In so doing, it recognizes employees who maintain high standards of personal conduct and make significant contributions to the work environment and community. The employee selected by the Purchasing Department to be recognized for the month of August 2004 is Debbie Lunt, Purchasing Clerk (nomination attached). Ms. Lunt has been invited to attend the Council meeting on Tuesday, August 17, 2004, to be recognized for her achievements and service. Attachment (1) xc: Department Director Debbie Lunt Councilmember Natividad AJL:Im Performance Recognition Program (2) ® Recycled Paper NOMINEE FOR EMPLOYEE OF THE MONTH I'd like to nominate Debbie Orozco Lunt, Purchasing Clerk, for `Employee of the Month'. The Purchasing Department is very small, and therefore each of us wear many hats. Debbie has been with the City for 4 years, and her normal daily responsibilities include: processing requisitions, purchase orders and invoices; analyzing quotes; preparing reports; maintaining manuals and logs; answering phones; handling the front counter; etc. In addition to this, she often fills in for the part time Warehouse Stock Clerk, receiving shipments, filling orders, and resolving warehouse problems. Recently, Debbie became aware of a potential problem, and took immediate action to correct it. When following up on an order of pool chlorine that had not been delivered, she learned that there had been a fire in the manufacturing plant, and that their stock of chlorine had been destroyed. They were unable to fill our order, and we were running low. She continued to monitor the situation, and work with the vendor to make sure our order was at the top of the list. Debbie knew we were coming up on the 4th of July weekend, and that the Public Works staff would need chlorine to get the pool ready and to keep it going over the long hot weekend. She was very persistent with the vendor, trying to find options. She contacted different suppliers, pursued diverting shipments from other companies, and was in constant communication with the vendor. Debbie was assured that we would have our shipment by July 7a', but that wasntt soon enough. On June 30th, we ran completely out of stock. Public Works was considering closing the pool for the 4th of July weekend, since there was no chlorine, which would pose a health and safety issue. At the last minute,' and in the middle of our fiscal year-end process and warehouse inventory, Debbie remembered that National City Transit used the same type of chlorine. Luckily they had 1.5, 50# pails, and `loaned' them to us. It was enough chlorine to get us through the long weekend, until our delayed shipment would arrive. Debbie's persistence and diligence ensured that the pool would stay open over the busy 4th of July weekend, for the citizens of National City to enjoy. This is just one example of how dedicated she is to the City, and how seriously she takes her job. We in Purchasing are committed to serving our customers, and doing whatever it takes to get the job done. This Amendment will also extend the Community Development Commission's existing eminent do- main authority for an additional twelve (12) years The current exemption for single family residences would not be changed. Pursuant to Sections 33348 and 33360 of the California Community Redevelopment Law, the Community Development Commission and City Council must hold a public hearing prior to the adoption of the Amendment to hear all testimony for and against the proposed Amendment. California Community Redevelopment Law, Sections 33355 and 33458, also provides that when a City Council serves as the governing board of the Community Development Commission, both bod- ies shall hold a joint public hearing to receive testimony on a Redevelopment Plan Amendment. Staff has researched the site and agrees with their request (see photos). The first one is at 9th Street and R Avenue. The street is painted red on one side but is only 20 feet wide. Should we get the other side painted? The complidrit was that vehicles had to back down the street when the AMR ambulances are responding to calls (this is now where AMR medics are staying). The second is from Capt. Gundert. He states that the alley at 1446 E 8th Street (9th Street and N avenue) used to be blocked by removable barricades so that the Engines could pull them and drive thru. Now there are parking spaces painted there? I know nothing about this since I've been here the parking spaces have been painted there? Do you know anything about this? Change Order A-200 (9:99) Explanation: The Library project includes a complete removal and replacement of the pavement on the northern half of 15th Street adjacent to the new library. According to the contract documents, the southern half is to be slurry -sealed and the cross gutter immediately east of National City Boulevard is to remain in place. This is how the project was put together when it was submitted to the State for Grant funding two years ago. Today, the whole of 15th Street is in poor condition and therefore the plan to slurry seal the southern half is no longer the correct fix for this street, especially since it will be the street right in front of the City's new library. I asked Jaynes Corporation, the library construction contractor, to propose a price to also remove and replace the southern half of the street and remove and replace the entire concrete cross gutter which is severely cracked while they are doing the work on the north half. Jaynes Corporation responded with a very reasonable price of $36,545. ("Reasonable" is based upon the following: We just opened bids on the annual pavement overlay and street reconstruction project, valued at approximately $1.1 million dollars which is also on today's agenda for award. If we change order the 15th Street work into the pavement project it would result in a cost of $41,500 using the unit costs of the low bidder on the pavement project). The work and