lessee, manager, officer or servant of any of them. (j) "City Engineer" shall mean the City Engineer of the City of National City or his designee. (k) "Clerk" shall mean the person or officer who is or acts as clerk of the City Council of the City of National City. (1) "Code" shall mean National City Municipal Code. SECTION 2. Designation of Residential Permit Parking Areas (a) The City Council shall, upon the recommendation of the Traffic Safety Committee and subsequent to a public hearing consider for designation as residential permit parking areas those residential areas meeting and satisfying the objective criteria therefore established in this policy statement. (b) The City Council shall then designate by resolution certain residential areas as residential permit parking areas in which motor vehicles displaying a valid parking permit may stand _or be parked without limitations by parking time or parking area restrictions established by this policy statement. Said resolution shall also state the applicable parking regulation and period of the day for its application, and the fee to be charged upon permit issuance. SECTION 3. Designation Criteria (a) A residential area shall be deemed eligible for consideration as a residential permit parking area if, based on studies prepared at the direction of the City Engineer, objective criteria establish that the residential area is impacted by commuter vehicles for any extended period during the day or night, or weekends, or during holidays. 2 (b) In determining whether a residential area identified as eligible for residential permit parking may be designated as a residential permit parking area, the City Council shall take into account factors which include but are not limited to the following: (1) The extent of the desire and need for the residents for residential permit parking; (2) The extent to which legal on -street parking spaces are occupied by motor vehicles during the period proposed for parking restriction; (3) The extent to which vehicles parking in the area during the period proposed for parking restriction are commuter vehicles rather than resident vehicles; (4) The extent to which motor vehicles registered to persons residing in the residential area cannot be accommodated by the number of available off-street parking spaces. (c) The following are set forth as minimum criteria in determining whether to proceed with a recommendation for approval of a Residential Permit Parking District: (1) The Residential Parking Permit District shall consist of at least one side of a street section between two consecutive intersecting streets. (2) At least 70 percent of the available curbside parking spaces are occupied by commuter vehicles during the time the parking study is being conducted. SECTION 4. besignation Process (a) When directed to do so by the Traffic Safety Committee, the City Engineer shall cause to have such surveys and studies as are deemed necessary to determine whether a residential area is eligible for residential permit parking. (b) Upon the completion of the surveys or studies, the City Engineer shall provide a written report to the Traffic Safety Committee on the subject of: (1) Eligibility of the residential area under consideration for residential permit parking; (2) Tentative boundaries for the proposed residential permit parking area; and 3 (3) Appropriate area prohibition or time limitation on parking and the period of the day for its application. (c) The Traffic Safety Committee shall review the report and its findings and subsequently make a recommendation to the City Council to approve or deny the proposed Residential Parking Permit District. The City Council at the next possible Council meeting following the Traffic Safety Committee meeting may set a date for a public hearing on the establishment of the proposed Residential Permit Parking District. (d) The Clerk shall cause notice of such hearing to be published twice in a local newspaper of general circulation in the city. The first publication shall be not less than ten days prior to the date of such hearing. (e) The City Engineer shall cause notice of such hearing to be posted conspicuously, at not more than one hundred foot intervals and at all street intersections, in the proposed residential permit parking area. (f) The notice shall clearly state; the purpose of the hearing; the location and date and time of the hearing; the tentative boundaries of the proposed residential permit parking area; and that any interested person shall be entitled to appear and be heard. SECTION 5. PUBLIC HEARING (a) At the public hearing the City Council may review the written reports, surveys and studies, take public testimony and determine whether the proposed Residential Permit Parking District is justified and:desired by the residents within the boundaries of the district and the immediate neighborhood. The City Council may then designate by resolution the new Residential Permit Parking District and direct the City Engineer to cause the appropriate signing of the District per Section 7. SECTION 6. Issuance of Permits (a) The City Engineer is hereby authorized and directed to issue, upon proper written application therefor, a parking permit. Each such permit shall list the license number of the motor vehicle for which it is issued, and the date when 4 it was issued. No more than one parking permit shall be issued to each motor vehicle for which application is made. The City Engineer is authorized to issue such rules and regulations, not inconsistent with this policy statement, governing the manner in which persons shall qualify for parking permits; (b) Parking permits may be issued for motor vehicles only upon application of the following persons; (1) A legal resident of the residential permit parking area who has a motor vehicle registered in his/her mane, or who has a motor vehicle for his/her exclusive use and under his/her control; (2) A person who owns or leases commercial property and actively engages in business activity within a residential permit parking area. However, no more than one parking permit may be -issued for each business establishment for a motor vehicle registered to or under the control of such a person. (c) Proof of residency shall be demonstrated by providing rent or utility receipts or other such documents that verifies residency to the satisfaction of the City Engineer. (d) Proof of motor vehicle ownership or vehicle use and control shall be demonstrated by providing a valid vehicle registration card and a valid drivers license. (e) Temporary residential parking permits may be issued for vehicles which are: (1) Owned, rented or under the operational control of any person who owns or leases property in the residential permit area, or (2) used in providing services to persons or property in the residential permit area. Temporary residential parking permits may also be issued to vehicles owned by temporary visitors who are residing in the residential permit parking area. Such temporary residential parking permits shall have all of the rights and privileges of a regular permit. A temporary parking permit shall be valid for no more than fourteen days from the date of issuance. No resident of a residential permit parking area shall be issued more than two temporary parking permits at one time. A temporary residential parking permit issued to a vehicle providing services or to vehicles owned by temporary visitors shall be considered to be a temporary permit issued to the resident of the property where the services are provided or the temporary visitors are residing. 