ITEM TITLE: Notice of Decision. — Planning Commission approval of a Conditiona! Use Permit modification and Zone Variance for less than required parking for an apartment complex located at 2525 Highland Avenue (Applicant: Nationwide Enterprises.) APPROVED BY: EXPLANATION: IThe 1.03-acre property is located on the east side of Highland Avenue, south of 24th Street in the Major Mixed -Use Corridor (MXC-2) zone. The site contains a three-story structure currently operating as a senior independent living facility (apartments). There is also a 55-space parking garage and an adult day care on site. The most recent approval on the site (2010-19 MCUP, Z) required a parking agreement with the neighboring church for overflow parking. The applicant wishes to modify the current CUP to remove this condition. The proposal includes the conversion of the adult day care to 23 parking spaces. The applicant has also applied for a Zone Variance for Tess than required parking, as removal of the parking agreement would result in a shortage of on -site parking as required by the Land Use Code. Planning Commission conducted a public hearing on June 2, 2014. Commissioners asked questions regarding business operations, findings, and conditions of approval. The Commission voted to approve the Conditional Use Permit based on attached findings and subject to Conditions of Approval.