cost breakdown associated with the work is further detailed in the attached copy of the proposed contract change order. It is recommended that the City Council adopt the attached resolution authorizing the Acting Director of Public Works/Engineering to execute the change order for this work. RESOLUTION NO. 2004 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE ACTING DIRECTOR OF PUBLIC WORKS/ENGINEERING TO EXECUTE A CHANGE ORDER WITH JAYNES CORPORATION FOR $36,545 TO INCLUDE THE REMOVAL AND RECONSTRUCTION OF THE SOUTHERN HALF OF 15TH STREET IMMEDIATELY ADJACENT TO THE NEW LIBRARY IN THE LIBRARY CONSTRUCTION PROJECT (THE NORTH HALF OF THE STREET IS A PART OF THE BASE CONTRACT AWARDED TO JAYNES CORPORATION) WHEREAS, the new public library project was submitted to the State for grant funding two years ago and included a complete removal and replacement of the pavement on the northern half of 15th Street adjacent to the new library, with the southern half of the street is to be slurry -sealed; and WHEREAS, the contract for the Library Construction Project was awarded to Jaynes Corporation on February 10, 2004, by the adoption of Resolution No. 2004- 19; and WHEREAS, today, the southern half of 15th Street, which will be directly in front of the new library, is in poor condition and needs the street and entire concrete cross gutter to be removed and replaced. NOW, THEREFORE, BE RESOLVED that the City Council of the City of National City hereby authorizes the Acting Director of Public Works/Engineering to execute a change order with Jaynes Corporation for $36,545 to include the removal and reconstruction of the southern half of 15t Street immediately adjacent to the new library in the Library Construction Project. EXPLANATION The project is proposed in the southeast corner of the Jimmy's Restaurant parking lot, adjacent to the west side of Interstate 805, at 1900 East Plaza Boulevard. There is an existing 65-foot tall freestanding sign in this portion of the lot that identifies Jimmy's Restaurant. The property is zoned General Commercial (CG-PD). The parking lot has 98 parking spaces and landscaping, consisting of trees and bushes, at the perimeter. The applicant proposes to install a wireless communications facility within a roughly 440 square foot lease area in the parking lot. The proposal includes replacing the existing 65-foot tall sign with a new 75-foot tall freestanding sign containing twelve panel antennas, and constructing a 242 square foot equipment shelter. The shelter would be similar in style and color to the restaurant. Due to the sign location being approximately 20-25 feet below the freeway, the actual height of the sign above the freeway would be approximately 45-50 feet. Planning Commission held hearings on this item on June 7 and July 19, 2004. At the initial hearing, there was no public testimony other than the applicant. Planning Commission discussion focused on the design of the new sign and the possibility of placing the equipment underground. The applicant stated that this was not feasible and offered to continue the hearing to address design issues. At the second hearing the Planning Commission considered a revised sign design. The sign face was redesigned to more closely match the look of the existing sign, with the angular design of the Jimmy's logo being incorporated. Additionally, the overall thickness of the sign was increased by 3 feet, for a total of 5-'Y2 feet. The Planning Commission voted to approve the Conditional Use Permit, finding that the proposal would not adversely affect the surrounding area. That the proposed use is deemed essential and desirable to the public convenience and welfare, since the new facility will improve the performance of the Cingular Wireless wireless communications network, resulting in enhanced service for it's customers. This Conditional Use Permit authorizes a wireless communications facility at Jimmy's Restaurant. The landscape plan shall reflect the use of drought tolerant planting and water conserving irrigation devices. 4. The permittee shall not object to co -locating additional facilities of other communication companies and sharing the project site, provided such shared use does not result in substantial technical or quality -of -service impairment for the permitted use. In the event a dispute arises with regard to co -locating with other existing or potential users, the City may require a third party technical study at the expense of either or both the applicant or the complaining user. This condition in no way obliga s the City to approve any co -location proposal if it is determined by the City not to be desirable in a specific case. 5. Any antennas, equipment or facilities that are abandoned, decommissioned, or become obsolete shall be removed. 6. Plans must comply with the 2001 editions of the California Building Code, the California Mechanical Code, the California Plumbing Code, the California Electrical Code, and California Title 24 energy and handicapped regulations. 7. 30-year composite roof shingles shall be used for the roof of any equipment shelter. 8. Television cable companies shall be notified a minimum of 48 hours prior to filling of cable trenches. 9. The sign and the exterior walls of any exposed equipment to a height of not less than 6 feet shall be treated with a graffiti resistant coating subject to approval from the Building and Safety Director. Graffiti shall be removed within 24 hours of its observance. 10. The deteriorated portions of the existing street improvements (ramp at entrance) along the property frontages shall be removed and replaced. 