HomeMy WebLinkAboutExplanationEXPLANATION: On April 7, 2009, a public hearing was neld to ascertain whether the public health, safety, and/or welfare required the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communications, or similar or associated services within the area described as Plaza Boulevard from Interstate 805 to the west of Palm Avenue. On April 7, 2009, City Council adopted Resolution No. 2009-74 to establish Underground Utility District No. 16A on Plaza Boulevard from Interstate 805 to the west of Palm Avenue for the purposes of replacing overhead wires, structures and poles with an underground system for electric and communications services to benefit public safety, health, and/or welfare. Within this resolution, it was resolved that by subsequent resolution, Council would fix the date upon which all poles, overhead wires and associated overhead structures shall be removed, by which all properties must be ready to receive underground service, and by which the underground wires and facilities for supplying electric communication, community antenna television, or similar or associated service shall be installed. Staff recommends that Council approve the fixed date for Friday, January 31, 2014 and request that the City Clerk cause a certified copy of the Resolution either by personal service or postal mail be directed to all utilities companies and anyone who may own poles or facilities fixed upon any pole(s) within District 16A — Plaza Boulevard from Interstate 805 to the west of Palm Avenue, as shown in Exhibit "A". The City Clerk is further requested to notify, either by personal service or postal mall, said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant shall, by the date of Friday, January 31, 2014, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations, and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California as of the date of adoption; of this resolution. Attached hereto, marked Exhibit "B" and hereby incorporated as part of this Resolution, is a list of all affected utility companies within Underground Utility District No. 16A. Also attached, marked Exhibit "C", and incorporated as part of this Resolution is a list of all persons owning real property within Underground Utility District No. 16A, as shown on the last assessment roll.
