BOARD / COMMISSION RECOMMENDATION ATTACHMENTS ( Listed Below ) N/A Resolution No. 2002-86 A-200 (9/80) RESOLUTION NO. 2002 — 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY ADOPTING REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO CANDIDATES' STATEMENTS SUBMITTED TO THE VO 1'ERS AT AN ELECTION TO BE HELD ON TUESDAY, NOVEMBER 5, 2002 WHEREAS, Section 13307 of the Elections Code of the State of California provides hat the governing body of any local agency adopt regulations pertaining to materials prepared y any candidate for a municipal election, including costs of the candidates' statements. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY DOES RESOLVE AS FOLLOWS: SECTION 1. GENERAL PROVISIONS. That pursuant to Section 13307 of the Elections Code of the State of California, each candidate for elective office to be voted for at an election to be held in the City of National City, California on Tuesday, November 5, 2002, may prepare a candidate's statement on an appropriate form provided by the City Clerk. The statement may include the name, age and occupation of the candidate and a brief description of no more than 200 words of the candidate's education and qualifications expressed by the candidate himself or herself. The statement shall not include party affiliation of the candidate, nor membership or activity in partisan political organizations. The statement shall be filed in typewritten form in the Office of the City Clerk at the time the candidate's nomination papers are filed. The statement may be withdrawn, but not changed, during the period for filing nomination papers and until 5:00 p.m. of the next working day after the close of the nomination period. SECTION 2. FOREIGN LANGUAGE POLICY. a. Pursuant to state law, the candidates' statement must be translated and printed in Spanish. b. Pursuant to the Voting Rights Act of 1965 (as amended) the City is required to translate candidates' statements into the following languages in. addition to English: Spanish. c. The City Clerk shall have all candidates' statements translated into the language specified in (b) above. SECTION 3. PAYMENT. The candidate shall be required to pay for the cost of printing the candidate's statement in a foreign language. The City Clerk shall estimate the total cost of printing, handling, translating, and mailing the candidates' statements filed pursuant to this section, including costs incurred as a result of complying with the Voting Rights Act of 1965 (as amended), and require each candidate filing a statement to pay in advance to the local agency his or her estimated pro-rata share as a condition of having his or her statement included in the voter's pamphlet. In the event the estimated payment is required, the estimate is just an approximation of the actual cost that varies from one election to another election and may be significantly more or less than the estimate, depending on the actual number of candidates filing Resolution No. 2002 — 86 June 18, 2002 Page Two statements. Accordingly, the City Clerk is not bound by the estimate and may, on a pro-rata basis, bill the candidate for additional actual expense or refund any excess paid depending on the final actual cost. In the event of underpayment, the City Clerk may require the candidate to pay the balance of the cost incurred. In the event of overpayment, the City Clerk shall pro -rate the excess amount among the candidates and refund the excess amount paid within 30 days of the election. SECTION 4. ADDITIONAL MATERIALS. No candidate will be permitted to include additional materials in the sample ballot package. SECTION 5. The City Clerk shall provide each candidate or the candidate's representative with a copy of this Resolution at the time nominating petitions are issued. SECTION 6. All previous resolutions establishing Council Policy on payment for candidates' statements are repealed. SECTION 7. This Resolution shall apply only to the election to be held on November 5, 2002, and shall then be repealed. SECTION 8. The City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. PASSED and ADOPTED this 18th day of June, 2002. George H. This proposed Memorandum of Understanding has been ratified by the members of the MEA. The effective date of this agreement is July 1, 2002, and would continue through June 30, 2005. This grant provides $125,000 in funding over a three-year period to hire and assign one full-time police officer as a School Resource Officer, with the remaining costs to be paid with local funds. Under the COPS in Schools grant program, applicants must enter into a partnership agreement with an official for a specific school district. The grant also requires that the applicant agency and the partner school district submit a Memorandum of Understanding. The National City Police Department completed a Memorandum of Understanding with the National School District and formed the required partnership necessary to submit the COPS in Schools grant application. The CIS School Resource Officer will be assigned exclusively to the National School District, which was identified as having the most need and a desire to be a partner in the CIS grant. The CIS School Resource officer must supplement and may not supplant current School Resource Officer positions. This MOU is similar to the one we currently have with the National School District and in it they agree to fund $29,994 of the costs not paid for by the grant over a three-year period. PAGE 2 National School District Superintendent Dr. George Cameron and Chief of Police Skip DiCerchio signed a MOU that was submitted