COMMUNITY DEVELOPMENT COMMISSION OF NATIONAL CITY
AND CENTEX HOMES
This Memorandum of Understanding between the Community Development
Commission of National City (CDC) and Centex Homes (Centex) dated June 17,
2003, will serve as a guideline for each entity. Each party will proceed to the
best of their ability to accomplish the tasks and resolve the issues set forth in this
Memorandum of Understanding.
Centex wants to build a mixed -use housing -retail complex in the Downtown
Redevelopment Area of National City. The CDC as the Redevelopment Agency
is supportive of Centex's plans. The CDC will use its best efforts to
accommodate the Centex development proposal, which includes:
• Up to 200 condominium units
• Retail / Live Work units on the ground floor of the major thoroughfare
• Two levels of underground parking with at least one parking space per
unit, and on -street parking for commercial uses.
• One hundred foot height level on the major thoroughfare and 50 heights
on the secondary street.
The following issues exist:
• The present City Land Use Code does not allow the density needed by
Centex.
• The CDC is set to prepare a Specific Plan and General Plan Amendment
(SP&GPA) for the Downtown area.
• The CDC is in the process of studying the amendment of the
Redevelopment Plan.
• If financial assistance is required, the CDC will have to impose the
statutory affordability covenants proportionate to the funding, relocate
tenants including replacement housing and require Prevailing Wages for
the development.
It is understood that:
• Centex wants a fast track of eight months for development entitlements
but that a SP&GPA must be undertaken.
• Centex wants to process plans concurrently with the Specific Plan
preparation; the CDC will explore with the City the issues process that
must be addressed to accomplish this request.
• Centex asks for development fee payment deferral until certificate of
occupancy; CDC agrees to develop a plan to provide such assistance.
ORIGINAL
• Centex will be required to undertake an environmental review and CDC
will direct the SP&GPA consultant to concurrently conduct same for this
site as well as the project area.
• The CDC will contract for the undertaking of a SP&GPA of the Downtown
area by July 15, 2003 with a completion date of December 1, 2003.
• To further the process, Centex and other interested developers will assist
in the development of the SP&GPA, environmental portion by
contributing an amount not to exceed $15,000. (the exact amount to be
determined with the hiring of a consultant).
• Concurrent with the SP&GPA planning process, the CDC will work with
the City to develop a fast track processing method for large-scale
projects such as contemplated by Centex.
• In order for Centex to secure options on the property with a specific
termination date, the CDC/City Planning Commission will hold Specific
Plan Public Hearings beginning in January '04 or earlier. In order to gain
community support, community meetings will begin with selection of the
consultant and continue throughout the process. The Planning
Commission will be involved at the beginning to assure a smooth
process. It is anticipated that the SP&GPA process should be
completed, including all public hearings by April 1, 2004.
This Memorandum of Understanding will terminate upon approval of the Specific
Plan and General Plan Amendment for Downtown National City on April 1, 2004
or upon approval of the Specific Plan and General Plan Amendment, whichever
is sooner.

RESOLUTION OF THE
COMMUNITY DEVELOPMENT COMMISSION
OF NATIONAL CITY APPROVING A
MEMORANDUM OF UNDERSTANDING BETWEEN
CENTEX HOMES AND THE CDC RELATIVE TO DEVELOPMENT
OF LARGE SCALE HOUSING RETAIL COMPLEX IN THE DOWNTOWN
WHEREAS, the Downtown Core of National City is suitable for large scale
development; and,
WHEREAS, the Community Development Commission is considering the
preparation of a Specific Plan and General Plan Amendment for the Downtown area for
suitability for Large scale, full block development; and
WHEREAS, the Centex Corporation is desirous of building a residential, retail
complex in the Downtown and needs to have a timetable for the preparation of a
Specific Plan and General Plan Amendment;
NOW, THEREFORE, BE IT RESOLVED THAT, The Community Development
Commission hereby directs the Executive Director to enter into that certain
Memorandum of Understanding with Centex Homes a copy of which is attached hereto.

SUBJECT: RESOLUTION NO. 2003-36: APPROVING A MEMORANDUM OF
UNDERSTANDING WITH CENTEX HOMES
Recommendation:
Approve resolution setting forth parameters relative to the development of large scale
housing in the Downtown Area.
Fiscal Impact:
The preparation of a Specific Plan and General Plan Amendment for downtown is
included in the `03/'04 CDC Budget; Environmental Impact supplement will be
reimbursed by Centex and others who desire to participate in downtown development.
The tax increment generated from the project will be significant, the project cost could
exceed $40,000,000.
Environmental:
CEQA is not applicable at this time. An Environmental Impact Report (EIR) will be
undertaken as part of the Specific Plan and General Plan Amendment (SP&GPA).
Background:
Centex Homes, one of the nation's largest home builders, has expressed interest in the
construction of a 200 unit condominium and retail development in the Downtown area.
This is consistent with the concept of a pedestrian friendly central core, and with the
newly formed Downtown Business Group, but does not fit into the current zoning
regulations. The subject resolution provides a basis for both the CDC/City and the
developer to explore this and other projects of similar density.

A Specific Plan and General Plan Amendment (SP&GPA), along with an Environmental
Impact Report (EIR) will be required. The subject Memorandum of Understanding calls
for a rather fast track to accomplish the planning effort and begin the hearing process.
With a project of this magnitude and importance, it is incumbent to assist the developer
(and others), to obtain community input and prepare a plan that will not only provide
affordable, quality housing but create a distinctive urban core that will serve the city well
for generations.