11. A permit shall be obtained from the Public Works Department for all improvement work within the public right-of-way. 12. Before this Conditional Use Permit shall become effective, the applicant and the property owner both shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. In 2003, a Conditional Use Permit was approved for a charter school (kindergarten - 6th grade) at the church. One of the issues brought up was separating the children playing outside from vehicular traffic. The play area is in the northwest portion of the site. The applicant proposes to construct a wall along the north and west property lines of the church. The lower 2 feet of the wall will be masonry with a stucco finish, and the upper 4 to 5 feet will be wrought iron sections between 6-foot tall masonry pilasters. The curved design of the fence will cause it to protrude above the pilasters up to 7 feet high. This exceeds the code limitation allowing a wall height of 4 feet in the front and exterior side yard setbacks, with 4'/2-foot tall pilasters. Other properties in the area, including the National Guard Armory adjacent to the south that is also in an Institutional Zone, have front fences or walls higher than 4 feet. Planning Commission held a hearing on this item on July 19, 2004. There was no public testimony at the hearing. The 5/8-inch fire detector meter on the east side of the property shall be relocated to the public right-of-way behind the sidewalk, outside of the perimeter wall. 6. Before this Zone Variance shall become effective, the applicant and the property owner both shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the Zone Variance. Location Map A-200 (Rev. 7/03) Background Report The project site is located in the Limited Commercial (CL) Zone at the northwest comer of 18th Street and Lanoitan Avenue. The vacant, irregularly shaped property is approximately 8,970 square feet in size. It has approximately 64 feet of frontage on 18th Street and about 103 feet on Lanoitan Avenue. The applicant proposes to construct a two-story building with four condominium units on the lot. It will be located on the westerly half of the property and will have a tile roof and stucco exterior with wood trim. The front facade, which will face toward Lanoitan Avenue, will feature four front entry porches and four eight foot wide garage doors (see attached Applicant's Plans). All four units will have similar floor plans and features. Each two -floor unit will have three bedrooms, two and a half bathrooms, a one -car garage, and an approximately 235 square foot patio/yard area at the rear. The building will be setback 10 feet from the west property line, 5 feet from the north property line and 15 feet from 18th Street. There will be a small four space parking lot accessible from Lanoitan Avenue. All of the spaces are standard size, excluding the space closest to unit 4, which is 17 feet deep (where 19 feet is standard). Additionally, the garage space for unit 4 has approximately 21 feet of backup space, where 24 feet is required. A four -foot wide area between the parking lot and the public sidewalk will be landscaped along with the 15 feet area between the building and 18th Street, and the private yard areas. The landscaping will consist of a mix of trees, shrubs and groundcover. Finally, a trash enclosure, for use by the occupants of all four units, will be constructed at the northwest edge of the parking lot. The Planning Commission held a public hearing on this proposal at their July 19, 2004 meeting. There was no public testimony; however, the Commissioners discussed the suitability of the site for the proposed development. Specifically, they focused on the functionality of the small parking lot. Additionally, Commissioners discussed possible aesthetic enhancements to the parking lot. Commissioners voted to approve the Tentative Parcel Map and Conditional Use Permit finding that the proposed project is appropriate for the site and that it will enhance the area in a manner that is compatible with existing development. The site is physically suitable for the proposed type of development, since the proposed multi -family development will be complementary to the existing commercial and multi- family development in the immediate area. 3. The site is physically suitable for the proposed density of development, since the site is large enough to accommodate the four units with individual outdoor patio/yard areas and functional off-street parking. 4. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, since there is no vegetation nor water on the partially developed and disturbed property. 5. The design of the subdivision and the proposed/required improvements are not likely to cause serious public health problems, since all necessary public services will be provided. 6. The design of the subdivision and the proposed/required improvements will not conflict with easements, acquired by the public at large, for access through or use of the property within the proposed subdivision, since no such easements are located on the site. 7. The discharge of sewerage waste from the subdivision into the City of National City sewer system will not result in violation of existing requirements prescribed by the California Regional Quality Control Board pursuant to Division 7 (commencing with Section 13000) of the Water Code, as specified by Government Code Section 66474.6. 8. The subdivision has been considered by the Planning Commission with regard to its effect on the housing needs of the region, and these needs are balanced by the public service needs of the residents and available fiscal and environmental resources. 9. The design of the subdivision provides, to the extent feasible, for future passive and natural heating and cooling opportunities in the subdivision, based on consideration of local climate, topography, property configuration and other design and improvement requirements without requiring reduction in allowable density or lot coverage. That the site for the proposed use is adequate in size and shape, since the 8,977 square foot property is large enough to contain four residential units, with eight off-street parking stalls and private patio/yard areas. 