DESCRIPTION OF CHANGE: This agreement change order has three components: 1. The first component of the change order is being written to include two services that were listed in the original Kleinfelder, Inc. contract as optional extras, but not included in the original amount approved by City Council for the contract. These additional services total $16,750. 2. The second component of the change order is being written to add $3,033 of additional work associated with contaminated soils discovered during the earthwork portion of the project. 3. The third component of the change order is for $1,800 of soil compaction testing associated with the relocation of the ultraviolet water treatment underground vault and the relocation of a sewer line. DISCUSSION: The following is a discussion of each component in the same order as listed above: 1. The original Kleinfelder proposal for the project included as optional extras retaining walls and reinforced concrete paving inspection and testing. These are considered special inspection services. At the time the contract with Kleinfelder was executed construction had not yet started and it was decided by the City that the inspection services to the degree specified within the proposal would not be necessary. However since we now have experience with the contractor it has become clear that in order to achieve the quality product that we expect we must perform these inspection services. A copy of the original Kleinfelder Inc. scope of work from the contract is attached to this change order. 2. During the earthwork portion of the project a large area of soil was uncovered that had the appearance of being contaminated with hydrocarbons. In accordance with the County of San Diego Environmental Health guidelines, excavation stopped and the material was tested. The testing ultimately revealed that the soil could be exported and disposed of as non -hazardous material. 3. During the construction of the project it was decided that the ultraviolet water treatment underground vault and a sewer line had to be relocated after they were already installed. A change order to perform the work was issued to the contractor. As part of the relocation work soil testing was required to ensure that the subgrade for the vault was stable and compact, and the backfill around the tank was compacted correctly. DESIGN AGREEMENT ADJUSTMENT: As a result of this change order the design agreement is adjusted as follows: 1. The price is increased in the amount of $21,583 from the current contract price of $54,000 to a new contract price of $75,583. 2. The time is unchanged. All work will be completed by April 2005 This change order shall be considered full compensation for furnishing and installing the materials, labor, tools and equipment, profit, overhead, and all incidentals for performing the work as described herein. A construction schedule was not available at the time we prepared this proposal. FEES/BUDGET Fees for our services will be charged on a time -and -materials basis at the rates currently under contract with the City. As always, no charges will be assessed for vehicle, mileage, standard test equipment, or routine project administration. For budgeting purposes we have prepared an Estimated Budget based on a brief review of the referenced documents. Our budget does not include costs for overtime, retesting, or reinspection. Our budget also does not include travel and per diem costs associated with shop welding inspection not within 50 miles of one of our 60 offices. LIMITATIONS Materials testing and observation services provided by Kleinfelder will be performed in accordance with generally accepted procedures practiged within the site area. It should be noted even with diligent monitoring construction defects alight occur. In all cases the contractor is solely responsible for the direction and quality 'of the work, adherence to plans and specifications, and repair of defects regardless of when they are found.
