ORDER OF BUSINESS: Public sessions of all Regular Meetings of the
City Council / Community Development Commission - Housing
Authority (hereafter referred to as Elected Body) begin at 6:00 p.m. on
the first and third Tuesday of each month. Public Hearings begin at
6:00 p.m. unless otherwise noted. Closed Sessions begin at 5:00 p.m.
or such other time as noted. If a workshop is scheduled, the subject
and time of the workshop will appear on the agenda. The Mayor and
Council members also sit as the Chairperson and Members of the
Board of the Community Development Commission (CDC).
REPORTS: All open session agenda items and reports as well as all
documents and writings distributed to the Elected Body less than 72
hours prior to the meeting, are available for review at the entry to the
Council Chambers. Regular Meetings of the Elected Body are webcast
and archived on the City's website www.nationalcityca.gov.
PUBLIC COMMENTS: Prior to the Business portion of the agenda, the
Elected Body will receive public comments regarding any matters
within the jurisdiction of the City and/or the Community Development
Commission. Members of the public may also address any item on the
agenda at the time the item is considered by the Elected Body.
Persons who wish to address the Elected Body are requested to fill out
a "Request to Speak" form available at the entrance to the City Council
Chambers, and turn in the completed form to the City Clerk. The Mayor
or Chairperson will separately call for testimony of those persons who
have turned in a "Request to Speak" form. If you wish to speak, please
step to the podium at the appropriate time and state your name and
address (optional) for the record. The time limit established for public
testimony is three minutes per speaker unless a different time limit is
announced. Speakers are encouraged to be brief. The Mayor or
Chairperson may limit the length of comments due to the number of
persons wishing to speak or if comments become repetitious or
irrelevant.
WRITTEN AGENDA: With limited exceptions, the Elected Body may
take action only upon items appearing on the written agenda. Items
not appearing on the agenda must be brought back on a subsequent
agenda unless they are of a demonstrated emergency or urgent
nature, and the need to take action on such items arose after the
agenda was posted.
Upon request, this agenda can be made available in appropriate alternative formats to persons with a
disability in compliance with the Americans with Disabilities Act. Please contact the City Clerk's Office at

EXPLANATION:
The Friends of the National City Public Library respectfully request City Council's acceptance of an art
piece designed by internationally known artist James Hubbell.
The art piece consists of a 19" x 31" stained-glass panel, portraying the artist's interpretation of the
eternal quest for the Grail. The panel is to be affixed to the inner side of a window in the Library's
Young Adult area. This is a second panel designed by Artist Hubbell. The first piece, featuring the
Russian legend of the Firebird, was donated to the Library in October 2009, and is currently gracing one
of the three windows in the Young Adult area.
The entire cost of the art piece as well as its installation will be fully defrayed by the Friends of the
Library. By donating this second piece of art, the Friends wish to share with a community who values art
many forms the opportunity to embrace Mr. Hubbell's outstanding craftsmanship that makes him one
—f the leading artists of his generation.

WHEREAS, the Friends of the Library (the "Donor") desires to donate an art

Purpose
From time to time, individuals, community groups and businesses may wish
to make donations to the City in either cash or in -kind contributions that
enhance projects, facilities, and programs, and the need for such projects,
facilities and programs often exceeds the City's ability to fund them.
Accordingly, it is an acceptable and appropriate practice to accept
donations, in order to enhance city programs and/or facilities to provide a
higher level of service to the public.
The purpose of this Policy is to establish an orderly and efficient process for
the acceptance of donations made to the City. It is also important to
process donations in such a way so as to distinguish donations made to the
City from those made to individuals, e.g. gifts or campaign contributions.
Policy
All donations made to the City shall be accepted and processed according
to the following:
1. The donation must have a purpose consistent with City goals and
objectives.
2. The City Council may decline any donation without comment or
cause.
3. The donation will not be in conflict with any provision of the law.
4. In kind donations will be aesthetically acceptable to the City.
5. The donation will not add to the workload of the City Council or staff
unless it provides a net benefit to the City.
6. The donation will not bring hidden costs such as starting a program
the City would be unwilling to fund when the donation was
exhausted.