2. That the site has sufficient access to streets and highways that are adequate in width and pavement type to carry the volume and type of traffic generated by the proposed use, since both 18th Street, a major arterial with a capacity of 25,000 average daily trips (ADT) and a volume of 7,000 ADT, and other nearby local residential streets have sufficient capacity to absorb the negligible increase of approximately 32 ADT. 3 3. That the proposed use will not have an adverse effect upon adjacent or abutting properties, since the proposed development will enhance the appearance of the predominantly commercial intersection. 4. That the proposed use is deemed essential and desirable to the public convenience and welfare, since the project will create additional homeownership opportunities suitable for families on a vacant commercial lot. FINDINGS FOR APPROVAL OF THE MIXED USE EXCEPTIONS 1. That because of special circumstances applicable to the property, shape, location and surroundings, the strict application of Title 18 of the Municipal Code (Zoning) deprives such property of privileges enjoyed by other property in the vicinity and under the identical zone classification, since irregular shape of the property makes it difficult to place a building outside of the required setbacks or to meet all standard parking dimensions. 2. That the requested exceptions are subject to such conditions which will assure that the adjustment authorized will not constitute a grant of special privileges inconsistent with the limitations upon other properties in the vicinity and zone in which such property is situated, since adequate setbacks, which are greater than those required for commercial development allowed in the zone, will be provided, and since each unit will have a sizable private patio/yard area. 3. Such entity shall operate under recorded conditions, covenants, and restrictions approved by the City Attorney as to form and content, which shall include compulsory membership of all owners and flexibility of assessments to meet changing costs of maintenance, repairs and services. 6. Plans must comply with the 2001 editions of the California Building Code, the California Mechanical Code, the California Plumbing Code, the California Electrical Code, and California Title 24 energy and handicapped regulations. 7. A grading and drainage plan shall be submitted showing all of the proposed and existing on - site and off -site .improvements. The plan shall be prepared in accordance with the City's standard requirements by a Registered Civil Engineer. All necessary measures for prevention of storm water pollution and hazardous material run-off to the public storm drain system from the proposed parking lot or development shall be implemented with the design of the grading. This shall include the provision of such devices as storm drain interceptors, clarifiers, or filters. Best Management Practices for the maintenance of the parking lot, including sampling, monitoring, and cleaning of private catch basins and storm drains, shall be undertaken in accordance with the National Pollution Discharge Elimination System (NPDES) regulations. A private storm water treatment maintenance agreement shall be signed and recorded. The checklists for preparation of the grading plan drainage plan and Standard Urban Storm Water Mitigation Plan (SUSMP) are available at the Public Works Department. 8. A soils engineering report shall be submitted for the Public Works Department's review, after Planning Commission approval. The report shall address the stability of all of the existing and proposed slopes on the property. It shall also address the adequacy of the building pads, the criteria for any new retaining wall design, the maximum allowable soil bearing pressure and the required pavement structural sections for the proposed streets, the parking areas, and the driveways. As a minimum, the parking lot pavement sections shall be 2 inch A.C. over 4 inch Class II aggregate base. The street pavement sections shall be in accordance with National City modified Standard Drawing G-24. All soils report findings and recommendations shall be part of the Public Works Department requirements. 9. A sewer permit will be required. The method of sewage collection and disposal shall be shown on the grading/drainage plan. Any new sewer lateral in the City right-of-way shall be 6 inch in size with a clean out. A sewer stamp "S" shall be provided on the curb to mark the location of the lateral. 10. A permit shall be obtained from the Public Works Department for all improvement work within the public right-of-way, and any grading construction on private property. 5 11. A cost estimate shall be submitted with the plans. A performance bond equal to the approved cost estimate for all of the proposed grading, drainage, street improvements, landscaping and retaining wall work shall be posted. Three percent (3%) of the estimated cost shall also be deposited with the City as an initial cost for plan checking and inspection services at the time the plans are submitted. The deposit is subject to adjustment according to actual work hours. 12. A title report shall be submitted to the Public Works Department, after the Planning Commission approval, for review of all existing easements and the ownership at the property. 13. The final parcel map shall meet all of the requirements of the Subdivision Map Act, and the City of National City Municipal Codes including certification, acknowledgement, complete boundary information and monumentation. 14. The subdivider shall submit an approval letter from Sweetwater Authority stating fire flow requirements have been met. If additional improvements are needed, the developer shall enter into an agreement for the water improvements with the Authority prior to obtaining the final map approval. 