NOTICE OF PUBLIC HEARING ITEM TITLE: A PUBLIC HEARING REGARDING A.PROPOSED TRASH SERVICE RATE INCREASE. EXPLANATION: The current contract with EDCO provides for an annual rate increase request. Any increase in landfill tipping fees are defined as pass -through costs, and the contract provides for an annual increase, equal to the CIP for San Diego, with a cap of 6%. These elements add $1.68 and $0.16 respectively. There are additional elements of cost to be considered: a. Funds obtained through the sale of recyclable materials are used to off -set the elements of cost. Projected receipts for the budget year are estimated for rate establishment purposes, and an adjustment is made in the following year for actuals. For FY93, the return was higher than anticipated, and a net 3 cents reduction and 21 cents in the commercial rate is included. b. The County, in the past, has issued free passes for tipping at the landfill for City sponsored City Wide Clean Up events. These free passes were withdrawn during the second half of FY94. EDCO has offered to absorb the tipping costs for the last FY94 event, but costs for tipping for the two City wide events for FY95 are included in the proposed rate. c. The multi -family recycling program as directed by the County has been implemented. The costs of so doing (subsequent to the pilot program) are included in the rate proposed at $0.76. d. The contract EDCO negotiated (with City permission) with Organic Recycling West has partially insulated the City from the green waste tip fee increase from $25.00/ton to $35.00/ton. By the contract, Organic Recycling West may charge (a) $5.00 less than the County green waste fee or $25.00 which ever is less. The contract provides for $21.00/ton through July and August this year, and provides for the $25.00 to be increased by the San Diego CIP for subsequent years. Implementation of the automated system is anticipated to develop an increased amount of green wastes as residents discover that it is cheaper to segregate than to pay for second automated cans. The impact of these charges will be reviewed with the next rate study with adjustments to be made then. e. As required by the contract, the franchise fee for FY95 is at 5%, at $.56. The above factors have been considered by the contractor working with staff to develop the rates' proposed by Attachment (1). The rates have been reviewed by the independent auditor (selected by the City and payed by the' contractor in accord with the contract) as shown on Attachment (2), Engagement Letter Deloitte & Touche and Attachment (3), Deloitte & Touche report. Attachment (4) is the County staff recommendations on the tip fee rate structure. Note that it is dated 1 June, and that the fees themselves have not yet been set by the County Board of Supervisors. This hearing was properly set and notice properly given as noted by Attachment (5). ADDITIONAL INFORMATION In developing the rate for commercial, the contractor discovered that the prior practice of increasing all commercial level of service rates by the same percentage as single family, resulted in some inequities between the cost of service (rate) and the cost of providing service. Correction has been made, and the new rate proposed is more akin to actual cost of service. Note that in applying their criteria some rates are actually reduced! Staff reviewed very carefully the new rate structures for commercial, and finds that the total income to EDCO is the same either way, that is, no advantage accrues to EDCO by this adjustment in the relative rates. Another area surfaced, for which no correction is proposed at this time. Although not directly required by the contract, EDCO established the "silver bag" program some time back. This is for senior citizens, head of household who may purchase silver bags from EDCO for 91 cents each - purchase of the bag includes pick-up and landfill costs. When the program started there were few customers, landfill costs were much less and the costs of the program did not greatly exceed the revenue produced. Such is not the case now. There are over 300 customers using this service now and the cost of providing it is in the $2.73/bag range. This represents a subsidy in the $18,000 total range that regular customers are bearing. Recognizing the sensitivity of this issue, no recommendations are made at this time, but consideration needs to be made of closing the gap between the costs of the bags and the cost of providing services. Next year's rate structure will provide a recommended rate increase that will close about 1/2 the distance. Although the rate increase of 23% is larger than would be hoped, it is caused largely by the over 25% increase in costs of tipping at the County landfills, and the cost of the mandatory multi -family recycling program costs. The basic contractors CPC increase is at 2.1%. The contractor is proposing at this time and as promised that upon implementation of the automated system 1 October, the single family rate will be reduced by 38 `cents/household per month. A rate for a second (and additional) automated containers has also been developed. Request is made that these rates also be approved now so that they may be implemented on 1 October 1994, without further Council action. The matter of urgency develops because of the very short lead time between the County's recommendation upon amount and timing of their tip fee increases (which is over 1/3 of the rate) and the 1 July implementation there of. If the application of the rate is delayed past 1 July, then the rate itself would have to increase over the rates recommended to permit the contractor to recoup the landfill costs of over 11 months instead of the 12 months. In short, urgency will provide the lowest rate to citizens. t. 1SPOSAIL- CIC) - -- -1 pni 6670 Federal Boulevard, Lemon Grove, California 91945 (619) 287-7555 Fax ((6193 287-5242 June 10, 1994 City of National City 1243 National Avenue National City, California 92050 