HomeMy WebLinkAboutExplanation - MechanicalStaff Report on the Adoption of the 2013 California Building Standards Code The California Health and Safety Code Section 17922 requires that each jurisdiction in the state adopt the most recent edition of the California Building Standards Code within 180 days of publication. If it is not adopted by a jurisdiction it has the force of law 180 days after publication. A jurisdiction may propose amendments, additions and deletions to those codes. When adopting the California Building Standards Code a jurisdiction may establish more restrictive standards reasonably necessary based on climatic, geological or topographical conditions. This year the California Building Standards Commission published the 2013 California Building Standards Code which is based on the 2012 International Building Code, 2012 International Residential Code, 2012 Uniform Plumbing Code, 2012 Uniform Mechanical Code and the 2011 National Electrical Code, 2013 edition. The National City Building Division recommends adoption of the 2013 California Mechanical Code with the following changes: • 15.14.080 Chapter 1, Division II, Section 516 "Recirculating Systems" — Deleted. Section 516 of the 2013 California Mechanical Code is deleted. In the prior 2010 Residential Code the installation of Recirculating Kitchen Systems were deleted from the code due to the large number of domestic kitchen fires due to grease buildup in the carbon filters since they were not being maintained properly. It is the recommendation of the Building Official and Fire Marshal that Recirculating Systems not be allowed in commercial kitchens since staffing levels do not provide sufficient time to perform the number of inspections required to maintain the required safety of the devices, nor can the department assure business staff maintains the required cleanings as specified by the manufacturer. Upcoming actions will include a Public Hearing and Final Adoption of the Ordinances, currently scheduled for the City Council Meeting on December 3, 2013.
