RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
APPROVING THE ESTABLISHMENT OF A CARDBOARD
RECYCLING PROGRAM, AND APPROVING A TRASH SERVICE
RATE CHANGE FOR EDCO DISPOSAL CORPORATION
The City Council of the City of National City does hereby resolve as
follows:
WHEREAS, the last trash service rate change for EDCO, the City's
franchised trash hauler was in June 1994; and
WHEREAS, the rate for waste disposal will be reduced to $47.50 effective
July 1, 1995 and the City Council has approved that this type change be treated as a pass -
through cost to trash subscribers; and
WHEREAS, additional services are being requested of EDCO, to wit,
cardboard recycling as provided for in the City's Source and Recycling Element.
WHEREAS, the new trash service rates will be comparable to those of
surrounding cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City that the proposed rate schedule, a copy of which is attached hereto as
Exhibit "A," is hereby approved, effective July 1, 1995.

FY-96 EDCO RATE REVIEW
General Background:
• The contract with EDCO provides for an annual rate review in June of each year. Changes in
landfill costs are to be treated as pass -through costs, and the contractor is entitled to an
increase based upon the San Diego C.P.I. with a 6% cap. The figures upon which the new
requested rate is based are subject to review by an audit firm selected by the City and paid by
the contractor (Deloitte & Touche LLP has been selected for the past few years and their
report is attached).
• The funds received for sale of recycled materials are to be used by the contractor as a negative
cost (that is, funds are to the benefit of City customers, and are used to decrease the rates
charged).
• The contractor will add cardboard to the items to be recycled this year, which will increase his
costs (the total cost of adding cardboard is more than the value of the cardboard).
• It should be noted that the franchise fee after going from 2% to 5% was scheduled to increase
1% per year at the City's option for the duration of the contract. Based upon Council's prior
deferral of the increase to 5% and, Council's suspension of the 1% annual increase, I have
instructed the contractor to prepare his rate adjustment request based upon remaining at the
5% franchise fee again for this year. Council concurrence is sought.
• With most of the elements of cost making up the rate decreasing, and accordingly the rate
itself decreasing, the contractor will obviously have less total gross income. This is the base
upon which the franchise fee is applied; and with it decreasing the amount to be paid in
franchise fee will decrease. The rate itself will decrease because of this.
FY-96 Rate Factors:
• The data presented by the contractor attributes cost elements to the above factors individually,
showing the impact on the overall rate of each.
Specifically:
• The tip fee change from $55/ton to $47.50/ton reduces the residential rate by $0.97/month
and the commercial rates by $5.87/month (for a three -yard can one time per week - rates for
other levels of commercial service are reduced accordingly).
• The 2-1/2% C.P.I. increases the residential rate by $0.21/month and the commercial rate by
$1.28/month.
• The increased value of recyclables has a significant impact, in that the actual value was higher
than anticipated when the rates were set. Adjustment (decrease) for single family is $0.22, and
for commercial is $1.32.

• The multi -family program was instituted during the fiscal year. The costs were estimated for
rate setting purposes, but actual costs were not as high as expected. A credit adjustment is
made to account for the lesser costs of last year, plus a further adjustment from the base cost
for this fiscal year. Net effect is a rate reduction for residential of $0.33 plus $0.06 and for
commercial of $2.03 plus $0.38.
• The rate adjustment because the 5% franchise fee will be applied to a lesser contractor gross is
a reduction of $0.08 residential and $0.44 commercial.
Silver Bag Program:
In January 1995, Council reviewed the Seniors' Silver Bag Program and directed that the costs of
the silver bags be increased to the point where the costs of providing the service more nearly
equaled the price of the bags. This to be done in easy steps, with the first change from $0.91 to
$1.50 to occur in January 1995, and be effective for 12 months. That 12 months would expire
mid -way in this rate review period, and any price modifications would require a mid -year rate
change. Rather than do that, and because of the changing circumstances with respect to landfill
tip fee costs, and hence the costs of the silver bag program, it is recommend that the current $1.50
per bag price remain for an additional six months, that is, until 30 June 1996, and that it be
considered as part of the June 1996 rate review period.
FY-96 Rate Recommendation:
• The overall rate charge recommendation is to reduce the monthly change for residential from
the present $16.30 to $14.85, and the current commercial (three yard bins once a week) from
$98.83 to $90.07 (with other levels of commercial service reduced accordingly) as noted on
the contractor request, and to leave the silver bag cost at its present $1.50 per bag through 30
June 1996. The senior citizen residential rate will remain at 20% below the single family rate
and will be $11.88. The price for a second 90 gallon contianer at the same single family
residence will drop from $10.81 to $3.87.
• As noted, the audit firm of Deloitte & Touche, LLP has expressed their review as shown in
the attached May 18, 1995 letter from them.

