Real Property Transaction — Lease of City -owned property at 1430 D Avenue to Boys' and Girls' Club
of Greater San Diego, Inc.

EXPLANATION:
For over one year, City staff has been involved in negotiations with the Boys' and Girls' Club of
Greater San Diego, Inc. (BGCGSD), for a 20-year lease of the City -owned property at 1430 D Avenue.
At the December 7, 2010 City Council meeting, the Council approved a lease with an early termination
provision authorizing the City to terminate the lease upon one year's notice if the Leased Premises were
needed for a municipal purpose of the City. When BGCGSD objected to this early termination provision,
City staff substituted BGCGSD's proposed language that would allow for early termination upon one
year's notice by the City "in the event the Leased Premises must be reclaimed for public use due to the
requirements of a governmental agency, such as the U.S. Army Corps of Engineers". However,
BGCGSD is now requesting additional language providing that if the Leased Premises are reclaimed,
the City shall, at no cost to BGCGSD, assist in the relocation of BGCGSD to an alternative site
substantially the same as the Leased Premises and acceptable to BGCGSD.
City Council direction is requested on this issue.