7. The donation must place no restriction on the City, unless agreed to
by the City Council.
8. The donation shall become the property of the City.
9. All donations will receive recognition appropriate to the level and
nature of the donation as determined by the City. For those of a
capital nature, that may be in the form of signage, marking or
naming, as determined by the City Council. Regardless of the
recognition strategy selected, the intent shall be to appropriately
honor the donor for their contribution to the community. The
appearance of traditional commercial advertising or product
endorsements that promote the donor shall be avoided.
10. All donations shall be accepted directly by Finance Department staff.
11. Cash donations exceeding $5,000, and in -kind donations exceeding
$5,000 in value, shall be accepted through a written agreement
consistent with these guidelines and approved by the City Council.
In -kind capital donations will be subject to normal City review,
permitting, inspection and insurance requirements.
12. At the time of acceptance, all donations, regardless of value, will be
acknowledged in writing in a form approved by the City Attorney.
The original acknowledgment will be sent to the donor and a copy
forwarded to the Finance Department.

The Friends of the National City Public Library request your acceptance of our gift
of another innovative glass art piece, to be affixed to the inner side of the small
window in the Young Adult Center. Both the Library Board of Trustees and the
National City Public Art Committee have reviewed and voted to accept this gift.
We are enclosing a picture of the proposed piece, which is inspired by the eternal
search for the Grail. This artwork was designed by the internationally known artist
Jim Hubbell. Mr. Hubbell was also the designer of the beautiful "Firebird" window
which was installed in this same area in October of 2009. This is an opportunity
for National City to be recognized as a community that values art in many forms.
Mr. Hubbell's new colored glass design will be a wonderful addition to our library.

UNCONDITIONAL DONATION OF PERSONAL PROPERTY
TO THE CITY OF NATIONAL CITY
The Friends of the National City Public Library (hereinafter referred to as "the Donor") hereby makes an
unconditional donation, in perpetuity, of a 19" x 31" stained-glass panel designed by artist James Hubbell inspired
by the eternal quest for the grail to be affixed to the inner side of a window in the library's Reference/Young Adult
area (hereinafter referred to as "the Donation") to the City of National City (the "City"). The Donor understands
and acknowledges that, pursuant to Sections 37354 and 37355 of the California Government Code, the City is
authorized to accept said Donation for any public purpose that the City desires.
Due to the nature of the donation, namely, a work of art, and the site on which it is installed, the Donor and
his/her/its agents, heirs, successors and assigns hereby waive any and all rights they may have under the California
Art Preservation Act, as set forth in Civil Code Section 987. The Donor agrees that upon completion, the physical
work of art which is created or installed pursuant to this Agreement shall be transferred to and shall vest in the City
of National City, and the Donor hereby expressly waives and releases all rights of ownership to the work of art,
including those under Civil Code Section 988. The Donor, his/her agents, heirs, successors and assigns also agree
not to attempt to defeat this waiver by cooperating with any organization which seeks to bring an action under Civil
Code Section 989.
Notwithstanding the foregoing, the parties acknowledge that it is the Donor's intent that the work of art being
donated herewith be displayed for an indefinite period of time in the National City Public Library. Accordingly, in
accepting the donation, the City agrees that in the event its City Council should determine in the future that the
work of art shall be removed from the Library, the City shall first give the Donor the option to take ownership of
and remove the work of from the Library at the Donor's sole cost and expense.
The Donor hereby releases the City of National City and its officers, employees and volunteers, against and from
any and all liability, loss, damages to property, claims, demands, suits, actions, proceedings, costs or attorney's
fees, of any kind or nature, resulting from or arising out of the City's use of the Donation.
The individual executing this document on behalf of the Donor represents that he/she has the legal power, right and
authority to bind the Donor; that all requisite action (corporate, trust, partnership or otherwise) has been taken by
the Donor in connection with authorizing the execution of this document; that this document shall be legally
enforceable as to the Donor; and that the execution of this document does not conflict with or result in the breach of
any contract, bond, note or other agreement or instrument to which the Donor is a party.

A Resolution authorizing the application to the State of California to update the "Targeted Employment Area"
for the San Diego Regional Enterprise Zone.

EXPLANATION:
State law currently authorizes forty-two Enterprise Zone (EZ) designations in California with two stated legislative purposes
for the of the EZ Program: 1) To "stimulate business and industrial growth in the depressed areas of the State"; and 2) To
establish a program "to help attract business and industry to the state, to help retain and expand existing state business and
industry, and to create increased job opportunities for all Californians." Essentially, EZs are competitively designated based
upon distress criteria (primarily poverty and unemployment levels) and the local government's capacity to carry out an
economic development program and provide additional local incentives. EZs are designated for 15 years. The San Diego
Regional Enterprise Zone (SDREZ), a collaborative designation with the Cities of Chula Vista, National City and San Diego
(SDREZ Partnership), was approved effective October 15, 2006. The City of San Diego is the lead agency and administrator
of the SDREZ and the Port of San Diego is a participating member of the SDREZ Partnership.
A "Targeted Employment Area" (TEA) is an area within a city, county, or city and county that is composed solely of those
census tracts that have at least 51 percent of its residents of low- or moderate -income levels. Its purpose, according to Section
'072(i) of the Government Code of the State of California, is to encourage EZ businesses to hire eligible residents from these
geographic areas. Currently, all census tracts in the City of National City qualify as a TEA.

