HomeMy WebLinkAboutEDCO Disposal Corporation - Rate Adjustment - Decrease - 1997RESOLUTION NO. 97-68 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING A REFUSE SERVICE RATE CHANGE FOR EDCO DISPOSAL CORPORATION, AND ESTABLISHING A REFUSE ENTERPRISE FUND WHEREAS, the last refuse service rate change for Edco Disposal Corporation, the City's contract refuse hauler, was in June 1996; and WHEREAS, the rate for waste disposal is estimated to be $32.00 per ton on July 1, 1997; and WHEREAS, a public hearing was held to consider the refuse service rate change at the regularly -scheduled City Council meeting of June 10, 1997, notice of which hearing was published according to law in a newspaper of general circulation in the City. At said hearing, the City Council considered oral and written evidence presented by the City Council, staff, and members of the public. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of National City that the proposed refuse service rate schedule, a copy of which is attached hereto as Exhibit "A" and incorporated herein by reference, is hereby approved, effective July 1, 1997. Said document is filed in the office of the City Clerk. BE IT FURTHER RESOLVED that a Refuse Enterprise Fund is hereby established to provide rate stabilization and to be used for refuse related purposes including AB 939 expenses, litter control, City assistance at Citywide cleanup, special studies, staff support and other related functions. A PUBLIC HEARING TO CONSIDER A REFUSE RATE REDUCTION REQUEST FROM EDCO, AND CONCURRENT ESTABLISHMENT a ref enterprise fund PREPARED BY C.R. Williams, Jr. DEPARTMENT Public Works EXPLANATION Based upon jointly projected costs, EDCO is recommending a rate DECREASE in Single family refuse service from the present $14.36 per month to a new rate of $13.95 per month. Basic rates for apartments will show a corresponding decrease, and the slightly improved apartment recycling rate warrants recommending that the current $0.54/UNIT/MONTH recycling fee be reduced to $0.51/UNIT/MONTH. Other components of service will receive reductions, comparable to the $13.95. The silver bag program was scheduled to increase this year but with the overall rate reduction it is recommended that the silver bag program not increase and that it stay at $1.85/bag. Staff is recommending the concurrent establishment of a REFUSE ENTERPRISE FUND to provide a source for refuse related expenditures and to provide for rate stabilization and the Notice of Public Hearing and Proof of Publication are on file in the office of the City Clerk. 1 Environmental Review X N/A Financial Statement Benefits from the refuse rate reduction will accrue to the citizens increase in Franchise fees to 7% will largely off -set the reduced The Enterprise fund will generate about $365 000 STAFF RECOMMENDATION Hold public hearing. Account No. N/A ATTACHMENTS ( Listed Below) EDCO letter of 30 May 1997 Deloitte & Touche letter of 30 April 1997 Resolution No. A-200 (Rev. 9/80) FY-98 EDCO RATE REVIEW BACKGROUND: • The contract with EDCO provides for an annual rate review in June of each year. Changes in landfill costs are to be treated as pass -through costs, and the contractor is entitled to an increase based upon the San Diego C.P.I. with a 6% cap. The C.P.I. increase for FY-98 is 2.9%. • The figures upon which the rate is based are subject to review (but not an audit as such) by an audit firm selected by the City and paid by the contractor. (Deloitte & Touche LLP has been selected for the past few years and their report is attached). • The funds received for sale of recycled materials are to be used by the contractor as a negative cost (that is, funds are to the benefit of City customers, and are used to decrease the rates charged). The market for recyclables is projected to remain as it has been. • The franchise fee will increase by 1 % to a total of 7% in accord with the contract. • The tipping fee (the cost to dispose of refuse at the landfill) is predicted to be $32.00 per ton, effective 1 July 1997. The contractor has been instructed to base his rate calculations on that rate for the entire Fiscal Year period. • The FY-98 proposed rate for refuse contains two new components: one, a significant over -collection by EDCO because of tip fee rate reductions; and, two, a recommendation for establishment of a Refuse Enterprise Fund. These items are interrelated in that both have impacts on short and long term rates and should be reviewed together. Pass -through Costs: In establishing rates, costs and quantities of pass -through items are estimated, and the amounts associated with each are used as a basis for the rate. If all estimates are very good, costs equal planned amounts. Experience has been, however, that there have been variances from estimates, causing the contractor to either over -collect or under -collect funds. The amounts have been minor and have been applied to rates the following year (e.g. if some element were over -collected, then that portion of the rate would be artificially lowered so that over the year