15. The developer shall bond for the monumentation, the public improvements and the on -site grading, drainage, landscaping, and other improvements through an agreement with the City prior to the approval of the final map. 16. All utility distribution facilities within the boundaries of the subdivision, and within the half street abutting the new subdivision, shall be placed underground. 17. The final map shall be recorded prior to issuance of any building permit. 18. All new property line survey monuments shall be set on private property, unless otherwise approved. 19. The parcel map shall use the California Coordinate System for its "Basis of Bearings" and express all measured and calculated bearings in terms of the system. The angle of grid divergence from a true meridian, and the north point shall appear on the map. Two measured ties from the boundary of the property to existing horizontal control stations shall be shown. 20. Television cable companies shall be notified a minimum of 48 hours prior to filling of cable trenches. 21. Exterior walls of buildings/ freestanding signs/ trash enclosures to a height of not less than 6 feet shall be treated with a graffiti resistant coating subject to approval from the Building and Safety Director. Graffiti shall be removed within 24 hours of its observance. 22. The property owner shall submit a letter to the Sweetwater Authority stating fire flow requirements. The owner shall enter into an agreement with the Authority for any water facility improvements required for the proposed project. 23. Before this Conditional Use Permit/ Tentative Parcel Map shall become effective, the applicant and the property owner both shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the Conditional Use Permit/ Tentative Parcel Map. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The Notice of Restriction shall provide information that conditions imposed by approval of the Conditional Use Permit/ Tentative Parcel Map are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. 24. Applicant's Plans (Exhibit A -revised datod 3/29/2001) BACKGROUND REPORT The project site is 1937 Lanoitan Avenue, a 10,500 square foot property on the east side of Lanoitan Avenue, approximately 50 feet north of 20th Street in the Single -Family Residential Extendable -Planned Development (RS-3-PD) Zone. The rectangular lot has 66 feet of frontage on Lanoitan Avenue and is about 159 feet deep; it slopes up moderately from the street to the rear of the property. There is an existing single -story, 2,000 square foot house on the front of the lot (see the attached site photographs). The applicant/owner resides in the house with his family. The house has a stucco exterior and hip roof with asphalt shingles; it is in fair condition. There is no garage or carport, but two surface parking spaces are adjacent to the rear of the house; the spaces are accessed by a 12 foot wide driveway that runs along the south property line. There is also one parking space in front of the house in the front yard setback area. Finally, there is a partially constructed wall in the front yard with columns that exceed the maximum height allowed. The property is located in a predominantly single-family neighborhood, with several duplexes located south of the site. Most of the immediate area is either zoned RS-3-PD or Single -Family Residential (RS- 2). The applicant/property owner is proposing to build a second detached single-family dwelling on the rear of the lot behind the existing house. The new house would be two -stories (22 feet) tall with four bedrooms and three bathrooms, and have a total of 1,800 square feet of floor area. A stucco exterior and gable roof with asphalt shingles are proposed. The new house would be separated from the existing house by about 37 feet; it would be setback from the north property line by five feet and the rear (east) property line by 12 feet. The proposal also includes a one -car carport on the south side of the house; an uncovered surface parking space would also be provided between the new house and the carport. Finally, the side and rear yard areas adjacent the new house would be landscaped, and the front yard area, abutting Lanoitan Avenue, would also be re -landscaped. The landscaping would consist of a mix of trees, shrubs, and grass. The proposal is consistent with Housing Element objectives for the development of new housing opportunities for all income groups. Regional demand and objectives in the Housing Element call for more housing development than has occurred in recent years. Additionally, the proposed four -bedroom house will be suitable for larger families as encouraged by the General Plan. The proposal will not increase the number of home ownership opportunities in the City. Staff asked the applicant about his intended use of the new house, and whether he had considered dividing the property into two lots. He stated that he and his immediate family will continue to reside in the existing house, and that he will likely rent the new house to family members; he does not desire to divide the property. The suitability of the lot to be split into two is not optimal, since the rear lot would not have street frontage or alley access, and since there is a somewhat narrow driveway for access to the property. The proposal meets applicable Land Use Code requirements, such as setbacks, separation between buildings, number of off-street parking spaces, and open space (yard areas). For example, the Land Use Code requires two off-street parking spaces for each single-family house; one of the two spaces needs to either be in a carport or a garage. Often times with discretionary permits, a two -car garage is required for each house. As previously mentioned, there is an existing parking space in the front yard that is prohibited and the front wall under construction may exceed height limits. Conditions requiring the illegal parking space be removed and the columns of the wall in the front yard be modified to comply with height limits have been included. Additionally, there is a trailer and small