Honorable Mayor and Members of the City Council: The Refuse Collection and Recycling Agreement between the City of National City and EDCO Disposal Corporation provides for certain periodic rate adjustments. The contract allows for a pass through of changes in the disposal site fee and annual adjustments by the amount of the local consumer price index. San Diego County staff has recommended an increase in the landfill tipping fee on July 1, 1994 to $55 per ton, a 27.9% increase from the current $43 per ton. In addition, after having foregone cost of living increases for the past two years, we are requesting a modest increase in operating expenses of 2.1 %. In July 1993, EDCO began a three month phase -in program, at no charge, for multi -family recycling. By the County -mandated date of October 1, 1993, EDCO had successfully implemented the program citywide. The proposed rates include a charge for this program, applied pro-rata over ail rubbish rates, as has been done with all recycling charges in National City. Because the proposal includes a recovery for costs from October 1993 to June 1994 as well as the cost of the program for next year, the charge for multi -family recycling will be reduced on July 1, 1995. Improved market prices for recyclables has resulted in a reduction in the commercial rate of 21 cents and in the residential rate of 3 cents. According to our contract with National City, the franchise fee is scheduled to increase from its current 2% level to 5% on July 1, 1994 and the rates have been increased accordingly. Beginning in 1994, San Diego County has suspended the practice of providing free dump passes for cities' annual clean-up days. EDCO Disposal has been providing the labor and transportation for two clean-ups per year in National City, and in May of this year EDCO paid over $9,400 in landfill fees for the Spring clean-up. EDCO is not requesting reimbursement of these fees, and the landfill cost for future clean-ups has been added to the overall tipping fee increase. Their report supports our request for what we feel are fair and reasonable rate adjustments. EDCO continues to offer a 20% discount for senior citizens in National City. EDCO is continuing on its program to implement automated residential rubbish collection in October 1994. EDCO will reduce the monthly residential rubbish rate by 38 cents at that time. Please approve the attached rate schedule to be effective July 1, 1994. As always, thank you for your consideration. Respectfully, EDCO Disposal Corporation Edward Burr President Commercial rubbish rates in National City have historically been raised by a constant percentage based on the increase for a standard three cubic yard bin serviced one time per week. The last two years have seen dramatic increases in landfill fees, however EDCO has not requested a cost of living increase for its operating expenses. Therefore, the landfill fee has become a increasingly larger portion of the commercial rates. As the tip fee has gone from $28 per ton to $43 per ton and now is expected to go to $55 per ton, the method of applying a constant percentage would yield inequitibie rates for multiple bins and higher service levels. In order to more accurately reflect the actual costs of collecting and disposing of rubbish for each customer, EDCO proposes this year's rate increases be based on constant amounts rather than a percentage. While yielding the same total revenues to EDCO, the new rate structure will be fairer to ail customers. The majority of customers will receive a increase that is lower than under the previous method, some will actually be decreased, and the few large customers, with the greatest volume of rubbish, will have increases greater than the previous method. In April 1994, EDCO negotiated a reduced tipping fee with an alternate disposal site which, while requiring additional driving time, will, in the future, guarantee further savings by remaining below the County's fee. This fee is scheduled to be increased in September 1994, based on changes in the County's rate (which are expected to occur on July 1, 1994). The implementation of automated residential rubbish collection in National City in October 1994 is expected to have a positive effect on participation in the yard waste program. EDCO will analyze the costs and benefits of the yard waste program and propose any adjustments to the current rates in conjunction with the next rate review effective July 1, 1995. Our procedures to be performed, which relate primarily to your fiscal year 1995 residential refuse rate, will consist of the following items: 1_ Read EDCO's internally prepared financial statements for the nine months ended February 28, 1994, and the audited financial statements for the year ended May 31, 1993. Inquire of Dan Gallaher (Controller for EDCO), as to any changes in accounting policies and methods of application which might affect the fiscal year 1995 refuse rate for National City. 2. Agree the 1994 refuse rate to the information required for the fiscal 1995 rate adjustment. 3. Obtain information which supports the Consumer Price Index adjustment as calculated by EDCO. 4. Recalculate franchise fees due to National City for the period from May 1, 1993 to February 28, 1994, to ascertain that they have been calculated based on cash collected as reported in EDCO's underlying financial records and that they are in accordance with contractual requirements. 5. Read franchise fee remittances made to National City by EDCO for the period from May 1, 1993 to February 28, 1994 to ascertain that they were made on a timely basis. From the underlying accounting records, judgmentally select daily recyclable totals and agree those totals to supporting work tickets. 12. Compare the estimated price per ton of recyclables used for calculating the projected fiscal year 1995 rates with documentation which supports actual prices currently in force. 