DESCRIPTION OF CHANGE:
This change order is written to provide for the removal and disposition of lead impacted
soil generated during the grading operations for the construction of the Paradise Creek
Educational Park, Phase I project. The total soil covered by this change order amounts to
approximately 860 Cubic Yards and will be removed form the project site stockpiles and
disposed at appropriate disposal sites located at either South Yuma County Landfill,
Arizona (new bid item no. 19) or US Ecology Corporation Landfill, Nevada (new bid
item no. 20).
NEW BID ITEMS ADDED VIA CHANGE OREDER NO. 1:
Bid Item 19
Remove, transport and dispose of approximately 840 Cubic Yards of lead impacted (Cal
Hazardous) soils from project site stockpiles to South Yuma County Landfill, Arizona
and provide all necessary chain of custody records required by the project's work plan.
The unit price to be paid for this work will be $92.05 per ton and is based on an agreed
conversion rate of 1.5 cubic yards per ton.
Bid Item 20
Remove, transport and dispose of approximately 20 Cubic Yards of lead impacted
(RCRA Hazardous) soils from project site stockpiles to US Ecology Corporation
Landfill, Nevada and provide all necessary chain of custody records required by the
project's work plan. The unit price to be paid for this work will be $190.95 per ton and is
based on an agreed conversion rate of 1.5 cubic yards per ton.
CONTRACT CHANGE ORDER NO. 1
This change order recognizes that time is of the essence and is based in good faith efforts
by both parties to quantify the volume of soils to be disposed and the cost of the removal,
transportation and disposal of the soil. The work to be done, therefore, will be quantified
for the purpose of approval of this change order, based on the table below and at no time
will the cost of the work will exceed $150,000.

All work shall be done by licensed personnel qualified and trained to handle, transport
and dispose of lead contaminated soils.
CONTRACT ADJUSTMENT:
As a result of this change order the contract price is adjusted as follows:
1. The contract price is increased in the amount of $150,000.00 from the
current contract price of $1,008,900 to a new contract price of $1,158,900.00.
The unit prices herein agreed shall be considered full compensation for furnishing all
labor, material, transportation, disposal, profit, overhead, and all incidentals for
performing the work described above and reporting costs and there shall be no other
adjustment. There shall be no compensation due to damages or additional payment for
delays as described in the 1997 edition of the Standard Specifications for Public Works
Construction, Section 6-6.3 for performing the work as described above.

WHEREAS, the contract for the construction of the first phase of the Paradise
Creek Educational Park was awarded to MJC Construction, Inc. on August 16, 2005, by the
adoption of Resolution No. 2005-179; and
WHEREAS, Change Order No. 1, in the amount of $150,000, is for the removal
and disposal of approximately 1,500 cubic yards of lead impacted soil from the Paradise Creek
site in accordance with State and federal regulations; and
WHEREAS, funds are available from a $500,000 Coastal Conservancy Grant
obtained by the Community Services Department on June 16, 2005.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby authorizes the Director of Public Works to execute Change Order No. 1
with MJC Construction, Inc. in the amount of $150,000 for the removal and disposal of
approximately 1,500 cubic yards of lead impacted soil from the Paradise Creek site in
accordance with State and federal regulations.

Item Title

Explanation
On August 16, 2005 the Council by resolution number 2005-179 awarded a contract in
the amount of $1,008,900 to MJC Construction for the construction of the first phase of
the Paradise Creek Educational Park (see attached A200).
Construction of the project began on September 19, 2005 and will be completed on or
before March 17, 2006. To date, the contractor has completed the grading operation,
which required the stockpiling of approximately 1,500 cubic yards of lead impacted soil
that must be disposed in accordance with strict regulations imposed by State and /or
Federal Agencies. Staff has negotiated a change order with MJC Construction to
remove and dispose of the contaminated soil on a not to exceed cost basis. This is in
accordance with the plan presented to Council on August 16, 2005.
The not to exceed cost of $150,000 to remove and dispose of the lead impacted soil will
be funded from the $500,000 Coastal Conservancy Grant obtained on June 16, 2005 by
the Community Services Department for this project. The level of lead contamination
requires that the soil be disposed at approved sites, which are located outside of San
Diego County (Kettleman Hills, CA and Copper Mountain, AZ). Thus, transportation and
special handling and reporting requirements mandated by the soil contamination levels
significantly increase the cost of this operation. Therefore, staff recommends approval
of the proposed change order.