motorhome stored in the rear yard area. The Building and Safety Department is continuing to pursue a complaint about a person living in the trailer. Staff has repeatedly requested that the applicant correct these Code violations over the past several months. Despite this effort the condition of the property has gotten worse; as of the writing of this report there were several cars stored in the rear yard in addition to the to the motorhome and trailer. The proposal meets most City Design Guidelines as well. In particular, the guidelines encourage the design of the second house to be compatible with the existing development, and for the existing development to be upgraded if needed. The new house would have a stucco finish with an asphalt shingle roof like the existing house, and the windows in both houses will be similar. A condition has been included requiring the roof pitch of the new house to match the pitch of the roof on the existing house. Also, the applicant has agreed to construct a new two -car carport adjacent the rear of the existing house; a condition requiring this has been attached. In addition to the previously mentioned conditions, a condition requiring a residential fire sprinkler system has been included as suggested by the Fire Department. Engineering Department conditions requiring the small existing retaining wall at the rear of the existing house to be rebuilt, and a grading/drainage plan prepared are also included with the standard conditions of approval. Planning Commission held public hearings on this item at the May 17th and June 21, 2004 meetings. At the May 17th meeting, several members of the public expressed concems about the condition of the property and the lack of available street parking in the area. The Planning Commission confirmed that the proposed development meets the off-street parking requirements, and discussed the condition of a property line fence, concluding that the possible replacement of the fence is a private matter between the two property owners. Finally, Commissioners considered the adequacy of Fire Department access to the rear house and questioned the need for maintenance of the fire sprinkler system required by the Fire Department. Commissioners continued the public hearing to the June 21, 2004 meeting to allow the Fire Department to comment on the site access and for the applicant to modify the plans to include a larger access driveway if needed. In between meetings, Planning staff met with and discussed the proposal in detail with the Fire Department. The attached message from the Deputy Fire Marshal, Jeff Burriss, notes that if the driveway were widened the Fire Department would still not use it because it is a small residential property; they would still fight a fire in the rear house from the street. He also notes that contemporary residential fire sprinkler systems are effective and require no maintenance. The Engineering Department confirmed that the retaining wall on the middle of the property was built without permits; however, they also noted that after the wall was constructed the applicant had it certified by a Registered Civil Engineer in order to satisfy City requirements. At the June 215` meeting, the Commissioners concluded that the proposal will positively mafect the overall property condition. That the proposed use is deemed essential and desirable to the public convenience and welfare, since the proposal will result in an increase in the housing stock in the City and region consistent with Housing Element objectives, which call for more housing and region consistent with Housing Element objectives, which call for more housing development than has occurred in recent years. Also, the proposed development will be suitable for a larger family as encouraged by the General Plan. This Planned Development Permit authorizes a second residential unit on the rear of a lot with an existing single-family house. Plans must comply with the 2001 editions of the California Building Code, the California Mechanical Code, the California Plumbing Code, the California Electrical Code, and California Title 24 energy and handicapped regulations. 8. The new house shall have a residential fire sprinkler system. Plans and for the system shall be submitted to the Fire Department for review and approval. 9. A minimum 1,000 gpm fire flow with a duration of two hours measured at 20 psi shall be provided. 10. A grading and drainage plan shall be submitted showing all of the proposed and existing on -site and off -site improvements. The plan shall be prepared in accordance with the City's standard requirements by a Registered Civil Engineer. All necessary measures for prevention of storm water pollution and hazardous material run-off to the public storm drain system from the proposed development shall be implemented with the design of the grading. This shall include the provision of such devices as storm drain interceptors, clarifiers, or filters. Best Management Practices for the maintenance of the parking lot, including sampling, monitoring and cleaning of private catch basins and storm drains, shall be undertaken in accordance with the National Pollution Discharge Elimination System (NPDES) regulations. A checklist for preparation of the grading and drainage plan is available at the Engineering Department. 11. A sewer permit will be required. The method of sewage collection and disposal shall be shown on the grading/drainage plan. Any new sewer lateral in the City right-of-way shall be 6 inch in size with a clean out. A sewer stamp "S" shall e provided on the curb to mark the location of the lateral. 12. A permit shall be obtained from the Engineering Department for all improvement work within the public right-of-way, and any grading construction on private property. 