BACKGROUND
The purpose of a TEA, according to Section 7072(i) of the Government Code of the State
of California, is to encourage EZ businesses to hire eligible residents from these
geographic areas. The incentive for these businesses is the availability of a tax credit for
hiring residents who reside in a TEA. To establish a TEA, an enterprise must submit an
application for TEA designation to the State Housing and Community Development
Department (HCD). The application must clearly identify the census tracts that will
constitute the proposed TEA and demonstrate that they meet the eligibility criteria. In
addition, the application must include certain specified documentation, such as
resolutions and a map of the TEA boundaries.
As required by the Government Code, each local governmental entity that has as
jurisdiction in the enterprise zone may elect to establish a TEA. In order to establish a
TEA, the jurisdiction/s must approve, by resolution or ordinance, the boundaries of the
TEA. A TEA may be, but is not required to be, the same as all or part of an enterprise
zone. In addition, its boundaries need not be contiguous nor encompass each eligible
TEA census tract within the jurisdiction. However there are several geographic
restrictions, for example, at least a part of each eligible TEA census tract shall be within
the territorial area of the enterprise zone jurisdictions. Only those census tracts within the
jurisdictions of the entities participating in the enterprise zone may be included in a TEA.
This restriction precludes census tracts from jurisdictions that are not a party to the
enterprise zone from inclusion in the TEA.
The Government Code also requires updates to the TEA within 180 days of updated
United States census data becoming available, each local governmental entity that has
jurisdiction of an enterprise zone shall approve, by resolution or ordinance, the
boundaries of its targeted employment area reflecting the new census data. It is
anticipated that since updated census data will now be made available annually, TEA
boundaries will be assessed on an annual basis to determine if census tracts meet TEA
eligibility requirements and make modifications as need.
San Diego's first regional TEA established in 1998 was for the Metro and South Bay EZs.
HCD approved the current TEA using 2000 census data in April 2012 retroactively to
October 15, 2006, the effective date of the SDREZ . The census tracts incorporating the
SDREZ do not have a high unemployment rate, however, these census tracts do have a
high concentration of extremely low to moderate income level population (Attachment
A). Establishing a new TEA for the SDREZ will encourage SDREZ businesses to hire
residents living in the TEA (Attachment B). One of the goals of the SDREZ is to
increase the income level of residents of the EZ by attracting and expanding industries in
the SDREZ that historically pay higher wages, such as manufacturing and high
technology. In the first five (5) years of the SDREZ designation, over 31,600 workers
were hired by 920 EZ companies and 87% of the workers lived in the TEA. The average
hourly rate for EZ eligible employees was approximately $11.30/hr.

RESOLUTION NO. 2013 —
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
AUTHORIZING THE APPLICATION TO THE STATE OF CALIFORNIA
HOUSING AND COMMUNITY DEVELOPMENT DEPARTMENT
TO UPDATE THE TARGETED EMPLOYMENT AREA FOR
THE SAN DIEGO REGIONAL ENTERPRISE ZONE
WHEREAS, on August 22, 2006, the City Council adopted Resolution No. 2006-
175 authorizing submission of an application to the State of California Housing and Community
Development Department ("HCD") for a San Diego Regional Enterprise Zone ("SDREZ")
designation including the cities of San Diego, Chula Vista, and National City (the "Partners");
and
WHEREAS, the Partners have an approved Targeted Employment Area ("TEA")
incorporating eligible low and moderate income 2000 Census Tracts within the cities of San
Diego, Chula Vista, and National City as designated areas approved by HCD to encourage
Enterprise Zone business to hire TEA residents and therefore receive state tax credits on wages
paid to these employees; and
WHEREAS, on July 1, 2008, the City Council of the City of National City adopted
Resolution No. 2008-135 approving the boundaries of the TEA and map for the San Diego
Regional Enterprise Zone; and
WHEREAS, the California Enterprise Zone Act requires Enterprise Zone
jurisdictions to update TEA boundaries as new United States census data is made available and
to approve by resolution or ordinance said boundaries by its governing body; and
WHEREAS, the Partners shall make application for a new TEA incorporating
eligible low and moderate income Census Tracts based on the most current census data
available as set forth in the eligible Census Tract table, attached hereto as Exhibit "A", and the
map, attached hereto as Exhibit "B", which is geographically consistent with the State TEA
eligibility criteria so as to maximize job creation opportunities for SDREZ business that hire TEA
residents so they can receive state tax credits on wages paid to these employees.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby supports and authorizes the Mayor or his designee to submit the
application to the State of California Housing and Community Development Department
establishing a new Targeted Employment Area for the San Diego Regional Enterprise Zone
consistent with the information set forth in Exhibit "A" and Exhibit "B".

