Head off hoistway for required clearance see ASI-06, X-35 [M+H COR 23] $619 2. Proposed gate at East parking lot area see ASI-22, X54 [M+H COR 33.001] $3,152 3. Adding a 2" hose connection adjacent to wall "B" [M+H COR 47] $3,375 REASON FOR CHANGE: 1. The heading off of the hoistway was required for the area of refuge clearance to be meet. 2. The reason a gate was added to the East parking lot was to give the fire department more access in and out of the parking lot area. 3. The added roof decking was installed between lines 1 and 4 to provide a smooth transition from the roof decking to the fascia. 4. The power for the zone dampers was added because it was not shown on the drawings. 5. The added CMU block at the trash enclosure was required because the plans showed the west wall being 3' in height and the fence on top but the elevation west needed to be solid CMU block. 6. This field welding of hold down anchors to a steel beam was required becasue it was not shown in the drawings. 7. The adding of a 2" hose connection adjacent to wall "B" was a request made by the Fire Dept. COST RECONCILIATION: Costs were reviewed by the architect and CM and negotiated to the satisfaction of the City. To achieve this with a 8' elevator the required hoistway minimum height is 24-3". We currently have approx 23'-3 9/16" at the lowest point of the hoistway_ Our subcontractor has looked at relocating the safe refuge area to the front of the cab, but because of the door operating equipment the front of the cab can not be considered a safe refuge area. Please review the attached elevator shop drawings from Mitsubishi and attached elevator code section and advise on how we are to proceed. Suggestion , 1. Box off top of elevator hoistway to allow for minimum overhead clear. Answer Date Answered: 05/23/04 Per discussion with manufacturer the clearance required can be reduced to 24'. The clearance can be required by heading out a 4' square area over the "Area of Refuge", per detail 5/S1.3, to allow the Gear are to extend above the bottom of framing. I want to verify some items before we proceed with the dispute resolution procedure. It is outlined in the contract documents, specifically in Specification 14212-2 item C Shop Drawings note 1: Manufacture may be required to adjust components to provide required escape/maintenance clearances within the structural envelope provided. As part of the shop drawing process clearly indicate clearances (roof structure will not be modified to accommodate). Is the adjusted components outlined in the specifications a $10,000 cost to your elevator subcontractor as your letter referenced. Had M+H subcontractor omitted this cost at bid time or is this a cost that M+H chose not to include? Currently we are now entertaining modifying the structural envelope deviating from specification which is being presented as a $619 dollar cost impact. To clarify, M+H is stating that there is a $10,000 upcharge to adjust components to the elevator or $619 to modify framing all of which is above base bid? From this review it appears M+H should have had carried the $10,000 adjustments to comply with specifications at bid time so the framing modification being proposed, really should be viewed as a $9,381 savings to the City? Is M+H pursuing the claim for their Framing Contractor and M+H associated OH&P because they feel that the work performed is above and beyond what has been outlined in the contract documents? The basis for our dispute stems from the fact that the architect's and specification was based on information provided to him by Thyssen Elevator, the or manufacturer. When we discovered the conflict with the height clearances in the e contacted Thyssen to make sure their original bid included a custom sized elevator cab ithin the framing dimensions given. They told us it would be an upcharge in excess of ide a custom cab. Please keep in mind that Thyssen had sent their bid to every General ing on this project on bid day, The elevator sub we had listed on bid day had a similar Marcotte + He ne then pursued an alternate solution, to modify the framing at the roof line, which resulted in a much smal er upcharge of $619 (COR #23), So now, not only is National City benefiting from a much cheaper elevat r, a savings in excess of $10,000, but you've also rejected our COR for $619 which Marcotte + Hea ne will have to pay to the framing subcontractor. We find this to be very unreasonable and request that yo re -review the COR. If you would like to set up a conference meeting, as outlined in Article 101.d,4, we will make ourselves available. We now know that JKA and Thyssen designed this project with a custom sized elevator cab in mind. Thyssen Elevator then bid the project to every General Contractor with a standard sized cab and did not qualify, or even mention an upcharge for a custom sized cab. There was no way we could have known on bid day that a custom sized cab was required. Yes, the spec has a paragraph that states "Manufacturer may be required to adjust components " but if we get a bid from the specified manufacturer on bid day who was