5 (f) Long-term visitor parking permits may be issued to residents of a permit district who require regular service or care over a long period of time. The resident must establish the need for a long-term permit by indicating a disability or a hardship situation that requires regular at home care or some other assistance for a period of more than two weeks. A resident shall be limited to one such long- term visitor permit which may be transferable to the vehicles of multiple care or service providers. Each care or service provider shall register their vehicle(s) with the Engineering Department. The long-term permit shall be valid for one year after the date of issuance. Long term visitor parking permits issued per this paragraph shall be counted against the permit limits of paragraph (g). (g) The number of permits issued to any one address in a residential area shall be limited to the number of curbside spaces along the property frontage or two, whichever is greater. Non -single family residential addresses shall be limited to two permits. The determination of the number of spaces along the property frontage shall be made by the City Engineer. SECTION 7., Posting of Residential Permit Parking Area Upon adoption by the City Council of a resolution designating a residential permit parking area., the City Engineer pursuant to Title II of the Code shall cause appropriate signs to be erected in the area indicating, prominently, thereon the area prohibition or time limitation, period of the day for its application, and conditions under which permit parking shall be exempt therefrom. SECTION 8. Display of Permits Permits shall be displayed in a manner determined by the Chief of Police. SECTION 9. Permit Parking Exemptions A resident motor vehicle or transient motor vehicle on which is displayed a valid parking permit as provided for herein shall be permitted to stand or be parked in a residential permit parking area without being limited by time restrictions or area prohibitions established pursuant to this policy. Said resident motor vehicle or transient motor vehicle shall not be exempt from parking restrictions or prohibitions established pursuant to an authority other than this policy. All other motor vehicles other than vehicles specified in Title II of the Code and vehicles where the operator or the passenger being transported by said vehicle displays a license issued under the provisions of the Section 22511.5 of the California Vehicle Code, parked within a 6 residential permit parking area shall be subject to the time restrictions or area prohibitions adopted as provided in this policy, as well as the penalties provided for herein. A residential parking permit shall not guarantee or reserve to the holder thereof an on -street parking space within the designated residential permit parking area. SECTION 10. Application for and Duration of Permit Each parking permit issued by the City Engineer shall be valid for not more than one year from the date of issuance. Permits shall expire on the last day of the anniversary month of the formation of the area in such manner as may be required by the City Engineer. Each application or reapplication for a parking permit shall contain information sufficient to identify the applicant, his residence address or address of real property owned or leased within a residential permit parking area, and the license number of the motor vehicle for which application is made, and such other information that may be deemed relevant by the City Engineer. SECTION 11. Permit Fees (a) The annual renewal fee for a residential parking permit shall be $10.00 and shall be revised by resolution at such time when user fees in general are updated. (b) The fee for a temporary residential parking permit shall be two dollars ($2.00). SECTION 12. Penalty Provisions (a) It shall be unlawful and a violation of this policy unless expressly provided to the contrary herein, for any person to stand or park a motor vehicle for a period exceeding the time limitation or in violation of the area prohibition established pursuant hereto. Said violation shall be an infraction punishable in accordance with the provisions of Title II of the Code. (b) It shall be unlawful and a violation of this policy for a person to falsely represent himself as eligible for a parking permit or to furnish false information in an application therefore; (c) It shall be unlawful and a violation of this policy for a person holding a valid parking permit issued pursuant hereto to permit the use or display of such permit on a motor vehicle other than that for which the permit is used. Such conduct shall constitute an unlawful act and violation of 7 this policy both by the person holding the valid parking permit is used. Such conduct shall constitute an unlawful act and violation of this policy both by the person holding the valid parking permit and the person who uses or displays the permit on a motor vehicle other than that for which it is issued; (d) It shall be unlawful and a violation of this policy for a person to copy, produce or otherwise bring into existence a facsimile or counterfeit parking permit or permits without written authorization from the City Engineer or designed. It shall further be unlawful and a violation of this policy for a person to knowingly use or display a facsimile or counterfeit parking permit in order to evade area prohibitions or time limitations on parking applicable in a residential permit parking area. A violation of this subsection shall be a misdemeanor punishable in accordance with the provisions of Section 11.12. of the Code. SECTION 13. Revocation of Permit The City Engineer or designed is authorized to revoke the residential parking permit of any person found to be in violation of this policy and, upon written notification thereof, the person shall surrender such permit to the City Engineer. Failure when so requested, to surrender a residential parking permit so revoked shall constitute a violation of law and of this policy. SECTION 14. Severability The provisions of this policy are severable and if any provisions,clause, sentence, subsection, word or part thereof is held illegal, invalid, or unconstitutional, or inapplicable to any person or circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability shall not affect or impair any of the remaining provisions, clauses, sentences, subsections, sections, words or parts of the policy or their application to other persons or circumstances. It is hereby declared to be the legislative intent that this policy would have been adopted if such illegal, invalid, or unconstitutional provision, clause, sentence, subsection, section, word or part had not been included therein, or if such person or circumstance to which the policy or part thereof is held inapplicable had been specifically exempted therefrom. Section 15. Sunset Provision and Removal of Designation.