EXPLANATION:
On April 2, 2013, the City Council Section discussed Section 3.5 of the current tow contra t that allows
the tow contractors to request an increase in tow fees to the Chief of Police, after the first twelve month
period of the current agreement.
On May 7, 2013, the City Council adopted a $20.00 increase for basic and medium tows and a $5.00
increase for the storage fee. The $75.00 fee for victim and witness vehicles impounded for investigation
purposes per Vehicle Code Sections 22655 or 22655.5 was adopted and added to the "Tow Fee
Schedule" of the tow contract.
Both tow contractors agree with this recommendation.

FIRST AMENDMENT TO THE AGREEMENT

BY AND BETWEEN THE CITY OF NATIONAL CITY AND
A TO Z ENTERPRISES, INC., DBA ROAD ONE TOWING
BY AMENDING SECTION 3.5 OF SAID AGREEMENT
THIS FIRST AMENDMENT to the Agreement for Towing and Impound Services is
entered into on this 21 st day of May, 2013, by and between the City of National City ("City") and A
to Z Enterprises, Inc., DBA Road One Towing ("Contractor").
RECITALS
WHEREAS, the City and the Contractor entered into an Agreement for Towing and
Impound Services ("Agreement") on or about October 1, 2011, providing for towing and impound
services by the Contractor from October 1, 2011 through September 30, 2013.
WHEREAS, Pursuant to Section 3.5 of the Agreement, Re -Opener Clause — Fee Schedule,
after the first 12 consecutive month period of the Agreement, Contractor may request and the City
may agree to increase the Fee Schedule set forth in Exhibit "A" to the Agreement to adjust the fees
consistent with the community standard for police towing in San Diego County.
WHEREAS, Contractor has requested in increase the Fee Schedule in Exhibit "A" to the
Agreement and the City finds that such increase is consistent with the community standard for
police towing in San Diego County.
WHEREAS, the Parties also desire to amend the Fee Schedule by adding a $75 fee for
Victim/Witness Impounds for victim and witness vehicles that are impounded for investigation
purposes in accordance with Vehicle Code Sections 22655 and 22655.5.
NOW, THEREFORE, the parties hereto agree that the Agreement shall be amended as
follows:
1. The Parties agree to amend the Fee Schedule set forth in Exhibit "A" to the Agreement

THIS FIRST AMENDMENT to the Agreement for Towing and Impound Services is
entered into on this 21 st day of May, 2013, by and between the City of National City ("City") and
Moynahan Towing ("Contractor").
RECITALS
WHEREAS, the City and the Contractor entered into an Agreement for Towing and
Impound Services ("Agreement") on or about October 1, 2011, providing for towing and impound
services by the Contractor from October 1, 2011 through September 30, 2013.
WHEREAS, Pursuant to Section 3.5 of the Agreement, Re -Opener Clause — Fee Schedule,
after the first 12 consecutive month period of the Agreement, Contractor may request and the City
may agree to increase the Fee Schedule set forth in Exhibit "A" to the Agreement to adjust the fees
consistent with the community standard for police towing in San Diego County.
WHEREAS, Contractor has requested in increase the Fee Schedule in Exhibit "A" to the
Agreement and the City finds that such increase is consistent with the community standard for
police towing in San Diego County.
WHEREAS, the Parties also desire to amend the Fee Schedule by adding a $75 fee for
Victim/Witness Impounds for victim and witness vehicles that are impounded for investigation
purposes in accordance with Vehicle Code Sections 22655 and 22655.5.
NOW, THEREFORE, the parties hereto agree that the Agreement shall be amended as
follows:
1. The Parties agree to amend the Fee Schedule set forth in Exhibit "A" to the Agreement
to increase the fee schedule as set forth below and in the attached Exhibit "A" to adjust
the fees consistent with the community standard for police towing in San Diego County.