a consultant in the design phase, we should be able to feel comfortable that the bid is complete for the scope required. M+HB used Mitsubishi on bid day only becuase they were slightly cheaper and we were confident they could match the Thyssen elevator. When this conflict came to light we had the opportunity to switch back to Thyseen but it wouldn't have mattered because Thyssen was also looking for a $10k+ extra for a custom sized cab. They way we're looking at this issue is this: the architects own consultant who bid the job failed to meet his own spec requirement, and on bid day there was no reason for a GC to suspect their scope was incomplete. National City should be viewing this issue as a cost savings already taken on bid day because the architects intent was to use a much more expensive cab that can now be resolved with some minor revisions to the framing. Change Order Number Twelve Resolution No. 2 QfL-2,�10 A-200 (Rev. 7/03) EXPLANATION: Each of the seven components of the requested change order are as listed below: 1. This work provides a clearance above the elevator car to be used for refuge if necessary. This clearance area is required by code. In order to obtain this clearance the framing had to be modified above the elevator. This was due to changes being made to the standard Mitsubishi elevator cab in the time between design and construction. An Architect Supplement Instruction (ASI) was issued to the contractor detailing this work. The cost is $619. 2. A gate in the wall immediately outside of the fitness room was inadvertently left off the plans during the design. This gate is necessary to provide better access to the parking lot and trash enclosure from within the building for fire personnel. An ASI was issued to the contractor detailing this work. The cost of this component of work is $3,152. 3. The roofing subcontractor and the roofing manufacturer, as a result of walking the job at the roofing preconstruction meeting, pointed out a component of the design of the roofing attachment to the fascia board that would create an area vulnerable to leaking. The issue was reviewed and the design was modified rectify this weakness. A price was negotiated with the contractor. The cost of this work is $1,465. 4. Zone dampers are included on the HVAC plans, but the electrical plans inadvertently did not include the power to the zone dampers necessary for their operation. A price was negotiated with the contractor to install the conduit and wiring necessary. The cost of this work is $5,485. 5. The plans showed the trash enclosure to have three feet of wrought iron fencing on top of the block walls, similar to most other site wall fencing on the project. This was an error. The trash enclosure should be a full height block wall. A price was negotiated with the contractor to install the full height block wall. The cost is $1,479. 6. The connection detail of the wood framing to the steel framing at the southern wall of the apparatus bay was not shown on the plans. It was necessary to field weld anchors on the steel beam to anchor the woods of the pony wall which is the north wall of the display room. A price was negotiated with the contractor to field weld the needed anchors at 16" on center. The cost is $1,044. 7. The fire department during the construction of the project requested that a 2-inch potable water connection be installed in the training area. As designed, the only water available in the training area was the water recycled through the UV/Pump Assembly charged fire hydrants. The fire fighters stated that they needed a potable water source to wash themselves and gear as a result of the training operations. Further, the 2" water source could be used to fill water tanks on their trucks on occasion. A price was negotiated with the contractor. The cost is $3,375. A complete breakdown of the costs are included as back-up to the attached change order number twelve. The total of all seven components is $ 16,620.00 RESOLUTION NO. 2004 — 236 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AUTHORIZING THE CITY ENGINEER TO EXECUTE CHANGE ORDER NO. 12 WITH MARCOTTE & HEARNES BUILDERS, INC. WHICH INCLUDES SEVEN VARIOUS REQUESTED OR REQUIRED STRUCTURAL, DESIGN AND DOCUMENT MODIFICATIONS TO THE PLANS AND SPECIFICATIONS FOR THE FIRE STATION PROJECT IN THE TOTAL AMOUNT OF $16,620 WHEREAS, the contract for the Fire Department Construction Project was awarded to Marcotte & Hearnes Builders, Inc. on February 17, 2004, by the adoption of Resolution No. 2004-31; and WHEREAS, various structural, design and document modifications to the plans and specifications which have been requested, or that are required, are necessary for the construction of the fire station project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby authorizes the City Engineer to execute Change Order No. 12 with Marcotte & Hearnes Builders, Inc. in the total amount of $16,620 for various structural, design and document modifications to the plans and specifications which have been requested, or that are required, for the construction of the fire station project.