13. A cost estimate shall be submitted with the plans. A performance bond equal to the approved cost estimate for all of the proposed grading, drainage and street improvements, landscaping and retaining wall work shall be posted. Three percent (3%) of the estimated cost shall also be deposited with the City as an initial cost for plan checking and inspection services at the time the plans are submitted. The deposit is subject to adjustment. 14. The existing, recently constructed retaining wall shall be properly permitted or removed. 15. Television cable companies shall be notified a minimum of 48 hours prior to filling of cable trenches. 16. Exterior walls of buildings/ freestanding signs/ trash enclosures to a height of not less than 6 feet shall be treated with a graffiti resistant coating subject to approval from the Building and Safety Director. Graffiti shall be removed within 24 hours of its observance. 17. The property owner shall submit a letter to the Sweetwater Authority stating fire flow requirements. The owner shall enter into an agreement with the Authority for any water facility improvements required for the proposed project. 18. Before this Planned Development Permit shall become effective, the applicant and the property owner both shall sign and have notarized an Acceptance Form, provided by the Planning Department, acknowledging and accepting all conditions imposed upon the approval of this permit. Failure to return the signed and notarized Acceptance Form within 30 days of its receipt shall automatically terminate the Planned Development Permit. The applicant shall also submit evidence to the satisfaction of the Planning Director that a Notice of Restriction on Real Property is recorded with the County Recorder. The applicant shall pay necessary recording fees to the County. The Notice of Restriction shall provide information that conditions imposed by approval of the Planned Development Permit are binding on all present or future interest holders or estate holders of the property. The Notice of Restriction shall be approved as to form by the City Attorney and signed by the Planning Director prior to recordation. 19. This permit shall become null and void if not exercised within one year after adoption of the resolution of approval unless extended according to procedures specified in Section 18.116.190 of the Municipal Code. A residential fire sprinkler system at this home will provide the fire department extra time to get in place to extinguish a fire if it has not already been put out by the sprinkler system. These systems, as currently installed, can last almost indefinitely with no maintenance. As far as widening the driveway to 20 feet to accommodate a 40,000 pound fire truck, that seems like overkill. We would not commit a fire engine to such a residential driveway in the first place. Also, there is no place for us to turn around if we could get in. Common usable open space means open space substantially free of structures but containing improvements which are part of a general development plan and are appropriate for the active or passive recreation of residents of a planned residential development. The common usable open space shall be designed and screened appropriately for its intended use, and shall have a minimum dimension of 10 feet. The common open space shall be located within the total development site and shall be used for active or passive recreational purposes by occupants of the development, or dedicated to the City for public park. Common usable open space shall not include public or private streets, driveways, private yards or patios, parking or loading spaces, or utility easements where the ground surface cannot be used appropriately for active or passive recreation, nor other areas primarily designed for other operational functions. Section 3. That section 18.04.462 of Title 18 of the Municipal Code be amended to read as follows: 18.04.462 Open space, private usable. Private usable open space shall be improved for recreational use by the residents of the unit to which it is credited. It shall be located adjacent to and accessible from the unit that it serves, and shall have a minimum dimension of five feet. At ground level it shall be screened by the use of five and a half foot tall dense landscaping or a wall/fence. If the space is four feet or higher above grade or at ground level but located such that the space faces a beneficial outward and open orientation the space shall be screened with three and a half foot tall dense landscaping or a wall/fence. Section 4. That section 18.14.301 of Title 18 of the Municipal Code be amended to read as follows: 18.14.301 Usable open space in multi -family projects. A. For projects of three units or more common usable open space shall be required in a minimum amount of 300 square feet per dwelling unit. Private usable open space may be substituted for such common usable open space in the ratio prescribed in section 18.14.3016, except that actual common usable open space shall be provided in the amount of 300 square feet or 75 square feet per unit, whichever is greater. B. Each square foot of private usable open space shall be considered equivalent to two square feet of required common usable open space, and may be so substituted, subject to the minimum requirements for actual common usable open space. At least seventy-five percent of the units shall be provided with at least 60 square feet of private usable open space. C. Provision of usable open space in setback areas and court, and indoors. 