13. Recalculate multi -family recycling rate projection, and compare to other similar programs, if any, in other municipalities. 14. Recalculate the effect of franchise fees on the fiscal year 1995 refuse rate calculation. 15. Ascertain that coverage levels of insurance in force comply with contractual requirements. As a result of our findings, you may determine that additional tests or calculations may be required to provide the necessary information. Additional work, if necessary, would concentrate on specific computations or verification of expenses, revenues, allocations or other relevant financial information. Prior to the commencement of any additional procedures, a definition of requirements and additional costs would be prepared and your approval would be required. Our procedures are primarily directed toward a review of the fiscal year 1995 refuse rate adjustment for services provided by EDCO and Recycling. They do not consider the quality of such services provided. However, should anything come to our attention during the course of our work that would indicate outstanding or poor quality service, we would also report these findings. Our report will summarize the procedures we performed and the results of these procedures. However, because the procedures performed by us will not be sufficient to constitute an audit made in accordance with generally accepted auditing standards, we will not express an opinion on the financial records of EDCO or Recycling or on the items discussed above. If we were to perform additional procedures or if we were to conduct an audit of the financial statements of EDCO or Recycling in accordance with generally accepted auditing standards, other matters might come to our attention that would be reported to you. -2- It is understood that the report will be solely for your information and is not to be referred to or distributed for any purpose to anyone who is not member of the management of the City of National City, EDCO or Recycling. It is understood that the report may be subject to disclosure as a public record under the California Public Records Act. An estimate of our proposed fee to perform these procedures is listed in Attachment A. We anticipate that our work will commence the final week of April 1994 and, in order to meet your deadlines, will be completed by the second fill week of May 1994. Our invoices are payable when presented. We will notify you immediately of any circumstances we encounter which would significantly affect our estimate. By signing this letter in the spaces provided below, EDCO and National City authorize the commencement of our work, and agree that the procedures described above meet the needs of the parties to the contract. In connection with the procedures referred to above, no matters came to our attention that caused us to believe that the specified accounts or the final calculation of items noted above, as they relate to the fiscal 1995 rate calculation prepared for the City by EDCO (attached as Exhibit A), should be adjusted. Because the above procedures do not constitute an audit made in accordance with generally accepted auditing standards, we do not express an opinion on any of the accounts or items referred to above. Had we performed additional procedures or had we made an audit of financial statements in accordance with generally accepted auditing standards, matters might have come to our attention that would have been reported to you. This report related only to the accounts and items specified above and does not extend to any financial statements of EDCO, taken as a whole. WHEREAS, the last trash service rate increase for EDCO was in July, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the proposed rate schedule, a copy of which is attached hereto as Exhibit "A," is hereby approved, effective July 1, 1994. CITY and CONTRACTOR now desire to amend Section 23 of said agreement, concerning application for rate changes, and those provisions pertaining to the rates charged by CONTRACTOR. Section 23 of the Agreement for Collection of Rubbish and Trash in the City of National City by and between the City of National City and Edco Disposal Corporation for Services Rendered is hereby amended to read as follows: Section 23. Applications for Rate Change: Contractor may apply, annually, for changes in the rates charged pursuant to this agree- ment. Said application shall be in writing, addressed to the City Manager of City, and contain the financial and statistical data upon which the rate change application is made. By agreement, annual "cost of living" changes will be based upon the CPI for San Diego and will be equal to the percentage change in the index with, however, a cap of 6 % . Thereafter, after report and recommendation to it by its manager, the City Council will act on said application, either grant the same, denying the same or granting some different rate schedule than that applied for. Such rate change shall be effective on July 1 of each year. 1 Changes in the rates (tipping fees) charged by the own- ers/operators of sanitary landfill sites utilized by the Contractor shall be considered as "pass -through" costs. Upon notification to the Contractor of a proposed tipping fee change, the Contractor should submit a letter request for rate change to the City, defining the impact of such change on his costs, and proposing a rate change that will exactly recoup the tipping fee change. Any approved rate change reflecting a change in tipping fees may be concurrent with the change in tipping fees. 2. That the National City Rate Schedule shall be as shown on Exhibit attached hereto and incorporated herein by reference, beginning July 1, 1994. 3. Except as otherwise provided herein, all of the provisions of the Agreement for Collection of Rubbish and Trash in the City of National City by and between the City of National City and Edco Disposal Corporation for Services Rendered, dated September 25, 1990, as amended on June 22 and November 9, 1993, shall remain in full force and effect.