EXPLANATION:
On April 7, 2009, a public hearing was held to ascertain whether the public health,
safety, and/or welfare required the removal of poles, overhead wires and associated
overhead structures and the underground installation of wires and facilities for supplying
electric, communications, or similar or associated services within the area described as
Plaza Boulevard from Interstate 805 to the west of Palm Avenue.
On April 7, 2009, City Council adopted Resolution No. 2009-74 to establish
Underground Utility District No. 16A on Plaza Boulevard from Interstate 805 to the west
of Palm Avenue for the purposes of replacing overhead wires, structures and poles with
an underground system for electric and communications services to benefit public
safety, health, and/or welfare. Within this resolution, it was resolved that by subsequent
resolution, Council would fix the date upon which all poles, overhead wires and
associated overhead structures shall be removed, by which all properties must be ready
to receive underground service, and by which the underground wires and facilities for
supplying electric communication, community antenna television, or similar or
associated service shall be installed. Staff recommends that Council approve the fixed
date for Friday, January 31, 2014 and request that the City Clerk cause a certified copy
of the Resolution either by personal service or postal mail be directed to all utilities
companies and anyone who may own poles or facilities fixed upon any pole(s) within
District 16A — Plaza Boulevard from Interstate 805 to the west of Palm Avenue, as
shown in Exhibit "A".
The City Clerk is further requested to notify, either by personal service or postal mail, said
property owners of the necessity that, if they or any person occupying such property desire
to continue to receive electric, communication or other similar or associated service, they
or such occupant shall, by the date of Friday, January 31, 2014, provide all necessary
facility changes on their premises so as to receive such service from the lines of the
supplying utility or utilities at a new location, subject to applicable rules, regulations, and
tariffs of the respective utility or utilities on file with the Public Utilities Commission of the
State of California as of the date of adoption of this resolution. Attached hereto, marked
Exhibit "B" and hereby incorporated as part of this Resolution, is a list of all affected utility
companies within Underground Utility District No. 16A. Also attached, marked Exhibit "C",

This is a request from St. Anthony's Church to conduct it's 83rd annual festival located at 1816 Harding
Avenue on Saturday June 1st from 12:00 p.m. to 10:00 p.m. Sunday June 2, 2013 from 6 a.m. to 6 p.m.
respectively. This event will consist of food and game booths, musical entertainment and concession
canopies with a total of 30 10x10 tents. The applicant will provide the overnight on -site security for the
event location. Portable restrooms will be provided as well.
The applicant is requesting that Harding Avenue between 18th Street and 19th Street be closed
Saturday June 1, 2013 at 5:00 a.m. through Sunday June 2, 2013 until 7 p.m. Harding Avenue will re-
open at 7 p.m. on Sunday. MTS bus services will be notified due to impacted bus stop location on
Harding Avenue and requested street closure.

on public or private property, the undersigned hereby agree(s) to defend,
indemnify and hold harmless the City of National City and the Parking Authority
and its officers, employees and agents from and against any and all claims,

damage, or both, or any litigation and other liability, including attorneys fees and

Stipulations required by the Fire Department for this event are as follows:
1) Maintain Fire Department access at all times.
2) Means of egress shall not be obstructed in any manner and shall remain
free of any material or matter where its presence would obstruct or render
the means of egress hazardous.
3) Access for Fire Department shall be maintained at all times. At no time
shall fire lanes, fire hydrants, fire protection systems of all types etc. be
obstructed at any time. A minimum of 20 feet wide shall be maintained for
the use of fire lanes.
4) All cooking booths or areas to have one 2A:10BC. If grease or oil is used
in cooking a 40:BC or class "K" fire extinguisher will be required.
Extinguisher to be mounted in a visible location between 31' to 5' from the
floor to the top of the extinguisher. Maximum travel distance from one
extinguisher to another shall not be more than 75 feet travel distance. All
fire extinguishers to have a current "State Fire Marshal Tag"
attached. Please see attached example
5) If tents or canopies are used, tents having an area in excess of 200
square feet and or canopies in excess of 400 square feet or multiple tents
and or canopies placed together equaling or greater than the above stated
areas, are to be used, they shall be flame-retardant treated with an
approved State Fire Marshal seal attached. A ten feet separation distance
must be maintained between tents and canopies. A permit from the Fire
Department must be obtained. Cooking shall not be permitted under
tents or canopies unless the tents or canopies meet "State Fire
Marshal approval for cooking. If cooking is to be done, a ten feet
separation shall be maintained from cooking appliance and
canopies. Certificate of State Fire Marshal flame resistancy shall be
provided to the National City Fire Department if applicable.

All food handlers will need the certificate from the health department. If
there will be "outside" vendors they will need to obtain a business license.
For instance, if the Church is making and selling the food that is fine. But,
if they are hiring a "Taquero" or other food vendor, that vendor will need a

Amplifiers and speakers must be directed away from nearby residences to
the extent feasible. Activities shall comply with Title 12 of the Municipal
Code (Noise).