the contractor would "pay back" over -collected monies - similarly in the event of under -collecting). These adjustments have in the past been small. They did affect two years' rates however - the following year when the correction was applied and the subsequent year when the correction was removed. With the changes this year we have experienced in tip fees ($40 to $38, to $32 and potential wide swings in the future) the amounts over-collected/under-collected are significant for FY-97 amounting to about $139,000 and could also be significant in FY-98 and beyond. This amount sets the stage for an alternate approach to dealing with these over/under-collections for pass -through costs. Specifically, the contractor has been directed to summarize all of the under-collection/over collections for FY-97; and rather than plowing them into the FY-98 rate, to rebate those monies directly to the City, to permit establishment of a REFUSE ENTERPRISE FUND. The workings of the fund are described elsewhere, but generally under-collections/over- collections would be accommodated from this fund, rather than impacting directly on rates for the following year. To ensure integrity of the fund, an additional amount would be assessed as a contractor cost in rate development. This will permit the Fund to bear the thrust of under-collection/over-collection rather than the rate directly, and would be part of the rate setting process. The Fund would also be used to meet the City's refuse related costs such as special studies, litter control, AB939 requirements, staff support to refuse, etc.. Refuse Enterprise Fund: The previous method of dealing with over-estimates/under-estimates of contractor pass - through costs (that is by melding monies so under or over collected into the following years rate), while fair in the past, is no longer appropriate. As discussed, the swings in tip fees and to a lesser extent in other pass -through costs have generated significant balances that should be discussed and budgeted at Council level. A REFUSE ENTERPRISE FUND would meet this need for control, and its establishment is recommended. Generally the FUND would provide for expenditures that are refuse related only, and would be as a result of a budget approved by Council. The use of The Fund for rate adjustments would be a part of the rate setting process. The results of FY-97 and prior year adjustments has resulted in an over collection by the Contractor of some $139,000. This amount will be rebated to the City in the FUND in 12 monthly installments based upon monthly collection. A mechanism must also be established to ensure the integrity of the FUND. That will be accomplished by designating an annual contribution to the fund as a contractor's cost element. That amount for FY-98 is set at $219,000 to be provided to the City in 12 monthly installments also based upon monthly collection. As indicated the fund would be used for refuse related purposes only. There are a number of refuse related functions that are now on -going (and a few that are not) that are required to be accomplished by the City in our approved AB939 Plans. Other functions such as litter control, City assistance at the City-wide Cleanup events, special studies, staff support including legal and contract administration are examples of work items so closely related to refuse that they should be funded by REFUSE. With Council approval of the concept as herein outlined, the City Manager will cause the REFUSE ENTERPRISE FUND to be established and will cause rate setting and budgeting procedures to be developed. For FY-98, proposed expenditures will be brought to Council. For FY-99 and future years, the REFUSE ENTERPRISE FUND will be routinely budgeted. PROOF OF PUBLICATION (2015.5 C.C.P.) The contract allows for a pass through of changes in the disposal site fee and annual adjustments by the amount of the local consumer price index. Fortunately, San Diego County landfill tipping fees have been reduced to $32 per ton from the previous $40 per ton. Disposal fees for yardwaste have also been reduced. In accordance with the Agreement, the franchise fee will increase from 6% to 7% on July 1, 1997. and we are requesting an adjustment for operating expenses based on the most recent CPI index of 2.9%. Also, Following staff direction, an element has been added to the rate structure to support the new Trash Enterprise Fund. We are pleased to bring forward a fourth straight rate reduction. The overall effect on the residential rate is a reduction of $0.41 in the residential rate and of $2.50 in the commercial rate. EDCO continues to offer a 20% discount for senior citizens in National City. As in prior years, EDCO's requests for rate increases have been subjected to independent review by the auditing firm of Deloitte & Touche. Their report supports our request for a fair and reasonable rate adjustment. Please approve the attached rate schedule to be effective July 1, 1997. As always, thank you for your consideration. Williams, Jr. Public Works Department City of National City 2100 Hoover