Honorable Mayor and Members of the City Council:
The Refuse Collection and Recycling Agreement between the City of National City and EDCO Disposal
Corporation provides for certain periodic rate adjustments. The contract allows for a pass through of
changes in the disposal site fee and annual adjustments by the amount of the local consumer price
index.
San Diego County / Solid Waste Authority staff has approved a decrease in the landfill tipping fee on
July 1, 1995 to $47.50 per ton, a 13.6% decrease from the current $55 per ton.
Improved market prices for recyclables collected in the curbside recycling program have resulted in a
reduction in the residential rate of $0.22 and in the commercial rate of $1.32.
Last year's rate included a recovery of costs for the multi -family recycling program which began in July
1993. This charge expires July 1, 1995 resulting in a reduction in the residential rate of $0.33 and in the
commercial rate of $2.03. In addition, improved market prices in the multi -family recycling program
have resulted in a reduction in the residential rate of $0.06 and in the commercial rate of $0.38.
In addition, we are requesting an adjustment for operating expenses based on the most recent CPI index
of 2.5%.
The overall effect on the residential rate is a reduction of $1.45 in the residential rate and of $8.76 in the
commercial rate. These reductions are in addition to the $0.38 reduction in the residential rate on
October 1, 1994 when automated residential rubbish collection began.
As in prior years, EDCO's requests for rate increases have been subjected to independent review by the
auditing firm of Deloitte & Touche. Their report supports our request for what we feel are fair and
reasonable rate adjustments.
EDCO continues to offer a 20% discount for senior citizens in National City.
Please approve the attached rate schedule to be effective July 1, 1995. As always, thank you for your

We have applied certain agreed -upon procedures, as discussed below, to accounting records and other
items as related to EDCO Disposal Corporation ("EDCO") and San Diego Recycling (Recycling"), as
requested by you to assist you in evaluating your contractual relationship with EDCO and Recycling. It
is understood that this report is intended for use of the City Council of National City and the
management of EDCO and Recycling. However, this report is a matter of public record and its
distribution is not limited.
The procedures we performed, which relate primarily to your fiscal year 1996 residential refuse rate
(attached to this report as Schedules 1 through 4), are summarized as follows:
1. We read EDCO's internally prepared financial statements for the nine months ended February 28,
1995, and the audited financial statements for the year ended May 31, 1994. We inquired of Dan
Gallaher (Controller for EDCO), as to any changes in accounting policies and methods of
application which might affect the fiscal year 1996 refuse rate for National City.
We agreed the 1995 refuse rate from the prior year's calculation to the refuse rate used in the
fiscal 1996 refuse rate calculation appearing at Schedule 1.
3. We obtained information from the U. S. Department of Labor - Bureau of Labor Statistics and
agreed such information to the amount used in the Consumer Price Index ("C.P.I.") adjustment
appearing on Schedule 2 in the 1996 refuse rate calculation.
4. We recalculated franchise fees due to National City for the period from March 1, 1994 to
March 31, 1995, to ascertain that they were calculated based on 5% of cash collected as reported
in EDCO's underlying financial records.
5. We read franchise fee remittances made to National City by EDCO for the period from March 1,
1994 to March 31, 1995 to ascertain that they were made on a monthly basis.

6. We agreed San Diego County estimated landfill tip fee of $55 per ton projected in the fiscal year
1995 rate review process appearing on Schedule 3 to correspondence from the County of San
Diego regarding the Tip Fee Resolution Approved for Implementation July 1, 1994.
7. We agreed actual tons of refuse collected for two judgmentally selected days in the period from
July 1, 1994 to February 28, 1995 to the supporting landfill tickets.
8. We recalculated the percentage effect of projected fiscal 1996 San Diego County landfill fee
decrease on the fiscal 1996 refuse rate appearing on Schedule 3.
9. We ascertained that one-time adjustments to the fiscal 1995 refuse rate were properly excluded
from the fiscal 1996 refuse rate. Such adjustments included the Multi -Family Recycling
Program: Reverse Prior Year Adjustment appearing on Schedule 1 and the Reversal of One Time
Adjustment in Fiscal 1995 Rate appearing on Schedule 4.
10. We recalculated the difference between the actual annualized revenues from the sale of
recyclables and the projected revenues from the sale of recyclables used in the fiscal year 1995
refuse rate appearing on Schedule 4.
11. We agreed total tons of recyclable materials sold appearing on Schedule 4 to underlying
accounting records for two judgementally selected months. From the underlying accounting
records, we judgmentally selected five daily recyclable totals and agreed those totals to
supporting work tickets.
12. We recalculated the effect of franchise fees on the fiscal year 1996 refuse rate appearing on
Schedule 1.
13. We agreed coverage levels of insurance in force to the insurance provider's certificate of
insurance to ascertain that such coverage was in compliance with contractual requirements.
In connection with the procedures referred to above, no matters came to our attention that caused us to
believe that the specified accounts or the final calculation of items noted above, as they relate to the
fiscal 1996 rate calculation prepared for the City by EDCO (attached as Schedules 1 through 4), should
be adjusted.
Because the above procedures do not constitute an audit made in accordance with generally accepted
auditing standards, we do not express an opinion on any of the accounts or items referred to above.
Had we performed additional procedures or had we made an audit of financial statements in accordance
with generally accepted auditing standards, matters might have come to our attention that would have
been reported to you. This report relates only to the accounts and items specified above and does not
extend to any financial statements of EDCO, taken as a whole.

A criminal complaint was filed by this office on July 11, 1995, charging William
Hardesty with violation of Section 7.10.020 of the National City Municipal Code (failure
to subscribe to trash service for 1717 Grove Street, National City).
A trial has been scheduled in Department 3 of the South Bay Municipal Court for
Thursday, September 21, 1995, at 11:00 a.m. Your presence as a witness at that time
is required. I will also be present to present your testimony by asking questions
regarding the defendant's failure to obtain an exemption to trash service.

The benefits of this trash rate decrease will accrue to the Citizens of National City. To the extent that the
rate goes down, the 5%-of-gross franchise fee payment to the City will decrease.

present $16.30/month to $14.85/month single family, from $98.83/month for the we y 3 cubic yard bin