with the grant on June 4th, 2001. Since the grant took longer to receive than anticipated, the MOU will need to be updated and approved by City Council for implementation. A copy of the signed MOU is attached. The $125,000 federal share of the grant will be paid in decreasing amounts over the three years of the grant. The local share will therefore increase over the three-year grant and the applicant agency must retain the grant position for one full local fiscal budget cycle. See the attached CIS budget summary and retention plan for details. The current total salaries and fringe benefits of the grant position, not including future pay increases since the grant was submitted on June 4, 2001, is $182,743. The federal share will be $125,000 and the applicant share is $57,743, with the National School district committed to funding $29,994 of the applicant share. This makes the City responsible for $27,749 over the first three years. The lion's share of the City commitment will be in the 4th year when we are required to retain the position for one full fiscal year. Proposal The Police Department proposes that the City Council authorize the acceptance of the COPS in Schools Grant Award of $125,000 and authorize the City Manger and the Chief of Police to sign all grant documents, specifically, the official Cops in Schools Award document which requires their signatures and must be returned within 90 days after April 25, 2002. We will create a positive learning environment by providing safe and secure campuses. We will accomplish these tasks through community oriented policing, public education, and by increasing the police presence on school campuses. Ensuring the safety of students and staff on school campuses in the City of National City is a priority to the school administration of the National School District and the National City Police Department. Campus security is enhanced by the presence of police officers. Having police officers on campus will also create a positive environment for interaction between police officers and youth in the community. Establishing positive relations and a meaningful partnership between the School District and the Police Department will ensure a positive learning environment for elementary school students. Recognizing these factors, the National School District and the National City Police Department agree to work together to provide the presence of a police officer on campus to help maintain a secure environment. To provide prevention and intervention by: • Developing student and faculty presentations on law related issues • Attend parent conferences/meetings • Attend Student Attendance Review Board (S.A.R.B.) meetings • Schedule security for school activities as needed 4. To continue to work with community social agencies on issues that affect students and/or their families. 5. To continue training National City Police Department personnel assigned to the school sites. C. School Liaison Officer -General Duties The school liaison officer will perform general law enforcement duties and educational training in the following areas: • Campus intrusion • Assaults and batteries on campus • Gang related crimes and violence • Weapons on campus • Alcohol and drugs on campus • Truancy • Schedule and conduct educational presentations to students, staff, parents, and the community regarding drugs, gangs, conflict resolution, and law related issues. Desired Outcomes The primary responsibility of the liaison police officer will be campus safety however the officer will provide needed services to related issues that impact the welfare and safety of students and faculty. The school liaison officer will also have the opportunity to network with social and educational providers from the Family Resource Centers located on two of elementary school campuses. These Centers provide training/assistance for families in the areas of parenting, domestic violence prevention, group support, mentoring, and job skills. As part of their services, the Center has staff from Children Protection Services and the Community Assessment Team to identify at risk youth. Through the networking process, the officer. will be better able to make full use of resources available in the comet so, the Police Department becomes a partner in the collaborative effort of social agencies that are working to address problems in the community. The desired outcome of this program is the following: 1. To address crime and disorder problems, gangs, and drug activities - affecting or occurring in or around the National School District campuses. 2. To develop and expand crime prevention efforts for students. 3. To educate likely school age victims in crime prevention and safety. 4. To educate youth, faculty, parents in drug abuse and gang awareness. 5. To educate student on strategies for conflict resolution and crime awareness. 6. Assist in developing school policy that addresses crime and recommend procedural changes. 