Notice of Decision — Planning Commission approval of a Conditional Use Permit and Planned
Development Permit for a new drive-in and drive -through restaurant within an existing shopping
center, with an exception for less than required parking, located at 3007 Highland Avenue.

The project site is the Sweetwater Square Shopping Center, north of State Route 54, in the MXD-2
zone. The applicant proposes construction of a new 1,395 square -foot drive-in Sonic restaurant with a
drive -through. The restaurant would operate from 6:00 a.m. to midnight daily. Construction would
necessitate removal of 44 parking spaces.
Commissioners asked questions regarding Conditions of Approval, General Plan consistency, other
similar restaurants in the City, hiring of City residents, temporary parking lot events, green/LEED
design, and temporary traffic plans for the initial opening period. The Commission voted to approve the
Conditional Use Permit and Planned Development Permit based on required findings and subject to
Conditions of Approval.