1. Both common and private usable open space provided at ground level may be provided in the interior side yard and rear yard setback areas, within courts, and within exterior side yard setback areas to within five feet of the property line. 2. But, as the project proceeds and the contingency fund impacts are identified we will reevaluate our ability to fund this additive alternate alley. RESOLUTION NO. 2004 — RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY SUPPORTING THE REPEAL OF THE NORTH COUNTY RECYCLED SOLID WASTE DISPOSAL INITIATIVE (PROPOSITION C) ADOPTED IN 1994 WHEREAS, the City of National City provides representation to agencies in connection with State and Federal water quality standards and related planning and policy matters, and participates in deliberations of and cooperates with regional land use planning agencies, and county planning agencies; and WHEREAS, the Pala Band of Mission Indians has submitted to the Registrar of Voters a citizens' initiative with more than 100,00 signatures to repeal the North county Recycled Solid Waste Disposal initiative (Proposition C), adopted by San Diego County voters in 1994, that would site a landfill in Gregory Canyon; and WHEREAS, the San Diego County Board of Supervisors has indicated it will place the citizens' initiative on the November general election ballot; and WHEREAS, the Gregory Canyon landfill site is adjacent to the San Luis Rey River groundwater basin that contains substantial quantities of renewable, natural, potable water, and which is also a potential site for underground storage of imported water, such sites being perilously deficient in San Diego County; and WHEREAS, recognized authorities in the fields of geology and landfill contaminants have stated unequivocally that any device currently available to contain contaminants in landfill operations must surely fail, and that such failures will lead to destruction of underlying groundwater basins as sources of native, potable water and as storage basins for imported water; and WHEREAS, the City of Oceanside has depended upon the San Luis Rey River for water supplies for over 120 years and has invested millions of dollars to maintain and preserve this valuable water supply for the citizens of Oceanside and will continue to develop the resource for its citizens now and for many generations in the future. This time, the opposing sides will be more evenly matched. The cam- paign will pitagroup of landfill inves- tors, who already have spent millions, against opponents that in- clude the Pala Band of Mission Indi- ans, who now have a prosperous casino to. help bankroll a campaign against the landfill. Yesterday, the county Board of Supervisors voted unanimously to place Proposition B on the Nov. 2 ballot If approved by a majority of vot- ers, it would overturn Proposition C, passed by 68 percent of those who cast votes in 1994. That measure amended the county's General Plan to allow for a landfill and recycling center in Pala's Gregory Canyon,. provided the developers obtained the required permits from state and federal agencies. Gregory Canyon Ltd., the partner- ship proposing the private landfill, has spent about$20 million on devel- oping it over the decade. Its political committee, Citizens for Environ- mental Solution, hasspent nearly $201,000 in recent months to count- er the anti -landfill initiative, ;includ- ing a series of full -page newspaper ads. Gregory Canyon was identi- fied as a possible landfill site in 1988. It is three miles east of Interstate 15, south of the San Luis Rey River. The 320-acre landfill would be built on the western slopes of Gregory Mountain, within 1,770 acres owned by Gregory Canyon Ltd. The mountain's eastern face overlooks the Pala Casino. "The people of San Diego County asked you, clearly and succinctly, to allow them to de- cide whether Gregory Canyon should be protected or de- stroyed," Lenore Volturno, Pa - la's environmental director, wrote in a statement to supervi- sors yesterday. 'Thank you for listening to them." Richard Chase, the landfill's project manager, said he was confident voters will reject the measure: "I think we're going to get 70 percent," Chase said. Much has changed in the 10 years since Proposition C, a point made by both sides. For the Pala Band, it is mon- ey and the power it brings. In 1994, thetribe had little to fund its cause and no campaign to rally around. It was over- whelmed by the landfill's back- ers, who spent more than $500,000 to blanket the county with direct -mail fliers. The tribe contends voters at the time weren't given all the facts before they approved the landfill, and didn't know the dump could harm the environ- ment and was near sacred Indi- an sites. The developers say the last 10 years have further proven the need for a landfill in North County. The area's population is growing, and so is the amount of trash it produces. The.county's San Marcos Land- fill closed in 1997 and space in other county landfills . is shrinking. "Everybody generates trash. No one believes we can recycle everything," Chase said. "The voters have a lot of common sense." Landfill proponents say mod- ern regulations and technolo- gy, such as a waterproof liner with a drainage system under it, would prevent leaks and make Gregory Canyon "the saf- est, most environmentally pro- tective landfill in San Diego County and throughout Califor- nia." They said Indian sites would be protected and contend the Pala band is driven by econom- ic interests because it doesn't want garbage trucks on state Route 76, the road to its casino. Opponents say they are not opposed to a landfill in North County, but contend Gregory Canyon is the wrong place for one because it would be within a few hundred yards of the San Luis Rey River and a major drinking -water aquifer under it After the approval of Proposi- tion C, the developers thought it would take a a few years to open the landfill. Progress has been exceedingly 'slow, with both sides filing lawsuits at ev- ery major step. In March, the fight heated up again. The Pala band, with its partner RiverWatch, a North County environmental group, announced plans to circulate petitions for a ballot measure. Gregory Canyon Ltd. struck back with newspaper ads, cau- tioning "Voters beware!" and. that the petitions sought to mis- lead the public. Landfill opponents collected 83,000 signatures; they needed 66,000. They also petitioned local governments and added to their list of supporters.