7. To enhance the National Police Department's community policing efforts by creating partnerships with the National School District and social/educational service providers that work with school age children, their families, and the community in general. It is the intention of the National City Police Department to seek additional funds to supplement the City's contribution to the program in the year(s) 2002-2005. Under this agreement the National School District will remit $ 29,994, payable to the Finance Director of the City of National City. Payment of the National School District's contribution will be as follows: The National School District will remit the City of National City $ 9,998, each year, for the three years that the COPS in Schools Grant is in effect. The National School District may also assist with funding at the end of the grant period, but is not obligated to. The City of National City and the School District agree to discuss payment of the School District's contributions upon the grant being awarded. The School District contributions are based on current police officers salary. These figures are subject to change based on the time that the grant is awarded and potential salary increases negotiated by the National City Police Officers Association. It will be the responsibility of the National City Police Department to complete the annual progress re0 uarterly financial status reports required by the grant. It will be the responsibility of the National City Police Department, specifically the Operations Support Lieutenant, to administer the program and manage the grant. It will be the responsibility of the National School District's representative to determine and develop the officers duties within the scope of the desired outcomes listed on page three. The Operations Support Lieutenant and the National School District representative will communicate on a quarterly basis and share information regarding the program's progress. A quarterly report will be completed by the Police Department and will be provided to the School District regarding the school officer's activities as they relate to: actual time spent at the school sites, presentations conducted, curriculum taught, and statistics regarding general enforcement activities. In order to provide an accurate account of the officer's time he/she will be required to maintain a daily log of activities. The logs will be kept at the Police Department for the purposes of program reporting. E. Organization Capacity The National City Police Department has takenprogressive steps to implement units that promote the community oriented policing philosophy of the organization. The school liaison officer employed through the COPS in Schools Grant will be assigned to the Police Department's Community Services Bureau, in conjunction with the D.A.R.E. program that also operates out of the unit. While assigned to the Community Services Bureau, the officer's immediate supervisor will be the Sergeant assigned to the unit. In the Sergeant's absence, the officer will report to the Operations Support Lieutenant in accordance to the Police Department's policies and procedures regarding chain of command. // rt Memorandum of Understanding Page 6 While in the capacity of a school liaison officer, the police officer performing the assignment will be in police uniform and have discretion and decision -making authority while performing general law enforcement at the schools. Per the National City Police Department's policy, the school liaison officer will have freedom and authority to make decisions and choices. CAUFIERD SAN DIEGO, CA We are writing on behalf of our clients the National Rifle Association (NRA), the California Rifle and Pistol Association (CRPA), and the members of those Associations that reside in your community. On January 1, 2002 a state law went into effect that requires all guns sold in California to be sold with an approved "firearm safety device," (i.e., a trigger lock), (Penal Code Section 12087, et seq.) With the effective date of that statute, any local ordinance on the same subject is duplicates, and is preempted by, the state law. It is our understanding that your city or county still has a "trigger lock" ordinance. We are writing on behalf of our clients to demand its repeal. Unfortunately, the level of conflict and redundance between municipal codes and state laws is increasing, particularly in the area of firearm regulation. This is becoming increasing confusing and problematic for NRA and CRPA members. To eliminate member confusion, our clients are therefore insisting that localities eliminate duplicative or conflicting ordinances from their municipal codes. Hopefully, litigation on this matter can be avoided. Most cities have promptly repealed preempted ordinances when brought to their attention. We are, however, prepared to file a lawsuit if necessary, and will seek our attorneys fees from your city or county when our clients prevail. WEAPONS Chapter 10.68 FIREARMS 10.68.020 Provision of trigger locks. A. It is unlawful for any firearm dealer to sell, give, lend or transfer ownership of any firearm without also providing with the firearm a trigger locking or similar device approved by the chief of police. The trigger locking or similar device shall be designed to prevent the unintentional discharge of the firearm. The trigger locking or similar device shall bye attached to the firearm prior to the completion of the sale, gift, lending or transfer transaction, and the firearm must leave the premises of the firearms dealer with the trigger locking or similar device attached. If a trigger locking or similar device cannot be attached because the firearm lacks a trigger guard, a lockable bag or box approved by the chief of police shall be used in lieu of a trigger locking or similar device. Nothing in this section shall prevent the firearms dealer from recovering the cost of the trigger locking or similar device by charging a price for the lock or similar device, either separately or as part of the price of the firearm. B. It is unlawful for any firearm dealer to sell, give, lend or transfer ownership of any firearm, without providing with the firearm printed material, approved by the chief