Avenue National City, California 91950-6599 Dear Mr. Williams: We have performed the agreed -upon procedures enumerated below, to accounting records and other items as related to EDCO Disposal Corporation ("EDCO") and San Diego Recycling ("Recycling"), which were agreed to by you, to assist you in establishing a refuse rate for the City of National City and in evaluating your contractual relationship with EDCO and Recycling. This engagement to apply agreed -upon procedures was performed in accordance with standards established by the American Institute of Certified Public Accountants. The procedures we performed, which relate primarily to your fiscal 1998 residential refuse rate, are summarized as follows: 1. We read EDCO's internally prepared financial statements for the nine months ended February 28, 1997, and the audited financial statements for the year ended May 31, 1996. We inquired of Dan Gallaher (Controller for EDCO), as to any changes in accounting policies and methods of application which might affect the fiscal 1998 refuse rate for National City. 2. We agreed the fiscal 1997 refuse rate from the prior year's calculation to the refuse rate used in the fiscal 1998 refuse rate calculation. 3. We obtained information from the U. S. Department of Labor - Bureau of Labor Statistics and agreed such information to the amount used in the Consumer Price Index ("C.P.I.") adjustment in the fiscal 1998 refuse rate calculation. We recalculated franchise fees due to National City for the period from April 1, 1996 to March 31, 1997, to ascertain that they were calculated based on 5% or 6%, as applicable, of cash collected as reported in EDCO's underlying financial records. 5. We read franchise fee remittances made to National City by EDCO for the period from April 1, 1996 to March 31, 1997 to ascertain that they were made on a monthly basis. 6. We agreed San Diego County estimated landfill tip fee of $40.00 per ton projected in the fiscal 1997 rate review process to correspondence from the County of San Diego regarding the Tip Fee Resolution Approved for Implementation July 1, 1996. 7. We agi actual tons of refuse collected for two judgmentally selected days in the period from July 1, 1996 to February 28, 1997 to the supporting landfill tickets. 8. We recalculated the percentage effect of the projected fiscal 1998 San Diego County landfill tip fee decrease on the fiscal 1998 refuse rate. 9. We ascertained that one-time adjustments to the fiscal 1997 refuse rate were properly excluded from the fiscal 1998 refuse rate. 10. We recalculated the difference between the actual annualized revenues from the sale of recyclables and the projected revenues from the sale of recyclables used in the fiscal 1997 refuse rate. 11. We agreed total tons of recyclable materials collected to underlying accounting records for two judgmentally selected months. From the underlying accounting records, we judgmentally selected five daily recyclable totals and agreed those totals to supporting work tickets. We determined the reasonableness of recycling rates as compared to three judgmentally selected recycling receipts. 12. We recalculated the effect of franchise fees on the fiscal 1998 refuse rate. 13. We recalculated the percentage effect of the yard waste disposal fee reduction on the fiscal 1998 refuse rate. 14. We agreed coverage levels of insurance in force to the insurance provider's certificate of insurance to ascertain that such coverage was in compliance with contractual requirements. We were not engaged to, and did not, perform an audit, the objective of which would be the expression of an opinion on the refuse rate for the City of National City. Accordingly, we do not express such an opinion on the rate. The sufficiency of the procedures is solely the responsibility of the specified users oft is report. Consequently, we make no representation regarding the sufficiency of the agreed -upon procedures described above either for the purpose for which this report has been requested or for any other purpose. Had we performed additional procedures or had we performed an audit in accordance with generally accepted auditing standards, other matters might have come to our attention that would have been reported to you. Based upon jointly projected hosts, EDCO is recommending a rate DECREASE in Single family refuse service from the present $14.36 per month to a new rate of $13.95 per month. Basic rates for apartments will show a corresponding decrease, and the slightly improved apartment recycling rate warrants recommending that the current $0.54/UNIT/MONTH recycling fee be reduced to $0.51/UNIT/MONTH. Other components of service will receive reductions comparable to the $13.95. The silver bag program was scheduled to increase this year but with the overall rate reduction it is recommended that the silver bag program not increase and that it stay at $1.85/bag. Staff is recommending the concurrent establishment of a REFUSE ENTERPRISE FUND to provide a source for refuse related expenditures and to provide for rate stabilization.