Explanation:
The construction of the Paradise Creek Educational Park has been a long awaited
dream of the Paradise Creek Educational Park Inc. group lead by Mr. Ted Godshalk,
the Coastal Conservancy Board and the City. In July 1999, the City Council approved
an agreement with Schmidt Design Group for the preparation of an enhancement plan
for this project, located along the Paradise Creek from 22nd Street to Hoover Avenue
(see locator map). Funding for the contract was obtained from a $50,000 grant from the
Coastal Conservancy Board, specially earmarked for this purpose. The plan was
completed in June 2001, and in December 2002, the Conservancy increased its grant
award to the City by $660,000, for a total award of $710,000 for the preparation of the
design and partial construction of the project. The Schmidt Design group completed
construction plans, specifications and cost estimates in April 2005. Their final estimate
of the construction cost of the project, was $1,750,000.
In early 2005, Community Services staff applied for a $500,000 grant increase to the
Coastal Conservancy Board and for other grants for which this project qualified with the
goal of obtaining the needed construction monies. The project was advertised for bids
in May 2005. Two bids were received and subsequently rejected, as they contained
errors that made the bid amounts invalid. However, encouraged by the prospect of
receiving the Conservancy grant increase, staff re -bid the project in late June 2005.
Since we were unsure of the ultimate funding available for the project, staff structured
the re -bid such that a contract could be awarded commensurate with the results of our
grant applications. On June 16, 2005 Community Services staff was notified that the
Coastal Conservancy Board had approved the $500,000 grant increase, bringing the
Conservancy's total grant for this project to $1,210,000. It should be noted that
$157,176 of the Conservancy grant has been utilized to prepare the plans and
specifications, leaving a net of $1,052,824 for construction purposes.
On July 28,'2005, four re -bid proposals were opened with the lowest re -bid submitted by
MJC Construction in the amount of $1,588,700.00. Consequently, staff met with Mr.
Godshalk to prioritize the items of work commensurate with the funding available for
construction, Based on this discussion and the need to start the work prior to the end of
summer, staff is recommending that a contract be awarded to MJC Construction that
includes the base bid (18 items of work) and three alternatives (A3 through A5,
inclusively) deemed important to create a functional project (see table below), should no
additional grant funding be available to immediately complete the project. The project
as re -bid did not include the removal of lead contaminated soils to be stockpiled by the
MJC Construction as part of their work. The cost to remove the stockpile is estimated to
range between $100,000 and $150,000, depending on the ultimate volume to be
disposed. Staff will return to Council at a future date for authorization to accomplish this
removal work, which could be done as a change order to MJC Construction's proposed
contract or bid out.

Therefore, and due to the. project's funding situation, staff is recommending the City
Council to award a contract to MJC.Construction in4he,amou.nt of,$1,008,900.00, with
the understanding that the ,award is contingent on the receipt -of the $500,000 grant
monies form the Coastal Conservancy prior to cor mencement of work. The contract
recommended for award includes the base bid work plus alternates A3 through A5,
only.

BACKGROUND & HISTORY
MJC Construction, Inc. is a local South Bay area family owned and operated
general contracting company with a Tong history of doing superior public works
projects in San Diego County. We have a very broad`range of experience
constructing almost every type of public improvement found locally. _Some of our
-completed projects include new public surface and underground improvements
for block grant projects, median installations with specialty stamped concrete and

storm drain and sewer installations, large private landscape projects with
architectural retaining walls and concrete, and public parks with all the amenities.