of police, that advises the user of safe firearm storage practices. C. In connection with any sale, gift, loan or transfer of a firearm, the firearm dealer shall obtain from the person receiving the firearm a signed acknowledgement that a trigger locking or similar device required by Section 10.68.020(A), and the printed material required by Section 10.68.020(B), has been provided with the firearm. The acknowledgment shall be in a form approved by the chief of police. The firearm dealer shall retain signed acknowledgments of receipt in the same manner and to the same extent as required by state law for other firearm transaction records. D. A firearm dealer who has fully complied with the provisions of this section relating to trigger locking or similar devices shall not be presumed to have made any representation to the transferee regarding the safety or appropriateness of the use of the trigger locking or similar device, nor shall the firearm dealer be liable in any civil action brought against the firearm dealer, to the extent such liability would be based solely upon the act of furnishing the trigger locking or similar device to a person in compliance with this section. E. The requirements of this section shall be in force and effect, and shall apply to all firearms dealers now or hereafter licensed, ninety days after the date of which the chief of police sends written notice to currently -licensed firearms dealers of the requirements of this section pertaining to approved trigger locking or similar devices, printed safety material and form of acknowledgment. F. The provisions of this section shall not apply to temporary lending transaction in which the firearm does not leave the premises of the firearms dealer. G. The requirements in Sections 10.68.020(A), (B) and (C) shall not apply to firearms that are curios or relics, as defined by federal law, Title 27 Code of Federal Regulations, Section 178. H. The requirements in Sections 10.68.020(A), (B) and (C) shall not apply to firearm dealers when they are involved in private party transfers conducted pursuant to California Penal Code Section 12082. CALIFORNIA PENAL CODE SECTION 12088.1 (Effective January 1, 2002) (a) All firearms sold or transferred in this state by a licensed firearms dealer, including private transfers through a dealer, and all firearms manufactured in this state, shall include or be accompanied by a firearms safety device that is listed on the Department of Justice's roster of approved firearms safety devices. (b) All firearms sold or transferred in this state by a licensed firearms dealer, including private transfers through a dealer, and all firearms manufactured in this state shall be accompanied with warning language or labels as described in Section 12088.3. (c) The sale or transfer of a firearm shall be exempt from subdivision (a) if both of the following apply: (1) The purchaser or transferee owns a gun safe that meets the standards set forth in Section 12088.2. Gun safes shall not be required to be tested, and therefore may meet the standards without appearing on the Department of Justice roster. (2) The purchaser or transferee presents an original receipt for purchase of the gun safe, or other proof of purchase or ownership of the gun safe as authorized by the Attorney General, to the firearms dealer. The dealer shall maintain a copy of this receipt or proof of purchase with the dealers' record of sales of firearms. (d) The sale or transfer of a firearm shall be exempt from subdivision (a) if all of the following apply: (1) The purchaser or transferee purchases an approved safety device no more than 30 days prior to the day the purchaser or transferee takes possession of the firearm. (2) The purchaser or transferee presents the approved safety device to the firearms dealer when picking up the firearm. (3) The purchaser or transferee presents an original receipt to the firearms dealer which shows the date of purchase, the name, and the model number of the safety device. The notification must be mailed no less than 72 hours prior to the event. FIRE 336-4550 1. A permit is required for the fireworks display from the fire department. The fee is eighty- five dollars ($85.00). 2. A permit is required to erect a tent having an area in excess of 200 square feet and a canopy in excess of 400 square feet or a combination thereof. Tents and canopies shall be treated with a flame-retardant and labeled as such. The fee per tent and/or canopy is $85.00 and is issued by the fire department. 3. All cooking booths shall have one 2A:l0BC or 40:BC fire extinguisher with a current California State Fire Marshal tag attached. 4. Metal cans with lids and labeled "HOT COALS ONLY", shall be provided for charcoal disposal. 5. A fire safety inspection shall be conducted by the fire department prior to the operation of the carnival, of all rides, cooking area, etc. 6. Fire safety inspection is to be conducted by the Fire Department of the designated fireworks display area prior to display being conducted. 7. There shall be fire department access into the booth areas at all times. 8. Access to Morgan and Kimball Towers fire department connections for fire sprinkler systems and standpipes shall be maintained at all times to both entrances. 9. Fire hydrants shall not be blocked or obstructed. 10. A Fire Department permit is required to operate a carnival. The fee is eighty-five dollars ($85.00). 11. Cost recovery for overtime is $352. A list of all participating vendors is to be provided to the Revenue and Recovery Division of the Finance Department. PARKS & REC. 336-4290 1.
